Abstract

With the enactment of Law Number 32 of 2004 which repealed the Act Number 22 of 1999 arising “the Vacuum of Law” in the foundation as well as in the implementation of village administration in Bali. On the one hand the Act Number 22 of 1999 was repealed, while the Law Number 32 Year 2004 not yet effective in Bali. In such “Vacuum of Law”, arose the polemic regarding the expected model or ideal format of villages held in Bali, which institutions should contribute to resolve cases that occurred in the village in a state of institutional dualism of village administration which is occurring in society and determined by their customary law, the form of out of court settlement in the customary dispute resolved by consensus agreement of peace through the customary laws. How is the effectiveness of out of court settlement in the village to resolve the customary disputes through the justice of the village peace by deliberation?In writing this article, the method used is the method of empirical research. Empirical legal research conceptualized as an empirical phenomenon that can be observed in real life. Settling disputes out of court by a justice of the peace in the village of indigenous people in Bali can be resolved peace and deliberation. The conclusion of the extrajudicial settlement in the village administration dualism conditions can be settled amicably without having to go through judicial mechanisms.

Abstract

Ketika pertama kali diumumkan sebagai pandemi global pada 11 Maret 2020 lalu oleh WHO jumlah infeksi di seluruh dunia telah mencapai lebih dari 121.000. Indonesia masih merasa aman dari wabah virus yang sudah melumpuhkan sebagian negara-negara di dunia, Presiden Joko Widodo pada awal Maret lalu yang tadinya membuat masyarakat berada di zona nyaman, harus mengakui kekalahan dengan adanya laporan kasus covid-19 yang disebabkan oleh virus SARS-Cov-2 atau yang lebih dikenal dengan sebutan virus Corona. Penyebaran virus yang tak-pernah-disangka akan sampai di Indonesia itu hingga kini masih berlanjut. Pusat Pemodelan Matematika dan Simulasi Institut Teknologi Bandung mempekirakan pandemi ini akan mencapai puncaknya pada akhir Maret dan berakhir pada pertengahan April 2020. Bahkan dengan kedinamisan data yang ada, prediksi tersebut bisa saja berubah. Data ini tentunya bukan untuk membuat kepanikan di tengah masyarakat, namun lebih untuk membuat masyarakat waspada dan memberikan gambaran bagi pemerintah dalam penanganannya. Yakni penanganan secara kompehensif, khususnya untuk mencegah penyebaran yang lebih luas agar jumlah infeksi dapat ditekan. Kini sebaran Covid 19 makin luas dan menghawatirkan. Jumlah kasus orang yang terpapar Covid-19 di Indonesia pun terus meningkat dari hari ke hari. Badan Nasional Penanggulangan Bencana (BNPB) sampai tanggal 28 April 2020 menyatakan ada sebanyak 9.511 orang positif, sembuh 1.254 orang sembuh, dan meninggal sebanyak 773 orang telah meninggal dunia akibat virus tersebut. Pemerintah memang telah menetapkan wabah Covid-19 itu sebagai bencana non alam dengan status sebagai bencana nasional berdasarkan ketentuan Undang-Undang Nomor 24 Tahun 2007 tentang Bencana Nasional. Pemerintah juga telah membentuk Gugus Tugas Percepatan Penanganan Covid-19. Di level daerah, masingmasing pemerintah daerah juga telah membentuk satuan tugas untuk menangani wabah Covid-19. Perluasan sebaran Covid 19 tersebut telah berimplikasi terhadap berbagai aspek kehidupan masyarakat di bidang ekonomi, sosial, budaya, dan hukum. Dari aspek peraturan perundang-undangan, setidaknya Indonesia telah memiliki 2 (dua) Undang-undang dan 1 (satu) Peraturan Pemerintah yang mengatur mengenai penanganan wabah yaitu UU Nomor 4 Tahun 1984 tentang Wabah Penyakit Menular, UU Nomor 6 Tahun 2018 tentang Kekarantinaan Kesehatan, dan Peraturan Pemerintah Nomor 21 Tahun 2020 tentang Pembatasan Sosial Berskala Besar (PSBB). Ketiga instrumen hukum tersebut belum terlalu lengkap diatur oleh peraturan teknis di bawahnya, terutama UU 6 Tahun 2018. Hal ini menjadi kendala dan urgen menjadi prioritas pemerintah. Untuk mencegah meluasnya sebaran Covid 19, Pemerintah-pun telah melakukan berbagi upaya untuk memutus mata rantai penularan virus Covid 19. Imbauan menggunakan masker, rajin mencuci tangan pakai sabun, social distancing, physical distancing, WFH, SFH, beribadah di rumah, sampai dengan penerapan PSBB. Namun nampaknya upaya pencegahan tersebut belum efektif sebagaimana yang diharapkan walaupun telah ada peraturan perundangundangan (hukum tertulis) yang menjadi dasar pelaksanaannya.

Abstract

In the context of criminal law, recognition of customary law begins with a very fundamental principle, namely the principle of legality – a legal basis for declaring an act as a criminal act. This paper examines the implementation of customary law regarding the violation of Penglipuran customary, in accordance with the customary delict from the perspective of the principle of legality and the future policy formulation of the principle of legality that accommodates the existence of customary law. To answer these problems, socio-legal research methods are used, data in the form of legal documents and results of in-depth interviews, various approaches (legal, theoretical, and historical approaches) and then analyzed through deductive-inductive methods. The results show that the Criminal Code adheres to the principle of formal legality, consequently, the written law is the only source to declare an act as an offense. Whereas in the Penglipuran community, it is known that customary delict is regulated not only in awig-awigbut also unwritten ones such as pararem penyahcah awig and perarem ngele. The existence of indigenous peoples is not only found textually but also commonly, carrying out their lives based on customary law which contains applicable values, principles, and norms. Therefore, it is necessary to formulate the principle of legality that accommodates the existence of customary law as a source of criminalizing acts. This is intended to realize a criminal law that accommodates the rights of indigenous peoples to “their own institutions, laws, and customs".

Abstract

Customary village con ict triggered by border disputes become an important issue occurred in Bali in recent decades. Unclear village boundaries can disrupt the tranquility of the traditional village concerned. This paper is intended to examine the participatory mapping approach through application of Global Possitioning System (GPS) for mapping the area of customary villages. The present research was conducted in Desa Adat Nyuh Kuning, Ubud, Gianyar, Bali. The study revealed that participatory mapping through the application of GPS is suitable for the mapping of customary villages. This approach produces a map of the village with high accuracy that the depiction of the boundary line in accordance with the coordinates in the eld. Delimitation of the territory by involving and ge ing agreement from neighboring villages will be able to prevent border disputes with neighboring indigenous villages.

Abstract

Penelitian ini bertujuan untuk menjelaskan proses pensertipikatan tanah adat di Bali melewati proses Pendaftaran Tanah Sistematis Lengkap (PTSL). Penelitian disusun berdasarkan hasil analisis hukum normatif bersama pendekatan peraturan perundang undangan serta pendekatan konsep guna mengkaji konsep dari hak pemilikan komunal serta teknik penelusuran bahan hukum menggunakan studi dokumen dan memakai analisis yang deskriptif kualitatif. Kesimpulan artikel ini, pertama, eksistensi tanah desa adat di Bali cukup kuat karena diakui berdasarkan hukum positif juga diakui berdasarkan hukum positif juga diakui dalam hukum adat Bali sesuai awig-awig desa setempat. Kedua, tata cara pensertipikatan tanah Desa adat di Bali yang dilakukan melalui program PTSL dapat dikatakan lebih sederhana dibandingkan dengan tata cara pensertipikatan tanah gunakaya (tanah milik perseorangan). Tata cara yang lebih sederhana ini, dalam beberapa hal membawa konsekuensi yang belum sesuai untuk pemilik tanah dan masyarakat contohnya (1) Adanya klaim dari warga atau pemohon PTSL atas bidang tanah adat yang kemudian ditingkatkan haknya menjadi hak milik atas namanya bukan nama desa adat setempat. (2) Adanya peralihan hak seperti jual beli atau lelang karena dipasang Hak Tanggungan (HT) atas bidang tanah adat namun telah disertipikatkan atas nama pribadi bukan desa adat.

Abstract

Bali has changed. The world is no longer partially controlled by men but there are forms of marriage where both the bride and groom act as purusha (the power of patriarchy) or have the same rights and obligations between them. This qualitative study found that the number of bride and groom couples in Bali who choose the form of marriage "pada gelahang" (having the same rights and obligations), from year to year tends to increase. The background or main reason for choosing the form of the marriage is to continue the regeneration. There are three principles or attitudes of life that need to be held and respected so that the marriage achieves prosperity and happiness forever (find a forever happiness), namely paksa, lasia, and satya.

Abstract

The Indonesian island of Bali is internationally renowned as a popular tourist destination. Tourists from around the world have been attracted to Bali’s rich and colourful displays of culture and its friendly people for many decades. Intertwined with the predominately Hindu culture that is so readily visible is the invisible customary legal system of Bali that regulates much of the daily life of the Balinese. This autochthonous legal system exists in plurality with the Indonesian state legal system. As with all legal systems, the Balinese customary law system is in a state of flux. This article will examine the foundational sources and purposes of authority in the Balinese customary law system and analyse the pressures of change upon that system. It will be argued that an embryonic quasi-common law system is developing in the Balinese customary law system due to the recent formation of the Majelis Utama Desa Pakraman and the Bali mawacara jurisprudence.

Abstract

This article examines the concept of Negen Dadua marriage in Bali, a unique form of marriage recognized within Balinese Customary Law. This concept has emerged as a solution to inheritance and lineage issues, particularly in families without male children. The research method employed is normative-conceptual, utilizing primary and secondary legal sources. The analysis reveals that Negen Dadua marriage, recognized under national and Balinese customary law, accords both husband and wife the status of purusa, allowing them to maintain responsibilities and rights within their respective families. This study finds that Negen Dadua marriage not only complies with Balinese Customary Law and Hindu religion but also reflects a shift towards gender equality. It offers a solution to the inequity in inheritance and social roles between men and women. This indicates a positive development in social and legal awareness of gender equality in Bali, especially in family law. This marriage form, embodying gender equality, presents an efficient solution to inheritance issues without disadvantaging any party. The article concludes that Negen Dadua marriage is a manifestation of gender equality within the Balinese Customary Law community and represents a progressive step towards recognizing women's rights. Abstrak Artikel ini mengkaji Perkawinan Negen Dadua di Bali, yang merupakan bentuk perkawinan alternatif dalam Hukum Adat Bali. Konsep ini muncul sebagai solusi untuk masalah pewarisan dan keturunan, terutama di keluarga tanpa anak laki-laki. Metode penelitian adalah normatif konseptual, menggunakan sumber hukum primer dan sekunder. Analisis menunjukkan bahwa perkawinan negen dadua, diakui dalam hukum nasional dan adat Bali, memberikan status purusa kepada kedua suami dan istri, memungkinkan mereka mempertahankan tanggung jawab dan hak dalam keluarga masing-masing. Studi ini menemukan bahwa perkawinan negen dadua bukan hanya mematuhi Hukum Adat Bali dan agama Hindu, tetapi juga mencerminkan pergeseran menuju kesetaraan gender, menawarkan solusi untuk ketidaksetaraan dalam pewarisan dan peran sosial antara laki-laki dan perempuan. Ini mengindikasikan perkembangan positif dalam kesadaran sosial dan hukum tentang kesetaraan gender di Bali, khususnya dalam hukum keluarga. Perkawinan ini, sebagai wujud kesetaraan gender, menawarkan solusi efisien untuk masalah pewarisan tanpa merugikan pihak mana pun. Artikel ini menyimpulkan bahwa perkawinan negen dadua adalah manifestasi dari kesetaraan gender dalam masyarakat Hukum Adat Bali dan merupakan langkah maju menuju pengakuan hak-hak perempuan.
