Abstract

This research demonstrates how adult female students at the Pondok Pesantren Riyadul Awamil Islamic, Serang Regency, understand Ilm Tajwid utilizing nadhom in the book Tuhfatul Atfal Wal Ghilman Fi Tajwid al-Quran (Tuhfatul). This kitab kuning is used at Islamic boarding schools throughout Indonesia, even Southeast Asia as a manual for reading the Quran. In order to gather information for this qualitative case study, interviews with Kyai, ustazah, and a select group of students were conducted along with observations of how the learning was being put into practice. this education was inextricably linked to the standard pesantren curriculum for mastering the kitab kuning. Its power comes in the ease with which students can learn the contents of the Tuhfatul book because the nadhoms are regular and rhythmic lines that students can easily pronounce, sing, and remember. Spreading its use to the community may be offered, along with suggestions for adjusting the learning process to the learner.

Abstract

This in-conreto legal research delves deeper into the legal basis determined by the Panel of Judges in deciding on a divorce lawsuit because the husband is a convict. The research takes a case that has been determined in one of the Religious Courts in the Special Region of Yogyakarta number 0909/ Pdt.G/2011/PA.BTL (0909). The results are then discussed in more depth according to Islamic law. Through the exploration of the rules of fiqh and the proposals of fiqh as well as interviews with several judges, it can be interpreted that the judge's decision has referred to the interests needed in the family by avoiding the risks that may arise due to the father/husband being sentenced to prison for several years. In the review of Islamic law, the judge has fulfilled the rules of fiqh and followed the fatwa of the agreed-upon fiqh school of thought.

Abstract

This research examines Islamic waqf in Tunisia, a topic that is rarely discussed in contemporary studies, especially from a historical and sociological perspective. Most of the existing studies focus more on normative aspects such as the laws, conditions, and pillars of waqf. In contrast, empirical research looking at the historical and sociological aspects of Islamic waqf is limited to local cases. Tunisia, which is known to be liberal in Islamic law reform, especially in the field of family law, rarely has in-depth studies on waqf. The purpose of this study is to analyse the organisation and administration of waqf in Tunisia and its impact on society. The research uses the literature method with a normative juridical approach which is descriptive analytical in nature. The results show that the organisation and administration of waqf in Tunisia are influenced by internal Muslim factors as well as government policies. The government, in particular, has a very dominant influence in the process. There are two main motivations from the ruling party: first, economic motivation that emerged since the French protectorate, which encouraged economic capitalisation; second, political motivation that initially supported certain political processes, but later developed for other political interests, as happened during the time of President Habib Bourguiba. The practice of waqf administration in Tunisia mostly involves administrative reform efforts in the broader context of Islamic law. Although there is no clear form of productive waqf, waqf in Tunisia has evolved in terms of its form and implementation mechanism in a more professional manner.
