Abstract

AbstractRecently, there is a shift in armed conflict in the world from the conflicts among states or between state and belligerent into the conflict which happened across nations’ border, such as the Islamic State of Iraq and Syria (ISIS). The ISIS is a non-state actor, which consequently means that the conflicts cannot be properly categorized into international armed conflict. As the consequence, the international humanitarian law cannot be put into practice. The alternative solution is to apply the Martens Clause by paying an ultimate appreciation of fundamental principles of international humanitarian law for the sake of humanity and human rights. AbstrakDewasa ini telah terjadi pergeseran subyek konflik bersenjata yang semula terjadi antar-negara atau antara negara dengan pemberontak menjadi konflik lintas-batas negara seperti Islamic State of Iraq and Syria (ISIS). Status ISIS dalam hukum internasional bukan sebagai negara melainkan sebagai aktor non negara (non-state actor). Perang melawan ISIS tidak termasuk ke dalam konflik bersenjata internasional karena tidak memenuhi kriteria berdasarkan Konvensi Jenewa Tahun 1949 dan Protokol Tambahan I Tahun 1977. Hal ini sangat mungkin memunculkan kesulitan pemberlakukan HHI. Sebagai alternatifnya, penerapan Martens Clause dapat dilakukan, yaitu dengan menghormati prinsip-prinsip fundamental yang menjadi dasar hukum humaniter internasional demi penghargaan terhadap kemanusiaan dan hak asasi manusia.

Abstract

Abstractof the Community Compliance of Paying Taxes. Taxes, based on Act no. 28 Year 2007 are compulsory contributions to the State which are indebted by individual or organization body, obliged based on Act, without any direct compensation, and spent by the state for the most prosperity of the community. There are a lot of the tax functions, such as infrastructure maintenance and education management. Thus, the augmentation of awareness in paying taxes can be done through the formal education. This research was an empirical research, using the primary and secondary data. The result showed that the State revenue can be increased from the taxes as one of it means. To be more effective, a bureaucratic reform on and contact center are made available. There is also a need to improve the awareness and willingness to pay taxes from the very beginning. It is proposed to elaborate the material of taxation in formal education curriculum to inculcate the awareness of paying taxes from the early stage. AbstrakPerhatian utama dari artikel ini adalah , Pertama , menggambarkan modernisasi pajak ; dan Kedua, membangun model Kepatuhan Komunitas Membayar Pajak . Pajak , berdasarkan Undang-Undang Nomor 28 Tahun 2007 adalah pungutan wajib kepada negara yang terhutang oleh individu atau organisasi badan hukum , wajib berdasarkan Undang-Undang , tanpa kompensasi langsung , dan menghabiskan oleh negara untuk sebagian besar kesejahteraan masyarakat . Ada banyak fungsi pajak , seperti pemeliharaan infrastruktur dan operasi pendidikan . Dengan demikian , augmentasi kesadaran dalam membayar pajak dapat dilakukan melalui pendidikan formal. Metode penelitian ini adalah penelitian empiris , dengan menggunakan data primer dan sekunder. Hasil penelitian ini bahwa praktik modernisasi dan reformasi di bidang perpajakan. Hal ini didukung dengan pembangunan kurikulum yang meliputi soal perpajakan untuk pendidikan dasar dan menengah . Realisasi kesadaran untuk membayar pajak adalah tugas kolektif dari pemerintah , masyarakat , serta pemangku kepentingan terkait.

Abstract

This article examines the current state of affairs with respect to local community empowerment through a traditional knowledge protection system in Indonesia, analysis of the potential impact of traditional knowledge protection management on the Indonesian economy, and making recommendations on the formulation and development of a new policy on the protection of traditional knowledge. The study is a doctrinaire research, and used a juridical approach. Secondary data were used , obtained largely through conducting a literature review of both printed and electronic materials publicly available in the library and internet. Content analysis technique based on deductive methods, was used in analyzing the data. The study came up with several findings. First, trade Related aspects of Intellectual Property Rights, Including Trade in Counterfeit Goods (TRIPs) Agreement as embodied in the provisions of the World Trade Organization (WTO) in 1994, succinctly show that Intellectual Property Rights issues are inseparable fromworld trade and investment. Secondly, protection system for traditional knowledge can be achieved by using laws that relate to Intellectual Property Rights (IPR) as well as non-IPR instruments, and using instruments other than laws. Thirdly, IPR is vitally important as it provides legal protection to commercial works.

Abstract

Pertumbuhan dan pengembangan daerah wisata diberbagai wilayah sebagai penggerak perkonomian suatu daerah berbanding lurus dengan resiko bencana yang akan dihadapi jika tidak dikelola dengan baik. Desa Gondosuli, Kecamatan Tawangmangu memiliki potensi wisata alam yang menarik sebagai tujuan investasi berbagai pihak, namun masalahnya adalah pembangunan objek wisata, sarana prasarana pendukung dan pemukiman diwilayah ini terkesan tidak memperhatikan karakteristik geografis, selain itu, menurut data kebencanaan menunjukkan bahwa wilayah desa wisata Gondosuli memiliki tingkat kerentanan bencana tanah longsor yang tinggi. Metode yang dilakukan adalah dengan melakukan peningkatan pengetahuan melalui diseminasi dan pelatihan mitigasi bencana alam berbasis komunitas yang bertujuan untuk meningkatkan kesadaran masyarakat dan pemerintah desa terhadap bencana dengan melibatkan Akademisi, BPBD Karanganyar, Perangkat Desa serta Masyarakat Desa Gondosuli. Program pengabdian ini mampu meningkatkan kesadaran akan karakteristik wilayah yang rentan bencana sekaligus berhasil membentuk komunitas tanggap bencana berbasis masyarakat desa Gondosuli.   Abstract Increasing Community Awareness of Gondosuli Village-Karanganyar Regency towards Environmental Management as an Effort to Reducing Disaster Risk. The growth and development of tourist areas in various regions, as an economic driver for an area, are directly proportional to the disaster risks that will be faced if not managed properly. Gondosuli Village, Tawangmangu Sub-district, has attractive natural tourism potential as an investment destination for various parties. However, the issue lies in the development of tourist attractions, supporting infrastructure, and settlements in this area, which seem to overlook the geographical characteristics. Additionally, according to disaster data, the Gondosuli tourist village area has a high vulnerability to landslides. The method used involves increasing knowledge through the dissemination and training of community-based natural disaster mitigation. The aim is to raise awareness among the community and village government regarding disasters by involving academics, the Karanganyar Regional Disaster Management Agency (BPBD), village officials, and the Gondosuli Village community. This community service program has succeeded in increasing awareness of the characteristics of disaster-prone areas and has effectively formed a community-based disaster response in Gondosuli Village.

Abstract

Issues regarding jurisdiction over the handling of sexual assault cases, especially on the high seas, are a major concern of the international community, especially if the victim is a stateless person. They are often isolated and have limited access to legal assistance. This situation makes them one of the most vulnerable groups to sexual assault. The Stateless Convention 1954 stipulates that stateless persons can request legal protection from the state parties to the Convention. While on the high seas, UNCLOS 1982 has regulated that the flag state has jurisdiction over every activity on a ship flying its flag. However, there is no clarity regarding specific protection for stateless persons on ships. This paper will identify which jurisdictions can apply when there is a sexual assault against a stateless person on a ship on the high seas. The research method used is prescriptive normative law with a statute approach by examining laws and regulations. We argue that when it comes to ships flying a particular flag and sailing on the high seas, UNCLOS 1982 should be considered customary international law. Furthermore, when similar crimes occur, there must be a justification for intervention by other states. Scientific contributions in this study are the identification and juridical analysis of the legal gap in legal protection for stateless persons who are victims of sexual violence on the high seas, as well as a new interpretation of state jurisdiction based on the provisions of UNCLOS 1982 and the 1954 Stateless Convention.

Abstract

AbstractRefugees are a group of people who were forced to leave the country because of very threatening fear. Fear is often due to natural disasters or conflict. In countries receiving refugees, they often experience inhumane treatment such as rape, assault, discrimination, repatriated by force, those lead to the violation of human rights. There has been regulation for human rights in refugee issues both internationally and regionally, for instance Convention related to Status of Refugee 1951 and The Protocol related to the Status of Refugee 1967. There are at least five basic rights of refugees, they are the right to be protected from returning to the country of origin forcibly (non refoulement), the right to seek asylum, the right to obtain equality and non-discrimination, the right to live and to be secured, as well as the right to return home.  AbstrakPengungsi adalah kelompok orang yang dipaksa untuk meninggalkan suatu negara karena takut yang sangat mengancam, dapat disebabkan oleh bencana alam atau konflik. Di negara-negara penerima, pengungsi sering mengalami perlakuan tidak manusiawi seperti perkosaan, penganiayaan, diskriminasi, dipulangkan secara paksa yang mengarah pada pelanggaran hak asasi manusia. Ada pihak-pihak yang telah menetapkan hak asasi manusia dalam masalah pengungsi baik internasional maupun regional, seperti Konvensi Status Pengungsi dari tahun 1951 dan Protokol yang berkaitan dengan Status Pengungsi 1967. Setidaknya ada lima hak dasar pengungsi, yaitu hak atas perlindungan dari kembali ke negara asal secara paksa (refoulement non), hak untuk mencari suaka, hak untuk mendapatkan kesetaraan dan non-diskriminasi, hak untuk hidup dan keamanan, serta hak untuk pulang.
