Abstract

Abstract: This paper discusses about law of waqf implementation in Indonesia. Regulations endow-ments have been proposed by the Government and approved by the legislature to form Undang-UndangNomor 41 Tahun 2004 about Waqf, which is complemented by the executive to establish and enforcePeraturan Pemerintah Nomor 42 Tahun 2006 about the implementation of Undang-Undang Nomor41 Tahun 2004. Implementation of the law has been prepared by forming Indonesian Waqf Board(BWI), and the Deed of Pledge Officer waqf (PPAIW) located in the Office of Religious Affairs, andIndonesian Ulema Council (MUI). In terms of cash waqf, also formed Islamic Financial InstitutionsRecipients Endowments money (LKS-PWU) to facilitate development cash waqf. For law enforcement,waqf was created as one of the absolute competence religious courts based on the examination andsettlement of formal law. From this effort, waqf management was expected to run well in accordancewith the laws in the set.

Abstract

The magnitude of the potential banking market-micro made many banks and other financial institutions makeprofits in the segment of small and micro finance as a market for rural banks (BPR), especially Islamic ruralbanks (BPRS). Thus, the BPRS efficiency was required to survive amid the competitions. This study usedparametric stochastic frontier approach (SFA) and the method of data envelopment analysis (DEA) to analyzethe level of efficiency of BPRS operation during the period of 2nd Quarter June 20111st Quarter March2013. The level of Bank efficiency could be integrated with the performance of banks which was adopted fromCentral Bank (BI) criterias, namely CAMEL (Capital, Asset Quality, Management, Earnings and liquidity).Based on the Spearman correlation, the results of this study indicated that the level of efficiency of BPRS usingthe SFA method had no real relationship with CAMEL, while the level of efficiency of BPRS using the DEAmethod had a real and weak relationship with CAMEL. Another result in this study showed that the level ofefficiency using SFA method was statistically higher than the level of efficiency using DEA method.

Abstract

The performance of Islamic banks during the Covid-19 pandemic has had an impact on the financial soundness of Islamic Banks. Islamic Banks in Indonesia should restructure the Financing (PYD) which results in the acquisition of revenue and net profit received by the bank. The aims of this study are to analyze the soundness of Bank BNI Syariah using the CAMEL, RGEC method, the level of cost efficiency and profitability. Then also measured the potential for BNIS bankruptcy with the Altman Z-Score model. The potential risk of bankruptcy in Islamic Banks is very possible if bank management during the Covid-19 pandemic are not carried out properly and professionally. Secondary data is used during the period 2015 to 2020 to analyze the performance of Islamic Banks before the pandemic and during the pandemic. The results of the CAMEL and RGEC analysis show that soundness conditions varied from "Not Very Good" to "Very Good" from 2015 to 2020. In 2020 the soundness condition of BNIS is "Fairly Good". Meanwhile, the Altman Z-Score shows that BNIS is experiencing a “Not Bankrupt” condition, the level of bank efficiency is “High” and at analysis of profitability as reflected by the ROA ratio, ROE during the pandemic has decreased.

Abstract

AbstractInsurance is a willingness to determine the loss as a substitute for large losses that are not yet certain. Along with technological advancement, the insurance industry has begun to develop and the marketing model has also transformed, initially marketing insurance products are only done face-to-face (conventional) method, but now the method was developed by using the telemarketing method. This study aims to determine how the legality of insurance agreements through telemarketing reviewed from Peraturan Otoritas Jasa Keuangan (POJK) Nomor 1/POJK.07/2013 and also to find out the suitability of the insurance agreement through telemarketing according to the principle of consensual in the agreement law at BNI Life. This research uses normative-empirical research and library research by conducting a study of the applicable laws and regulations that support the results of a study. The results of the study show that the insurance offers made by BNI Life were in accordance with those stipulated in POJK 1/2013. However, in practice, the insurance agreement made when making the offer cannot be a perfect agreement, because the insurance agreement through telemarketing by BNI Life does not fulfil the principle of consensual in the agreement law.Keywords: Agreement, Insurance, Telemarketing, Legality

Abstract

This research demonstrates conceptual corporate governance (CG) which has relationship with regulations and Islamic teaching. Then, to investigate CG in Islamic Bank in Indonesia and to review law aspects and Islamic values related to rules of corporate CG in Islamic Bank in Indonesia. The study used qualitative approach using study literature and interview to analyze the implementation of corporate governance in Islamic bank in Indonesia. This study found that Islamic Banks which issued the rules of CG were not following philosophy of Islamic principles and not following strongly Islamic law and positive law. Hence, there were several fraud cases on Islamic banks inIndonesia. Islamic corporate governance in Indonesia still not find the implementation like in Malaysia. Rules of CG through regulation for Islamic bank is involving futher researher to examine the right policy. The regulation of corporate governance regulations for Islamic bank still need to be refined and turned into Islamic corporate governance standard in accordance with Islamic principles and national laws which required by Islamic bank.

Abstract

Start from DPR (Dividend Payout Ratio) as the benchmark that a way to indicate how much investor could get from investing his capital on a public company. As we know that many public company in Indonesia was registered in Jakarta Islamic Index also need to share some of their profit to their investors. DPR is one of the most investor consideration before investing in stock of public company. There are financial variables that could determine DPR such as ROA, DER, asset growth, and DPR a year before. The objects of this study are companies that listed on Jakarta Islamic Index on 2009–2014 period. Selection of the samples in this study using purposive sampling method and found 10 companies fit the criteria that obtained from Indonesia Stock Exchange. This study is using common-effect-panel data regression analysis. Adjusted R-square value in this study is 72.88%. DPR t-1 is partially have significant effect positively on DPR with regression coefficient value of 0.437055. However, DER partially have no effect on the DPR. Variables that affect most on DPR is DPR t-1.

Abstract

One of Government Programs in encouraging for small and medium enterprises (SMEs) is Kredit Usaha Rakyat (KUR). The purpose of the implementation of the program to address the capital investment problem particularly un-bankable proposal. KUR makes SMEs will be able to obtain financing. Then the government authorize the commercial bank for the implementation. One of the authorized commercial bank is Bank SyariahMandiri (BSM). This paper present the findings that debtors characteristics of KUR in BSM is 57.69% male, 85.71% of enterprises, 50% of high school graduates, and 50% of debtors have been become SMEs between 1-10 years. The determinant factors of the debtors of KUR in BSM assumed into five variables, namely information KUR procedures, debtor perception of the KUR, transaction costs, their understanding the value of KUR and Islamic values.

Abstract

Abstract. This study is to measure and analyze the levels of productivity and liquidity of Islamic Banks in Indonesia. This study uses a non-parametric method, contrived from the Malmquist Productivity Index, to measure and analyze the level of productivity of Islamic Banks. Also, this study uses the Liquidity Creation (LC) scale as a liquidity indicator. The regression of the Tobit model is used to measure the effects of independent variables, namely; productivity, liquidity, Financing to Deposit Ratios/FDR, Non-Performance Financing/NPF, and the Capital Adequacy Ratio/CAR, on the profitability of Islamic banks, as represented by Return on Assets/ROA. This study shows that FDR, NPF, and CAR are statistically significant to ROA, while Total Factor Productivity/TFP and LC are not statistically significant. Other results show the level of productivity of Islamic Banks decreased during the period 2011-2020. In terms of liquidity level, Islamic banks did have a sound level of liquidity, based on mapping the criteria of FDR, NPF, and CAR, where the LC always grew. This study shows the novelty of integrating productivity, liquidity, and profitability techniques, to measure Islamic Banking Performance in Indonesia.Keywords: Islamic Bank, Total Factor Productivity, Liquidity Creation, ProfitabilityJEL: G21, R51 Abstrak. Tujuan dari penelitian ini adalah untuk mengukur dan menganalisis tingkat produktivitas dan likuiditas Bank Umum Syariah di Indonesia. Penelitian ini menggunakan metode non parametrik yakni Malmquist Productivity Index untuk mengukur dan menganalisis tingkat produktivitas Bank Umum Syariah. Selain itu, penelitian ini menggunakan Liquidity Creation (LC) sebagai indikator likuiditas. Regresi model Tobit digunakan untuk mengukur pengaruh variabel bebas, yaitu; produktivitas, likuiditas, Financing to Deposit Ratio/FDR, Non-Performance Financing/NPF, dan Capital Adequacy Ratio/CAR terhadap profitabilitas bank syariah yang direpresentasikan oleh Return on Assets/ROA. Penelitian ini menunjukkan bahwa FDR, NPF, dan CAR berpengaruh signifikan terhadap ROA, sedangkan Total Factor Productivity/TFP dan LC tidak berpengaruh signifikan. Hasil lainnya menunjukkan bahwa tingkat produktivitas Bank Umum Syariah menurun selama periode 2011-2020. Dari sisi tingkat likuiditas, bank syariah memang memiliki tingkat likuiditas yang sehat berdasarkan pemetaan kriteria FDR, NPF dan CAR, dimana LC selalu meningkat setiap periode.
