Abstract

This study examines the enforcement of election crime law in Bone Regency, focusing on the role and effectiveness of Bawaslu and Sentra Gakkumdu. The research aims to identify the dominant forms of election violations and analyze the mechanisms used to address them. Using a qualitative-descriptive method, the study gathers data through interviews, documentation, and legal analysis. The findings reveal that the most common violations involve state civil apparatus involvement, vote buying, and the misuse of government facilities. While enforcement efforts adhere to existing legal frameworks, challenges persist, including limited coordination between institutions and time constraints in legal processing. The study concludes that improving legal enforcement in regional elections requires not only regulatory consistency but also stronger institutional synergy and community-based preventive strategies. These insights contribute to the development of a more effective and integrity-driven election law enforcement model.

Abstract

This research analyzes and formulates solutions to the problem of land law dualism in Indonesia which is characterized by the conflict between customary law (living law) and positive law (positive law). This dualism has created tensions between the recognition of indigenous peoples' rights to land and the state's authority to regulate the control and use of land, resulting in legal uncertainty, overlapping arrangements, and protracted agrarian conflicts. This research uses normative legal research methods with a focus on literature studies, examining primary legal materials such as the 1960 Basic Agrarian Law, the 1945 Constitution, and land-related regulations; secondary legal materials in the form of scientific literature, legal journals, research results, and the views of experts; and tertiary legal materials in the form of legal dictionaries, encyclopedias, and other supporting references. The approaches used include a historical approach to trace the roots of land law dualism since the colonial era, a conceptual approach to examine the theory of customary law and positive law, a legislative approach to analyze applicable legal norms, and a case approach through the study of land practices in Gorontalo, the Special Region of Yogyakarta, and Papua. The results of the study show the need for the integration of customary law into the national land law system through strengthening the position of customary law as a legitimate source of land law, the establishment of laws on indigenous peoples, and the preparation of regional regulations in areas that still have indigenous communities. This effort is expected to end the dualism of land law and create legal certainty that is in line with local values.

Abstract

Penelitian ini mengkaji penegakan hukum tindak pidana pemilu di Kabupaten Bone, dengan fokus pada peran dan efektivitas Bawaslu dan Sentra Gakkumdu. Penelitian ini bertujuan untuk mengidentifikasi bentuk-bentuk pelanggaran pemilu yang dominan dan menganalisis mekanisme yang digunakan untuk mengatasinya. Dengan menggunakan metode kualitatif-deskriptif, penelitian ini mengumpulkan data melalui wawancara, dokumentasi, dan analisis hukum. Temuan tersebut mengungkapkan bahwa pelanggaran yang paling umum melibatkan keterlibatan aparatur sipil negara, pembelian suara, dan penyalahgunaan fasilitas pemerintah. Sementara upaya penegakan hukum mematuhi kerangka hukum yang ada, tantangan tetap ada, termasuk koordinasi yang terbatas antar lembaga dan keterbatasan waktu dalam pemrosesan hukum. Studi ini menyimpulkan bahwa meningkatkan penegakan hukum dalam pilkada, tidak hanya membutuhkan konsistensi regulasi tetapi juga sinergi kelembagaan yang lebih kuat dan strategi pencegahan berbasis masyarakat. Wawasan ini berkontribusi pada pengembangan model penegakan hukum pemilu yang lebih efektif dan didorong oleh integritas.

Abstract

Perkembangan minimarket modern di Kota Gorontalo menimbulkan berbagai implikasi hukum terhadap keberlangsungan Usaha Mikro, Kecil, dan Menengah (UMKM). Kehadiran minimarket modern memberikan kemudahan akses kebutuhan masyarakat, namun juga berpotensi menimbulkan persaingan usaha yang tidak seimbang apabila mekanisme perizinannya tidak diatur secara optimal. Penelitian ini bertujuan untuk menganalisis prinsip mekanisme perizinan minimarket modern terhadap UMKM di Kota Gorontalo serta model mekanisme perizinan yang ideal dalam melindungi dan memberdayakan UMKM. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Sumber bahan hukum terdiri atas bahan hukum primer, sekunder, dan tersier yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa prinsip mekanisme perizinan harus mengedepankan keadilan, keseimbangan usaha, perlindungan UMKM, dan kepastian hukum. Selain itu, model mekanisme perizinan yang ideal dilakukan melalui pengaturan zonasi, pembatasan jarak pendirian minimarket modern, kemitraan dengan UMKM lokal, serta pengawasan pemerintah daerah secara berkelanjutan guna menciptakan persaingan usaha yang sehat dan berkeadilan di Kota Gorontalo.

Abstract

This study examines the reform of criminal law protection of Asmat carvings as a form of traditional cultural expression and communal rights of the Asmat indigenous people in South Papua. The main problem lies in the ineffectiveness of the modern Intellectual Property Rights system based on individual ownership in protecting communal cultural heritage such as Asmat carvings that have spiritual, social, historical, and symbolic value. Various violations still occur, such as imitation of carving motifs, mass reproduction, commercial exploitation without permission, and registration of copyrights or industrial designs by outsiders without fair sharing of benefits for indigenous peoples. This study aims to analyze the legal protection of the Asmat carvings and formulate a criminal law reform model that is more responsive to the communal rights of indigenous peoples. The method used is normative legal research with a legislative approach, a conceptual approach, and a case approach supported by literature studies. The results of the study show that although the constitution, the Copyright Law, and the Law on the Advancement of Culture have provided normative recognition of communal rights, criminal law has not expressly accommodated communal ownership as an object of legal protection. The absence of special criminal offenses, difficulties in the evidentiary mechanism, weak institutional capacity, and lack of optimal integration between customary law and criminal law are the main obstacles, criminal law reform is needed through the recognition of indigenous peoples as legal subjects, the formulation of special criminal acts against the exploitation of traditional culture, the application of the principle of Free Prior Informed Consent (FPIC), and the integration of customary law in national law enforcement.
