Abstract

There are three areas of law that live and grow (the living law) in Indonesia, which are Customary Law, Islamic Law, and Western Law. These three areas of law are the main material for the national legal system. Islamic law which is based on the Qur'an and hadith has perfectly regulated all aspects of life including muamalah matters, and one part of muamalah activity is pawning. The rapid development of Islamic Banks is a challenge to itself to make the actors in this industry need to innovate in creating banking products, but of course, it must be in accordance with Islamic principles. This research was conducted by tracing the various legal bases for the application of gold pawning to Islamic banks and the practice model so that this research was carried out in a normative juridical manner using a statute approach and comparative law studies as well as complementing it with the results of interviews regarding the practice of gold pawning on Islamic banks. The results of the study shows that the values of Islamic law, which are the living law after going through legal politics, have been transformed into and become part of the national legal system. Therefore, their practice is in accordance with sharia principles.

Abstract

Human rights are natural that have been attached to individuals since birth and given directly by God Almighty and as a gift, World Health Organization has the right to education, health rights, employment rights, and so on. As is known, the dense population of Indonesia, increasing competition, and narrow employment and income are not as expected in addition to the growing daily needs of living, encouraging people to prefer to work abroad commonly referred to as Indonesian Migrant Workers (PMI). This fact, in fact, is not balanced by the government's ability to provide jobs that are able to absorb them. The narrowness of employment in the country has caused the lower society to turn to wider and more economically promising job opportunities abroad. On the other hand, the state is the party that is obliged to guarantee economic rights. This right is a human right today. This article discusses the concept of Employment Agreements as an Effort to Protect and Fulfill Human Rights for Indonesia Migran Workers.

Abstract

his study aims to propose a halal tourism model by adopting religious humanism integrated with the creative industry as a baseline. This is a legal study with a statutory approach, relying on various laws and regulations as the primary data, including MUI’s fatwas. This study found that religious humanism can be integrated into the development of the halal tourism industry based on creative industries, with Regional Regulations (Perda) as the guideline. The integration of religious humanism in development is possible with the participation of all stakeholders. This is because the development of halal tourism is not merely about tourism objects but also the community. In this case, religious people easily accept the idea and are willing to participate as long as the integration is structured. Abstrak. Abstract

Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector (P2SK) represents the Government’s commitment to strengthening the national financial system, including the development of human resources in the financial sector. However, the implementation of this mandate poses a specific challenge for Islamic banking, as its human resources (Sumber Daya Insani/SDI) are required not only to meet technical and professional standards, but also to embody Islamic values that underpin sharia-based financial operations. Existing regulations on SDI development in the financial sector tend to adopt a general and technocratic approach, leaving a regulatory gap in accommodating the distinctive characteristics of Islamic banking SDI. This research aims to examine how the P2SK Law and its related regulations govern SDI development in Islamic banking and to formulate an SDI development model that is normatively aligned with sharia principles while remaining compliant with the prevailing legal framework. Employing doctrinal legal research with a statutory approach, this study analyzes relevant laws and regulations, supported by Ibn Khaldun’s theory of human development and the perspective of Sharia economics as a branch of political law. The findings propose an SDI development model for Islamic banking that integrates technical competence, professional integrity, and spiritual intelligence rooted in tawhid and akhlaq, and demonstrates its compliance with the P2SK Law and relevant OJK regulations. Theoretically, this research contributes to the integration of Islamic human resource concepts into legal scholarship, while providing a practical normative reference for regulators and Islamic banking institutions in formulating SDI development policies.
