Abstract

Selama ini wakaf selalu diidentikkan dengan wakaf tanah milik, namun seiring lahirnya Undang-Undang Nomor 41 Tahun 2004 tentang Wakaf, menjadikan  konsep  wakaf    mengandung  dimensi yang sangat luas yang tidak hanya mencakup harta bergerak saja, melainkan juga harta tidak bergerak, yakni termasuk wakaf uang yang penggunaanya sangat luas yang tidak terbatas pada pendirian tempat ibadah dan sosial kegamaan. Kehadiran undang-undang ini diproyeksikan sebagai sarana rekayasa sosial, melakukan perubahan- perubahan pemikiran, sikap dan perilaku umat Islam serta untuk memberdayakan wakaf yang merupakan salah satu instrumen dalam membangun kehidupan sosial ekonomi umat Islam. Di samping itu juga sebagai momentum permberdayaan wakaf secara produktif sesuai dengan nafas syari’at Islam.

Abstract

The come up of Marriage Law No. 1 1974 on Marriage and KHI (Compilation of Islamic Law) is the demands and as the answers to all the unrest and uncertainty faced by the Muslim community to be the foundation and or references in overcoming problems related tofamily law. A bill of the Law on modern marriage is a form of response to pressure from women's organizations at the time, and greatly this ordinance establishes rules of monogamy and gave equal rights to divorce for women and men although the ordinance only applied to people who choose the rules of registration of marriage. Article 1 of Law No. 1 Year 1974 on Marriage, which meant that the marriage is aphysical and spiritual bond between a man and a woman as husband and wife, having the purpose of establishing a happy and lasting family founded on the Belief in God Almighty. From the conception ofreligious law and the country has actually oriented to human welfare. However, the law is no more than the normative rules that govern people's behavior patterns, the number of legal issues facing society,especially in matters of marriage, then the marriage law required to provide answers to these problems. Therefore, the law should evolve according to the changing times so that can accommodate the growingvalues in society, including in this case the value of their customs, traditions and religion. The law should also not be closed to the renewal effort that suits your needs and benefit together. Ideally, the law should uphold Islamic principles and values of human rightsamong them welfare.

Abstract

In the modern context, legal doctrine is often positioned as a perfect value. This attitude positioned legal doctrine as absolute and people will not be able to evaluate. Civil law and common law as a modern school of law consider this condition as the position to implement concept of justice. Islam has offered a different form of justice. In Islam, justice is not only about socio-religious rites but also the implementation of syariat and haqiqat by Indonesian Muslims. The concept of justice in Islam can be different from those of civil and common law. Justice in Islam is more in the equity of legal procedures and substantive character as the core of legal justice.

Abstract

Assimilation is a process of fostering prisoners whose implementation is by assimilation of prisoners in the community with the aim of restoring the social functions of prisoners back in community life. During the Covid-19 pandemic, assimilation was given because there were excess occupancy in Correctional Institutions so it was feared that inmates would be exposed to Covid-19. This study aims to identify and explain the implementation of assimilation for prisoners in terms of maqashid al-syari'ah. For this reason, this study uses a type of empirical juridical research with a qualitative approach. Sources of data used in the form of primary data and secondary data, and data collection techniques using observation and interviews. As for the data analysis technique, this research used qualitative descriptive. The result of the research is that the implementation of assimilation for prisoners is not necessarily given to all prisoners, but must meet the substantive and administrative requirements as stipulated in the provisions of Article 4 and Article 5 of the Regulation of the Minister of Law and Human Rights Number 32 of 2020. In the review of maqashid al-syari' Ah, the assimilation policy for prisoners can be said to be directly proportional to the value of maintaining hifdz ad-din (maintaining religion), hifdz an-nafs (maintaining the soul), hifdz al-al-aql (maintaining reason), hifdz al-nasl (maintaining offspring) , hifdz al-mal (maintaining property).Asimilasi merupakan proses dari suatu pembinaan narapidana yang pelaksanaannya dengan membaurkan narapidana di lingkungan masyarakat dengan tujuan untuk memulihkan fungsi sosial narapidana kembali di dalam kehidupan masyarakat. Pada masa pandemi Covid-19, asimilasi diberikan karena terdapat kelebihan hunian di Lembaga Pemasyarakatan sehingga dikhawatirkan Narapidana akan terpapar dari Covid-19. Penelitian ini bertujuan untuk mengetahui dan menjelaskan pelaksanaan pemberian asimilasi bagi Narapidana ditinjau dari maqashid al-syari'ah. Untuk itu penelitian ini menggunakan jenis penelitian yuridis empiris dengan pendekatan kualitatif. Sumber data yang digunakan berupa data primer dan data sekunder, dan teknik pengumpulan data menggunakan observasi dan wawacara. Sedangkan untuk teknik analisis data, penelitian ini menggunakan deskriptif kualitatif. Hasil penelitian ialah pelaksanaan asimilasi bagi Narapidana tidak serta merta diberikan kepada semua Narapidana, melainkan harus memenuhi persyaratan substantif dan adminsitratif sebagaimana diatur dalam ketentuan Pasal 4 dan Pasal 5 Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 32 Tahun 2020. Dalam tinjauan maqashid al-syari’ah, kebijakan asimilasi bagi Narapidana dapat dikatakan berbanding lurus dengan nilai menjaga hifdz ad-din (memelihara agama), hifdz an-nafs (memelihara jiwa), hifdz al-al-aql (memelihara akal), hifdz al-nasl (memelihara keturunan), hifdz al-mal (memelihara harta).

Abstract

The implementation of the Village Information System is essentially a manifestation of the District / City Government in implementing the mandate of Law Number 6 of 2014 concerning Villages, namely developing a village information system and developing rural areas in order to facilitate and encourage the Village Government to improve and provide public services by utilizing technology Village-based Information and Communication (ICT) based on developments in the digital era, so that it can be accessed quickly and easily by the community and all stakeholders. The application of the Village Information System is expected to have positive implications and at the same time guarantee the implementation of village government to be more effective and efficient, transparent and accountable. The obligation to develop the village information system is attached to the Regency / City, not to the Central Government. During this time, the legal basis used in the development of public information systems based on the Village Information System refers to Law Number 6 of 2014 concerning Villages, Law Number 25 of 2009 concerning Public Services, Law Number 14 of 2008 concerning Openness of Public Information , and Governor Regulation of Central Java Province Number 47 of 2016 concerning Guidelines for the Development of Village Information Systems in Central Java Province.Abstrak  Pelaksanaan Sistem Informasi Desa hakikatnya merupakan perwujudan Pemerintah Daerah Kabupaten/Kota dalam mengamalkan amanat Undang-Undang Nomor 6 tahun 2014 tentang Desa, yaitu melakukan pengembangan sistem informasi desa dan pembangunan kawasan perdesaan guna menfasilitasi serta mendorong Pemerintah Desa untuk meningkatkan dan memberikan kemudahan pelayanan publik dengan memanfaatkan Teknologi Informasi dan Komunikasi (TIK) berbasis website Desa seiring perkembangan di era digital, sehingga dapat diakses dengan cepat dan mudah oleh masyarakat dan semua pemangku kepentingan. Penerapan Sistem Informasi Desa diharapkan dapat memberikan implikasi positif dan sekaligus menjamin dalam penyelenggaraan pemerintahan desa agar lebih efektif dan efisien, transparan dan akuntabilitas. Kewajiban pengembangan Sistem Informasi Desa tersebut melekat pada Kabupaten/Kota, bukan pada Pemerintah Pusat. Selama ini, landasan hukum yang digunakan dalam pengembangan pelayanan publik berbasis Sistem Informasi Desa yakni mengacu pada Undang-Undang Nomor 6 Tahun 2014 tentang Desa, Undang-Undang Nomor 25 Tahun 2009 tentang Pelayanan Publik, Undang-Undang Nomor 14 Tahun 2008 tentang Keterbukaan Informasi Publik, dan Peraturan Gubernur Provinsi Jawa Tengah Nomor 47 Tahun 2016 tentang Pedoman Pengembangan Sistem Informasi Desa di Provinsi Jawa Tengah.

Abstract

DISCRETIONARY LEGAL ACTION (FREIESER- MESSEN) IN THE WELFARE STATE CONCEPT: PERSPECTIVE OF STATE ADMINISTRATION LE- GAL AND ISLAMIC LAW. Regulation of  wisdom known as discretionary or ‘freiesermessen’ essentially is a legal act of government or supplies tool of  state administration. This action carried out by the agency or the officials carrying out the government affairs to be able to act on their own initiative in solving social problems. This paper is an analysis of  discretion or ‘freiesermessen’ as one of  the means to move for official or administrative departments of  the State to take action without having to be bound completely on legislation. As a result, in the ideal level, the government has the authority to make discretionary without being tied entirely to the law. But in practical terms, it does not mean that the government or officials of  the State administration can act arbitrarily, but rather an attitude that must be accounted for. In other words, despite government intervention in the lives of  citizens is indispensable in the conception of  the welfare state, but also the accountability of each government action is indispensable in a State of law that upholds the values of truth and justice. keywords: Law act, Discretion, State administration legal, Islamic Law.Peraturan  kebijaksanaan  yang  dikenal  dengan  istilah  diskresi atau freiesermessen pada hakikatnya merupakan tindakan hukum pemerintah atau alat perlengakapan administrasi Negara. Tindakan ini dilakukan oleh badan atau pejabat yang melaksanakan urusan pemerintahan untuk dapat bertindak atas inisiatif  sendiri dalam menyelesaikan persoalan-persoalan sosial. Tulisan ini merupakan analisis terhadap diskresi atau freiesermessen sebagai salah satu sarana yang memberikan ruang bergerak bagi pejabat atau badan-badan administrasi Negara untuk melakukan tindakan tanpa harus terikat sepenuhnya pada undang-undang. Hasilnya, pada tataran ideal, pemerintah memang diberikan kewenangan untuk membuat diskresi tanpa harus terikat sepenuhnya pada undang-undang. Namun pada tataran praktis, tidak berarti pemerintah atau pejabat administrasi Negara dapat bertindak semena-mena, melainkan sikap itu haruslah dipertanggungjawabkan. Dengan kata lain, meskipun campur tangan pemerintah dalam kehidupan warga Negara merupakan keniscayaan dalam konsepsi welfare state,   tetapi pertanggungjawaban setiap tindakan pemerintah juga merupakan keniscayaan dalam Negara hukum yang menjunjung tinggi nilai-nilai kebenaran dan keadilan.kata kunci: Tindakan hukum, Diskresi, Hukum administrasi negara, hukum Islam.

Abstract

This article aims to explore how to optimize the judges of the Jepara Religious Court in preventing child marriage amid increasing requests for dispensation every year as a result of changing the age limit for marriage in the Marriage Law. To answer these objectives, this article uses a type and research approach, namely sociological juridical with a qualitative basis. The primary data source was obtained directly from the informants, namely the Jepara Religious Court judges. The secondary data sources are in the form of books and journals which are still relevant to this theme. To obtain the data and information needed in this article, data collection techniques such as interviews were used. After the data is obtained, the next step is to process the data using data analysis techniques in the form of descriptive qualitative. The results of this study indicate that the optimization carried out by the judges of the Jepara Religious Court in preventing child marriage along with the increase in cases of requests for dispensation of marriage include carrying out administrative tightening and adding recommendation letters from doctors or midwives, and recommendation letters from social services or workers following Court Regulation Number 5 the Year 2019. In addition to conducting massive and simultaneous outreach by involving all elements of society such as religious leaders, community leaders, parents or guardians, families, educational institutions, NGOs, and local government to provide education to the public so they have legal awareness and provide an understanding of negative effects of child marriage.

Abstract

This research study aims to determine the factors behind the low legal awareness of Troso weaving craftsmen in recording creations and to examine this legal awareness using the approach of Law Number 28 of 2014 and the Sharia Economic Law. The type of method used in this research is sociological juridical based on a qualitative approach. The data sources used are primary data (interviews) and secondary data. The research results show that the legal awareness dimension of some Troso weaving craftsmen in recording creations is still relatively low. The low legal awareness of craftsmen is influenced by factors, namely cognitive and affective. Cognitive is closely related to the level of understanding of the procedures for requesting creation registration, and effectiveness is related to an attitude that tends to be apathetic and skeptical is caused by a mindset pragmatic that is only oriented towards production or sales. The reality of legal awareness shows its application Law Number 28 of 2014 in society has not been fully effective, and if viewed from Sharia Economic Law, the reality of low awareness in recording creations is a form of non-compliance in implementing the principles of benefit and written principles in Islamic law. It is hoped that the results of this research can contribute to raising full awareness of Troso weaving craftsmen in recording their creations so that every work they create in the form of woven motifs will have legal protection and their exclusive rights will not be denied. Kajian penelitian ini bertujuan untuk mengetahui faktor-faktor yang melatarbelakangi rendahnya kesadaran hukum pengrajin tenun Troso dalam pencatatan ciptaan serta menelaah kesadaran hukum tersebut dengan pendekatan Undang-Undang Nomor 28 Tahun 2014 dan Hukum Ekonomi Syariah. Jenis metode yang digunakan dalam penelitian ini adalah yuridis sosiologis dengan basis pendekatan kualitatif. Sumber data yang digunakan berupa data primer (wawancara), dan data sekunder. Hasil penelitian menunjukkan bahwa dimensi kesadaran hukum sebagian pengrajin tenun Troso dalam pencatatan ciptaan terbilang masih rendah. Rendahnya kesadaran hukum pengrajin tersebut dipengaruhi oleh faktor yaitu kognitif dan afektif. Kognitif erat kaitannya dengan tingkat pemahaman terhadap prosedur permohonan pencatatan ciptaan, dan afektif berkaitan dengan sikap yang cenderung apatis dan skeptis yang disebabkan mindset pragmatis yang hanya berorientasi pada produksi atau penjualan. Realitas kesadaran hukum tersebut menunjukkan penerapan Undang-Undang Nomor 28 Tahun 2014 di masyarakat belum sepenuhnya berjalan efektif, dan apabila ditinjau dari Hukum Ekonomi Syariah realitas rendahnya kesadaran dalam pencatatan ciptaan merupakan bentuk ketidakpatuhan dalam pengamalan prinsip kemaslahatan dan prinsip tertulis dalam hukum Islam. Hasil penelitian ini diharapkan dapat berkontribusi menumbuhkan kesadaran penuh pengrajin tenun Troso dalam pencatatan ciptaan sehingga setiap karya ciptaannya berupa motif tenun nantinya memiliki perlindungan hukum dan hak eksklusifnya tidak teringkari.

Abstract

One of the current challenges faced by the Sharia Financing Savings and Loan Cooperative (KSPPS) Baitul Maal Wat Tamwil (BMT) Muamalat Mulia Kudus is that many members fail to meet their obligations in providing mudharabah financing, which affects the operational health of the institution. This study aims to explore the settlement model implemented by KSPPS BMT Muamalat Mulia Kudus for members with mudharabah receivables and analyze it from the perspective of maslahah mursalah. This research employs a sociological juridical approach with a qualitative methodology. The findings reveal that KSPPS BMT Muamalat Mulia Kudus addresses the issue of mudharabah receivables through dialogue, offering financing restructuring, continuous monitoring of members, issuing warnings and legal summons, and executing collateral confiscations. From the perspective of maslahah mursalah, these policies are seen as a solution that balances the institution’s need to maintain property ownership by providing relief to members. To prevent financing issues in the future, Sharia Microfinance Institutions are encouraged to thoroughly assess the financial condition of prospective members before approving any form of financing. AbstrakSalah satu masalah sampai saat ini dihadapi Koperasi Simpan Pinjam Pembiayaan Syariah (KSPPS) Baitul Maal Wat Tamwil (BMT) Muamalat Mulia Kudus adalah banyak dari anggota tidak memenuhi prestasi dalam pemberian pembiayaan mudharabah sehingga berimplikasi terhadap kesehatan operasional lembaga tersebut. Penelitian ini bertujuan untuk mengeksplorasi model penyelesaian yang dilakukan KSPPS BMT Muamalat Mulia Kudus terhadap anggota dalam piutang mudharabah, dan menganalisisnya dalam perspektif maslahah mursalah. Penelitian ini termasuk dalam jenis penelitian yuridis sosiologis dengan basis pendekatan kualitatif. Hasil penelitian menunjukan bahwa dalam menyikapi permasalahan piutang mudharabah kebijakan yang diterapkan KSPPS BMT Muamalat Mulia Kudus yaitu berdialog, menawarkan restrukturisasi pembiayaan, monitoring secara berkelanjutan terhadap anggota, memberikan peringatan dan somasi hukum, serta melakukan eksekusi sita jaminan. Kebijakan yang diterapkan tersebut dalam perspektif maslahah mursalah sebagai solusi mewujudkan kemaslahatan bersama dalam menjaga kepemilikan harta bagi lembaga dan memberikan keringanan beban kepada anggota. Untuk mencegah timbulnya permasalahan pembiayaan diharapkan Lembaga Keuangan Mikro Syariah menganalisis terhadap kondisi calon anggota sebelum mengambil keputusan dalam memberikan segala bentuk pembiayaan.
