Abstract

This research departed from strong legal positivism in the development of legal science and legal practice in Indonesia. This research aims to analyze the positivism in legal science and legal practice, particularly in law enforcement reflected on judge jurisprudence (court verdict). The method used in this research was juridical normative with library study approach, related to expert’s doctrines and news sources related to some cases in Indonesia. This research explains that positivism highly affects law enforcement system. It can be seen from some judge jurisprudences tending to emphasize dominantly the positive law and ordinance and to prioritize law certainty. It of course generates pros and cons within society concerning judge verdict in some cases by people considered overriding justice aspect. In making verdict, a judge should obligatorily prioritize justice value, and law certainty and benefit and thereby can protect, put anything in order, and create peace in society life in dealing with the challenge of rapid time change.

Abstract

Indonesia telah terpilih menjadi Anggota Tidak Tetap Dewan Keamanan Perserikatan Bangsa-Bangsa (Anggota Tidak Tetap DK PBB) pada periode 2019-2020. Hal ini merupakan salah satu prestasi yang luar biasa, mengingat Indonesia dipercaya oleh negara-negara anggota PBB untuk menjadi salah satu anggota dari Organ Utama PBB yang memiliki tugas untuk menjaga perdamaian dan keamanan dunia. Wilayah Laut Tiongkok Selatan (LTS) merupakan wilayah yang tengah menjadi sengketa antara negara-negara sekitar yang merasa memiliki klaim atas wilayah tersebut. Sengketa ini telah menjadi perhatian dunia dimana ketegangan-ketegangan sikap yang ditunjukkan oleh negara-negara tersebut semakin hari semakin mencemaskan dalam stabilitas keamanan di wilayah tersebut. Berbagai provokasi dan kebijakan luar negeri dari masing-masing negara dilakukan untuk memenangkan klaim atas wilayah tersebut. Indonesia sebagai Anggota Tidak Tetap DK PBB memiliki salah satu kewajiban untuk ikut serta dalam menyelesaikan sengketa internasional atas wilayah LTS tersebut yang di klaim oleh negara-negara. Indonesia dapat menjadi pihak penengah untuk memberikan sudut pandang lain dalam menyelesaikan sengketa tersebut secara damai. Tujuan dari penelitian ini adalah untuk mengkaji keterlibatan Indonesia dalam upaya menyelesaikan sengketa di wilayah LTS berdasarkan United Nations Convention on the Law of the Sea 1982 (UNCLOS 1982). Metode yang digunakan dalam penelitian ini yaitu penelitian hukum normatif. Penelitian ini dilakukan dengan cara meneliti dan mengkaji bahan-bahan pustaka yang telah dikumpulkan oleh tim peneliti. Bahan pustaka yang diteliti dan dikaji terdiri atas bahan primer, bahan sekunder, dan bahan tersier. Pencarian data dilakukan dengan studi pustaka atau studi dokumen dan keseluruhan data yang diperoleh akan dianalisis secara kualitatif.

Abstract

Formula-E organizers are included in the Governor's Instruction Number 49 of 2021 and are made on a regional priority scale. This caused controversy considering that at that time, Indonesia was still hit by COVID-19, and the government was trying to handle the community and carry out economic recovery. The research problem formulation is the legal politics of the DKI Jakarta government's policy in implementing Formula-E during the covid-19 pandemic. The purpose of this research is to determine the interests of the people affected by the implementation of Formula-E, which is used as a regional priority scale in the implementation of Formula-E Instruction Governor (INGUB) Number 49 of 2021. This type of research is descriptive qualitative; namely, it describes research based on theories and legal materials about legal politics and policies made by the government. This study uses a qualitative descriptive method using literacy studies and legislation—techniques in analyzing data using narrative analysis techniques. This study concludes that the administration of government affairs must prioritize the safety of the people first above other interests. The regulations that apply must be under the hierarchy so that the existing regulations do not conflict with higher regulations because the regulations at the lower level must adapt to the regulations at the upper level, namely the 1945 Constitution (UUD 1945) and the Pancasila State Constitution.

Abstract

The background of this research is that people's welfare and regional development in Central Java have not increased. This is a very serious problem that needs to be properly addressed. The Indonesian constitution mandates in the preamble of paragraph 4 that the state aims to advance public welfare. This study aims to contribute ideas, namely legal politics, to increase welfare based on strengthening the manufacturing industry in Central Java. This study uses a normative juridical method with a statutory and conceptual approach. The results of this study are that to increase welfare based on strengthening the manufacturing industry in Central Java, at least ten choices of legal politics (policies) are needed, namely; legal harmonization, reforming the bureaucracy, optimizing the risk management team, optimizing cooperation with the private sector, maintaining economic commodities, sustainable infrastructure development, optimizing technology and industrial digitization, maintaining energy availability, holding national and international scale exhibitions, establishing special areas for development research. Recommendations in this study; researchers must conduct research related to increasing welfare through the manufacturing industry because there is still very little literature that can provide additional insight for society in general and for stakeholders and industrial digitization, maintaining energy availability, organizing national and international scale exhibitions, establishing special areas for development research. Abstract

The implementation of outer space exploring and using activities by a state builds on the Space Treaty 1967. This provision governs two basic principles in using outer space: non-appropriation and freedom exploration. The principle of giving the states a freedom to do their activities in outer space leads so many space objects to be launched. Some problems then result from the activities done by the states in outer space: outer space debris problem, falling space object, and misuse.  If a state does an activity and then results in damage or loss against other stages in the outer space, it will be imposed with a liability as governed in the Liability Convention 1972. This research focuses on a study on the concept of state’s liability if its activities in outer space results in damage/loss against other states. This research used a normative legal research method, aiming to analyze the concept of fault from the state’s action resulting in damage/loss against other states in outer space. This analysis is important because the term of the fault of state action is not defined in Liability Convention 1972.

Abstract

The provisions of Outer Space Law govern a state's activities in outer space. The implementation of such activities needs advanced technology, which limits the ability of many countries to explore and exploit outer space. Data indicates that developed nations dominate outer space management, leaving countries without access to sophisticated technology unable to participate fully in space exploration and exploitation. This dominance triggers disparity between developed and developing countries, leading to unequal application of rights and obligations as outlined in Outer Space Law. While the law promotes international collaboration to address this issue, it does not explicitly require developed countries to involve developing nations in outer space activities. This study aims to refine the concept of international collaboration to ensure fair management and exploitation of outer space by all countries. This study is normative in nature, focusing on evolving the concept of international collaboration in outer space. Primary and secondary legal materials and non-legal sources were used as secondary data collected through a literature review and analysed qualitatively. The developed concept emphasises international cooperation and mutual assistance, proposing a framework for collaboration between developed and developing countries. This concept seeks to ensure equitable management of outer space. It reshapes the rights and obligations of states by encouraging all launching states to involve developing countries in space exploration and exploitation.

Abstract

Indonesia, as a vast island state surrounded by extensive seas, holds a strategic advantage in the maritime sector. The coastal areas, rich in resources, play an indispensable role in the lives of numerous Indonesians. Despite the abundance of resources, the well-being of the population faces uncertainties attributed to management challenges. A prominent issue exacerbating the decline in the coastal ecosystem and diminishing productivity is the phenomenon of overfishing. Characterized by the excessive extraction of fish beyond their capacity to replenish, overfishing poses a severe threat to coastal areas. This unsustainable practice is rooted in legal ambiguities, conflicts in authority, and the bio-geophysical degradation of resources within coastal zones. The detrimental consequences of overfishing necessitate immediate attention and intervention to preserve coastal ecosystems and secure the livelihoods of those reliant on them. Addressing these challenges, the focus of this research is on preventing the widespread occurrence of overfishing in coastal areas and mitigating the impacts of existing overfishing activities. The primary strategy proposed involves the development of a robust legal framework for the management of coastal areas. Through the establishment of clear legal guidelines, resolution of uncertainties, and mitigation of conflicts in authority, this research aims to lay the groundwork for sustainable and responsible practices in coastal resource management. The research aims to provide valuable insights that contribute to the enhancement of coastal area management, ultimately fostering ecological sustainability and improving the welfare of communities dependent on these vital resources. By delving into the complexities of coastal resource management, this study seeks to enrich the discourse surrounding sustainable practices, thereby facilitating informed decision-making and policy development in the quest for a harmonious coexistence between human communities and coastal ecosystems in Indonesia.

Abstract

The rapid advancement of digital technology has heightened concerns regarding personal data protection, particularly in Indonesia, where regulatory frameworks are still evolving. The ransomware attack on Indonesia’s National Data Center (Pusat Data Nasional/PDN) on June 20, 2024, which led to the leakage of citizens’ personal data and disrupted public services, has sparked widespread public criticism and demands for stronger data protection measures. This incident highlights Indonesia’s weak national cybersecurity system and raises critical questions regarding the state’s responsibility for safeguarding personal data under both domestic and international law. The findings reveal that while Indonesia has enacted Law No. 27 of 2022 on Personal Data Protection, its enforcement remains weak, leaving citizens vulnerable to cyber threats. From an international law perspective, Indonesia is obligated to protect personal data under frameworks such as the International Covenant on Civil and Political Rights (ICCPR) and the Responsibility of States for Internationally Wrongful Acts (RSIWA 2001). However, gaps in implementation, lack of institutional coordination, and inadequate cybersecurity infrastructure continue to hinder effective protection.  The novelty of this research lies in its dual legal analysis, bridging domestic and international legal responsibilities while examining the broader implications of state accountability in cybersecurity governance. This study contributes to legal discourse by proposing reinforced legal frameworks, improved institutional coordination, enhanced international cooperation, and the adoption of sophisticated cybersecurity technologies. Strengthening legal, social, and cultural structures is essential to prevent future data breaches and ensure comprehensive protection of Indonesian citizens’ personal data.

Abstract

This research focuses on analyzing the effectiveness of the provision about the measurable fishing as specified in the Government Regulation Number 11 of 2023 as an attempt of preventing overfishing and maintaining the sustainability of biodiversity in Indonesian waters and sea territory. This study is a normative research with statute approach. The data used was secondary one consisting of primary legal, secondary legal, and non-legal materials. Overfishing phenomenon is a serious problem endangering ocean resource and environment. Some countries have reported the overfishing problems damaging the sea ecosystem. Indonesia is one of countries predictably encountering overfishing phenomenon, particularly in northern Java water territory. The indicators of overfishing phenomenon are smaller size of fish and fewer fish caught requiring the fishermen to go farther to catch fish. The fact of overfishing leads to a policy about zone-based measurable fishing and catching quota. This policy can cease overfishing phenomenon because it can control and monitor fish catch, and thereby makes resource and environment better in water or sea territory. Considering the conclusion of research, the concept of measurable fishing formulated by Indonesia is based on zone and quota. Zone base prioritize equal share for the fishermen, promotes economic growth, and determines the capacity of catch allowed for a certain species, while quota base focuses on the limitation of fish catching level based on the potency of fish caught that can control the fishing rate according to the fish resource.

Abstract

Pendidikan inklusif merupakan upaya nyata dalam mewujudkan hak penyandang disabilitas untuk mendapatkan akses pendidikan yang setara. Penelitian ini menganalisis kebijakan pendidikan inklusif di SD Terpadu Ma’arif Gunungpring (SD TEMA), Kabupaten Magelang, guna menilai efektivitasnya dalam memberikan perlindungan bagi peserta didik penyandang disabilitas. Penelitian ini menggunakan metode empiris dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa meskipun SD TEMA telah menerapkan pendidikan inklusif, masih terdapat berbagai tantangan, seperti keterbatasan tenaga pendidik yang memiliki kompetensi khusus, kurangnya sarana prasarana yang mendukung, serta diskriminasi yang masih terjadi di lingkungan sekolah. Selain itu, kebijakan pemerintah terkait pendidikan inklusif belum sepenuhnya terimplementasi secara optimal, terutama dalam aspek penyediaan Unit Layanan Disabilitas. Berdasarkan konsep keadilan John Rawls, kebijakan pendidikan inklusif harus menjamin kesetaraan bagi seluruh peserta didik tanpa terkecuali. Meskipun kebijakan pendidikan inklusif telah diterapkan, pelaksanaannya masih perlu diperkuat dengan peningkatan kompetensi tenaga pendidik, penyediaan sarana dan prasarana yang lebih memadai, serta pembentukan Unit Layanan Disabilitas sebagai pusat koordinasi dan pendukung pendidikan inklusif. Oleh karena itu, peningkatan kapasitas tenaga pendidik, penyediaan infrastruktur yang memadai, serta sinergi antara sekolah dan pemerintah menjadi langkah strategis dalam meningkatkan efektivitas kebijakan ini.
