Abstract

Hak Asasi Manusia adalah hak pokok atau hak dasar yang dibawa oleh manusia sejak lahir yang secara kodrat melekat pada setiap manusia dan tidak dapat di ganggu gugat karena merupakan anugerah Tuhan Yang Maha Esa, Indonesia sebagai negara hukum pancasila yang demokratis memiliki kewajiban dalam perlindungan hak asasi manusia, perlindungan HAM dalam negara hukum harus termaktub dalam konstitusi ataupun hukum nasional. Jenis penelitian yang digunakan dalam penelitian ini ialah penelitian yuridis normatif. Sebagai negera hukum pancasila HAM telah termuat dalam pancasila itu sendiri, seperti kebebasan dalam beragama dan kepercayaan. Sedangkan sebagai negara demokrasi pancasila, perlindungan HAM menjadi tujuan sekaligus prasyarat bagi berjalannya demokrasi.Kata Kunci: Negara Hukum, Demokrasi; HAM.

Abstract

This research purpose is to analyze the consumer legal protection efforts and reviewing obstacle factor of implementation of consumer protection related to the trademark circulation of the counterfeit health products in Central Java. This research carried out is a empirical research.. The collecting data used are library research and field studies. The results of this study indicate that There so many parties that involved to handle this case in regard with The Consumer legal protection related to the trademark circulation of health product including, Drug and Food Inspection Agency, Health Office, Industry and Trade Office, and Central Java Special Criminal Review of the Central Java Regional Police. The counterfeiting trademark and health products will be handled by the Commercial Court and Drug and Food Inspection Agency. The criminal legal protection by giving penalties to people who have committed crimes and trademark violations. The factors inhibiting the implementation of the consumer legal protection related to the trademark circulation of health product in Central Java: the lack of the public awareness toward the counterfeit trademark of health product and the lack of the public awareness to report the existence of counterfeit drugs to the authorities.

Abstract

Persaingan perdagangan jasa konstruksi yang kompetitif antar negara di ASEAN adanya dampak MEA memicu adanya kesenjangan di bawah penguasaan pasar jasa konstruksi oleh negara anggota ASEAN yang mempunyai kualitas yang lebih baik daripada negara anggota lainnya. Penelitian ini bertujuan untuk menganalisis dampak kebijakan pemerintah Indonesia terhadap persaingan perdagangan jasa di bidang konstruksi dalam rangka masyarakat ekonomi ASEAN, dan perbandingan persaingan perdagangan jasa di bidang konstruksi antara  Indonesia dengan negara anggota ASEAN lainnya dalam rangka masyarakat ekonomi ASEAN. Metode yang digunakan dalam penelitian adalah metode yuridis empiris, dengan spesifikasi penelitian deskriptif - analitis, jenis data yang digunakan adalah data primer dan data sekunder. Metode analisis data yang digunakan bersifat kualitatif. Hasil penelitian dan pembahasan ini adalah kebijakan persaingan perdagangan jasa di bidang konstruksi dilakukan dengan meningkatkan sumber daya konstruksi nasional yang mempunyai daya saing berkualitas dalam perdagangan jasa konstruksi di era MEA melalui undang - undang yang berkaitan dengan jasa konstruksi, perdagangan, kepemilikan penanaman modal, keinsinyuran.Pembatasan kepemilikan modal dari pemerintah Indonesia mendorong minat investor yang rendah untuk  berinvestasi di Indonesia, dengan hambatan kualitas SDM Indonesia yang belum mampu bersaing dengan negara yang memiliki daya saing SDM yang baik. Perbandingan daya saing kemudahan berbisnis di bidang jasa konstruksi antara Indonesia dan negara anggota ASEAN lainnya saat ini Indonesia berada di peringkat Ke 7 dari 10 negara ASEAN. Perbandingan  investasi dan tenaga kerja masih dikuasai oleh Singapura. Dampak kebijakan pemerintah Indonesia dalam persaingan perdagangan jasa di sektor konstruksi di era  MEA adalah  lebih banyak dampak negatif terhadap perdagangan di sektor jasa konstruksi walaupun era MEA telah berlangsung selama setahun. Pemerintah Indonesia diharapkan  melakukan evaluasi dan perbaikan terhadap jasa konstruksi nasional agar menjadi lebih baik lagi dari waktu ke waktu.

Abstract

Pelaksanaan komersialisasi hasil temuan Inventor ASN menjadi kewajiban Litbang karena biaya kegiatan penelitian dibiayai oleh negara. Komersialisasi pada prakteknya tidak berjalan lancar. Tujuan penelitian untuk menganalisis pelaksanaan dan hambatan proses komersialisasi pada Kementerian Kelautan dan Perikanan (KKP) dan Kementerian Pertanian. Metode penelitian yang digunakan adalah pedekatan yuridis empiris., dengan pelaksanaan penelitian di KKP dan Kementerian Pertanian. Ditemukan bahwa setiap kementerian memiliki metode komersialisasi terhadap invensi masing-masing inventor berbeda-beda. Perbedaan dalam metode komersialisasi berefek dalam keberhasilan Balitbang mengkomersialkan sebuah invensi. Simpulan penulisan adalah terdapat beberapa kendala dalam proses komersialisasi invensi, baik itu kendala dari pihak Balitbang maupun dari pihak Inventor ASN. Kendala komersialisasi menimbulkan dampak para Inventor ASN tidak bisa menerima kompensasi dari invensi tersebut bilamana tidak berhasilnya invensi tersebut tidak mampu dikomersialisasikan.

Abstract

The achievement of a Trademark in order to become famous is not an easy job, the obstacle of building a Trademark into a well-known trademark is a factor that encourages the emergence of fraudulent competition that is detrimental to others. The Issuance  of Law No. 20 of 2016 concerning Trademarks and Geographical Indications is deemed unable to accommodate fraudulent competition. This study aims to examine the law politics of famous Trademark protection in terms of the development of Trademark law in Indonesia and to compare the protection of famous Trademarks in Indonesia with other countries to avoid fraudulent competition in the use  Trademarks. This study is applied a normative juridical approach. The results of the study show that even though Indonesia has made  amendment toward Trademark Law (UUM) 5 times, there is no specific definition of a well-known brand within  Indonesia. Indonesia does not yet have arrangements regarding fraudulent competition in the brand, even though Indonesia has anti-competition laws, but fraudulent competition in Indonesia does not use it as a legal basis.Keywords: Trademark; Well-Known Trademark;  Fraudulent Competition.

Abstract

The implementation of outer space exploring and using activities by a state builds on the Space Treaty 1967. This provision governs two basic principles in using outer space: non-appropriation and freedom exploration. The principle of giving the states a freedom to do their activities in outer space leads so many space objects to be launched. Some problems then result from the activities done by the states in outer space: outer space debris problem, falling space object, and misuse.  If a state does an activity and then results in damage or loss against other stages in the outer space, it will be imposed with a liability as governed in the Liability Convention 1972. This research focuses on a study on the concept of state’s liability if its activities in outer space results in damage/loss against other states. This research used a normative legal research method, aiming to analyze the concept of fault from the state’s action resulting in damage/loss against other states in outer space. This analysis is important because the term of the fault of state action is not defined in Liability Convention 1972.

Abstract

The provisions of Outer Space Law govern a state's activities in outer space. The implementation of such activities needs advanced technology, which limits the ability of many countries to explore and exploit outer space. Data indicates that developed nations dominate outer space management, leaving countries without access to sophisticated technology unable to participate fully in space exploration and exploitation. This dominance triggers disparity between developed and developing countries, leading to unequal application of rights and obligations as outlined in Outer Space Law. While the law promotes international collaboration to address this issue, it does not explicitly require developed countries to involve developing nations in outer space activities. This study aims to refine the concept of international collaboration to ensure fair management and exploitation of outer space by all countries. This study is normative in nature, focusing on evolving the concept of international collaboration in outer space. Primary and secondary legal materials and non-legal sources were used as secondary data collected through a literature review and analysed qualitatively. The developed concept emphasises international cooperation and mutual assistance, proposing a framework for collaboration between developed and developing countries. This concept seeks to ensure equitable management of outer space. It reshapes the rights and obligations of states by encouraging all launching states to involve developing countries in space exploration and exploitation.

Abstract

Indonesia, as a vast island state surrounded by extensive seas, holds a strategic advantage in the maritime sector. The coastal areas, rich in resources, play an indispensable role in the lives of numerous Indonesians. Despite the abundance of resources, the well-being of the population faces uncertainties attributed to management challenges. A prominent issue exacerbating the decline in the coastal ecosystem and diminishing productivity is the phenomenon of overfishing. Characterized by the excessive extraction of fish beyond their capacity to replenish, overfishing poses a severe threat to coastal areas. This unsustainable practice is rooted in legal ambiguities, conflicts in authority, and the bio-geophysical degradation of resources within coastal zones. The detrimental consequences of overfishing necessitate immediate attention and intervention to preserve coastal ecosystems and secure the livelihoods of those reliant on them. Addressing these challenges, the focus of this research is on preventing the widespread occurrence of overfishing in coastal areas and mitigating the impacts of existing overfishing activities. The primary strategy proposed involves the development of a robust legal framework for the management of coastal areas. Through the establishment of clear legal guidelines, resolution of uncertainties, and mitigation of conflicts in authority, this research aims to lay the groundwork for sustainable and responsible practices in coastal resource management. The research aims to provide valuable insights that contribute to the enhancement of coastal area management, ultimately fostering ecological sustainability and improving the welfare of communities dependent on these vital resources. By delving into the complexities of coastal resource management, this study seeks to enrich the discourse surrounding sustainable practices, thereby facilitating informed decision-making and policy development in the quest for a harmonious coexistence between human communities and coastal ecosystems in Indonesia.

Abstract

Kedaulatan memberi kekuasaan dan kewenangan kepada negara untuk melaksanakan suatu sistem hukum nasional atas teritorial, warga negara, aset-aset negara, termasuk orang asing. Dalam mengambil tindakan terhadap warga negara asing, tentu hal tersebut akan berpengaruh terhadap hubungan dengan negara asal orang tersebut. Hubungan bilateral antara dua negara harus dijaga agar dapat menguntungkan kedua belah pihak. Hubungan diplomatik dan konsuler dilaksanakan untuk tujuan tersebut. Pada praktiknya, sering kali terjadi tindakan yang dianggap merugikan salah satu pihak meskipun di satu sisi, pihak lain hanya melakukan penegakan hukum di negaranya. Penulisan ini membahas mengenai permasalahan yang berupa kasus eksekusi mati tanpa notifikasi terhadap salah satu pekerja migran Indonesia oleh Arab Saudi dan membahas mengenai tindakan Arab Saudi melanggar hukum internasional atau tidak serta dampaknya terhadap hubungan Indonesia dan Arab Saudi setelah kasus tersebut terjadi. Pada penulisan hukum ini digunakan metode penelitian yuridis normatif dengan meneliti sumber berupa peraturan, teori, serta kaidah hukum. Pada penulisan ini, akan dicapai kesimpulan bahwa setiap manusia berhak atas hidup dan hak tersebut wajib dilindungi dan tak dapat dirampas, setiap negara memiliki Yurisdiksi melaksanakan ketentuan hukum yang terjadi di teritorialnya sehingga tindakan Arab Saudi tidak melanggar hukum internasional serta dikarenakan lebih tingginya konsep kedaulatan negara di atas hubungan internasional maka perlu adanya kesepakatan lebih lanjut antara Indonesia dengan Arab Saudi agar kasus serupa tidak terjadi.

Abstract

This article aims to analyze the current practices of academic freedom in Indonesia, driven by the premise that academic freedom is a cornerstone for every scholar with their expertise to seek, explore, innovate, and develop knowledge without intervention from certain parties. This concept is deeply rooted in the freedoms of thought, opinion, and expression in public, which are integral to the framework of human rights. This article is a study employing a normative juridical approach, attempting to examine the relevant legislation and actual circumstances. The data used is secondary data, focusing on various types of literature that explore the complex relationship between academic freedom, human rights, and democracy. The research findings indicate that in Indonesia, regulations governing academic freedom are enshrined in Law No. 12 of 2012 on Higher Education, Law No. 14 of 2005 on Teachers and Lecturers, and Law No. 20 of 2003 on the National Education System. Nevertheless, instances of persecution and dismissal of academic staff often occur on grounds of threatening nationalism or possessing subversive ideologies that ultimately disturb public security. The coordinator of the Indonesian Caucus for Academic Freedom cites several cases attacking academic freedom, such as cyber-attacks, repression of student actions, and criminalization of academics who speak out against corruption and for academic freedom, such as those involving Saiful Mahdi from Syiah Kuala University and Ubedillah Badrun from the State University of Jakarta (UNJ). This article aims to uncover the issues arising in the practice of academic freedom and the alignment between existing regulations and the human rights framework, using a normative juridical method. Academic freedom must serve as the foundation for the development of knowledge for the nation's welfare.
