Abstract

In accordance with one of the ideals of the General Election, namely to produce quality representatives of the people and the spirit to create a government free from corruption, collusion and nepotism. In the 2019 legislative election, the KPU established KPU regulation No. 20 of 2018 concerning the Nomination of Members of the DPR, Provincial DPRD, and Regency/City DPRD in the 2019 Election. The KPU added a requirement to become a member of the legislature which in article 4 paragraph (3) states that for former convicts of drug dealers, sexual crimes against children, or corruption prohibited from participating in the nomination of members of the legislature. These provisions are considered contrary to Law no. 7 of 2017 concerning General Elections. The formulation of the problem in this paper is how to manifest the fulfillment of prisoners' human rights in filling state positions as regulated in Law Number 7 of 2017 concerning General Elections. The research method used is a normative juridical research method. Normative research requires a statutory approach and a conceptual approach. The data collection technique used is through the study of documents and literature on secondary data in the form of primary, secondary and tertiary legal materials. The conclusion is that there are several decisions of the Constitutional Court, the Supreme Court and the Decisions of the Bawaslu which also hinder the enactment of these provisions. These provisions relate to the limitation of Human Rights, namely the limitation of Political Rights, namely the right to be elected as regulated in Law Number 39 of 1999 concerning Human Rights.

Abstract

Tindak pidana Pemilihan Umum (Pemilu) adalah tindak pidana pelanggaran dan/atau tindak pidana sebagaimana diatur dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum. Tindak pidana dalam pemilu sebenarnya tertuang dalam KUHP yang tertuang dalam Bab IV Kitab Kedua KUHP yaitu tentang “kejahatan terhadap pelaksanaan kewajiban dan hak negara”. Hukuman bersyarat bagi tindak pidana pemilu tidak diatur dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilu, namun hakim dalam beberapa kasus tindak pidana pemilu menggunakan hukuman bersyarat untuk menghukum terdakwa tindak pidana pemilu. Permasalahan yang diangkat dalam tesis ini adalah bagaimana penerapan, penerapan dan pertimbangan hakim dalam memutus tindak pidana pemilu dengan sanksi pidana bersyarat. Penelitian yang dilakukan adalah penelitian hukum normatif dan pendekatan penelitian yang digunakan adalah pendekatan undang-undang dan pendekatan kasus yaitu dengan menggunakan sumber data sekunder bahan hukum yaitu yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum. tersier yaitu dengan menganalisisnya menggunakan metode kualitatif untuk dapat menarik kesimpulan secara deduktif. Penjatuhan sanksi pidana bersyarat tidak ada dan tidak diatur dalam Undang-Undang Nomor 7 Tahun 2017 Tentang Pemilihan Umum, melainkan diatur dalam KUHP Pasal 14a. Majelis Hakim dalam memberikan putusan atas perkara tindak pidana pemilu Nomor 170/Pid.Sus/2019/PN. BNA dan putusan Nomor 171/Pid.Sus/2019/PN. BNA menerapkan hukuman bersyarat terhadap kedua terdakwa.

Abstract

In founding the foundation there is also no uniformity. Notaries usually do not have a standard format regarding the founding deed of the foundation. As a result, each foundation can have its own articles of association as well as the Civil Society Association. Each foundation can make the articles of association according to their needs. The study was conducted using a normative juridical approach with the aim of obtaining secondary data, namely the inventory of legislation and data collection tools in the form of document studies. The foundation was established and developed with the family's efforts so that when the foundation developed rapidly and had many assets, the assets were owned by the family, family assets. The foundation is managed jointly by the family so that when a foundation regulation is established demanding changes to the Articles of Association, this means that there will be separation of foundation assets, restoration of the social functions of the foundation, transparency of accountability and publicity of the foundation's financial statements and ownership of the foundation belongs to the community. This condition is certainly burdensome for the foundation's owners

Abstract

The circulation of alcoholic beverages requires licensing, as regulated in the following regulations: Presidential Regulation of the Republic of Indonesia Number 74 of 2013 on the Control and Supervision of Alcoholic Beverages, and the Minister of Trade Regulation Number 20/M-DAG/PER/4/2014 on the Control and Supervision of Procurement, Distribution, and Sale of Alcoholic Beverages (hereinafter abbreviated as Minister of Trade Regulation No. 20/M-DAG/PER/4/2014) along with the amendments made by the Ministry of Trade. This study uses normative legal research because in addressing the formulated problems, it is clear that the research prioritizes literature or secondary data. Normative legal research emphasizes secondary data, including regulations and legal theories, while also examining the legal norms prevailing in society, leading to the discovery of legal principles in the form of dogma or legal doctrine that are scientifically theoretical and can be used to analyze the discussed issues. The regulation of alcoholic beverage sales is normatively adequate in the implementation of control over the sale of alcoholic beverages. According to the prevailing laws and regulations, the sale of alcoholic beverages is only permitted in certain places such as bars, discotheques, 3 to 5-star hotels, and locations that are not adjacent to places of worship, government offices, and hospitals. However, in reality, the practice of selling alcoholic beverages in the city of Medan still occurs in places that do not comply with the regulations, such as shops and wholesalers, resulting in legal uncertainty.

Abstract

Penelitian ini dimaksudkan tentang bagaimana penerapan proses rekrutmen kepengurusan partai politik dalam mencari pengurus dalam pelaksanaanya yang merujuk kepada undang-undang partai politik nomor 2 tahun 2011, secara umum partai politik merupakan suatu kunci dari keberhasilan suatu sistem perpolitikan negara, dan kunci terpentingnya adalah rekrutmen kader dan pengurus partai politik, yang merupakan suatu indikator yang penting untuk melihat perubahan dan pembangunan suatu partai politik dalam membangun sistem politik pada pemerintahan suatu negara. Tujuan penelitan ini adalah mengkaji kaidah-kaidah hukum serta menganalisis permasalahan hukum tentang rekrutmen partai politik didalam proses rekrutmen mencari kepengurusan. Metode Penelitian penelitian yang digunakan adalah deskritif analitis. Hasil Penelitian, menelaah dari sisi hukum berdasarkan aturan undang-undang Nomor 2 Tahun 2011 tentang partai politik dan Anggaran Dasar dan Anggaran Rumah Tangga partai politik, dalam penelitian ini membuat kesimpulan bahwa seperti dalam  rekrutmen mencari jabatan pengurus masaih banyak partai politik melakukannya dengan cara yang tidak demokratis, seperti jabatan yang pempuyai pengaruh signifikan di tubuh partai politik, seperti jabatan Ketua DPD, Ketua DPC, Bendahara, Sekjen partai sampai Ketua umum partai politik. Sehingga berimplikasi pada elektabilitas partai politik dan citra partai politik yang buruk dan tidak demokratis.

Abstract

Abstract: Human rights are natural rights that are inherent from the moment humans are born, one of which is the right to equal status before the law, the fulfillment of which is mandatory for the state and the entire community. Aceh is one of the special regions where Islamic sharia qanuns are implemented, including the provisions on ikhtilath and adultery therein. In its application, it often becomes a contradiction when one party admits to having committed adultery while the other party does not confess, even though the crime in q uestion was committed jointly with the same tempus and locus delicti. The method used in this research is normative juridical with analytical descriptive characteristics which are collected using literature study techniques and analyzed using qualitative data analysis methods. The results of the research found that there was inequality before the law, That is state violated human rights by omission by not fulfilling the principle of non-derogable rights, so there was a need for a judicial review of the Aceh Qanun that was more dynamic and in line with current developments, judges in this case should be able to determine justice as it should be, is not only a mouthpiece for the law, but is obliged to explore, follow and understand the values that live in society. Keywords: equality before the law, human rights, khalwat jinayah and qanun. Abstrak: Hak Asasi Manusia merupakan hak kodrati yang melekat sejak manusia dilahirkan, salah satunya hak dalam kedudukan yang sama di mata hukum di mana pemenuhannya wajib dilakukan negara dan seluruh masyarakat. Aceh ialah salah satu daerah istimewa dengan penerapan qanun syariat Islam, termasuk ketentuan ikhtilath dan zina didalamnya. Dalam penerapannya seringkali menjadi kontradiksi manakala satu pihak mengaku telah melakukan perzinahan sedang pihak satunya lagi tidak mengaku, padahal tindak pidana dimaksud dilakukan secara bersama dengan tempus dan locus delicti yang sama. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan sifat Deskriptif Analitis yang dikumpulkan dengan teknik studi pustaka dan dianalisis dengan metode analisis data kualitatif. Hasil penelitian menemukan bahwa terjadinya inequality before the law, negara melakukan pelanggaran hak asasi manusia by ommision dengan tidak dipenuhinya asas non derogable rights, sehingga perlu uji materi Qanun Aceh yang lebih dinamis dan sesuai dengan perkembangan zaman, hakim dalam hal ini seharusnya dapat menentukan keadilan sebagaimana seharusnya, tidak hanya sebagai corong undang-undang, melainkan wajib menggali, mengikuti, dan memahami nilai yang hidup di masyarakat. Kata kunci: kedudukan yang sama dimata hukum, ham, khalwat jinayah dan qanun.

Abstract

Abstract: Village Head Election (Pilkades) is an event in a democratic party at the village level as village autonomy/village rights to elect new leaders from the village community. The village head election in Cinta Damai Village was in conflict over the results of a very narrow vote dispute, a difference of 9 votes which was marked by various frauds, resulting in dissatisfaction with the results of the village head election, the losing party felt they had been disadvantaged by the results obtained, but the problem is that the Regent of Deli Serdang still inaugurated with the Decree of the Regent of Deli Serdang Number 395 of 2022 concerning the ratification and appointment of the Head of Cinta Damai Village, Percut Sei Tuan District dated May 18, 2022 on behalf of Josta Josevina Tambunan. The purpose of this study was to determine and analyze the settlement of the lawsuit for the cancellation of the Deli Serdang Regent's Decree against the appointment of the Head of Cinta Damai Village, the results of the analysis of the judge's decision regarding the judge's considerations in resolving the dispute over the election of the Head of Cinta Damai Village, and the validity of the judge's decision regarding the cancellation of the Deli Serdang Regent's Decree concerning the Appointment of the Head of Cinta Damai Village. Based on this research, the results obtained are that dispute resolution is carried out through the State Administrative Dispute Resolution process according to Law Number 5 of 1986 by submitting files to the PTUN, PTUN to PK as a form of lawsuit to revoke the Decree of the Regent of Deli Serdang in determining the election of the head of Cinta Damai Village. Keywords: Lawsuit, Settlement, Decision, Head of Love Peace Village  Abstrak: Pemilihan Kepala Desa (Pilkades) adalah suatu acara dalam pesta demokrasi di tingkat desa sebagai otonomi desa/hak desa untuk memilih pemimpin baru yang berasal dari masyarakat desa. Pemilihan kepala desa di Desa Cinta Damai terjadi konflik atas hasil perselisihan suara yang sangat tipis, berselisih 9 suara yang diwarnai berbagai kecurangan, sehingga terjadi ketidakpuasan atas hasil pilkades, pihak yang kalah merasa telah dirugikan dengan hasil yang diperoleh, namun yang menjadi masalah Bupati Deli Serdang tetap melantik dengan Keputusan Bupati Deli Serdang Nomor 395 Tahun 2022 tentang pengesahan dan pengangkatan Kepala Desa Cinta Damai, Kecamatan Percut Sei Tuan tanggal 18 Mei 2022 atas nama Josta Josevina Tambunan. Tujuan penelitian ini untuk mengetahui dan menganalisis penyelesaian gugatan pembatalan Keputusan Bupati Deli Serdang terhadap pengangkatan Kepala Desa Cinta Damai, hasil analisis putusan hakim terhadap pertimbangan hakim dalam menyelesaikan sengketa pemilihan Kepala Desa Cinta Damai, serta keberlakuan putusan hakim terhadap pembatalan Keputusan Bupati Deli Serdang tentang Pengangkatan Kepala Desa Cinta Damai. Berdasarkan penelitian ini diperoleh hasil bahwa penyelesaian sengketa dilakukan melalui proses penyelesaian Sengketa Tata Usaha Negara menurut Undang-Undang Nomor 5 Tahun 1986 dengan melimpahkan berkas ke PTUN, PTUN samapai PK sebagai bentuk gugatan pencabutan SK Bupati Deli Serdang dalam penetapan pemilihan kepala Desa Cinta Damai. Kata kunci: Gugatan, Penyelesaian, Keputusan, Kepala Desa Cinta Damai

Abstract

Abstract: Strengthening the function of forming regional regulations/legislative function of the DPRD in forming regional regulations has formal juridical legitimacy based on Article 18 paragraph (6) of the 1945 Constitution of the Republic of Indonesia that "Regional Governments have the right to establish regional regulations and other regulations to carry out autonomy and assistance duties .” As well as the enactment of Law Number 23 of 2014 concerning Regional Government and Law Number 17 of 2014 concerning the MPR, DPR, DPD and DPRD, it is hoped that the DPRD can be more active and productive in actualizing its function of forming regional regulations/legislative functions. However, unfortunately, so far the function of forming regional regulations in the DPRD of North Sumatra Province has been the object of research. The aim of this research is to find out and analyze the implementation of the legislative function of the DPRD of North Sumatra Province for the 2019-2024 period as well as knowing and analyzing the process of forming regional regulations in North Sumatra Province. This research uses a normative juridical method with an approach taken by examining all laws and regulations relating to the legal issues being handled. So, this research was carried out by analyzing theories related to the Implementation of the Regional Regulation Formation Function in the DPRD of North Sumatra Province in the Formation of Regional Regulations based on literature related to existing problems, and relevant laws and regulations. Keywords: Regional Regulations, Regional Autonomy, DPRD Functions Abstrak: Penguatan fungsi pembentukan peraturan daerah/fungsi legislasi DPRD dalam membentuk peraturan daerah telah mempunyai legitimasi secara yuridis formal didasari dalam Pasal 18 ayat (6) UUD NKRI Tahun 1945 bahwa “Pemerintahan Daerah berhak menetapkan peraturan daerah dan peraturan-peraturan lain untuk melaksanakan otonomi dan tugas pembantuan.” Serta berlakunya Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah dan Undang-Undang Nomor 17 Tahun 2014 tentang MPR, DPR, DPD dan DPRD mengharapkan DPRD dapat lebih aktif dan produktif dalam mengaktualisasikan fungsi pembentukan peraturan daerah/fungsi legislasi yang dimilikinya. Namun sayangnya, selama ini fungsi pembentukan peraturan daerah di DPRD Provinsi Sumatera Utara sebagai objek penelitian Tujuan penelitian ini adalah untuk mengetahui dan menganalisis pelaksanaan fungsi legislasi DPRD Provinsi Sumatera Utara Periode 2019-2024 serta mengetahui dan menganalisis proses pembentukan peraturan daerah Provinsi Sumatera Utara. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan yang dilakukan dengan menelaah semua undang-undang dan regulasi yang berkaitan dengan isu hukum yang ditangani. Maka, dalam penelitian ini dilakukan dengan menganalisis teori-teori yang berkaitan dengan Pelaksanaan Fungsi Pembentukan Peraturan Daerah di DPRD Provinsi Sumatera Utara dalam Pembentukan Peraturan daerah berdasarkan literatur-literatur yang berkaitan dengan permasalahan yang ada, dan peraturan perundang-undangan yang relevan. Kata kunci: Peraturan Daerah, Otonomi Daerah, Fungsi DPRD
