Abstract

Criminological Analysis of Sexual Violence in Higher Education (Study of the TPKS Law and the Minister of Education, Culture, Research, and Technology Regulation). The purpose of this study is to determine efforts to prevent and handle sexual violence in relation to the TPKS Law and to identify supporting and inhibiting factors in prevention and handling in higher education in relation to the TPKS Law. This study employed a mixed methods approach. Primary data came from field research, including interviews and a questionnaire to determine the number of sexual violence cases in higher education. Secondary data came from library research, including literature and books related to the research. Efforts to prevent and handle sexual violence in the university environment are linked to the TPKS Law and the Minister of Research, Technology and Higher Education Regulation. The supporting factor in the process of preventing and handling sexual violence cases at UNM is the excellent support from the University Leadership. The obstacles in the performance of the PPKS Task Force are the adjustment of time between the PPKS Task Force Team for case examinations due to the busy main tasks so that examinations are often carried out outside campus operating hours, limited facilities and infrastructure also become obstacles in the performance of the UNM PPKS Task Force

Abstract

Violent crimes are a form of legal violation that have multidimensional impacts on victims, perpetrators, and society. Violence not only causes physical and psychological suffering but also creates social instability, collective fear, and economic and psychological burdens. The characteristics of violent crimes in Indonesia reflect socio-cultural and legal complexities that require a holistic response strategy. With a high prevalence of gender-based violence and high levels of underreporting, victim protection, legal outreach, and law enforcement reform are crucial to reducing the number of violent crimes. This research uses legislative, conceptual, and comparative approaches. The research is related to the prevention and handling of violence, so it is hoped that this research can provide considerations for policymaking related to the prevention and handling of violence in the future. In other words, this research can also serve as ius contituendum. Before the specific regulations on sexual violence, the Criminal Code, the ITE Law, and the Pornography Law were in effect. Then, Regulation of the Minister of Education, Culture, Research, and Technology No. 55 of 2024 concerning the prevention and handling of sexual violence that favors victims came into effect. The ministerial regulation requires every educational institution to establish a PPKS Task Force, provide holistic services for victims, and impose administrative sanctions on perpetrators. The existence of these various special regulations creates challenges, the solution of which lies in harmonizing norms and implementing the lex specialis principle, where the TPKS Law is positioned as the primary and comprehensive special law.

Abstract

Angka kecelakaan kerja di Indonesia mengalami peningkatan signifikan mencapai 47.300 kasus hingga April 2025 atau meningkat 12% dibandingkan periode yang sama tahun sebelumnya. Sektor konstruksi menjadi penyumbang tertinggi kasus kecelakaan kerja, termasuk pada proyek pembangunan Pengadilan Tata Usaha Negara (PTUN) Makassar yang memiliki risiko tinggi akibat penggunaan alat berat dan mesin canggih. Penelitian ini bertujuan menganalisis pengaruh implementasi Sistem Manajemen Keselamatan dan Kesehatan Kerja (SMK3) terhadap frekuensi kecelakaan kerja dan mengidentifikasi optimalisasi manfaat Jaminan Kecelakaan Kerja (JKK) pada proyek pembangunan PTUN Makassar. Penelitian menggunakan pendekatan mixed method dengan desain kuantitatif dan kualitatif. Data kuantitatif diperoleh melalui survei terhadap pekerja konstruksi untuk mengukur frekuensi kecelakaan kerja, sedangkan data kualitatif dikumpulkan melalui wawancara mendalam dengan manajemen proyek, pekerja, dan pihak BPJS Ketenagakerjaan untuk mengeksplorasi implementasi SMK3, penyediaan Alat Pelindung Diri (APD), dan optimalisasi manfaat JKK
