Abstract

Maqasid interpretation, or interpretation based on the goals of Islamic law, plays an important role in deepening the understanding of Qur'anic legal verses. It seeks to uncover the intentions and purposes hidden behind the legal verses, highlighting the legal aspects underlying the rules. One of the tafsir works that considers this approach is Tafsir al-Jassas. This article analyses the contribution of Tafsir al-Jassas in revealing the maqasid (objectives) of Islamic law, especially in the context of legal verses. The content analysis method is used to explore al-Jassas' views on selected legal verses, focusing on the interpretations and interpretations he produces. The findings of this analysis illustrate how al-Jassas' commentaries provide deep insights into the application of maqasid in Islamic law, demonstrating its relevance in the modern legal context. The conclusion of this article emphasises the importance of expanding the use of maqasid-based interpretive approaches in understanding the Islamic legal heritage, to address contemporary challenges and enhance a more holistic understanding of the values and objectives of shari'a law. Keywords: Verses of Law, Tafsir Al-Jassas   Tafsir maqasid, atau penafsiran berdasarkan tujuan-tujuan syariat Islam, memainkan peran penting dalam memperdalam pemahaman terhadap ayat-ayat hukum Al-Qur'an. Tafsir ini berusaha mengungkap maksud dan tujuan yang tersembunyi di balik ayat-ayat hukum, menyoroti aspek-aspek hukum yang mendasari aturan-aturan tersebut. Salah satu karya tafsir yang mempertimbangkan pendekatan ini adalah Tafsir al-Jassas. Artikel ini menganalisis kontribusi tafsir al-Jassas dalam mengungkapkan maqasid (tujuan-tujuan) hukum Islam, khususnya dalam konteks ayat-ayat hukum. Metode analisis konten digunakan untuk mengeksplorasi pandangan al-Jassas terhadap ayat-ayat hukum yang dipilih, dengan fokus pada interpretasi dan penafsiran yang dihasilkannya. Temuan dari analisis ini menggambarkan bagaimana tafsir al-Jassas memberikan wawasan mendalam mengenai aplikasi maqasid dalam hukum Islam, menunjukkan relevansinya dalam konteks hukum modern. Kesimpulan artikel ini menekankan pentingnya memperluas penggunaan pendekatan tafsir berbasis maqasid dalam memahami warisan hukum Islam, untuk mengatasi tantangan kontemporer dan meningkatkan pemahaman yang lebih holistik terhadap nilai-nilai dan tujuan hukum syariat. Abstract

Sepanjang sejarah Indonesia, wacana Undang-undang Perkawinan selalu melibatkan tiga kepentingan; agama, negara dan perempuan. Oleh karena itu, perlu pemahaman undang-undang perkawinan, terutama dari aspek sejarahnya, dikarenakan (1) mengetahui pengaruh kemayoritasan kaum muslimin Indonesia terhadap penerapan hukum Islam di Indonesia, dan (2) menentukan strategi pendekatan bangsa ini dengan hukum Islam. Kesimpulan dari tulisan ini adalah, pertama, pada masa penjajahan terdapat dua periode sejarah hukum perkawinan Islam dengan berlatar pada dua teori, yaitu teori receptio in complexu dan teori receptie. Kedua, dalam masa awal kemerdekaan lahir dua dua undang-undang perkawinan, yaitu Undang-undang Nomor 22 Tahun 1946 tentang Pencatatan Nikah, Talak, dan Rujuk serta Undang-undang no. 32 tahun 1954 Tentang Penetapan Berlakunya Undang-Undang Republik Indonesia Tanggal 21 Nopember 1946 Nomor 22 Tahun 1946 Tentang pencatatan Nikah, Talak dan Rujuk di Seluruh Daerah Jawa dan Madura. Ketiga, dalam masa setelah  lahirnya Undang-undang No. 1 tahun 1974 tentang Perkawinan terdapat dua masa, yaitu (1) masa kelahiran undang-undang tersebut, dan (2) masa penerapan dari undang-undang tersebut dengan lahirnya Kompilasi Hukum Islam.

Abstract

United Nations ratified the Convention on the Rights of the Child in 1089. It is a form of legal protection for children to meet children's rights in UN member countries. As a UN convention, it has coercive power on all UN member states to sign and ratify the Convention. The topic of child rights becomes interesting when the discussion focuses on countries with a long historical culture and civilization. One of them is the Malay civilization, namely Brunei, Indonesia, Malaysia, and Singapore, all are members of the United Nations. This paper presents the finding related to the agreement of the Malay community to the Convention on the Rights of the Child and the follow-up of that agreement in its implementation in the legal system of these countries. At the end of the article, it is concluded that: (1) four countries belonging to the Malay family, Indonesia, Malaysia, Singapore and Brunei, have agreed and ratified the Convention on the Rights of the Child (CRC), but with the application of reservation rights for Malaysia and Brunei; (2) four countries have passed child laws; and (3) the diversity of age limits for children in the four countries. [Pada tahun 1089 Perserikatan Bangsa-bangsa mengesahkannya sebagai Kovensi Hak Anak (Convention of Rights of The Child), yang bentuk perlindungan hukum terhadap anak, sebagai upaya pemenuhan terhadap hak-hak anak di negara-negara anggota PBB. Sebagai konvensi PBB, maka mempunyai kekuatan memaksa pada semua Negara anggota PBB untuk menandatangani dan meratifikasi konvensi tersebut. Menjadi menarik ketika difokuskan pada negara-negara yang mempunyai sejarah panjang, terutama mempunyai kesamaan rumpun dan budaya. Salah satunya adalah negara rumpun Melayu, yaitu Brunei, Indonesia, Malaysia, dan Singapura, yang kesemuanya merupakan anggota PBB. Dalam konteks inilah tulisan ini hadir, yaitu untuk mengetahui persetujuan negara negara rumun Melayu terhadap Konvensi Hak Anak, dan tindak lanjut dari persetujuan tersebut dalam implementasinya dalam system hukum negara-negara tersebut. Di akhir tulisan disimpulkan bahwa: (1) empat negara rumpun Melayu, Indonesia, Malaysia, Singapura dan Brunei, telah menyepakati dan meratifikasi Konvensi Hak Anak (CRC), namun dengan pemberlakuan hak reservasi untuk Malaysia dan Brunei; (2) empat negara telah mengesahkan undang-undang anak; dan (3) adanya keberagaman batasan usia anak di empat negara tersebut.]

Abstract

Studi Islam, sebagai bidang kajian ilmiah, menunjukkan keberagaman pendekatan yang khas, masing-masing menawarkan sudut pandang yang berbeda untuk memahami dimensi-dimensi yang kompleks. Studi monodisiplin dalam ilmu pengetahuan Islam menyelami secara mendalam aspek-aspek tertentu, berfokus pada disiplin tunggal seperti teologi, yurisprudensi, atau sejarah. Eksplorasi khusus ini mengungkap detail-detail halus dalam domain yang terbatas. Sebagai kontras, studi interdisiplin dalam kajian Islam melampaui batas disipliner, menjalin hubungan antara berbagai bidang seperti filsafat, sosiologi, dan ilmu politik. Pendekatan ini mengembangkan pemahaman komprehensif tentang pengaruh Islam di berbagai ranah, mengungkap keterkaitan yang rumit. Studi multidisiplin menggabungkan wawasan dari berbagai disiplin, menciptakan mozaik yang mencerminkan keragaman kompleks peradaban Islam. Dengan memanfaatkan metodologi antropologi, sastra, ekonomi, dan lainnya, pendekatan ini merangkul keberagaman yang melekat dalam pemikiran dan praktik Islam. Studi transdisiplin dalam kajian Islam melampaui batasan-batasan disipliner secara keseluruhan, mengintegrasikan perspektif-perspektif yang berbeda ke dalam kerangka kerja yang terpadu. Pendekatan holistik ini menentukan kembali batas-batas, mengundang kontribusi dari bidang di luar akademis, seperti seni, spiritualitas, dan keterlibatan masyarakat, yang memperkaya pemahaman lebih inklusif dan holistik tentang dampak Islam yang mendalam pada masyarakat. Pendekatan-pendekatan dalam studi Islam, mulai dari kedalaman yang terfokus hingga sintesis yang luas, secara kolektif memperkaya wacana ilmiah, menawarkan jalur-jalur yang beragam untuk menjelajahi dan memahami sifat multifaset Islam serta signifikansinya secara global.

Abstract

Qur’anic studies in Indonesia have undergone significant methodological transformations, evolving from oral traditions to written interpretations. This study addresses the scholarly gap regarding the lack of integrated analyses that holistically examine the traditions of Qur’anic recitation, writing, and interpretation in the Indonesian context. Employing a qualitative method through desk research, this study critically engages with both primary and secondary sources, including classical and contemporary tafsir works, standardized Indonesian mus}h}af editions, and academic journal articles. The findings reveal that the evolution of Qur’anic studies in Indonesia has been shaped by the interplay between local cultures and global Islamic traditions. Oral transmission methods such as Baghdadiyah and nagham characterized the early phase which gradually transitioned into written forms exemplified by the production of standardized mus}h}af manuscripts such as Mushaf Bahriyyah, Bombay, Braille, and Sign Language editions which aim to ensure both accessibility and authenticity. In terms of interpretation, prominent Indonesian scholars such as Abdur Rauf Singkili, HAMKA, and M. Quraish Shihab have developed context-based approaches tailored to socio-cultural realities. This study concludes that Qur’anic studies in Indonesia are dynamic, continually adapting to technological, cultural, and social changes. However, further research is necessary to explore interdisciplinary interpretive approaches involving gender, ecology, and socio-political issues. Strengthening contextual and thematic interpretations will enhance the role of the Qur’an as a responsive and transformative source of guidance for contemporary Indonesian Muslim society.

Abstract

The rapid growth of digital platforms in global commerce has reshaped conventional transactional norms, including among Indonesian Muslims, raising normative debates on the legitimacy of e-commerce within Islamic jurisprudence. While prior studies have addressed e-commerce in Islamic legal discourse, few have examined the transformation of ʿurf (customary practice) as a legitimate legal source in the digital age. This study introduces the DigitalʿUrf Alignment Model (DUAM), an integrative legal-epistemological framework that systematizes the adaptation of classical ʿurf to digital contexts through maqāṣid al-sharīʿah based validation. Employing a qualitative-normative approach, the research analyzes Fatwa No. 146/2021, issued by the National Sharia Council of the Indonesian Ulema Council (DSN-MUI), classical and contemporary fiqh sources, and emerging digital transaction models. It integrates concepts from uṣūl al-fiqh, maqāṣid al-sharī‘ah, and socio-philosophical reasoning to reconceptualize ʿurf as a dynamic category of legal interpretation. The findings affirm that digital ʿurf, structured through DUAM, enables its institutionalization as a normative legal source for fatwa and provides a scalable method for integrating classical jurisprudence with digital finance regulations.

Abstract

This article intended to discover and analyze the fulfillment of the educational rights of assisted children at LKPA Blitar during the COVID-19 pandemic and the obstacles to fulfilling the educational rights of assisted children at LKPA Blitar during the COVID-19 pandemic. Two significant findings can be elaborated from the research. Firstly, the educational rights of children at LPKA Class I Blitar during the Covid-19 pandemic have been fulfilled and have been implemented by LPKA Class I Blitar by existing provisions, namely Law no. 23 of 2002 concerning Child Protection, Law no. 11 of 2012 concerning the Juvenile Criminal Justice System and Law no. 20 of 2003 concerning the National Education System. Secondly, there are several obstacles in implementing education for students at LPKA Class I Blitar during the COVID-19 pandemic related to several problems. The limited educational and coaching facilities, the level of education and motivation of correctional students, and factors changing the methods used in the learning process hindered the successful fulfillment of educational rights to the children.

Abstract

According to von Savigny, the study of history in law has urgent value regarding legal continuity in the past, present and future. Of course, this also applies to the history of Indonesian criminal law, which has entered a new phase with the enactment of Law Number 1 of 2023 concerning the Criminal Code. This article aims to understand the historical aspect of the formation of the 2023 Criminal Code, which is more broadly related to the history of the development of criminal law in Indonesia. At the end of the article, it is concluded that the periodization of the development of criminal law in Indonesia can be divided into six stages, namely: (1) the Nusantara kingdom period, (2) the VOC colonial period, (3) the Dutch colonial period, (4) the Japanese colonial period, (5) the period after independence, and (6) the period for the formation of the 2023 Criminal Code. The period for the formation of the 2023 Criminal Code can be explained by characterizing: (1) efforts to realize the ideals of Indonesian law, or volkgeist (spirit of the people), (2) that the Criminal Code is a recodification after decodification, and (3) recognition of customary law as "local wisdom".

Abstract

The emergence of dynamic problems of the people in aspects of life demands immediate responses and solutions. One of the dilemmatic problems is the sanctions for criminal acts of hudud. The holy text of the Qur'an which is relevant throughout the ages is expected to be a solution to these problems so that a rereading of the interpretation of the Qur'an is needed which contains elements of legal renewal that are in accordance with the context. The interpretation of The Message of The Qur'an is one of the contextual interpretations that is considered capable of overcoming today's problems. The formulation of the main problem in this study is how to analyze Muhammad Asad's interpretation in the interpretation of The Message of the Qur'an against the verses of hudud. This study is a library research with a qualitative approach using a descriptive-in-depth analysis method. The results of this study indicate that Muhammad Asad's interpretation of the verses of hudud, which in this study focuses on the verses of zian and sirqah, can be concluded in two ways. First, that Asad's interpretation of the verses of zina is classified as a textual interpretation because it still applies the punishment of caning in the current context. Meanwhile, Asad's interpretation of the sirqah verses includes contextual interpretation and can be applied today

Abstract

This article discusses the increase of number in theft crimes during the pandemic based on criminology and Islamic criminal law. The condition of the world today that struck by a pandemic gave many impacts on various aspects of life, one of which is the economy. The “stay at home” policy to reduce the spread of the Covid-19 outbreak resulted in many massive layoffs, which in turn weakens the economy's community, which on the other hand increased the theft crime rate. According to criminology, the increase of theft crime during the pandemic is affected by sociological factors. It is because of those with a weak economic capacity who cannot meet their basic needs. Besides, there is also an imbalance in the structure of society, which then results in dysfunction of social construction. Meanwhile, in the study of Islamic criminal law, the reason for the occurrence of criminal acts is due to the inability of humans to maintain their nature and the presence of outside influences. Of course, this also rejects the theory of the existence of a relationship between poverty and crime, because basically, those who in material poverty and material wealth all have the potential to commit crimes so that all depend on their return to their respective nature.
