Hak Asasi Manusia (HAM) merupakan hak-hak yang berasal dari harkat dan martabat yang melekat pada manusia. Hak ini sangat mendasar, yang mutlak diperlukan agar manusia dapat berkembang sesuai dengan bakat, cita-cita, serta martabatnya. Hak ini juga dianggap universal, artinya dimiliki semua manusia tanpa perbedaan berdasarkan bangsa, ras, agama, atau genderPada tulisan artikel ini, penulis menggunakan Teori Kedaulatan Rakyat dari beberapa pemaparan yang telah penulis utarakan di atas penulis ingin fokuskan kajian pada tanggung jawab dan aparatur keamanan dalam memahami hak warga perspektif teori kedaulatan rakyat. Yang mana Teori Kedaulatan Rakyat adalah sebuah teori yang menyatakan bahwa kekuasaan tertinggi berada di tangan rakyat.

Abstract

At the end of 2019, the world is experiencing the Covid-19 pandemic, which spreads very quickly. The government made Various policies, such as the PSBB policy, study from home, work from home, and other social restrictions. This has an impact on family harmony. Because there were many layoffs during the pandemic, it was vulnerable to domestic violence due to economic and other problems. The solution to domestic violence is to hold pre-marital counseling for prospective brides; during the pandemic and carried out online. The research method used is the library research method, using a normative juridical approach. Data collection techniques used documentation and analysis using descriptive and content analysis methods. During a pandemic, people spend more time at home, so domestic violence often occurs. Another reason is that many people have been laid off and are experiencing economic difficulties. Pre-marital counseling during a pandemic is carried out online, the implementation time is shortened, and strict health protocols must be implemented.

Abstract

Ibn Asyur was the second originator who made the concept of Maqashid Syariah into all scientific disciplines after Al Syathabi, in line with the journey of maqashid Syariah to become a field of knowledge. Sharia banking is also the second concept after the presence of conventional banking, but that is not a thing that prevents Islamic banking from continuing to grow and develop to spread benefits. Ibnu Asyur in his thoughts conveyed the similarity between maqashid sharia and the main objective of establishing sharia banking. Maqashid sharia in the perspective of Ibn Asyur can produce indicators of growth and development of sharia banking to be very rapid and of course still useful for Muslims and humanity in general.

Abstract

Pondok Pesantren (Islamic Boarding School) is one of the non-formal education which was founded by ulama figures (kyai) as a place to gain religious knowledge. Currently, Islamic boarding schools have undergone many changes, these changes are marked by the inclusion of formal/general education in pesantren. The purpose of this study was to determine how the strategy of the entrepreneurial spirit in the Al-Khoirot Islamic boarding school environment, Malang Regency. The method used in this study is a qualitative research based on the philosophy of postpositivism. The results of this study conclude that the strategy for developing an entrepreneurial spirit in the Al-Khoirot Islamic boarding school is by direct assistance by caregivers and head of the board to students who have the will to learn skills. To develop the creative economy in the Al-Khoirot Islamic boarding school environment, students are given the task of making various forms of different and interesting skills.

Abstract

Cases of gross human rights violations are complex and sensitive issues in Indonesian legal politics. With a historical backdrop that includes authoritarian times and armed conflict, governments are faced with serious challenges. Transitional Theory of Justice offers a framework for addressing these issues through courts, reparations, truth and reconciliation, and institutional reform. However, policy implementation requires consideration of international pressure, victim protection, civil society participation, and human rights education. Governments are faced with a dilemma between accountability and reconciliation, with the need to maintain a balance between justice and peace. In addition, it is necessary to consider the political implications of government actions, while institutional reform and sustainable approaches are key in addressing gross human rights violations.

Abstract

The purpose of this study is to assess the appropriateness of the gold pawn financing contract with the DSN-MUI fatwa and fiqh muamalah at the BMT UGT Nusantara Legung Branch. Data is gathered by observation, interviews, and recording as part of the qualitative research methodology, which also incorporates a field and literature approach. The findings demonstrated that a legally qualified applicant, gold collateral, and ujrah determination in line with the nominal financing are all necessary for the BMT UGT Nusantara Legung Branch to carry out the financing contract. The contracts utilised are qard and rahn, and in the event of default, gold collateral is sold without going through an auction. This implementation is generally adequate when considering fiqh muamalah and the DSN-MUI fatwa; nonetheless, it is important to highlight three key differences: 1. According to fiqh muamalah, the finance agreement employs qard and rahn, but the DSN-MUI fatwa has an extra ijarah agreement. 2. According to fiqh muamalah, the agreement and the amount of finance determine the gold storage fee; nevertheless, the DSN-MUI fatwa restricts the fee to actual expenditures. 3. According to fiqh muamalah, the sale of gold collateral without an auction is acceptable; nevertheless, the DSN-MUI fatwa mandates an auction procedure in the event that the rahin is unable to repay the loan. This study demonstrates that, despite being permitted under muamalah fiqh, three practices used in the BMT UGT Nusantara Legung Branch's financing contract with gold collateral are not compliant with the DSN-MUI fatwa.

Abstract

Violence is a criminal act that threatens humanity and injures vital human rights. Moreover, the child is the main target. This kind of violence needs to be followed up as well as possible so that the same violence does not occur. Therefore, this paper is intended to contribute to the construction of thought from the point of view of fiqh jinayat and human rights. This study uses a normative qualitative method with a fiqh jinayat approach and human rights as a research perspective. The results of this study include: a) chemical castration in fiqh jinayat is classified as a sanction that is not based on syarak rules. This is because castration itself is not strictly legalized by the Shari'a. Therefore, chemical castration cannot be applied, so that it can be applied to the realm of adultery which results in whipping or stoning, homosexuality which results in death, or the trial which consequents punishment; b) chemical castration is very contrary to human rights, both based on the constitutional version of humanity and Islam. This injures human rights, because chemical castration does not actually have a positive effect on the perpetrator, but has a negative effect with quite fatal consequences. Therefore, IDI is reluctant to be the executor of this action, because it violates the medical code of ethics.

Abstract

Leadership is a very important aspect of human life. As it is known that humans are created as social beings, meaning that in living their lives on this earth, humans cannot walk individually. Therefore, humans as creatures who need each other need to have a leader to be able to direct and align the goals to be achieved by each individual. Leadership in the Qur'an itself is explained by various terms and different editors, one of which is in one editor it is termed ulul amri while in another it is described as caliph. Researchers in this study will examine these two keywords according to the perspective of Tafsir Al-Manar. With the results, said the caliph in Q.S Al-Baqarah verse 30 explaining that humans in this world have a duty as khalifatullah on earth, therefore two tasks must be carried out by humans, the first task is to be able to prosper the earth through the potentials that Allah has given. give to humans as well as reason and mind, secondly, the duty is to always carry out Allah's commands and stay away from His prohibitions. Meanwhile, the word ulul amri in Q.S An-Nisa' verse 59 hints to the leader to put forward a democratic leadership attitude in the sense of always building teamwork and deliberation in deciding and determining a case. return to the truth of the Qur'an, Hadith, and the results of the official ijma'. Rasyid Rida's interpretation of ulil amri to ahlul halli wal aqdi indicates that leaders must be appointed from people who have the competence and understand the common good. Abstrak Kepemimpinan merupakan aspek yang sangat penting bagi kehidupan manusia. Sebagaimana diketahui bahwa manusia diciptakan sebagai makhluk sosial, artinya dalam menjalani kehidupannya di muka bumi ini, manusia tidak bisa berjalan secara perindividu. Oleh karena itu, manusia sebagai makhluk yang saling membutuhkan satu sama lainnya perlu memiliki seorang pemimpin untuk bisa mengarahkan dan menyelaraskan tujuan-tujuan yang ingin dicapai oleh setiap individu. Kepemimpinan dalam Al-Qur’an sendiri dijelaskan dengan berbagai Istilah dan redaksi yang berbeda-beda, salah satunya dalam satu redaksi di istilahkan dengan ulul amri sedangkan di redaksi lain dijelaskan dengan khalifah. Peneliti dalam penelitian ini akan mengkaji dua kata kunci tersebut menurut perpektif Tafsir Al-Manar. Dengan hasil, kata khalifah dalam QS Al-Baqarah ayat 30 menjelaskan bahwa manusia di dunia ini memiliki tugas sebagai khalifatullah di muka bumi, oleh karena itu ada dua tugas yang harus dijalankan manusia, pertama bertugas untuk bisa memakmurkan bumi melalui potensi-potensi yang sudah Allah berikan kepada manusia seperti halnya akal dan pikiran, kedua, bertugas untuk selalu melaksanakan perintah Allah dan menjauhi larangannya. Sedangkan kata ulul amri dalam QS An-Nisa’ ayat 59 mengisyaratkan kepada pemimpin untuk mengedepankan sikap kepemimpinan yang demokratis dalam artian selalu membangun kerjasama tim dan musyawaroh dalam memutuskan dan menentukan suatu perkara, Kemudian apabila memang terdapat perbedaan pandangan atau pendapat maka pemimpin dan semua anggotanya harus mengembalikan kepada kebenaran Al-Qur’an, Hadist dan hasil ijma’ resmi. Penafsiran Rasyid Rida tentang ulil amri kepada ahlul halli wal aqdi mengindikasikan bahwa pemimpin harus benar-benar diangkat dari orang yang memang memiliki kompetensi dan mengerti akan kemaslahatan bersama.
