Abstract

The termination of performance allowances for members of the Indonesian National Police who receive demotion sanctions is the focus of this study. Legal issues arise because this practice refers to internal directives and instructions that have not yet been recognized as valid legislation. Using a normative approach, an analysis was conducted on regulations and principles of administrative law to examine the legality of this policy. Presidential Regulation Number 103 of 2018 concerning Performance Allowances for Employees within the Indonesian National Police and Regulation of the Head of the Indonesian National Police Number 7 of 2020 concerning Procedures for Providing Performance Allowances for Employees within the Indonesian National Police both do not contain explicit provisions regarding the termination of performance allowances due to demotion. Policies based on internal directives also lack general legal binding force. Potential violations of the principles of legality, legal certainty, and proportionality arise from this situation. A reconstruction of the policy based on clear and proportional regulations is emphasized as a necessity in this study.

Abstract

Anak mempunyai peranan penting dan negara bertanggung jawab untuk menjamin hak-haknya atas kelangsungan hidup, tumbuh kembang, serta perlindungan dari diskriminasi dan kekerasan. Anak sebagai kelompok rentan yang kerap menjadi korban kekerasan, termasuk kekerasan seksual, hal ini menjadi isu penting dalam hukum Indonesia. Meskipun Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual telah ditegakkan, namun kasus kekerasan seksual terhadap anak masih marak terjadi di berbagai lingkungan. Hal ini dapat dilihat dari berbagai kasus yang terjadi di beberapa daerah yang menunjukkan adanya ketidakadilan dalam perlindungan hukum terhadap anak korban serta minimnya perhatian terhadap hak atas pemulihan bagi anak. Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap anak korban kekerasan seksual dan menjamin pemulihan hak-hak anak korban. Metode yang digunakan adalah yuridis normatif dengan pendekatan konseptual, perundang-undangan, studi kasus, yang dikaji berdasarkan norma dan aturan hukum yang terkait dengan kasus kekerasan seksual terhadap anak. Hasil penelitian menunjukkan bahwa meskipun regulasi telah memberikan perlindungan terhadap anak, namun pelaksanaan perlindungan hukum dan pemulihan hak-hak korban belum optimal. Sebagaimana tercermin dari hasil putusan beberapa perkara, menunjukkan bahwa pemidanaan yang diberikan kepada pelaku tidak sebanding dengan dampak yang dialami oleh korban, serta pemulihan fisik dan psikis korban masih kurang diperhatikan.

Abstract

Nominee agreements (agreements on behalf of others) are often used as a tool to get around the prohibition of land ownership by Foreign Nationals (WNA) on Certificates of Title (SHM) in Indonesia. This article examines the position and characteristics of nominee agreements in the Indonesian legal system and assesses their potential as a means of economic crimes, especially related to corporate crimes, asset embezzlement, money laundering, and violations of agrarian provisions. With a qualitative data-based juridical-normative approach, this study identifies the legal risks that arise, the possibility of criminal liability for the parties involved (actual owners, nominees, intermediaries, and corporations), as well as obstacles and evidentiary strategies in criminal cases involving the covert agreement. The results of the study show that although the nominee agreement is originally a civil agreement, there is sufficient room for the application of economic delinquency when the agreement is used as a means of concealing ownership, facilitating the transfer of profits, or obscuring aspects of ownership in order to avoid legal prohibitions. Enforcement recommendations include strengthening evidentiary standards, inter-institutional coordination (prosecutor's office, police, BPN, PPAT), the use of financial forensic tools, and regulatory updates to clarify the criminal consequences of nominee practices that are detrimental to the public interest

Abstract

E-Commerce is a new concept that is commonly described as the process of buying and selling goods or services on the Word Wide Web Internet or the process of buying and selling or exchanging products, services and information through information networks including the internet. E-commerce is a business activity that is carried out electronically through an internet network or the activity of buying and selling goods or services through digital communication channels. E- Commerce is doing business online. The existence of E-Commerce is a promising business alternative to be implemented at this time, because E-Commerce provides a lot of convenience for both parties, both from the seller (merchant) and from the buyer (buyer) in conducting trade transactions, even though the parties are on two different continents though. In this research, the method used is the normative legal method with the specifications of the research results used, namely deduction. The purpose of this research is to understand the development of commerce as a trading medium in Indonesia. For e-commerce entrepreneurs, it is necessary to build trust that starts from the reliability of the service system. For consumers, it is necessary not to worry anymore about shopping on the internet. Abstract

This study aims to analyze the comparison of dispute resolution mechanisms in the Katarungang Pambarangay system in the Philippines with the concept of restorative justice in Indonesia, as well as assess the effectiveness of both in resolving community disputes. This study uses normative legal methods with statutory approaches, conceptual approaches, and comparative approaches. The results of the study show that the Katarungang Pambarangay system regulated in Republic Act No. 7160 (Local Government Code of 1991) is a community-based mechanism that is mandatory and structured through the stages of mediation, conciliation, and arbitration by the Tagapamayapa Board. Meanwhile, restorative justice in Indonesia is an integrated approach in the formal criminal justice system based on Law Number 20 of 2025 concerning the Criminal Code, which is implemented through the authority to terminate investigations and prosecutions. In terms of effectiveness, both systems show positive results in dispute resolution. Katarungang Pambarangay has proven to be effective in increasing community participation and reducing the burden on the courts, while restorative justice in Indonesia has shown a significant increase in the number of case settlements, victim satisfaction, and the potential to suppress recidivism. The main difference lies in the nature of obligations and implementing actors, where the Philippines emphasizes the role of the community, while Indonesia relies on law enforcement officials. The study concludes that both systems have their advantages and that the integration between community-based approaches and state institutional support can be an ideal model for more effective and equitable dispute resolution.
