Abstract

In the rapidly growing digital era, the phenomenon of fraud and identity theft in online business has become a significant challenge. In the face of this threat, legal protection of consumers plays an important role, especially in the context of a criminal law perspective. This research uses a qualitative approach with a literature study to explore these issues by taking into account the views of legal experts, government officials, consumer victims, and other stakeholders. Secondary data used included relevant laws, regulations, case studies, and academic literature. The results of this research discuss the complexities and challenges in criminal law enforcement related to fraud and identity theft in online businesses. The research emphasizes the importance of cross-sector collaboration and the development of best practices in enhancing consumer protection. The implications of these findings for law enforcement policy and practice are set out as recommendations for governments, law enforcement agencies, e-commerce companies and non-governmental organizations. This research provides an in-depth understanding of consumer protection issues in online business from a criminal law perspective and contributes to the overall improvement of the consumer protection system.

Abstract

The increasing problem of copyright and patent infringement in digital business has become a serious concern in recent years. This research explores the perceptions of digital business actors in Indonesia regarding the legal protection of intellectual property, particularly through criminal law enforcement against copyright and patent violations. In rapidly developing digital businesses, intellectual property such as copyrights and patents have become crucial assets for companies to maintain their competitive advantage. However, copyright and patent infringement in digital business presents serious challenges, especially with increasing technological advances and internet penetration. This research uses qualitative methods that focus on an in-depth analysis of the perceptions of digital business actors in Indonesia regarding criminal law enforcement on copyright and patent violations. Data collection was carried out through interviews with digital business actors using a semi-structured interview guide. Data analysis was carried out using thematic analysis. The research results show that digital business actors have a high awareness of the importance of IPR protection, but they still face big challenges related to protection that is not yet effective and often does not provide an adequate deterrent effect against copyright and patent infringement.

Abstract

Restorative justice is an alternative approach in the criminal justice system that balances offender rehabilitation, victim recovery, and community interests. This article analyze the implementation of restorative justice in Indonesia, its contribution to offender rehabilitation, and its role in facilitating victim recovery and strengthening a sense of social justice. The research method used is normative-juridical with descriptive analysis, reviewing laws and regulations, court decisions, academic literature, and international practices as comparative material. The results of the study indicate that restorative principles have been institutionalized through the Juvenile Justice and Child Protection Law, the Criminal Code, Supreme Court Regulation Number 1 of 2024, and regulations related to the termination of prosecution through a peace agreement. Offender rehabilitation is achieved through education, counseling, skills training, mediation, and community involvement to reduce recidivism. A victim-centered approach prioritizes compensation, psychosocial support, and community participation, fostering justice, social reintegration, and local wisdom–based collective harmony. Obstacles such as limited facilities, officer training, inter-agency coordination, and social stigma need to be addressed for effective implementation. Restorative justice affirms the philosophy of humanist criminal law, creating an inclusive, participatory, and recovery-oriented justice system, while strengthening social harmony and public trust in the law.
