Abstract

Abstrak: Maslahat merupakan tujuan utama dalam agama Islam, Allah menurunkan ajaran terutama dalam masalah hukum Islam tidak bisa dilepaskan untuk kemaslahatan manusia, walaupun terjadi perbedaan pada hakikat kemaslahatan dari segi sumber maslahat, tetapi ulama bersepakat dalam hal tujuan utama hukum Islam adalah jalb al-mashalih wa daru al-mafasid, bagaimana hukum Islam dapat sebanyak mungkin memberikan manfaat dan kebaikan pada manusia sekaligus menghilangkan segala kemungkinan terjadinya kerusakan dan bahaya bagi manusia.

Abstract

This paper discusses the hadith of women's leadership to get a comprehensive and comprehensive understanding of the values contained can provide insight for Muslims, especially women who want to take part in the public sphere. A woman needs to pay attention to the conditions as a leader who has the capability and credibility and still pays attention to existing boundaries and continues to make the hadith of the Prophet as a reference in holding a leadership position.

Abstract

Abstract: Maslahat is the main goal in Islam, Allah teaches down the teachings especially in the issue of Islamic law cannot be released for the benefit of human beings, although there is a difference in the nature of the benefit from the aspect of the source of maslahat, but the scholars agree in terms of the main purpose of Islamic law is jalb al-mashalih wa daru al-mafasid, how Islamic law can as much as possible provide benefits and goodness to humans while eliminating any possibility of damage and danger to humans.

This research aims to describe pamali in trading of Pattae society. This study used descriptive qualitative method. Data was collected by observation, interview, and documentation. The findings showed that pamali culture in trading of Pattae society is a legacy from ancestors that descended from generation to generation. It is a belief that is never done and has become a habit of society. However, some people do not trust the tradition any more because they think it is not in accordance with this era and it also makes people difficult to carry out trading activities.

Abstract

Indonesian Muslims have not maximally applied maturity of marriage age as an important aspect in obtaining marital success. Apart from the concept of maturity of diverse marriage age, divorces and many marital problems based on the immaturity of a married couple still rife in Indonesia. The government has even issued regulations related to the age of marriage through Law number 1 of 1974 that was revised by Law number 16 of 2019, which stipulates that marriage is limited to a minimum age of 19 years for the two brides. This article aims to find the concept of quality-oriented marriage age to complement the quantity-oriented idea as applied by the Indonesian government and as understood differently by Muslims based on the opinions of the scholars (‘ulamā). This article abstracts the concept of the ideal age of marriage from the instructions of the Prophet Muhammad PBUH as the primary reference of Islamic teachings by discussing the hadīth using the ma‘ānī al-ḥadīṡ analysis with three interpretation techniques namely textual, intertextual, and contextual interpretation to obtain comprehensive meaning. The results of the examination show that the hadīth requires the criteria for the maturity of the marriage age in the form of religious, physical, financial, and social maturity. These qualitative criteria fulfill the element of maqāṣid al-syarī‘ah and are interconnected so that they should be actualized as a new basis in the formulation of policies related to the maturity of marriage age in Muslim societies.

Abstract

ومن الأمور الأخلاقية التى يهتم بها الإسلام الفقر وعلاجه حتى وردت الآيات فى الحث على علاجه. ولكن لا يستطيع أي أحد أن يتجنبه قبل بيانه من خلال القرآن بمنهج خاص حتى انكشفت معانيه وأنواعه وعلاجه. ومن ناحية أخرى، إن معنى الفقر الذى اشتهر عند الناس منحصر فى فقر المال فحسب، بل الفقر إلى الله تعالى داخل تحت إسم الفقر وإن كان الغالب فيه فقر المال.  ولحل كيفية علاج الفقر فى تصور القرآن الكريم ولرعاية الناس من الفهم الخطأ فيها، ذهب الكاتب كشف موقف القرآن حول الفقر أهو شيئ محبوب أو مرغوب عنه، وبعد ذلك بين الباحث كيفية علاجه باستخدام منهج موضوعي بطريقة وسيلة معينة وطريقة جمع المواد وتحليلها وتنظيمها حسب طرق المنهج الموضوعي.رأى الباحث أن الفقر هو وصف عدمي يعنى عدم وفاء الكسب والمال لمؤنته ومؤونة عياله بالكلية أو بعضها وهو يشترك مع معنى المسكنة وإن اختلفا فى أيهما أسوأ حالا. وموقف القرآن أنه لا يريد أحدا فقيرا بل يحثه فى طلب الرزق ليكون عاملا للأعمال الصالحة المحتاجة إلى المال فى تطبيقها. فالفقر ليس أمرا محبوبا ولا أمرا مأمورا بل هو مجتنب عنه بل تارة يدعو إلى كفر. فيجب للغني أو الموسر علاجه إما بإخراج الزكاة وهى أولى الوسائل لعلاج ذلك التفاوت وتحقيق التكافل أو الضمان الاجتماعي في الإسلام أو صدقة التطوع أو الإنفاق المرغّب فيه من الله أو الأجرة أو الإطعام من الهدي والفدية ونهما أو النكاح بمزيد اهتمامه في الكسب والجد التام في السعي حيث ابتلى بمن تلزمه نفقتها شرعا وعرفا.

Abstract

This study aims at examining the use the principle of i`tibar al ma'alat in the MUI fatwa number 14 of 2020 concerning the organization of worship in situations of the Covid-19 outbreak. MUI fatwa number 14 of 2020 forced most Muslims in Indonesia to worship out of the box. the results of the study it was found that the MUI in issuing fatwa number 14 of 2020 had considered the principle of i'tibar al ma'alat, the prohibition of worshiping in congregation in areas with high distribution potential was determined in order to anticipate the spread of the Covid-19 outbreak. However, the MUI does not generalize all regions, this is also done based on the principle of i'tibar al ma'alat to avoid the practice of tafrith to religious orders in the midst of society
