Abstract

The title of this research is "Implementat ion of the Settlement of Notary Ethical Code Violation concerning Notary Name Board Installation in Denpasar". The problems formulated are: 1 How is the implementation of the provisions of Article 83 of Law No. 2 of 2014 concerning amendment s to the Law No. 30 of 2004 concerning the Notary Position and Ethics Code of Extraordinary Congress in connection with the installation of Notary Name Board in Denpasar? 2. What i s the responsibility of the Notary with the ethical code violations of Notary name board? The above problems were studied and analyzed with legal theories such as the effectiveness of legal theory, the theory of legal responsibility with empirical legal research method.From research conducted some problems were found concerning the violation of the size of the installed Notary name board, it is contrary to what is stated in the rules of the Ethical Code.

Abstract

This study aims to find and analyze the concept of simple evidentiary in bankruptcy cases and to find and analyze the characteristics of simple evidentiary in bankruptcy cases. This research is a type of normative legal research using a statutory approach and a conceptual approach. The results showed that the simple concept of proof in bankruptcy cases is not the whole proving process in the bankruptcy case trial process, but only simply proving of the existence of the debt. However, if it turns out that at trial there are difficulties in proving the three facts mentioned above, then it is certain that the proof is not simple. In bankruptcy cases, the trial process is carried out with simple evidentiary intended so that this case can be resolved quickly and effectively. Quick because the settlement of bankruptcy cases in the commercial court has determined the time period at each level of the judiciary. Effective because the decision on the bankruptcy petition case is instantaneous.

Abstract

AbstractThe Good faith principle as stated in Article 1338 paragraph (3) of the Civil Code, has not been maximally implemented in BPR credit agreements, so it is important to review the transformation of good faith principle of the Civil Code in banking provisions, especially BPR in realizing sound credit. The research uses normative juridical legal methods. The results of the study show that the transformation of the principle of good faith stated in the Civil Code has not been explicitly stated in the provisions of banking law in Indonesia. The existence of principle of good faith explicitly only exists in Article 1338 Paragraph (3) of the Civil Code. Meanwhile, in the provisions of the Banking Law the existence of the principle of good faith is only implied by the principle of economic democracy by using the precautionary principle that is applied carefully and in good faith, as well as the principles of trust and confidence in good ability, ability, intention and morals from customers or the community in returning credit. The transformation of the principle of good faith should be clearly stated in the norm structure into the Banking Law and other related banking legal provisions.AbstrakGood faith principle sebagaimana tercantum pada Pasal 1338 ayat (3) KUHPerdata, belum diimplementasikan secara maksimal dalam perjanjian kredit BPR, sehingga penting mengkaji  transformasi asas itikad baik KUH Perdata dalam ketentuan perbankan khususnya BPR  dalam  mewujudkan perkreditan yang sehat. Metode penelitian menggunakan metode penelitian hukum yuridis normatif. Hasil penelitian menunjukkan bahwa Transformasi asas itikad baik yang tercantum dalam KUHPerdata belum secara eksplisit ternormakan dalam ketentuan hukum perbankan di Indonesia. Keberadaan asas Itikad baik secara eksplisit hanya eksis dalam Pasal 1338 Ayat (3) KUHPerdata. Sementara itu, dalam ketentuan Undang-Undang Perbankan keberadaan asas itikad baik  hanya  tersirat dari asas demokrasi ekonomi  dengan menggunakan prinsip kehati-hatian yang diterapkan secara hati-hati dan itikad baik,  serta prinsip kepercayaan dan keyakinan akan kemampuan, kesanggupan, itikad serta akhlak yang baik dari nasabah atau masyarakat dalam mengembalikan kredit. Transformasi asas itikad baik sebaiknya dituangkan dalam struktur norma secara tegas ke dalam Undang-Undang Perbankan dan ketentuan hukum perbankan terkait lainnya.

Abstract

The purpose of this study is to determine and analyze the authority to manage assets by Pakraman Village and the new rights and obligations that arise after the appointment of Pakraman Village as the subject of communal (communal) property rights on land. The type of research used in this article is normative legal research conducted by reviewing applicable laws and regulations and using secondary data as primary data. Based on the results of the research, conclusions can be formulated as follows: (1) The authority possessed by Pakraman Village as the holder of Joint (Communal) Property Rights on land, is closer to the authority of use rights without a period of time/as long as they are used; and (2) the appointment of Pakraman Village to be subject to communal (shared) property rights on land according to the Ministerial Decree of ATR/BPN No. 276/2017, to provide protection and legal certainty for the existence of the druwe land position in Pakraman village. Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis kewenangan mengelola harta kekayaan oleh Desa Pakraman dan hak dan kewajiban baru yang timbul setelah ditunjuknya Desa Pakraman sebagai subyek hak milik bersama (komunal) atas tanah. Jenis penelitian yang digunakan dalam artikel ini adalah penelitian hukum normatif yang dilakukan dengan mengkaji peraturan perundang-undangan yang berlaku serta menggunakan data sekunder sebagai data utama. Berdasarkan hasil penelitian, dapat dirumuskan kesimpulan sebagai berikut: (1) Kewenangan yang dimiliki oleh desa pakraman sebagai pemegang Hak Milik Bersama (Komunal) atas tanah, lebih dekat kewenangan hak pakai tanpa jangka waktu/selama dipergunakan; dan (2) Penunjukan Desa Pakraman menjadi subyek Hak Milik Bersama (komunal) atas tanah menurut Kepmen ATR/BPN No. 276/2017, untuk memberikan perlindungan serta kepastian hukum terhadap eksistensi dari kedudukan tanah druwe desa pakraman.

Abstract

ABSTRAK Hukum meliputi aspek yang multi ukuran. Itu sebabnya hingga dikala ini para sarjana hukum belum pula menciptakan definisi yang pas mengenai hukum. Yang jelas, hukum merupakan indikasi kemasyarakatan. Manusia selaku perorangan ataupun pribadi cenderung berkumpul dengan beberapa manusia yang lain maka terbentuknya kelompok manusia yang hidup bersama. Sebab cenderungnya manusia hidup berkelompok biasa disebut makhluk sosial. Kelompok manusia yang hidup bersama dengan tujuan yang sama itu dituturkan publik. Sebetulnya masyarakat itu terdiri dari manusia, baik selaku perseorangan( orang) ataupun kelompok-kelompok manusia yang sudah berhimpun buat bermacam keperluan serta tujuan. Supaya ikatan antar manusia bisa berjalan dengan baik hingga diperlukan ketentuan bersumber pada mana orang melindungi kepentingannya serta menghormati kepentingan serta hak orang lain cocok hak serta kewajiban yang ditetapkan dalam ketentuan tersebut. Aturan- aturan ilah yang diucap hukum, yang mengendalikan seluruh ikatan antar manusia. Baik ikatan orang ataupun perseorangan ataupun dengan kelompok, kelompok dengan antar orang ataupun kelompok dengan pemerintah. Tujuan riset ini buat mengkaji kepastian hukum untuk warga hukum adat menimpa pengaturan kekayaan intelektual di Indonesia. Riset ini memakai tata cara riset hukum normatif dengan pendekatan perundang-undangan serta riset kepustakaan. Hasil riset mengungkapkan bahwasanya jaminan hukum bagi masyarakat hukum adat sudah diatur secara internasional melalui TRIPs Agreement, dan secara nasional di Indonesia merujuk pada UU No. 28 Tahun 2014 Tentang Hak Cipta dan Pengaturan Pemerintah No. 27 Tahun 2019. Kata Kunci : Hukum, Masyarakat Adat, Interaksi. ABSTRACT Law includes multi-dimensional aspects. That is why until now legal scholars have not yet found a precise definition of law. What is clear, the law is a social phenomenon. Humans as individuals or individuals tend to gather with other individuals and by forming groups of humans who live together. Because of this tendency to group, humans are called social beings. A collection of people who live together with a common goal is called society. In fact, society consists of humans, both as individuals (individuals) or groups of people who have gathered for various needs and goals. In order for human relations to work properly, rules are needed based on which people protect their interests and respect the interests and rights of other people according to the rights and obligations specified in these rules. God's rules are called laws, which govern all relations between humans. Both the relationship between individuals or individuals and with groups, groups with individuals and groups with the government. This study purpose to examine legal certainty for indigenous and tribal peoples regarding the regulation of intellectual property in Indonesia. This studi applies normative legal research methods with a statutory approach and literature study.The research results reveal that legal certainty for indigenous and tribal peoples has been regulated internationally through the TRIPs Agreement, and nationally in Indonesia referring to Law no. 28 of 2014 concerning Copyright and Government Regulations No. 27 of 2019. Abstract

Tujuan penulisan ini yaitu untuk mengetahui dan menganalisa mengenai kewenangan Notaris dalam pengikatan jaminan pesawat udara sebagai jaminan hutang. Penelitian ini menggunakan metode penelitian hukum normatif. Eksistensi lembaga jaminan hipotek untuk pesawat udara dijamin dan Hipotek tidak berlaku lagi atas tanah dan segala sesuatu yang berkaitan dengan tanah. Namun dengan berlakunya UU Penerbangan, Maka objek Hipotek menjadi jelas. Status, Pendaftaran dan Kebangsaan Pesawat Udara Dalam bidang hukum perdata, status hukum pesawat udara adalah benda tidak bergerak. Kewenangan Notaris dalam pengikatan jaminan pesawat udara sebagai jaminan hutang berdasarkan teori kewenangan merupakan kewenangan atribusi yang langsung diberikan oleh Pasal 1171 BW jo Pasal 15 ayat (3) UUJN. Pasal 1171 BW menjelaskan bahwa pembebanan hipotek harus dilakukan dengan akta autentik yang dibuat di hadapan pejabat yang berwenang dalam hal ini adalah notaris. Kepentingan debitur terlindungi apabila perjanjian hipotek dilakukan dengan akta hipotek, hal tersebut termuat dalam Penjelasan Pasal 15 ayat (3) UUJN menjelaskan bahwa notaris berwenang dalam pembuatan akta hipotek pesawat udara. Dari penjelasan tersebut, Notaris secara tegas berwenang membuat suatu akta hipotek pesawat terbang. Kewenangan notaris dalam membuat akta hipotek pesawat terbang memberikan suatu perlindungan hukum dan kepastian hukum bagi para pihak. Oleh karena itu, lembaga jaminan hipotik yang paling relevan untuk pesawat udara adalah jaminan hipotek. The purpose of this writing is to find out and analyze the authority of a Notary in binding aircraft collateral as debt security. This research uses normative legal research methods. The existence of a mortgage guarantee institution for aircraft is guaranteed and mortgages are no longer valid for land and anything related to land. However, with the enactment of the Aviation Law, the object of the Mortgage becomes clear. Aircraft Status, Registration and Nationality In the field of civil law, the legal status of an aircraft is an immovable object. The Notary's authority to bind aircraft collateral as debt security based on the theory of authority is the attribution authority directly granted by Article 1171 BW in conjunction with Article 15 paragraph (3) UUJN. Article 1171 BW explains that mortgage assignment must be carried out with an authentic deed made before an authorized official, in this case a notary. The debtor's interests are protected if the mortgage agreement is carried out with a mortgage deed, this is contained in the Elucidation to Article 15 paragraph (3) UUJN explaining that a notary has the authority to make an aircraft mortgage deed. From this explanation, the Notary is expressly authorized to make an aircraft mortgage deed. The authority of a notary in making an aircraft mortgage deed provides legal protection and legal certainty for the parties. Therefore, the most relevant mortgage security institution for aircraft is mortgage security.
