Abstract

Conflict resolution of natural resources management is considered to be based on adat institutions when a conflict is resolved by adat law justice system in an adat forum by applying adat norms. Government, adat law community, and the private sector parties must be serious in empowering adat institutions. The seriousness of the government towards the recognition of adat intitution is outlined in the legislation. The seriousness of the adat law community is shown by receiving critically and carefully various new values that are good for strengthening the social life of the next community. The position and status of members of adat law communities are not only as a passive recipient of the local culture, but also as an actor, creator, and innovator agents of adat institutions. Members of adat law communities as active subjects carry out innovation and revitalization of adat institutions in order to adjust to the challenges of the times. The seriousness of the private sector is manifested in the willingness form of consultation with members of adat law communities to understand the feelings of the heart and the willingness of members of adat law communities.

Abstract

Ketika pertama kali diumumkan sebagai pandemi global pada 11 Maret 2020 lalu oleh WHO jumlah infeksi di seluruh dunia telah mencapai lebih dari 121.000. Indonesia masih merasa aman dari wabah virus yang sudah melumpuhkan sebagian negara-negara di dunia, Presiden Joko Widodo pada awal Maret lalu yang tadinya membuat masyarakat berada di zona nyaman, harus mengakui kekalahan dengan adanya laporan kasus covid-19 yang disebabkan oleh virus SARS-Cov-2 atau yang lebih dikenal dengan sebutan virus Corona. Penyebaran virus yang tak-pernah-disangka akan sampai di Indonesia itu hingga kini masih berlanjut. Pusat Pemodelan Matematika dan Simulasi Institut Teknologi Bandung mempekirakan pandemi ini akan mencapai puncaknya pada akhir Maret dan berakhir pada pertengahan April 2020. Bahkan dengan kedinamisan data yang ada, prediksi tersebut bisa saja berubah. Data ini tentunya bukan untuk membuat kepanikan di tengah masyarakat, namun lebih untuk membuat masyarakat waspada dan memberikan gambaran bagi pemerintah dalam penanganannya. Yakni penanganan secara kompehensif, khususnya untuk mencegah penyebaran yang lebih luas agar jumlah infeksi dapat ditekan. Kini sebaran Covid 19 makin luas dan menghawatirkan. Jumlah kasus orang yang terpapar Covid-19 di Indonesia pun terus meningkat dari hari ke hari. Badan Nasional Penanggulangan Bencana (BNPB) sampai tanggal 28 April 2020 menyatakan ada sebanyak 9.511 orang positif, sembuh 1.254 orang sembuh, dan meninggal sebanyak 773 orang telah meninggal dunia akibat virus tersebut. Pemerintah memang telah menetapkan wabah Covid-19 itu sebagai bencana non alam dengan status sebagai bencana nasional berdasarkan ketentuan Undang-Undang Nomor 24 Tahun 2007 tentang Bencana Nasional. Pemerintah juga telah membentuk Gugus Tugas Percepatan Penanganan Covid-19. Di level daerah, masingmasing pemerintah daerah juga telah membentuk satuan tugas untuk menangani wabah Covid-19. Perluasan sebaran Covid 19 tersebut telah berimplikasi terhadap berbagai aspek kehidupan masyarakat di bidang ekonomi, sosial, budaya, dan hukum. Dari aspek peraturan perundang-undangan, setidaknya Indonesia telah memiliki 2 (dua) Undang-undang dan 1 (satu) Peraturan Pemerintah yang mengatur mengenai penanganan wabah yaitu UU Nomor 4 Tahun 1984 tentang Wabah Penyakit Menular, UU Nomor 6 Tahun 2018 tentang Kekarantinaan Kesehatan, dan Peraturan Pemerintah Nomor 21 Tahun 2020 tentang Pembatasan Sosial Berskala Besar (PSBB). Ketiga instrumen hukum tersebut belum terlalu lengkap diatur oleh peraturan teknis di bawahnya, terutama UU 6 Tahun 2018. Hal ini menjadi kendala dan urgen menjadi prioritas pemerintah. Untuk mencegah meluasnya sebaran Covid 19, Pemerintah-pun telah melakukan berbagi upaya untuk memutus mata rantai penularan virus Covid 19. Imbauan menggunakan masker, rajin mencuci tangan pakai sabun, social distancing, physical distancing, WFH, SFH, beribadah di rumah, sampai dengan penerapan PSBB. Namun nampaknya upaya pencegahan tersebut belum efektif sebagaimana yang diharapkan walaupun telah ada peraturan perundangundangan (hukum tertulis) yang menjadi dasar pelaksanaannya.

Abstract

This article aims to analyze recognition and respect towards adat law community and adat law in Indonesia legal pluralism context; the strength and weakness of adat law as conflict resolution mechanism; model on state recognition and respect towards adat law community and its adat law in order to reduce the weakness of adat law as a tool to resolve conflict. This is a legal normative article which written based on secondary data, such as books, articles, news, research report, and laws. Collected secondary data are selected based on the issues and analyzed qualitatively. Analysis results on descriptive report which explains the issues comprehensively. This article found that (1) In Indonesia legal pluralism context, the state has not recognized and respect adat law community and its adat law wholeheartedly. It is proven by cumulative limitations which hard to be fulfilled by the adat law community in order to be recognized and respected by the state; (2) The strength of non-litigation conflict resolution based of adat law principles is not about win or lose solution, but about win-win solution. Win-win solution has purpose to achieve justice which acceptable to all parties. Win-win solution is obtained based on consensus from conflicting parties until justice is achieved. The weakness of adat law in Indonesia Law context is the fact that Indonesia adopts European Continental system of law, therefore adat law is not the state law. Adat law is understood by understanding the life of the community where adat law is applied. Adat law is implemented voluntarily, without any force from the state. The weakness of adat law as tool of conflict resolution is the dependency towards good faith between parties. The decision cannot be implemented, unless there is good faith from the conflicting parties; (3) model of adat law community and its adat law recognition and respect is synergic combination model between self declaratory by the adat law community and decisive state recognition with strict limitation which hard to be implemented by the adat law community.

Abstract

Joint land ownership has been in existence for long time in Indonesia, especially in Java. Such a unique ownership system has inherent problem, namely potential conflict among the factual owners. This article aims to analyze the philosophical background of joint land ownership and its legal problems. This normative legal research was conducted through library-based study. It is found that there are three contributing factors that created the joint land ownership system. These include historical factors, philosophical factors, and the change of land economic value. In the past, joint land ownership system was introduced by the head village (bekel) to alleviate the burden of the tax payment. The philosophy of joint land ownership system refers to the philosophy of farmer life that can be identified from several values such as mutual trust and honesty in the spirit of kinship/togetherness.

Abstract

The purposes of this study are to identify and analyze the importance of bainduak by female immigrants who come to Lubuk Sikaping area of ​​Pasaman Regency and analyze the legal effect`s position of female immigrants who bainduak in the law of adat`s marriage in Lubuk Sikaping Pasaman Regency. The method of this study uses the juridical empiric which observes about the reactions and interactions that occur when the system norms implements in society. The data are analysed by using qualitative and data are presented in descriptive approach by using inductive in conclusion. The results of this study show that: The reasons of female immigrants of Minangkabau doing bainduak in Lubuk Sikaping Pasaman Regency are: (a) "Mamak Ditingga Mamak Ditapati", (b) Obtaining adat`s protection, (c) The needs for delivering aspirations and solving problems, (d) Acknowledgment, and (e) Obtaining legal guarantees from the adat law institution in bainduak environment
