Abstract

The name of AlphaJunaidiyah Tarekat attributed to the Sufi Abu al-Qasim Junaid al-Baghdadi. This Tarekat has a special attraction for its followers; those are the practical deeds, not exclusive and highly compromised with the situation of modern life. Historically this Tarekat has included the oldest Tarekat in the Islamic world, but its new entrants and developing in Indonesia, about 1956. This Tarekat is open, accepting students from various backgrounds and give them freedom to follow another tarekat. The genealogy of Junaidiyah Tarekat is not continued, but by his followers accepted the validity of the argument berzakhi theory or Uwaisy, which is commonly believed by the Sufis. The Junaidiyahs teachings or doctrines were sourced from the teachings of the books of Tawheed, Fiqh and Sufism is popular among Ahlussunah wal Jamaat. Abstract

Abstract

Masalah penulisan sejarah (historiografi) Banjar sepertinya kurang mendapat perhatian. Karenanya sejarawan Banjar di daerah ini sangat langka. Untuk menulis sejarah Banjar yang lengkap bahannya bukan tidak ada, umpamanya yang ditulis oleh Belanda. Sumber-sumber sejarah baik Iisan, tulisan, atau benda-benda peninggalan yang ada di daerah ini sangat banyak dan perlu digali, terutama kisah-kisah sejarah yang tersebar dari mulut ke mulut para tecuha masyarakat Banjar. Historiografi Banjar akan lebih bermakna kalau mengikuti perkembangan metodologi penulisan sejarah modem. Oleh karenanya penggunaan metodologi dan teori penting dilakukan dalam historiografi, agar sejarah yang dihasilkan tidak sekadar kisah, tetapi mempunyai nilai historitas

Abstract

Abstract: Facing or directing towards Qibla, which is one of the essential conditions for the validity of prayer, is sometimes challenging and tends to rely on existing directions or estimations. Among the various Qibla direction indicators circulating in society, especially in South Kalimantan, the Nagara-made compass was found (from one of the Districts in South Hulu Sungai Regency), which later became known as the Nagara compass. The research method used by the author is qualitative research, which produces descriptive data. The type of research is field research, conducted by gathering data by observing the object to be studied, with the researcher as the subject (actor) of the research. The reason for using this type of research is to obtain data in line with the location's data and to avoid invalid data regarding the Nagara compass. The data obtained are collected through observation techniques and data analysis through the science of falak. This study proves that the results of the Qibla direction indication by the Nagara compass cannot be considered scientifically accurate and cannot be justified scientifically; it can only be used as a mere aid for estimating the Qibla direction.Keywords: Qibla, Compass, magnetic correction. Abstrak:Ketentuan menghadap atau mengarah ke Qiblat yang merupakan salah satu syarat sahnya shalat, terkadang merupakan hal yang sulit untuk dilakukan, dan cenderung memanfaatkan arah yang sudah ada atau dengan taksiran saja. Diantara sekian banyak alat penunjuk arah Qiblat yang beredar di masyarakat, khususnya di Kalimantan Selatan, ditemukan kompas buatan Nagara  (salah satu Kecamatan di Kabupaten Hulu Sungai Selatan), kompas ini kemudian lebih dikenal dengan kompas Nagara. Metode penelitian yang dilakukan penulis merupakan metode penelitian kualitatif yang menghasilkan data deskriptif. Untuk jenis penelitian yaitu penelitian lapangan. Dengan cara mencari data dengan melihat obyek yang akan diteliti. Dimana peneliti sebagai subyek (pelaku) penelitian. Alasan peneliti menggunakan jenis penelitian ini bertujuan untuk mendapatkan data sesuai dengan data lokasi, serta untuk menghindari data yang tidak valid terhadap kompas Nagara. Data yang diperoleh menggunakan teknik observasi dan telaah data melalui ilmu falak. Penelitian ini membuktikan bahwa hasil penunjukkan arah Qiblat kompas Nagara secara ilmiah belum dapat dikatakan akurat dan malah belum dapat dipertanggungjawabkan keilmiahannya, dan hanya dapat dijadikan sebagai alat bantu semata, untuk mengira-ngira “arah” Qiblat.Kata Kunci : Qiblat, Kompas, koreksi magnet,

Abstract

Abstrak: Penelitian ini akan membahas tentang hak sekufu (kesetaraan antara suami dan istri dalam keluarga pada komponen-komponen tertentu) dalam perkawinan masyarakat Banjar dalam Kitab Nikah oleh Syekh Muhammad Arsyad al-Banjari. Buku yang disusun oleh ulama Banjar abad ke-16 ini membuktikan bahwa persoalan kafa'ah yang diajarkan dalam hadits Nabi memiliki ciri khas tersendiri oleh para ulama Banjar, Kalimantan Selatan. Penelitian ini akan membuktikan apakah teori sekufu berdampak pada kelangsungan penentuan hak nikah calon pengantin pria yang akan melamar calon istrinya. Meskipun banyak yang meneliti tentang hak kafa'ah dalam pernikahan, penelitian ini belum membahasnya karena implikasi dari sekufu didasarkan pada adat Banjar. Tidak hanya itu, kafa'ah juga dijadikan sebagai tolak ukur atau standar dalam memilih pasangan. Metode yang digunakan dalam penelitian ini adalah studi kepustakaan dengan sumber utama kitab an-Nikah karya Syekh Muhammad Arsyad al-Banjary, serta penelitian lapangan berupa wawancara untuk menambah informasi yang relevan dengan hasil penelitian penulis. Penelitian ini menemukan bahwa menurut al-Banjari, kafa'ah merupakan hak bagi perempuan yang dapat menentukan pilihan dalam hal ijab kabul melalui hak-hak keluarga perempuan. Hal ini membuktikan bahwa hak sekufu terlihat dalam bentuk keluarga, bukan individuKata Kunci: Al-Banjari;Kitabun Nikah;Sekufu;Penentuan   Abstract: This research will discuss the right of sekufu (equality between husband and wife in a family on certain components) in marriage in Banjar society in the Kitabun Nikah by Shaykh Muhammad Arsyad al-Banjari. This book, which was compiled by the 16th-century Banjar cleric, proves that the issue of kafa’ah taught in the Prophet's Hadith has its characteristics by the scholars of Banjar, South Kalimantan. This study will prove whether the sekufu theory has an impact on the continuity of determining the marriage rights of the groom who will propose to his future wife. Although many have researched the right of kafa'ah in marriage, this research has not discussed it because the implications of sekufu are based on Banjar customs. Not only that but kafa'ah is also used as a benchmark or standard in choosing a partner. The method used in this research is a literature study with the primary source of the book an-Nikah by Sheikh Muhammad Arsyad al-Banjary, as well as field research in the form of interviews to add relevant information to the results of the author's research. This study found that according to al-Banjari, kafa’ah is a right for women who can make choices in terms of marital consent through the rights of the woman's family. Abstract

Penelitian ini bertujuan untuk mengetahui implementasi nilai dakwah melalui toleransi beragama di pondok pesantren di Provinsi Kalimantan Selatan. Hal ini penting dipahami karena tudingan yang mengatakan bahwa pondok pesantren di Kalimantan Selatan masih rawan tertular paham radikal keagamaan. Metodologi yang dipakai ini merupakan penelitian lapangan, sumber data berupa hasil wawancara dengan pimpinan pondok pesantren dan juga para guru pengasuh pondok pesantren yang berada dalam wilayah Kalimantan Selatan terkait isu-isu toleransi beragama. Data penelitian dianalisis dengan menggunakan teknik analisis data kualitatif dengan pendekatan sosiologi. Hasil penelitian menunjukan bahwa implementasi nilai dakwah melalui toleransi beragama di pondok pesantren dalam Provinsi Kalimantan Selatan berjalan dengan sangat baik. Pemahaman para usataz dan ustazah tentang toleransi beragama dan berkeyakinan semuanya merujuk kepada ayat Al-Quran dan contoh perilaku kebaikan Nabi Muhammad terhadap orang-orang non muslim. Di samping itu, negara Indonesia yang berdasarkan atas Pancasila, UUD 1945, dan UU di bawahnya juga menjadi rujukan ketika para ustaz dan ustazah menjelaskan toleransi beragama. Toleransi beragama itu diimplementasikan dengan mempersilahkan kepada penganut agama lain untuk mendirikan tempat ibadah mereka di tengah masyarakat muslim, termasuk melakukan segenap aktivitas keagamaan lainnya. Tudingan bahwa pondok pesantren di Kalimantan Selatan telah terkontaminasi paham radikal tidak terbukti. Penelitian ini merupakan penelitian pertama yang mengkaji tentang toleransi beragama di pondok pesantren dalam Provinsi Kalimantan Selatan, sehingga menjadi dasar kebijakan terhadap perumusan peraturan terhadap lembaga pendidikan.

Abstract

At this time, in the contemporary and modernization era, it is easier for couples who want to get married, especially with economic conditions that have begun to recover from the influence of the pandemic, so this is very supportive of quickly achieving their desire to marry. For couples who have previously been married and want to remarry, of course there are other requirements that must be met. Thus, sometimes some couples take shortcuts in falsifying their identity, such as being a widow or a virgin, in order to achieve their desire to get married officially. This is not impossible, in fact, it often happens that prospective female partners deliberately fake their identities to be accepted by male partners who are still virgins. The main problem in this research is how to implement the husband's right to annul the marriage due to falsifying the identity of the prospective wife, as well as how the judge's legal considerations are in resolving this problem. This study uses qualitative research methods with a normative descriptive approach. Data sources are based on literature studies and court decisions which are then analyzed using the content analysis method. The research results prove that the husband's rights in cases of identity fraud by his future wife are protected by the state based on statutory regulations so that the husband can take legal action to defend his rights. The judge in this case has given appropriate legal considerations so that no party is harmed as a consequence of their respective actions.

Abstract

This study explores the reform of Islamic family law in Indonesia through the integration of maqāṣid al-sharī‘ah and the principles of justice and public welfare (maṣlaḥah) in response to the challenges of digital transformation. Employing a normative-juridical and comparative approach, it examines the limitations of the Kompilasi Hukum Islam (KHI) in addressing issues arising from technological developments and the growing demands for the protection of women and children. The findings reveal persistent inequalities in provisions concerning marriage guardianship, polygamy, and the legal status of children born out of wedlock. Guided by the objectives of maqāṣid al-sharī‘ah—particularly justice (‘adl), welfare (maṣlaḥah), and human dignity (karāmah insāniyyah)—the study affirms that authentic Islamic reform can be achieved without departing from Sharia’s normative foundations. Lessons from Morocco and Malaysia demonstrate that renewal within Islamic law is attainable through institutional innovation and contextual sensitivity. The research concludes that Indonesia’s Islamic family law reform should be maqāṣid-driven, justice-oriented, and digitally adaptive to ensure a fair, moral, and responsive legal framework consistent with the spirit of Islamic law in the modern age.
