Abstract

The research has the objectives of identifying and analyzing the presence of penalty clause under Employment Agreement from Employment Law perspective and identifyng as well as analyzing the implementation of penalty clause under Employment Law by Mediator on Employment within their recommendation. This is a normative and empirical research. The data is obtained from library and field research by way of document review and interview of the subject of research. The data are analyzed qualitatively while the result is presented descriptively. The result research shows that the presence of penalty clause under Employment Agreement is not regulated explicitly under Employment Law, but since one of the aspects of Employment Law is subject to Civil Law through Employment Law, the provision of Contract Law regulated under Book III of The Indonesian Civil Code remains applicable. In this regard, Civil Law must be deemed as law in general, unless otherwise determined by Employment Law. A mediator’s recommendation on Employment Law does not fully implement penalty clause which is presence in The Employment Agreement since it is considered as contradictory to the reasonableness and justice. Mediator prioritizes good faith principle over pacta sunt servanda principle in providing their recommendation.

Abstract

Abstract West Nusa Tenggara (NTB) is one of the regions in Indonesia with significant potential in the field of livestock farming. In the context of the agricultural industry, livestock is considered a valuable asset, and monitoring their health is crucial for improving livestock productivity. This research aims to determine the relationship between the body temperature of cattle (Y) and environmental factors, namely air humidity (), environmental temperature (), and barometric pressure (), using smart livestock data provided by PT Telkom. The study was conducted in Pengengat Village, NTB, involving correlation and regression analysis. The analysis results indicate a significant positive correlation between the body temperature of cattle and environmental temperature () and a negative correlation with humidity (). Additionally, there is a strong positive correlation between the body temperature of cattle and barometric pressure (). The multiple linear regression equation obtained is as follows: = –26.816842418191094 + -0,0014707 + 0.39772325 + 0.04927779. Model testing shows excellent prediction quality with low Mean Squared Error (MSE) values (0.3849 for training and 0.4623 for testing). Furthermore, the high R-squared (R^2) values (0.7283 for training and 0.7110 for testing) indicate that the linear regression model can predict the body temperature of cattle based on the analyzed environmental factors. Abstract

Uterine cancer is commonly treated through hysterectomy, the surgical removal of the uterus. This research examines the legality and bioethical implications of performing a hysterectomy on a pregnant uterine cancer patient, focusing on Indonesian health law and UNESCO Universal Declaration on Bioethics and Human Rights to evaluate whether conducting a hysterectomy on a pregnant uterine cancer patient aligns with Indonesia’s health laws and bioethical principles established by UNESCO. Findings indicate that Indonesian health law does not specifically regulate hysterectomies performed on pregnant uterine cancer patients. However, the law does address abortion in cases of medical emergencies, although Law No. 1 of 2023 lacks detailed criteria for what constitutes such emergencies. Under human rights law, the right to life is non-derogable, both the mother and the fetus (if legally recognized as a child) are entitled to this right. Nonetheless, based on the principles of bioethics, particularly autonomy, beneficence, and non-maleficence, the right to life of the pregnant woman may take precedence, provided she is fully informed, mentally competent, and voluntarily consents to the procedure. In light of these considerations, it is imperative for Indonesia to enact legislation that clearly governs hysterectomy procedures for pregnant cancer patients and to define medical emergencies and the legal status of the fetus more explicitly. Such legal clarity is essential to ensure the consistent protection and promotion of human rights within the Indonesian healthcare system.

Abstract

Abstract

This research uses a mixed-methods approach with a cross-sectional study design conducted in Tapin District, South Kalimantan. The research population includes 4,704 employees of PT A, with a sample of 374 respondents selected using proportionate stratified random sampling. The research instrument is a validated questionnaire that has undergone readability testing, expert validation (Aiken's V ≥0.75), and reliability testing (Cronbach's Alpha 0.884-0.931). Data analysis uses Structural Equation Modeling-Partial Least Squares (SEM-PLS) with SmartPLS 4.0.9 software. The structural model shows moderate-substantial explanatory power (R²=0.593; Q²=0.364). All three hypotheses were accepted with significance p<0.001. OHS Knowledge is the strongest predictor (β=0.331; f²=0.172 medium), followed by Management Commitment (β=0.285; f²=0.075 small) and Supervisory Function (β=0.272; f²=0.062 small). Convergence of quantitative and qualitative findings shows 50.5% of respondents emphasized OHS knowledge as the most influential factor, with 23.8% recommending priority for applicative training. Controlling unsafe actions depends more on individual competency development than organizational factors, consistent with Social Cognitive Theory. These findings have important implications for community health, as improved workplace safety can reduce accident burden on mining workers and their families. Further research is recommended using longitudinal designs to explore the long-term impact of OHS programs on community health, conducting comprehensive cost-benefit analysis, developing family safety programs models, and exploring mediation-moderation mechanisms using multilevel modeling.
