Abstract

Penelitian ini bertujuan untuk memahami konstruksi pemahaman keagamaan Imam dan Khotib di kota Ambon tentang vaksin Covid-19. Penelitian ini merupakan penelitian lapangan dengan pendekatan sosiologis dan metode deskriptif. Hasil penelitian ini menunjukkan bahwa konstruksi pemahaman keagamaan Imam dan Khotib di kota Ambon tentang vaksin Covid-19 terbagi menjadi dua, Pertama, para Imam dan Khotib yang menolak vaksin Covid-19 dan beranggapan bahwa vaksin Covid-19 bertentangan dengan Islam; Kedua, para Imam dan Khotib yang menerima vaksin Covid-19. Penerimaan dan penolakan terhadap vaksin Covid-19 didasari oleh pemahaman atas ayat Al-Quran yang sama (Surah Al-Baqarah: 195 dan QS. Asyuara’: 80) tetapi menghasilkan pemahaman yang berbeda. Hal ini menunjukkan bahwa pemahaman keagamaan sangat dipengaruhi oleh latar belakang dan konteks sosial.

Abstract

Intervensi pemerintah terhadap pasar dipandang suatu kebutuhan, tujuannya adalah dalam rangka melindungi konsumen dari unsur kerugian atau kemadharatan. Namun demikian, dalam literature hadis, sebagian narasi mengindikasikan adanya larangan intervensi pemimpin dalam mengatur mekanisme penetapan harga pasar. Ditinjau dengan menggunakan pendekatan kontekstual, perkembangan tradisi, kultur, budaya, serta lahirnya kompleksitas problematika baru justru mendorong pemerintah dan para sarjana muslim untuk mereinterpretasi pemahaman baru terkait hadis tas’ir sehingga berimplikasi dalam memberikan solusi alternatif terhadap kebijakan-kebijakan ekonomi yang mapan dan produktif. Tujuan studi literature ini dalam rangka melacak hadis-hadis tas’ir serta bagaimana bangunan konstruksi pemahaman para ulama dalam menafsirkan makna hadis tas’ir tersebut. Koleksi hadis tas’ir dikumpulkan dari beragam kitab-kitab turats hadis, lalu dianalisis menggunakan metode deskriptif analitik. Temuan penelitian ini memperlihatkan bahwa tas’īr diperbolehkan oleh para ulama dengan beberapa dhowābith. Hal ini menunjukkan Kontekstualisasi pemahaman hadis sangat penting agar Islam tidak kaku terhadap perkembangan zaman. Islam menjadi responsif terhadap tantangan dan permasalahan yang muncul. Sehingga Islam menjadi shalihun li kulli makan wa zaman.[The Relevance of The Tas'ir Hadith (Price Setting) to The Economic System in Indonesia. Government intervention in market policies is seen as a necessity, the aim is to protect consumers from elements of loss or harm. However, in the hadith literature, some narratives indicate that there is a prohibition on the intervention of the leader in regulating the market pricing mechanism. Judging by using a contextual approach, the development of traditions, culture, culture, and the birth of new problematic complexities actually encourage the government and Muslim scholars to reinterpret new understandings related to the tas'ir hadith so that it has implications for developing alternative solutions to established and productive economic policies. The purpose of this literature study is to trace the traditions of tas'ir and how to construct the understanding of the scholars in interpreting the meaning of the hadith of tas'ir. The collection of tas'ir hadiths was collected from various turats hadith books, then analyzed using descriptive analytic methods. The findings of this study show that tas'īr is allowed by scholars with several dhowābith. This shows the contextualization of the understanding of hadith is very important so that Islam is not rigid to the times. Islam becomes responsive to the challenges and problems that arise. So that Islam becomes shālihun li kulli makān wa zamān.]

Abstract

Tattooing is a part of art that many people do. However, Islamic law prohibits people with tattoos, on the other hand, medical science also prohibits people with tattoos from donating blood. This article tries to explain whether there is a match (relevance) between the prohibition of tattooing according to Islamic law and the prohibition of blood donation for people with tattoos according to medical science. To answer this question, the author collects data from various sources of scientific writings in the form of books or journals that describe the prohibition of tattooing according to Islamic law and also scientific writings related to the prohibition of blood donation for people with tattoos according to health. This disclosure is important to explore to uncover the maqasid al-syari' in prohibiting the act of tattooing according to Islamic law. The results obtained from the scientific data above show that the Prophet Muhammad forbade his people from getting tattoos. This prohibition is stated in several hadiths of the Prophet Muhammad with a clear prohibition expression, namely using the phrase "la'ana" (Allah/Rasulullah curses). The use of this phrase for a legal act, namely getting a tattoo, shows that the act is forbidden. Medical also prohibits blood donation for people with tattoos, this is because the behavior of sticking needles and alcohol into the pores of the body is an act of damaging body parts. The reason for the medical prohibition for people with tattoos to donate blood is also the concern of contracting various diseases in the blood cells of people with tattoos caused by the needle being inserted into the blood vessels through the skin, and the entry of other substances into the blood cells. The prohibition of tattoos by the Prophet Muhammad SAW turns out to be in accordance with medical science which prohibits people with tattoos from donating blood. This conformity can be seen in the principles of Islamic law which forbids harmful acts, and medical also positions the act of tattooing as having harm. Abstract

This paper analyses the acceptance of the majority of Christians towards implementing the 29th Qur'anic Recitation Competition (MTQ) in Maluku Province. MTQ is a form of Islamic Awakening, an event for Muslims. However, this event was held in Saumlaki, where the Muslim population is only four percent (4%). This MTQ is an anomaly where the relationship between Muslims and Christians is mutual respect, unlike in other places that are usually in conflict. Therefore, this MTQ is unique and exciting because a Christian majority carries it out, and a pastor leads the committee of the event. In this study, the acceptance of the Christian majority toward MTQ will be further examined using qualitative research and a sociological approach. The primary sources of this research are stakeholders and parties who participated in the 29th MTQ activities of Maluku Province. The data sources were determined by purposive sampling, while the secondary sources of this research were books and articles relevant to the research theme. This research shows that there is an identity transformation carried out by the majority of Christians in accepting the implementation of the MTQ, such as the use of the hijab by event organisers, who are Christians, in each segment of the competition; the use of the Catholic Center Hall as a venue for the competition, where a cross and a painting of the Virgin Mary were displayed for the Syarhil (explanation) of the Qur'an competition. This research also found a convergence in the relationship between the Muslim minority and the Christian majority. As explained, religious activities such as MTQ can be an adhesive of the relationship between Islam and Christianity and an example of religious moderation.

Abstract

This study aims to explore the compatibility of capitalism and Islam. Capitalism, which is identical with self-centeredness and greed, is often at odds with Islam. Have we employed some descriptive, interpretation, and philosophical approaches, this study concludes that capitalism and Islam are compatible. The Quran mentions several characteristics of capitalism, such as private ownership and profit maximization. Private ownership and capital accumulation are permitted in Islam, and the freedom to own property is a measure of productivity. Profit maximization, which is the core of capitalism, is also available in the Quran. Islam permits profit-taking within certain parameters. This situation demonstrates the compatibility of capitalism and Islam. However, it is necessary to incorporate Islamic norms to make capitalism more compatible with Islam.

Abstract

This article discusses maqasidi's interpretation of the ahkam verses used in the decision of the IV 2012 Ijtima' Ulama of the Indonesian MUI Fatwa Commission regarding the confiscation of assets of perpetrators of criminal acts of corruption, where the results of this ijtima were then discussed again in the decision of the Ijtima' Ulama of the Fatwa Commission Throughout Indonesia VIII,  Number 12/Ijtima' Ulama/VIII/2024 concerning review of the draft law regarding confiscation of assets related to criminal acts. This research mainly analyzes the verses used and their relevance to eradicating corruption. To analyze the verses used as the basis for the Fatwa Commission's Ulama Ijtima Decision, researchers used the maqasidi interpretation. The method used in this article is qualitative, in the form of a descriptive analysis of the results of the decision of the IV and VIII Ijtima' Ulama of the Indonesian Fatwa Commission regarding the confiscation of assets of perpetrators of criminal acts of corruption and the review of the draft law regarding the confiscation of assets related to criminal acts. In contrast, secondary data associated with this research is written. The results of this research show the relevance of the verses about eradicating criminal acts of corruption. As for the maqasidi interpretation approach, the use of verses in decisions can be seen from several aspects, namely: first, the text and law depend on the objective, and the MUI decision uses the appropriate verse for the theme to be decided. Second, the text and law depend on the purpose; the MUI uses fiqhiyah rules to strengthen the interpretation of verses and decision arguments. Third, genuinely bringing benefits and preventing damage (Jalbu al-Mashalih wa Dar'u al-Mafasid), MUI is very concerned about efforts to get benefits and to avoid damage. The recommendations in the decisions given prove this. Fourth, considering the legal impacts (I'tibar al-Maalat), the MUI also pays attention to the legal effects that will arise. Therefore, the MUI provides recommendations in the form of mitigation notes for the legal consequences that will occur.

Abstract

Abstrak: Rangkaian sejarah panjang perdebatan hubungan hukum nasional dengan hukum internasional menunjukan tidak mudahnya mentranformasikan hukum nasional yang mengakomodir keduanya. Monisme dan dualisme di Indonesia dipraktekan secara bergantian sesuai dengan kebutuhan dalam peradilan dalam memutuskan suatu perkara. Prakteknya disesuaikan dengan keyakinan dalam menilai suatu peristiwa hukum perlu ditranformasikan menjadi hukum nasional atau tidak, walaupun secara doktrin Indonesia menganut monisme sebagaimana diamatkan oleh Pasal 11 Undang-Undang Dasar 1945. Kontradiksi dari keduanya menyebabkan Indonesia belum secara tegas dan konsisten dalam melaksanakan konstitusi. Metode deskritif historis dengan periodesasi: Orde Lama, Orde Baru dan Orde Reformasi digunakan untuk memberikan gambaran dan pemahaman bahwa dengan rangkaian sejarah dapat menunjukan secara jelas mengenai hubungan hukum nasional dengan hukum internasional di Indonesia. Ketegasan sikap pemerintah Indonessia menjadi titik tolok penting dalam menentukan pilihan demi terwujudnya kepastian hukum, perlindungan terhadap hak asasi manusi dan menguatkan lembaga peradilan dalam memutuskan suatu perkara terhadap sengketa yang melibatkan entitas internasional.   Abstract: The long history of the debate on the relationship between national law and international law shows that it is not easy to transform national law to accommodate both. Monism and dualism in Indonesia are practiced alternately according to the needs of the judiciary in deciding a case. The practice is adjusted to the belief in assessing a legal event needs to be transformed into national law or not, although doctrinally Indonesia adheres to monism as stated by Article 11 of the 1945 Constitution. The contradiction between the two causes Indonesia to not firmly and consistently implement the constitution. Historical descriptive method with periodization: Old Order, New Order and Reform Order is used to provide an overview and understanding that with a series of history can show clearly about the relationship between national law and international law in Indonesia. The firmness of the Indonesian government's stance is an important benchmark in making choices for the realization of legal certainty, protection of human rights and strengthening the judiciary in deciding a case against disputes involving international entities.
