Abstract

Abstract:  Differences Idul Fitri and Idul Adha has several times occurred in Indonesia, the latest is Idul Adha 1435 H (2014) ago. Actually, the issue is what are the criteria that indicates the month it is a new month so that people can know about it. Rukyah al-hilal, or inkanur Rukyat reckoning early qamariyah is used to determine how at the turn of a new month-to-month old. The difference in the determination of the beginning of Ramadan and the feast is actually happening between organizations and government (in this case the Ministry of Religious Affairs). The question that arises is who has the right of authority in determining the start of Ramadan and Hari Raya in Indonesia? Regardless of the method of determination which they are used, whether through rukyat al-hilal, reckoning or both combined, a clear difference of opinion is a negative influence on society. Sometimes people were confused, choose which opinion. Even if one of the opinions they choose, they assume that the most correct opinion and the other opinion is wrong. Diambilpun option would be related to the validity of a series of worship, such as Eid al-Adha with religious sacrifice. However, the Government of Indonesia mengkompanyekan that these differences should not become an issue, depending on the confidence and stability of each as well as promote tolerance of difference. Keywords: Difference, Eid al-Adha and Sacrifice Abstrak: Perbedaan Idul Fitri dan Idul Adha sudah beberapa kali terjadi di Indonesia, yang terbaru adalah Idul Adha 1435 H (2014) yang lalu. Sebenarnya, isu ini adalah apa kriteria yang menunjukkan bulan itu adalah bulan baru sehingga orang bisa tahu tentang hal tersebut. Rukyah al-hilal, atau hisab Qomariyah imkanur rukyat merupakan awal tahun yang digunakan untuk menentukan bagaimana pergantian akhir bulan kepada awal bulan. Perbedaan dalam penentuan awal Ramadhan dan hari raya yang sebenarnya terjadi antara organisasi dan pemerintah (dalam hal ini Departemen Agama). Pertanyaan yang muncul adalah siapa yang memiliki hak otoritas dalam menentukan awal Ramadhan dan Hari Raya di Indonesia?. Terlepas dari metode penentuan yang mereka digunakan, baik melalui rukyat al-hilal, hisab atau keduanya dipadukan, perbedaan yang jelas dari masyarakat  adalah pengaruh negatif atas isu yang berbeda pada masyarakat. Kadang-kadang masyarakat bingung mau pilih yang opini yang mana?. Bahkan jika salah satu dari pendapat mereka pilih, mereka menganggap bahwa pendapat mereka yang paling benar dan pendapat lain adalah salah. Pilihan yang diambilkan akan berhubungan dengan keabsahan dari serangkaian ibadah, seperti Idul Adha dengan hari raya Kurban. Namun, Pemerintah Indonesia mengumumkan bahwa perbedaan ini seharusnya tidak menjadi masalah, tergantung pada kepercayaan dan stabilitas masing-masing serta mempromosikan toleransi perbedaan. Kta Kunci: Perbedaan, Idul Adha dan Qurban

Abstract

This paper takes the topic of religious freedom. Freedom of belief when faced with the principle of freedom of religion promoted by the declaration of human rights cause differences in public perception. The formulation of freedom of religion can be understood by choosing or embracing a religion, out of a religion and no religion is the scope of freedom of religion. This also affects the law and the provision of transitional religious sanctions contrary to the principle of religious freedom which will affect the violation of human rights. The existence of clash between two interests is the author interested in discussing it further.This research is library research (literature study), with normative approach. Data collection is done by recording, reviewing and reviewing all information obtained from primary and secondary data. After the data collection process is complete, data selection, data grouping, and description process is the compilation of data into a narrative text. Then the data is analyzed qualitatively to get the conclusion.This research produces: 1) There is a difference of opinion of scholars related to the issue of religious transition. The majority of religious scholars believe that the case of religious transition into the hudud finger. This is due to the definite and permanent form of punishment and there is no chance for the ruler to forgive him. Meanwhile, according to Hanafiyah incase this transition case of religion on takzir jarimah, the consequences of death penalty is fixed and permanent, but there is an opportunity for the ruler to forgive him and forgive him; 2) For the murder of transitional people in the shari'ah of Islam is the replacement of religion accompanied by war. The war in the Islamic Shari'ah is a major crime that includes one of the crimes that disrupt the security of the state and damage the existing system.

Abstract

Kebebasan berkeyakinan misalnya, apabila dihadapkan dengan prinsip kebebasan beragama yang diusung oleh deklarasi tersebut menimbulkan perbedaan persepsi dalam masyarakat. Rumusan dari kebebasan beragama dapat dipahami dengan memilih atau menganut suatu agama, keluar dari suatu agama dan tidak beragama adalah cakupan dari kebebasan beragama. Hal ini juga berpengaruh terhadap hukum dan pemberian sanksi murtad bertentangan dengan prinsip kebebasan beragama yang nantinya akan berimbas pada pelanggaran hak asasi manusia. Adanya pembenturan antara dua kepentingan inilah penulis tertarik membahasnya lebih lanjut dalam bentuk makalah. Terjadi perbedaan pendapat ulama terkaait dengan persoalan murtad. Mayoritas ulama berpendapat kasus murtad masuk ke dalam jarimah hudud. Hal ini disebabkan karena bentuk hukuman pasti dan permanen dan tidak ada peluang bagi penguasa untuk memaafkannya. Sedangkan menurut Hanafiyah memasukkan kasus murtad ini pada jarimah takzir, konsekwensi hukuman mati itu sudah pasti dan permanen, tapi ada peluang bagi penguasa untuk memaafkannya dan mengampuninya.

Abstract

Endowments money were not only provides a new alternative for Muslims in Indonesia in berwakaf. But also serves to provide a solution for improving the welfare of the wider community. The introduction of cash waqf in the lives of Muslims in Indonesia have shifted he old paradigm. Besides the introduction of this money back waqf has also provided ample opportunity for Muslims from all walks of life to participate ful????ill waqf money though not in large numbers. The conclusions are the First, endowments developed in accordance with the development of society itself or can be said to be associated with social change. Second, the Act perwakafan in Indonesia combines different school a second opinion about the object waqf that includes movable and immovable. Among the moves bendak including cash and precious metals. Third, endowments money can be used as motivation berwakaf for Muslims, various facilities offered in cash waqf, Muslims will more easily give their contribution to the capital endowments without having to wait in a very large number.

Abstract

Abstract Meaning of distribution in the wider Islamic economics, which includes ownership arrangements elements of production and sources of wealth. Islam allow common ownership and specific ownership and put to each of the two kaedah-kaedah to inheritance, grants and testament. Islamic Economics comes with a distribution system that realizes a variety of purposes that include various areas of life and has contributed along sysri'ah political system and others in realizing the common objectives of Shariah. The purpose of distribution in Islamic economics can be grouped for purposes of propaganda, education, social and economic. Distribution of justice in Islam is necessary, in order to prevent the accumulation of wealth. There are three ways you can do to penyesuaikan melestrikan differences and economic balance between the individuals in the community or state. First, do not allow accumulation or hoarding of wealth and ensure the availability of community needs any nationality or religion, and do not spend money or property to luxury. Second, do not let the circulation of wealth only in a minority. Third, Islam does not allow the imbalance in the distribution of wealth and income, which would upset the balance of the economy. However, the discrepancy can provide motivation for creativity and initiative to achieve integration and cooperation not bring up the differences and conflicts. Abstract

This study aims to analyze the effect of household responsibilities from the perspective of  personality,  motivation,  cognition and  work  responsibility on  the academic achievement of married students at the MA Bayang Islamic High School. This research approach is quantitative research with survey method and cross sectional design. The research population is all married students who are registered as active students of the 2018 Islamic High School MA Bayang. Samples were taken by accidental sampling technique as many as 40 people. The research instrument used   observation   sheets,   questionnaires,   interviews   and   documentation.   The author's data collection techniques use observation, questionnaires, and documentation. While the data analysis technique the author presents in the form of data tabulation techniques and processed with SPSS version 16 computational techniques,  then the data  that  has been  processed  is interpreted and  analyzed. Questionnaire data was analyzed using the percentage equation to calculate the Total Respondent Achievement (TCR), while the inferential data was calculated using Multiple Linear Regression. From the results of the study, it was found that the personality/attitude of married students in household responsibilities had an average index of 3.24 and the level of achievement of respondents was 64.8% with a good enough category, a significant effect on academic achievement of 0.032, while motivation (college support from partners in household) the average index is 3.22 and the level of achievement of respondents is 64.3% with a fairly good category, it does not significantly affect academic achievement where the value of b is -0.013, and cognition of household students with an average index of 3.21 with the level of achievement   of   respondents   64.3%,   has   a   significant   effect   on   academic achievement, where the value of b is 0.025.

Abstract

This study discusses about marital conflict of the community in Lempur Tengah, one of village in Gunung Raya district, Kerinci Regency. The type of this research is a field research, with a qualitative approach. The primary data source in this study is the community of  Lempur Tengah Village, Gunung Raya District, Kerinci Regency. Secondary data sources consist of books and literature related to conflict management in the household. The data collection technique in this study is to use snowball sampling, while the technical data processing consists of 3 related things namely data reduction, data presentation and conclusion. The results of this research revealed several forms of marital conflict that occurred in the households of the Lempur Tengah Village community, Gunung Raya District, namely: verbal violence, physical violence, defensiveness, and withdrawal from the couple. Among the four forms of conflict verbal abuse is a dominant form of conflict. The causes of marital conflict in Lempur Tengah Village community are caused by several factors, namely economic factors, children, communication failure, jealousy and religious factors. The cause of the conflict in the households of the Lempur Tengah Village community was dominated by economic factors. Conflict resolution in this study refers to the 5 conflict management styles proposed by Robbins and Judge, namely the style of competition, collaboration, avoidance, accommodation and the style of compromise. The compromise style is the one most in accordance with what the Lempur Tengah Village community does in resolving conflicts that occur in marriage

Abstract

Khilafiyah that occurred in Gunuang Omeh because people worshiped to maintain what had  been  practiced  and  left  behind  by  previous  parents  or  scholars.  A review of  the  results  of this study shows that in general, people worship. First, people who are thick with their stance or  understanding,  while  still  practicing  what  they  have  learned  from  previous  scholars, teachers  and  parents.  Second,  people  who  cannot  accept  differences  in  worship  so  that  they establish a place of worship to worship according to the practice they believe is carried out by the elderly who are still on their stance that their practice is the most correct or in worshiping an opinion they believe in. the truth is and the people who worship are willing to accept openly the acts of worship of others who are not the same as their practice of the younger generation. Third,  khilafiyyah  in  Gunuang  Omeh  District  is  not  a  new  thing,  this  is  commonplace  but  the scholars  try  to  unite  and  provide  an  explanation  of  khilafiyah  in  worshiping  the  community even  though  there  are  still  scholars  who  remain  strong  with  their  daily  practices  or  imitate what  has  been  passed on  by their  predecessors.  Fourth,  trying not  to  question the problem of khilâfiyah  and  not  showing  khilâfiyah  in  the  community  even  though  this  kind  of  thinking  is difficult  to  put together  in  the  same  concept  among  Niniak  Mamak  in  Gunang  Omeh  District. Because  this  Niniak  Mamak  has  a  clan  or  leader  of  their  people  who  they  have  to  unite  and provide an explanation for worshiping which they have disputed so far, but in practice Niniak Mamak is also involved in the khilafiyah sphere even though the majority of Niniak Mamak are ulama and community leaders who heard and became a role model by the people in Gunuang Omeh. Abstract

This paper discusses the dynamics of khuluk according to fiqh and its implementation in the Religious Courts. Khuluk according to fiqh is a divorce pronounced by a husband with an agreement to pay / iwadh from his wife to her husband due to fears that the wife is unable to carry out the laws of Allah SWT. These concerns can be in the form of the wife not being able to love her husband or the inability of the wife to carry out her obligations as a wife. Meanwhile, khuluk in the Religious Courts is a divorce lawsuit filed by the wife or her legal representative because the husband violates Article 116 of the Compilation of Islamic Law as the reason for the divorce or the husband fulfills the shigat talik talak. This research is a normative-empirical legal research, namely research conducted by examining written regulations and their aspects. This research uses a legislative approach, a conceptual approach, and a comparative approach. The results of this study explain that the divorce lawsuit contained in fiqh, the Compilation of Islamic Law is different from the review of divorce claims with the Marriage Law and PP 9/1975.
