Abstract

This study aims to examine the readiness and obstacles to the implementation of digital transformation of land services through electronic land certificates in Indonesia, especially related to the role and authority of PPATs towards this policy. This study uses a normative juridical approach, namely a research study based on statutory regulations. The data source used is secondary data. The results show that PPATs have a role in maintaining the validity and security of land transactions through the making of valid land deeds. The existence of electronic land certificates is an effort to resolve land disputes and assist the role of the PPAT in facilitating the digitization process of land administration services such as helping to improve data security, transparency and validity, and reduce duplication or forgery of land certificates. However, there are several challenges in its implementation, such as the readiness of technological infrastructure, data security, and limited human resources skilled in information technology. By understanding the role and challenges faced by PPATs, this study provides recommendations for improving the process of issuing electronic land certificates and supporting the government's efforts to improve more modern and efficient land services in Indonesia.

Abstract

Dalam perjanjian kredit modal kerja dapat menimbulkan sengketa berupa wanprestasi. Dalam kasus perjanjian kredit modal kerja antara PT Bank Perkreditan Rakyat Jateng selaku kreditur dengan Alm. Hasyim Mustofa selaku debitur terjadi wanprestasi karena debitur meninggal dunia dan ahli waris tidak ada itikad baik untuk menyelesaikan seluruh kewajiban yang ditinggalkan. Penelitian ini bertujuan untuk mengetahui kewajiban ahli waris terhadap hutang debitur (pewaris) dalam perjanjian kredit modal kerja dengan PT Bank Perkreditan Rakyat Jateng dan apabila ahli waris tidak bersedia membayar hutang debitur (pewaris) dalam perjanjian kredit modal kerja tersebut dapat dinyatakan wanprestasi atau tidak. Metode penelitian yang digunakan dalam penulisan hukum ini yaitu yuridis empiris. Berdasarkan hasil penelitian, ahli waris memiliki kewajiban untuk menyelesaikan seluruh hutang yang ditinggalkan oleh pewaris. Hal tersebut dikarenakan tidak adanya keterangan atas penolakan harta warisan dari ahli waris yang dapat dibuktikan dengan adanya putusan pengadilan agama yang berisi penetapan ahli waris. Dengan diterimanya warisan, maka seluruh hak dan kewajiban akan beralih kepada ahli waris. Dengan demikian, bagi ahli waris yang tidak memiliki itikad baik untuk membayar hutang dari pewaris dapat digugat wanprestasi oleh kreditur yang dalam hal ini adalah pihak PT Bank Perkreditan Rakyat Jateng.

Abstract

Distribution of music through digital platforms, such as SoundOn on TikTok, has become a dominant phenomenon in the modern music industry. However, the implementation of royalty distribution to copyright holders has become a significant concern in this context. This research employs a normative research approach to analyze the legal foundations, policies, and practices related to royalty distribution to copyright holders in the distribution of music through the SoundOn platform on TikTok. Evaluation of royalty implementation is conducted by considering transparency, oversight, reporting, and fairness in royalty distribution. Recommendations are provided for improvements, including enhancing transparency, developing algorithms, and consulting with copyright holders. Thus, this study offers valuable insights to improve the practices of fair and sustainable royalty distribution in the digital music industry.

Abstract

Managing song and music copyright royalties is a crucial aspect in the entertainment industry, especially in the context of the increasingly growing karaoke business. This study aims to investigate song and music copyright royalty management practices in the karaoke business, with a focus on implementation and compliance with applicable copyright regulations. Through a case study approach, we analyze the strategies, policies and procedures implemented by karaoke businesses in managing royalties, as well as their impact on relations with copyright holders and the sustainability of the industry. Data was collected through in-depth interviews with karaoke business owners, copyright holders and other related parties. Our findings illustrate the challenges and opportunities faced by karaoke businesses in complying with copyright regulations, while also identifying best practices in royalty management that can improve the balance between the interests of businesses and copyright holders. The practical and theoretical implications of these findings are discussed, along with recommendations for further improvement and development in the management of song and music copyright royalties in the context of the karaoke business. It is hoped that this research will provide valuable insights for stakeholders in the entertainment industry and contribute to the literature on copyright management and business sustainability.

Abstract

This study explores the role of notaries in the protection of intellectual property rights (IPR) in Indonesia compared to international standards, aiming to identify opportunities for improvement and harmonization. Employing qualitative research methods and comparative studies, the research combines literature analysis, comparative analysis, and methodologies of content analysis and SWOT. Findings reveal significant differences in the practices of Indonesian notaries compared to international standards, facing challenges such as regulatory complexity, technological dynamics, and limited IPR awareness. It is recommended that Indonesia aligns its IPR regulations with international standards, enhances notary training, adopts advanced technology, and strengthens inter-agency cooperation. These steps are expected to improve IPR protection, reinforce Indonesia's position in the global economy, and support a sustainable ecosystem of innovation and creativity.

Abstract

Law Number 20 of 2016 concerning Trademarks and Geographical Indications regulates the legal protection trademarks in Indonesia. Trademark disputes in Indonesia still often occur, especially regarding trademark similarities. The trademark registration system that generally known is the constitutive system (First To File). The purpose of this paper is to find out how the first to file principle is applied in trademark disputes and the legal consequences of decisions on trademark disputes. The method used in this study is normative juridical. Based on the results of the study, even though a trademark has been registered for the first time, if it is proven that the trademark has exceeded its legal protection period of 10 years, the legal consequences are that anyone can use the trademark.

Abstract

Recent changes to the Patent Law in Indonesia have sparked discussion regarding efforts to balance pharmaceutical innovation, protection of local industries, and the potential for evergreening practices. This study is a doctrinal research that uses a multi-approach analysis to examine the interaction between these variables in the context of Patent Law Number 65 of 2024. The study draws on literature reviews, theories and concepts related to drug patents, the pharmaceutical industry, the right to affordable medicine, and the evergreening. The research also includes an analysis of relevant laws and regulations, including the Patent Law before and after the amendment, to identify the changes and the underlying legal politics. The results show that the removal of Article 4 (f) of the Patent Law, which previously excluded certain inventions as inventions, may open up opportunities for the evergreening. However, the government argues that the deletion aims to protect local pharmaceutical companies and broaden the definition of invention. This study critically examines these claims, taking into account the readiness of the local pharmaceutical industry to compete with multinational corporations. In addition, there is a need for a strict control mechanism to ensure the validity of the invention in the patent as well as an objective evaluation of the inventive step and its therapeutic value. This study concludes that without adequate planning, the extension of patent protection to minor modifications may prolong commercial dominance of drugs, open opportunities for evergreening practices and ultimately hinder public access to essential and affordable drugs.

Abstract

ABSTRACTAn authentic deed is official document with full evidentiary power in Indonesian legal system. However, in practice, there are situations where an authentic deed may be degraded to underhanded deed, which holds lower legal authority. This paper explores the causes of such degradation, the notary's liability, and the forms of legal protection available to notaries. Through a normative analysis of relevant legislation, case studies, and jurisprudence, the paper finds that the degradation of authentic deeds is generally caused by procedural errors, violations of formal requirements, and invalidity of signatures. Notaries are responsible for the deeds they create and may face legal sanctions if degradation occurs. To protect notaries, it’s recommended to strengthen oversight by professional organizations, enhance training, and implement professional liability insurance.Keywords: Liability; Notary; Degradation of DeedABSTRAKAkta autentik merupakan dokumen resmi yang memiliki kekuatan pembuktian penuh dalam sistem hukum Indonesia. Namun, dalam praktiknya, ada situasi di mana akta autentik dapat terdegradasi menjadi akta di bawah tangan sehingga kedudukannya turun menjadi akta di bawah tangan. Jurnal ini membahas penyebab terjadinya degradasi akta autentik, tanggung jawab notaris atas degradasi tersebut, dan bentuk perlindungan hukum yang dapat diberikan kepada notaris. Melalui yuridis normatif terhadap peraturan perundang-undangan yang berlaku, studi kasus, dan yurisprudensi, jurnal ini menemukan bahwa degradasi akta autentik umumnya disebabkan oleh kesalahan prosedural, pelanggaran syarat materiil serta syarat formil, dan ketidakabsahan penandatanganan. Notaris bertanggung jawab atas akta yang dibuatnya dan dapat menghadapi sanksi hukum jika terjadi degradasi akta. Untuk melindungi notaris, disarankan adanya penguatan pengawasan oleh organisasi profesi, peningkatan pelatihan, dan penerapan asuransi profesi.Kata Kunci: Tanggung Jawab; Notaris; Degradasi Akta

Abstract

The rapid expansion of generative artificial intelligence in visual content production has intensified legal debates on authorship, originality, and the permissible boundaries of stylistic imitation under copyright law, as large-scale automated generation increasingly blurs the distinction between protected expression and unprotected style. This article examines the doctrinal ambiguity surrounding AI-generated visual works, particularly with regard to stylistic emulation, market substitution, and the potential erosion of creators’ economic and moral interests. Employing a doctrinal-normative legal method complemented by comparative and policy-oriented analysis, the study formulates operational criteria to distinguish lawful stylistic inspiration from infringing expressive replication by translating core copyright principles, including the idea–expression dichotomy, originality, and substantial similarity, into practical analytical tools. The findings indicate that, while existing copyright doctrine remains normatively relevant, it requires methodological operationalization to address the scale, speed, and distributive impacts of generative technologies on creative labor markets. The article further proposes integrating these doctrinal and policy considerations into clinical legal education through problem-based learning models to strengthen students’ doctrinal competence, technological literacy, and normative sensitivity. It argues that effective governance of AI-generated visual works demands a holistic framework combining doctrinal clarification, impact-oriented policy evaluation, and educational reform in order to foster a more adaptive and socially responsive copyright regime in the age of generative artificial intelligence.

ABSTRACTThe enactment of Law Number 2 of 2014, which amends Law Number 30 of 2004 concerning the Office of Notary, aims to support the implementation of the Cyber Notary concept in Indonesia’s legal system. However, its implementation still faces various legal obstacles, resulting in inconsistencies within the regulatory framework. This study aims to analyze regulatory disharmony and challenges in the implementation of Cyber Notary in Indonesia. This research employs a normative juridical method with an analytical approach to legal theories and a comparative study of relevant legislation. The findings indicate that the implementation of Cyber Notary has not been effective due to the lack of regulatory alignment. Consequently, the digitalization process of notarial services in Indonesia encounters significant obstacles, preventing the optimal realization of technology-based notarial services.Keywords: Cyber Notary; Indonesia; Regulatory Contradictions.ABSTRAKUndang-Undang Nomor 2 Tahun 2014 yang mengubah Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris telah diberlakukan untuk mendukung konsep Cyber Notary dalam hukum Indonesia. Namun, implementasinya masih menghadapi kendala hukum yang menciptakan ketidaksesuaian dalam sistem perundang-undangan. Penelitian ini bertujuan untuk menganalisis ketidaksesuaian regulasi serta problematika dalam penerapan Cyber Notary di Indonesia. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan analisis terhadap teori hukum serta perbandingan undang-undang terkait. Hasil penelitian menunjukkan bahwa penerapan Cyber Notary belum dapat berjalan secara efektif karena adanya disharmoni regulasi. Akibatnya, proses digitalisasi layanan Notaris di Indonesia masih terhambat, sehingga transformasi menuju layanan notaris berbasis teknologi menghadapi tantangan yang signifikan.Kata Kunci: Cyber Notary; Indonesia; Antitesis Peraturan.
