Abstract

Wacana ikhtilaf merupakan suatu keniscayaan yang tidak dapat dipungkiri. Karenanya, menyamakan pendapat adalah suatu hal yang bertentangan dengan kodrat manusia yang Tuhan telah tetapkan. Perbedaan mazhab di kalangan ulama sebuah fenomena khazanah kekayaan Islam yang memberi hidup secara variatif. Fikih yang mengarah pada sikap intoleran dan diskriminatif terhadap kelompok lain sudah saatnya dibaca secara kritis sebagai sebuah produk sejarah yang sangat mungkin untuk dirubah. Tulisan ini menawarkan tentang pengembangan karakter toleran dalam menyikapi perbedaan mazhab fikih dengan melewati empat ruang lingkup pendidikan karakter, yaitu olah hati (spiritual and emotional development), olah pikir (intellectual develompmet), olah raga (physical and kinesthetic develop-ment) serta olah rasa dan karsa (affective and creativity development). Empat karakter di atas, akan memberikan persepsi kepada subjek dalam menyikapi perbedaan (ikhtilaf) yang pada akhirnya berujung pada sikap toleran ataukah intoleran. ------------------------The discourse of ikhtilaf is an undeniable reality. These four characters will give per-ception to address the differences (ikhtilaf) among Muslims and eventually come to either tolerant or in-tolerant character.

Abstract

The discourse of ikhtilaf is an undeniable reality. Consequently, to put forward opinion in the same agreement will likely to contradict with human nature which has been determined by Allah SWT. The different thoughts among the ulamas are actually good phenomena in Islamic teaching, which lead to Isla to be more variativ. Fiqh minded which are triggering into in-tolerancy dan discriminative character toward the other groups should be critically understood as an historical product which is very possible to be changed. This paper proposes tolerant character development in facing the difference among Islamic thought schools (mazhab fiqh) through four scopes of character education: that are, spiritual and emotional development, intellectual develompmet, physical and kinesthetic development, and affective and creativity development. Abstract

Fiqh and Tafsir Ahkam are basic courses at the Faculty of Usuluddin and the Faculty of Sharia. These two disciplines of science are the products of ulama's legal thinking whose objects are different but inseparable from one another. Faqih (fiqh expert) and mufassir (interpreter) can sit together to solve the legal problems faced by people with their respective approaches and methods. In this paper, these two disciplines are discussed with various perspectives. Epistemologically has its own specifications, and axiologically has their respective roles in answering the problems of humanity.

Abstract

Diskursus penerapan prinsip syariah dalam akad perjanjian murabahah yang bebas riba, maisir, garar, haram, dan zalim di industri perbankan syariah selalu menjadi narasi yang terus dikaji. Penerapan prinsip syariah menjadi penting pada industri perbankan syariah, karena menjadi distingsi terhadap industri keuangan konvensional. Tulisan ini bertujuan mengkaji diskursus penerapan prinsip syariah dalam akad pembiayaan murabahah pada Bank BNI Syariah cabang Makassar dan Unit Usaha Syariah BPD Sulsel. Hasil penelitian menunjukkan bahwa penerapan prinsip syariah pada industri perbankan syariah masih menyisahkan problem fikih dan problem kepentingan perbankan syariah atau dikenal dengan istilah ‘urf tijary. akomodasi ‘urf tijary dalam kepentingan perbankan syariah masih lebih dominan ketimbang konsistensi penerapan prinsip syariah fikih dan fatwa an-sich.

Abstract

This article aims to analyze and provide ideas about the absorption of moderation values to those who are competent. Fatwa is flexible. Fatwas must have moderate dimensions. This article uses a philosophical approach by analyzing literature, both in the form of classic literature, books, journals and other sources. This article provides the idea that absorption of Fatwas is moderated by balancing all aspects. It is neither hard nor loose. Such a style of Fatwa can be seen from the results of the decided Fatwa that remains in the corridor of the Shari’a, weighs greater consideration, matches the reality of the needs of Muslims, and provides equal convenience. Fatwa must become barometer controlling changes in social reality for Muslims. Every emerging legal issue is responded quickly and accurately. However, what needs to be considered is the method used in exploring the laws related to contemporary problems according to the Fatwa procedure and all its consequences. The implications of the study indicatea that the absorption of moderate Fatwa are things that should get attention, both among laity and competent mufti. Mufti is demanded to produce Fatwa that can be accepted by Muslims but does not neglect religious texts originating from Allah. and the Messenger of Allah. Mufti must adopt policies regarding the problems faced by Muslims today. The moderate Fatwa aims to prevent Muslims from carrying out legal arbitrarily and in accordance with their own passions

Abstract

Abstract The main problem in this research is How is the Tradition of Pilgrimage to the Grave After the Wedding Day in the Perspective of Islamic Law (Case Study in Bitowa Village, Manggala District, Makassar City). The main problem is divided into two sub-problems, namely 1) What is the public's view of the tradition of visiting the grave after the wedding day in Bitowa Village, Manggala District, Makassar City?, 2) How is the tradition of visiting the grave after the wedding day in the perspective of Islamic law in Bitowa Village, Manggala District, Makassar City. The results of this study indicate that the tradition of visiting the grave after the wedding day is carried out in the Bitowa Village community with the procedures carried out during a grave pilgrimage such as visiting family graves, preparing all preparations before leaving for a grave pilgrimage such as (pots filled with water; flowers; and leaves). pandanus), greet the grave experts, pour water and sow flowers and pandan leaves on the visited graves, face the Qibla when praying at the visited graves, send prayers to the deceased by reciting short suras closed with Surah al-Fatihah. And the wisdom that can be taken is that we always remember that living humans will inevitably experience death, as a mirror to increase the deeds of worship to Allah SWT, and ask Allah for forgiveness for the sins of the deceased through prayer. In Islam the pilgrimage to the grave is a prescribed worship and of course it must be in accordance with what was taught by the Prophet Muhammad, so the grave pilgrimage carried out by the people of Bitowa Village can be done as long as no one violates sharia such as asking for something at the grave. But to pray for it is not a problem. Even if it is a tradition, because it is considered a good tradition. Keywords: Islamic Law, Grave Pilgrimage, Marriage.

Abstract

Maqashid syari’ah adalah konsep yang terpadu dalam tatanan nilai mencakup visi dan misi agama Islam. Konsep tersebut adalah hasil ijtihad jumhur ulama setelah mengadakan pengamatan mendalam terhadap al-Qur’an dan Hadis Rasulullah. Di dalamnya mengandung perintah yang bernilai wajib untuk senantiasa dijaga, di saat yang sama juga menjadi hak asasi bagi setiap manusia untuk dimiliki dan dinikmati. Kewajiban dan hak terpadu dalam konsep ini yang sudah barang tentu ada skala prioritas dari tingkatan-tingkatannya.

Abstract

The subject of this paper is how the freedom of women in choosing a potential husband. In general, ideas can be put forward in a society where the pattern of relationship is traditional, marriage is perceived as a social necessity which is part of the inherited social tradition. This study aims to find out how the views of the Shafi'i School and the Hanafi School of Women in choosing a husband. Whether choosing a husband candidate is a woman's absolute right or is there interference from parents. Where cases of matchmaking and the practice of forced marriage by parents of girls are still found in Indonesian society. Mazhab Syafi'i and the Hanafi School have different opinions about women's freedom to choose a husband. The Shafi'i school is of the opinion that a girl who is not yet an adult, in this case, according to him, he can marry the girl even without his permission. According to him, for a widow there must be clear consent from the person concerned. Meanwhile, according to the Hanafi School, the consent of a woman, either a widow or a girl, must be in the marriage and vice versa, if they refuse the marriage contract, it cannot be carried out

Abstract

AbstrakPotensi zakat pertanian di Desa Bissoloro sangat besar, terkhusus dalam pertanian padi dan jagung. Setiap panen rata-rata masyarakat paling di bawah 30 karung atau 1.500 kg dan paling banyak 80 karung gabah (padi). Sedangkan jagung berkisar antara 3 ton sampai 8 ton dalam satu kali panen. Pengelolaan zakat di Desa Bissoloro Kecamatan Bungaya Kabupaten Gowa, belum berjalan dengan baik. Masih ada masyarakat yang belum mengeluarkan zakat, sebab kurangnya pemahaman tentang hukum zakat. Dalam hal pengeluaran zakat di Desa Bissoloro, ada yang sudah sesuai syariat Islam dan ada yang belum sesuai serta takaran zakat pertanian yang dikeluarkan, sesuai dengan yang mereka inginkan atau dirasa cukup tanpa memikirkan bahwa ini sudah sesuai dengan yang ditentukan dalam Islam. Berdasarkan Undang-undang tentang pengelolaan zakat pada pasal 38, dijelaskan bahwa zakat harus dikelola oleh lembaga yang resmi agar tidak terjadi kesinambungan sosial. Walaupun pihak Kecamatan mengatakan akan membentuk kembali amil zakat yang lebh baik, akan tetapi itu hanya di kecamatan bukan di Desa Bissoloro.Kata Kunci: Hasil Pertanian, Potensi Zakat,  Zakat pertanian.AbstractThe potential for agricultural zakat in Bissoloro Village is very large, especially in rice and corn farming. Every harvest the community averages at least 30 sacks or 1,500 kg and a maximum of 80 sacks of grain (paddy). While corn ranges from 3 tons to 8 tons in one harvest. The management of zakat in Bissoloro Village, Bungaya District, Gowa Regency, has not been going well. There are still people who have not issued zakat, due to a lack of understanding of the law of zakat. In terms of spending zakat in Bissoloro Village, there are those that are in accordance with Islamic law and some are not appropriate and the amount of agricultural zakat issued is according to what they want or is deemed sufficient without thinking that this is in accordance with what is specified in Islam. Based on the Law on the management of zakat in article 38, it is explained that zakat must be managed by an official institution so that social sustainability does not occur. Although the sub-district said it would re-establish a better amil zakat, but that was only in the sub-district, not in Bissoloro Village.Keywords: Agricultural Products, Agricultural Zakat, Potential Zakat.

Abstract

Artikel ini membahas tentang apa yang menjadi latar belakang adanya perbedaan pendapat dikalangan ulama mengenai maulid. Kemudian menjelaskan dasar dan rujukan para ulama memandang maulid sebagai suatu perbuatan yang diperbolehkan ataukah tidak diperbolehkan, sehingga dapat diketahui komparasi para ulama memandang tradisi maulid tersebut. Penelitian ini menggunakan jenis kualitatif lapangan dengan menggunakan teknik wawancara. Adapun sumber data pada penelitian ini yaitu data primer dan data sekunder. Metode  pengumpulan data yang digunakan adalah teknik pengamatan lapangan dan teknik kutipan atau literature yang ada. Selanjutnya pengolahan data/analisis data yaitu dengan menggunakan teknik  ppenelitian kualitatif yaitu dengan menggabambarkan hasil penelitian dengan menguraiakan kalimat dan tekniknya menggunakan analisa deduktif yaitu mengambil suatu kesimpulan yang bersifat umum menuju ke pernyataan yang bersifat khusus. Hasil dari penelitian ini menunjukan bahwa 1) sejarah tradisi sayyang pattu’du’ dalam peringatan maulid tidak terlepas dari pengaruh agama dan budaya dapat dikatakan bahwa tradisi tersebut lahir dari akulturasi antara agama dan budaya. 2) prosesi pelaksanaan dari tradisi sayyang pattu’du’ dalam peringatan maulid tersebut tidak terlepas dari nuansa yang bersifat agamis seperti pembacaan barzanji dan sholawat Nabi dengan diselipi budaya yang masih sangat dilestarikan. 3) adanya perbedaan pendapat dikalangan para ulama dalam hal ini ulama klasik dan ulama kontemporer dalam menanggapi persoalan maulid ada yang mengatakan boleh dan adapula yang mengatakan tidak boleh bahkan di bid’ahka
