Abstract

Abstrak Mobilitas orang asing yang masuk ke wilayah Indonesia semakin meningkat, selain mempunyai tujuan wisata, ada pula yang berminat untuk berbisnis, melakukan investasi, dan mengemban tugas dari negaranya. Terkait kebutuhan hunian oleh orang asing, maka secara hierarki dan sistematis berdasarkan delegatif Undang-Undang Republik Indonesia Nomor 5 Tahun 1960 Pasal 42 huruf b membentuk Peraturan Pemerintah Republik Indonesia Nomor 103 Tahun 2015.  Subtantif peraturan pelaksana ini tidak akan efektif bila dilihat dari substansi validitas suatu norma keharusan (sollen) yang berarti daya mengikatnya masih pantas dan menjadi telah untuk dilanggar oleh orang asing dan secara skeptis norma tersebut menimbulkan kerancuan dalam hal pelaksanan secara praktis sehingga hukum tidak dapat memfungsikan hukum untuk menata perubahan. Kata Kunci : Pengaturan, Pembelian Hunian, Orang Asing.  Abatract The mobility of foreigners entering the territory of Indonesia is increasing, besides having tourist destinations, there are also those who are interested in doing business, making investments, and carrying out duties from their country Regarding residential needs by foreigners, it is hierarchi and systematic based on the delegation of The Act Number 5 Year 1960 Article 42 letter b establishes Government Regulation Number 103 of 2015. This substantive implementing regulation will not be effective when viewed from the substance of validity norms of necessity (sollen) which means that the binding power is still appropriate and has been violated by foreigners and skeptic the norm creates confusion in terms of practical implementation so that the law cannot function the law to organize change. Keywords: Regulation , Residential Purchases, Foreigners

Abstract

Terasering adalah metode budidaya lahan yang sudah digunakan selama ribuan tahun. Tidak hanya bermanfaaat dalam pertanian, terasering juga menyajikan keindahan alam sehingga menjadikan terasering sebagai daya tarik wisata yang populer dewasa ini. Salah satu objek wisata terasering adalah Wisata Ceking Rice Terrace di Desa Adat Tegalalang. Pengelolaan objek wisata Ceking Rice pada mulanya kurang efektif dan muncul banyak tantangan serta kesulitan, maka dari itu konsep Triple Helix relevan terhadap pengelolaan objek wisata. Dengan metode normatif, konsep Triple Helix digunakan sebagai kerangka untuk menganalisis interaksi antara pemerintah, akademisi, dan sektor bisnis dalam mengembangkan solusi komprehensif untuk pengelolaan Ceking Rice Terrace. Pendekatan ini mendorong pembangunan yang terkendali, menghormati nilai konservasi, dan didukung oleh perjanjian yang menyeimbangkan pelestarian warisan, perlindungan lingkungan, dan pembangunan ekonomi. Berdasarkan hasil analisis, Triple Helix yang memiliki tiga pihak, yakni pemerintah desa adat, akademis, dan pebisnis memiliki peran penting masing-masing. Pemerintah desa adat berfokus pada regulasi yang melindungi objek wisata, menjadikan pedoman serta batas bagi pebisnis yang prioritasnya adalah mengelola objek wisata. Sementara itu, pihak akademis menitikberatkan pada edukasi, penelitian, dan perjanjian. Ketiga pihak tersebut harus mampu berkolaborasi dalam mengelola objek wisata sehingga tidak menimbulkan kerugian.

Abstract

Digital transformation has changed the way family data is managed and stored. The vulnerability of family data has become a serious concern due to the increase in data breach incidents. This research aims to analyze public compliance with family data protection regulations and the ideality of government governance regulations regarding family data protection regulations. This research uses normative legal research methods to analyze the comparison of family data privacy protection regulations between Indonesia and England. This research examines various legal guidelines and policies by applying legislative techniques and a conceptual approach. The legal system theory is used as an analytical framework to evaluate the effectiveness of regulations, law enforcement, and legal culture's influence on public compliance. Data was collected through a literature review of primary and secondary sources, including documents, archives, books, and scientific research findings. The research results show First, that family data protection regulations in England are first more standardized with a higher level of public compliance than in Indonesia. Secondly, Indonesia still faces challenges such as the weak bargaining position of data subjects, the absence of clear guidelines for data controllers, and the need for an independent oversight authority. This research recommends regulatory improvements, the establishment of competent authorities, and enhanced public education to strengthen Indonesia's personal data protection system, particularly family data.

Abstract

The concept of courtroom television has been implemented in Indonesia but not in its entirety. The implementation of courtroom television in criminal justice still has pros and cons which of course can provide education to the public about the law and carry out judicial supervision. This study uses a normative legal research method. The validity of courtroom television from the legal aspect of the principle of being open to the public, the openness of this trial is basically the State of Indonesia as a country of law requires the enforcement of nomocracy that can truly be implemented objectively. The concept of courtroom television or courtroom television is a complete and live broadcast covered by the press in the courtroom with a set of electronic media equipment by means of broadcasting, to divert and focus attention on all subjects (Judges, Clerks, Public Prosecutors, Lawyers, Defendants and Witnesses or Experts) without any review or comment. Open trials to the public, born from the principle of due process of law which is inseparable from the history of Human Rights.

Abstract

Tourism sector development contributes to regional income growth. One example is Gianyar Regency, which has various tourist destinations, including the Ceking Terrace Tourist Attraction. This destination is famous for its terraced views located in Kedisan Traditional Village, Tegallalang District. This research discusses the regulation and implementation of the profit-sharing agreement in the management of the Ceking Terrace Tourist Attraction. The method used is empirical legal research. The results of the study show that the legal regulation regarding the profit-sharing in the management of this tourist attraction is governed by the Gianyar Regency Regional Regulation No. 10 of 2013. This regulation stipulates that traditional villages and traditional institutions have rights within the profit-sharing system for managing this tourist attraction. The profit-sharing agreement includes the rights and obligations of the involved parties, including the management body of the Ceking Terrace Tourist Attraction, which is entitled to guarantees as per the agreed contract. The management body is also obligated to ensure the smooth operation of the management. Additionally, landowners are entitled to compensation for the rice fields used as tourist attractions, with the obligation to maintain its beauty in accordance with the agreement

Abstract

The research aims to explore the impact of geographical indications on increasing the value of products or commodities, thereby boosting the economy of the region where the geographical indications originate. This focus is directed towards the producers rather than the farmers (protecting the communal society) and adheres to the "first to file" principle, where the party that first applies for registration is prioritized. The study utilizes a normative legal research method, focusing on the lack of norms regarding the parameters for protecting the registration of geographical indications. It appropriately employs the following approaches: statute approach, conceptual approach, and analytical approach. The research emphasizes that the assessment and application of geographical indications with a combination of factors must be fulfilled jointly or consider both natural and human factors influencing the quality characteristics of the produced goods. For instance, potential protection under geographical indications with a combination of factors involves products with main raw materials. The goal is to prevent imitation claiming to be a genuine product in circulation and exploiting geographical indications for the benefit of the rights holder. To ensure beneficial certainty, the geographical indications with a combination of factors require a parameter.

Abstract

Fenomena pungutan liar yang berkedok parkir ilegal di Kota Denpasar menimbulkan kerugian bagi masyarakat dan menghambat optimalisasi Pendapatan Asli Daerah (PAD). Praktik ini tidak hanya melanggar peraturan daerah, tetapi juga dapat dikualifikasikan sebagai tindak pidana pemerasan menurut Pasal 368 KUHP. Penelitian ini bertujuan menganalisis implementasi penegakan hukum terhadap pungutan liar sektor perparkiran, serta mengidentifikasi hambatan internal dan eksternal dalam pelaksanaannya. Metode yang digunakan adalah pendekatan hukum yuridis empiris dengan memadukan analisis normatif dan fakta lapangan. Data primer diperoleh melalui wawancara dengan pihak Perumda Bhukti Praja Sewakadarma dan aparat terkait, sedangkan data sekunder berasal dari peraturan perundang-undangan, literatur, dan dokumen resmi. Hasil penelitian menunjukkan bahwa meskipun telah ada Peraturan Wali Kota Denpasar Nomor 64 Tahun 2023 dan kerjasama dengan Satgas Saber Pungli, praktik pungutan liar masih terjadi akibat lemahnya pengawasan, kebijakan yang tumpang tindih, serta resistensi masyarakat adat terhadap aturan pajak parkir. Oleh karena itu, sinergi antarinstansi, penegakan hukum yang konsisten, dan pendekatan sosial kepada masyarakat menjadi kunci dalam pemberantasan pungutan liar di sektor perparkiran Kota Denpasar.
