Abstract

In relation to fulfilling their daily needs, the position and existence of consumers in a dominant society are under businessmen. This has caused the potential loss of customers due to the actions of businessmen. It is not unusual for businessmen to exploit consumers for their interests and advantages without thinking and often neglecting the rights of consumers. This has given rise to disputes between consumers and businessmen that need to be resolved thoroughly and fairly, with legal certainty. The Act No. 8 of 1999 concerning consumer protection has regulated the resolution of consumer disputes which can be carried out outside the court through the Consumer Dispute Settlement Agency (BPSK). The existence of BPSK as a consumer dispute resolution institution does not seem to provide maximum protection to consumers because there are many problems, including the process and procedures for resolving disputes at BPSK. Based on the results of the research and analysis carried out, it is concluded that the resolution of consumer disputes through BPSK in terms of time is relatively faster because it has to be decided within a maximum of 21 working days compared to resolving consumer disputes through general courts which take years. But on the other hand, many problems exist related to the existence of BPSK as a consumer dispute resolution institution, including in the institutional sector, BPSK human resources, inconsistent laws, and so on.

Abstract

Limited Liability Companies in Indonesia, under the applicable law (Law 40/2007 and PP 47/2021), are under the obligation to realize its corporate social responsibility. The idea of CSR is to force the company to make it presence felt beneficially by the local community and wider society.  Unfortunately, not all companies are willing and able to meet its corporate social responsibility, or even if they chose to do so, proportionality is disregard. This paper, using Rudolph von Jhering's point of view, explores and identifies what legal or non-legal factors hinders the implementation of CSR.

Abstract

APPLICATION OF BUSINESS CONTINUITY PROVISIONS (GOING CONCERN) IN BANKRUPTCY TO INCREASE THE VALUE OF BANKRUPTCY ASSETS (Decision No. 54/Pdt.Sus-PKPU/2020/PN Niaga Sby), the aim of this research is to determine the duties and authority of the curator in the management and/or or settlement of bankruptcy assets and to find out the application of the going concern provisions in the bankruptcy of PT. Banjar Intan Mandiri based on Decision No. 54/Pdt.Sus-PKPU/2020/PN Niaga Sby. The research method used in this study is a normative juridical research method with Law no. 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations. The results of this research are that the Curator has the authority to carry out the task of managing and/or settling all of the debtor's assets which become bankruptcy assets. This is because by law the Debtor loses his right to control and manage his assets which are included in the bankruptcy assets from the date the bankruptcy decision is declared. In carrying out its duties, the Curator is not required to obtain approval from or provide prior notification to the Debtor or any of the Debtor's organs, although in circumstances other than bankruptcy such approval or notification is required. The curator is obliged to take actions that can increase the value of the bankrupt assets. The application of business continuity provisions in bankruptcy cases is within the framework of legal protection for debtors and has a positive impact on increasing the company's economic value which in turn is used to pay debts to its creditors.

Abstract

One form of law that has a real and important role in people's lives is contract law. The term "contract" is called "overeenkomst" in Dutch and "agreement/agreement" in English. An agreement is defined in Article 1313 of the Civil Code, which states "An agreement is an act by which one or more people bind themselves to one or more other people". Contract law can be said to be a law that is formed when someone promises something to another person. In this case, both parties have agreed to enter into an agreement without any enforcement or decision by only one party. The type of research is normative legal research. Normative law, there are several approaches in this legal study. In this approach, the authors receive information from various aspects of the problem they want to find answers to. Conclusion: Restructuring of motorcycle consumer protection agreements in financial companies. In essence, Regulation 22/2023 was issued to further strengthen consumer protection in the financial services sector by facilitating coordination of PUJK internal control. In this case, the new framework is expected to guarantee.

Abstract

This is where the financing company (leasing) manages the purchase of motor vehicles on credit. The financing company (leasing) is tasked with making a credit agreement containing payment provisions, interest, late fines, tenor, and default clauses. Also, each vehicle is registered as a fiduciary guarantee which is civilly a unit when the payment has not been paid in full by the debtor, the motorcycle unit is an object of fiduciary guarantee controlled by the creditor (leasing) The approach method used in this study uses a juridical-empirical approach. The juridical approach is used to analyze various laws and regulations governing credit. While the empirical approach is used to analyze law as a rule that is not merely normative, but law can see in the lives of people who always interact and relate to aspects of community life. The meeting of these two interests is what can make cession can be used as an alternative solution to solving problematic credit where each party will equally benefit whether from the debtor, creditor or cessionary side. The cessionary has a very important role where when the cessionary can bring together the interests of the old creditors and the debtor, the problematic credit can be resolved easily. As a new creditor, the cessionary can mediate with the debtor to find a middle ground for resolving the problem of bad credit.

Abstract

The imbalanced position of consumers compared to business actors has led to the potential for disputes between consumers and businesses, known as consumer disputes. These disputes arise when consumers demand compensation for damages, pollution, and losses incurred from consuming goods or utilizing services. According to Law Number 8 of 1999 concerning Consumer Protection, a consumer dispute can be resolved either through the Court or out of Court. Resolving consumer disputes outside of Court is the absolute competence of the Consumer Dispute Resolution Agency. (BPSK). Normatively, the presence of BPSK provides many benefits to consumers; however, in practice, this is not the case, and in many instances, it often fails to provide legal protection to consumers. This includes issues related to the distribution of BPSK, which is not easily accessible to consumers as it is not available in all districts/cities. There are several contradictory regulations in its management, including human resource constraints, that, in many ways, need an understanding of the legal aspects of dispute resolution, especially regarding its position as a quasi-judicial body. Therefore, as a form of legal protection for consumers, BPSK must be empowered in various aspects.

Abstract

The Resolution of Music and Song Copyright Disputes Through Arbitration in Providing Legal Protection for Owners in Indonesia is traditionally managed by the Commercial Court, which is often criticized for being slow, costly, and inefficient, thereby failing to offer optimal legal protection for creators. This situation highlights the need for alternative dispute resolution methods. This study analyzes the challenges of resolving copyright disputes through the Commercial Court and examines arbitration as a faster, more effective alternative for protecting music and song creators' rights in Indonesia. Using a normative legal research approach with legislative and conceptual methods, the research involved literature studies of primary and secondary legal materials. Data were analyzed qualitatively through descriptive analysis and deductive reasoning to assess legal synchronization, case studies, and a comparison between litigation and arbitration. Findings show that Commercial Court processes take 160 to 250 days on average, entail high costs, and involve complex bureaucracy, often resulting in inadequate protection for creators. In contrast, arbitration, especially through the Intellectual Property Arbitration and Mediation Agency (BAM HKI), provides a faster resolution (typically 90–180 days) and is conducted by intellectual property specialists, though its rulings require district court enforcement. The study concludes that arbitration is a viable and strategic alternative to litigation for music copyright disputes. It recommends raising awareness and encouraging the use of BAM HKI among creators and policymakers to improve accessible, efficient, and specialized legal protection, thereby strengthening Indonesia’s intellectual property landscape.

Abstract

Penelitian ini membahas perlindungan hukum bagi kreditur dalam memperoleh hak atas putusan pailit debitur terkait keberadaan aset debitur di luar negara (cross-border insolvency). Tujuan penelitian ini adalah untuk menganalisis perlindungan hukum yang tersedia bagi kreditur dan mengusulkan langkah-langkah ideal bagi kurator dalam menangani aset debitur yang tersebar di berbagai negara. Metode yang digunakan dalam penelitian ini adalah penelitian yuridis normatif dengan pendekatan kasus, berfokus pada putusan-putusan Pengadilan Niaga Jakarta Pusat yang relevan. Hasil penelitian menunjukkan bahwa kurator sering kali menghadapi kesulitan dalam mengeksekusi aset debitur yang berada di luar yurisdiksi Indonesia. Hal ini mengakibatkan hak-hak kreditur tidak terpenuhi, karena banyak aset debitur yang tidak dapat dijangkau secara hukum. Diskusi dalam penelitian ini mencakup perlunya pengaturan hukum yang lebih jelas mengenai kepailitan lintas negara untuk meningkatkan kepastian hukum bagi kreditur. Penelitian ini diharapkan dapat memberikan wawasan bagi mahasiswa hukum dan lembaga perumus undang-undang untuk merancang regulasi yang efektif dalam menangani aset debitur pailit lintas batas, demi perlindungan hukum yang lebih baik bagi kreditur.

Abstract

Penelitian ini menggarisbawahi peran penting bank sebagai perantara dalam mendukung perekonomian nasional melalui pemberian kredit untuk kepentingan bisnis. Meskipun UU Perbankan 1998 tidak menyebutkan secara spesifik mengenai korupsi, namun terdapat keterkaitan yang jelas, terutama dalam pemberian kredit. Penelitian yuridis normatif ini menyoroti bagaimana tindak pidana korupsi, akibat hukum dan pencegahan tindak pidana korupsi pada sektor perbankan terkait dengan kasus Putusan Nomor: 09/PID/TPK/2013/PT.DKI dengan menggunakan pendekatan perundang- undangan dan pendekatan analisis. Dengan menggunakan pendekatan perundang-undangan dan analitis, studi ini mengkaji keterkaitan antara tindak pidana korupsi, konsekuensi hukum, dan pencegahannya di sektor perbankan, dengan fokus pada Putusan Nomor: 09/PID/TPK/2013/PT.DKI. Kasus ini mengungkapkan transformasi penyimpangan kredit menjadi tindak pidana korupsi, yang menjerat individu seperti Athouf Ibnu Tama. Dalam kasus-kasus perbankan dan korupsi yang terjadi secara bersamaan, pelanggaran SOP dan kerugian keuangan merupakan perbuatan melawan hukum secara formal. Untuk mencegah korupsi, memperkuat kontrol internal, mematuhi standar, dan perilaku etis sangat penting, namun konflik dengan Undang-Undang Perbankan dapat muncul, terutama mengenai kewenangan penyidik pasca pemberian kredit dan potensi dampak terhadap kerahasiaan nasabah.
