Abstract

Penelitian ini bertujuan untuk penegakan hukum undang-undang informasi dan transaksi elektronik (UU ITE) terhadap hukuman pengguna media sosial ujaran kebencian. Jenis Penelitian Hukum Normatif. Metode pendekatan yang digunakan adalah perundang-undangan dan kajian pustaka terkait judul peneliti, sedangkan metode menggunakan analisis Kualitatif dengan cara menganalisis hasil bahan penelitian yang relevan dengan tujuan penelitian. Hasil penelitian tentang ujaran kebencian terdapat pada pengaturan (UU ITE) No.19 Tahun 2016 atas Perubahan Undang-Undang No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, dimana bagi pelaku pengguna media sosial ujaran kebencian diatur dalam Pasal.28 ayat (2) isinya” Setiap Orang dengan sengaja dan tanpa hak menyebarkan informasi yang ditujukan untuk menimbulkan rasa kebencian atau permusuhan individu dan/atau kelompok masyarakat tertentu berdasarkan atas suku, agama, ras, dan antar golongan (SARA). Ancaman Hukuman Pasal 45 A ayat (2) isinya” Setiap Orang yang dengan sengaja dan tanpa hak menyebarkan informasi yang ditujukan untuk menimbulkan rasa kebencian atau permusuhan individu dan/atau kelompok masyarakat tertentu berdasarkan atas suku, agama, ras, dan antargolongan (SARA) sebagaimana dimaksud dalam Pasal 28 ayat (2) dipidana dengan pidana penjara paling lama 6 (enam) tahun dan/atau denda paling banyak Rp1.000.000.000,00 (Satu miliar rupiah). Sedangkan upaya penanggulangan pelaku pengguna media sosial ujaran kebencian, diatur dalam Surat Edaran Kapolri Nomor SE/6/X/2015, tentang Penanganan Ujaran Kebencian ( Hate Speech). Untuk mengedepankan Fungsi Binmas dan Polmas, dimana peran dari kepolisian diharapkan untuk memberikan sosialisasi dan penyuluhan hukum tentang ujaran kebencian dimasyarakat melalui toko agama, toko masyarakat, toko pemuda dan akademisi untuk optimalisasi tindakan represif atas ujaran kebencian. Selanjutnya peran perangkat pemerintahan diharapkan untuk mengkondusifkan daerah masing masing melalui Kecamatan, Kelurahan/Desa, dan Perangakat RT/RW sebagai wadah pertama dalam hubungan emosional dimasyarakat.

Abstract

Menikah adalah sesuatu yang diperintahkan oleh Allah SWT dan Rasul, yang di dalamnya terdapat hikmah, antara lain mampu mendatangkan ketentraman batin dan mencegah manusia dari maksiat. Perkawinan di bawah umur memerlukan permohonan dispensasi yang diajukan oleh pemohon/orang tua untuk syarat perkawinan yang sah dan didukung dengan bukti permohonan yang rasional untuk meyakinkan hakim dalam memberikan pertimbangan terhadap putusan Pengadilan Agama. Penelitian ini didasarkan pada penelitian hukum normatif studi kasus dengan mengkaji Putusan Pengadilan Agama Rantauprapat Nomor 62/Pdt.P/2017/PA.Rap. Jenis penelitian kualitatif. Hasil pembahasan dispensasi anak di bawah umur memiliki dasar bahwa mereka boleh menikah sesuai dengan Pasal 7 ayat (1) UU No. 1 tahun 1974 menyatakan " Perkawinan hanya diperbolehkan jika pihak laki-laki telah mencapai usia 19 (sembilan belas) tahun dan pihak wanita telah mencapai usia 16 (enam belas) tahun. Namun dalam ketentuan ayat (2) UU No.1 Tahun 1974 disebutkan “Dalam hal terjadi penyimpangan dari ayat (1) pasal ini, dapat dimintakan dispensasi kepada Pengadilan atau pejabat lain yang ditunjuk baik oleh laki-laki maupun perempuan. Dispensasi terhadap anak di bawah umur dapat diajukan ke Pengadilan Agama atas dasar dalil yang kuat semata-mata untuk menjadikan perkawinan sebagai hubungan yang harmonis demi kelangsungan hidup rumah tangga. dispensasi anak di bawah umur, sesuai dengan pedoman peraturan perundang-undangan yang berlaku. Dispensasi anak di bawah umur dapat diajukan ke Pengadilan Agama atas dasar argumentasi yang kuat semata-mata untuk menjadikan perkawinan sebagai hubungan yang harmonis dalam kelangsungan hidup rumah tangga. Dalam pertimbangannya, hakim telah tepat dan benar dalam memberikan putusan penetapan dispensasi anak di bawah umur, sesuai dengan pedoman peraturan perundang-undangan yang berlaku. Dispensasi anak di bawah umur dapat diajukan ke Pengadilan Agama atas dasar argumentasi yang kuat semata-mata untuk menjadikan perkawinan sebagai hubungan yang harmonis dalam kelangsungan hidup rumah tangga. Dalam pertimbangannya, hakim telah tepat dan benar dalam memberikan putusan penetapan dispensasi anak di bawah umur, sesuai dengan pedoman peraturan perundang-undangan yang berlaku.

Abstract

Keterpanggilan kami sebagai pengabdi karena melihat kondisi wilayah yang kami jadikan sasaran untuk mengadakan sosialisasi bahaya narkoba berada dalam keadaan terancam dari pengaruh penyalahgunaan narkoba. Dari gejala yang kami tangkap dari informasi yang terdekat dan terpercaya bagi kami untuk lebih cepat mengadakan sosialisasi bagaimana dahsyatnya tingkat kerusakan bagi masa depan generasi muda yang ada di Desa Tebing Tinggi tersebut. Sehingga penyuluhan atau sosialisasi bahaya narkoba harus digalakkan mengingat kasus narkoba yang meningkat terutama generasi muda yang rentan untuk mencoba obat – obatan terlarang. Keterpanggilan kami sebagai pengabdi karena melihat kondisi Di Desa Tebing Tinggi yang kami jadikan sasaran untuk mengadakan sosialisasi bahaya narkoba berada dalam keadaan terancam dari pengaruh penyalahgunaan narkoba.

Abstract

Kegiatan Sosialisasi tentang Pentingnya Administrasi Penduduk ini merupakan bagian dari kegiatan Pengabdian kepada Masyarakat yang dilaksanakan di Desa Bandar Kumbul, Kecamatan Bilah Barat, Kabupaten Labuhanbatu. Pengabdian kepada masyarakat ini dilakukan oleh Dosen dan Mahasiswa Universitas Labuhanbatu dibantu oleh perangkat Desa. Target pengabdian kepada masyarakat ini yaitu kelompok masyarakat di Desa Bandar Kumbul.Permasalahan yang dihadapi Pemerintah Desa Bandar Kumbul yaitu kurangnya pengetahuan warga akan pentingnya memiliki dokumen-dokumen kependudukan, kurangnya informasi tentang bagaimana cara pengurusan kepemilikan dokumen-dokumen kependudukan, dan adanya informasi yang salah bahwa mengurus dokumen-dokumen kependudukan itu mahal dan sulit. Tujuan dilaksanakannya kegiatan sosialisasi ini adalah agar masyarakat memahami dan menyadari akan pentingnya kepemilikan dokumen-dokumen kependudukan bagi warga negara.

Abstract

The purpose of this study was to determine the educational values of patriotism in students of the PPKn Study Program at Labuhanbatu University. The approach used in this research is a qualitative research type, with a descriptive approach because this research is to describe and explain about the education of patriotism character values that are obtained directly and in real terms through interviews. structured towards students of the 1st (one) semester PPKn Study Program which is carried out for one month. Data collection methods used in the research included observation, interviews and documentation. The results of the study concluded regarding the process of instilling patriotism educational values obtained during structured interviews with material that had been prepared beforehand, many students did not understand the material. Such as material about (1) Willing to sacrifice which is interpreted as a form of fighting spirit to defend the country from enemy threats, (2) Defending the country such as national defense reserves or conscription for every citizen if needed for the integrity of the Indonesian nation, (3) love of the motherland such as commemorating the independence day of the Indonesian nation, maintaining the unity of the Indonesian republic and not being divided, and (4) Pancasila as the state ideology in which there are five precepts that must be carried out in every joint of the country. Pancasila as a unifying nation and the foundation of a country to maintain the integrity of a nation and instill nationalism and patriotism of the nation.

Abstract

This research is based on the fact that in Sempan Village there is have potential eco tourism for Bukit 7 Sempan which requires professional institutions. However, there is a void in the legal basis for the Sempan Village Government in creating institutional governance. This research was written using an empirical normative approach that relies on secondary data and primary data. The role of the village is part of the constitutional aspect because the village is an autonomous government unit. Village government is indeed a part that cannot be separated geographically because the village government area is also a regional government area. But uniquely, on the one hand, the village also always has its autonomy, namely in terms of controlling the village household and making village regulations. The village is a self-governing community, a form of autonomy from the Sempan Village Government in managing Sempan 7 Hill is by forming a Tourism Awareness Group (Pokdarwis). Efforts to guarantee legal certainty. By giving Pokdarwis legality, it will enjoy a position like other legal subjects.

Abstract

The implementation of this community service aims to become a facilitator between village officials and the community in identifying problems faced by the village related to the community, providing suggestions for alternative legal solutions in the village and providing ideas for understanding the law to the community in accordance with the scientific field that has been owned. The methods used are socialization of laws and regulations, discussions, training and visits to people's homes. With all the advantages and disadvantages, it is hoped that this work program can be useful for students and the Bukit Layang Village community and can be a stimulant for developing legal awareness for the village community.

Abstract

This research aims to determine the effect of the government expenditure model and green growth based on green energy consumption in Indonesia which has 4 variables, namely carbon emissions, energy consumption, economic growth and government expenditure. The analytical method used in this research is the Vector Auto Regression (VAR) model with the Impulse Response Function (IRF) test, Forecast Error Varince Decomposition (FEVD), stationarity test, cointegration test, structural lag stability test, and optimal lag length test. . The results of the Vector Autoregression research using lag 1 as the basis show the contribution of each variable to the variable itself and other variables. The results of the Vector Autoregression analysis also show that the past variable (t-1) contributes to the current variable, both the variable itself and other variables. From the results of the analysis, there is a reciprocal relationship between one variable and another variable. Response Function Analysis shows the response of other variables to changes in a variable in the short, medium and long term, and it is known that the stability of the response of all variables is formed within a period of 5 years or the medium term. and long term. Variance Decomposition Analysis shows that there are variables that have the largest contribution to the variable itself in the short, medium and long term, such as CO2, EC, and GOV. Meanwhile, another variable that has the greatest influence on the variable itself in the short, medium and long term is CO2 which is strongly influenced by GOV and GDP.

Abstract

This study aims to determine the effect of fintech, the amount of money in circulation, interest rates and economic growth on the analysis of digital economic trends on monetary policy in Indonesia. There are four variables in this study, namely fintech, the amount of money in circulation, interest rates and economic growth. The analysis method used is Vector Autoregression with the Impluse Response Function test or abbreviated as IRF and the Forecast Error Variance Decomposition test commonly abbreviated as FEVD, stationarity test, cointegration test, lag structure stability test and optimal lag length test. There is a contribution from each variable to the variable itself and other variables, according to the results of the Vector Autoregression study with a lag basis of 2. In addition, the results of the Vector Autoregression analysis show that the past variable (t-1) contributes to the current variable both to the variable itself and to other variables. The results of the analysis show that there is a reciprocal relationship between the variables. By using response function analysis, we can see if there is a response from other variables to changes in one variable in the short, medium, or long term. In addition, we know that the stability of all variables is formed in the short, medium, and long term. According to the Variance Decomposition Analysis, factors such as Fintech and Money Supply contribute the most to the variable itself. However, other variables that have the greatest influence on the variable itself and are supported by other variables in the short, medium, and long term are economic growth and interest rates are most influenced by Fintech.

Abstract

This study uses a normative legal research method. Normative legal research is examining law from an internal perspective with the object of research being legal norms. This study aims to determine the Urgency of Imposing the Death Penalty on Narcotics Dealers Reviewed from a Human Rights Perspective. Discussion Results: The death penalty is one of the main punishments regulated in Article 10 of the Criminal Code. Where, the death penalty is carried out by shooting the perpetrator dead as regulated in the law. The death penalty is a form of accountability for unlawful acts and this punishment is the highest punishment of all existing punishments and is regulated in the Criminal Code. The death penalty for drug dealers is something that must be done and expedited, because the circulation of narcotics is currently increasingly rampant and the impacts it causes greatly affect the lives of the nation's next generation, as well as security and order in the nation and state today and in the future. The consideration to impose the death penalty on drug dealers is more directed towards providing a deterrent effect on the perpetrators as well as law enforcement to create a sense of justice in society. The death penalty imposed under Indonesian law still has pros and cons in some circles of society and legal observers. That the death penalty is a violation of the Human Rights to life, because basically death belongs only to God Almighty. The death penalty when associated with the Human Rights Law, then clearly violates what is formulated in the Human Rights Law Articles 4 and 9. However, in contrast to what is stated in Articles 70 and 73, that there are restrictions set by law as long as the freedom to live does not violate the provisions set by law, such as violating public order, morality, morals, or the interests of the nation. While the criminal acts committed by drug dealers have clearly violated the provisions in question, the death penalty is actually a punishment that clearly does not violate the Human Rights Law.
