Abstract

The annulment of a Sale and Purchase Deed (Akta Jual Beli/AJB) by the court, despite being executed in accordance with legal procedures, creates legal uncertainty for good-faith purchasers in land transactions. This study aims to analyze the application of the principle of legal certainty in Decision Number 31/Pdt.G/2024/PN Bangil and to examine the forms of legal protection available for good-faith buyers. The novelty of this research lies in its analysis of the judiciary’s tendency toward formalistic reasoning in assessing the validity of AJBs, which consequently weakens substantive legal protection for purchasers acting in good faith. This study employs a normative legal research method using statutory, conceptual, and case approaches through qualitative-prescriptive analysis of primary, secondary, and tertiary legal materials. The findings reveal that the panel of judges placed greater emphasis on formal aspects, particularly the delay in the land title transfer registration process, rather than protecting purchasers who had fulfilled the legal requirements of a valid transaction in good faith. This condition demonstrates that the application of substantive legal certainty in land dispute resolution remains inadequate. Legal protection for good-faith purchasers can be strengthened through the optimization of the Land Deed Official’s (PPAT) role, timely land registration obligations, and the availability of repressive legal remedies such as appeals, cassation, judicial review, and derden verzet. This study underscores the importance of reconstructing legal protection for good-faith purchasers in order to achieve a balance between formal legal certainty and substantive legal certainty, while also serving as a reference for the development of land law policies and technical guidelines for judges and PPAT officials.Keywords: Legal Certainty; Legal Protection; Good-Faith Purchaser; Sale and Purchase Deed.

Abstract

The loss of shipped goods in PT JNE’s delivery services causes financial harm to consumers and raises legal issues regarding the liability of service providers. This study aims to analyze the legal protection available to consumers against lost shipments and to examine the legal remedies that may be pursued. The research employs an empirical juridical method with a socio-legal approach, using primary data obtained through interviews with service users and related parties, as well as secondary data from statutory regulations and legal literature. The findings indicate that existing legal protection has not been effectively implemented, as reflected in cases where compensation is not optimally fulfilled. Several respondents reported that the claims process is often complex and lacks transparency, resulting in legal uncertainty for consumers. This condition demonstrates a gap between normative provisions under consumer protection law and their practical enforcement, and suggests potential breach of contract (wanprestasi) by the service provider. Dispute resolution may be pursued through non-litigation mechanisms, such as the Consumer Dispute Settlement Agency (BPSK), or through litigation in court. Therefore, strengthening supervision and law enforcement is essential to ensure consumer protection and enhance the accountability of delivery service providers. Keywords: legal protection; delivery services; PT JNE; compensation; breach of contract

Abstract

Oral agreements are still commonly used in civil law practice, particularly in legal relationships based on mutual trust. This study examines the evidentiary strength of oral debt agreements through an analysis of Decision Number 146/Pdt.G/2021/PN BPP. The research employs a normative juridical method using statutory, case, and conceptual approaches. Research data were obtained through library research on primary legal materials, including the Indonesian Civil Code and relevant court decisions, as well as secondary legal materials in the form of books and scholarly journal articles. The findings indicate that oral agreements are legally recognized as long as they fulfill the validity requirements of contracts as stipulated in Article 1320 of the Indonesian Civil Code. In the case examined, the Panel of Judges established the existence of a legal relationship between the creditor and the debtor based on evidence such as fund transfer records, correspondence, and witness testimony, thereby confirming that the oral agreement possessed sufficient evidentiary value. However, the request for the seizure of shares as security was rejected because it conflicted with Supreme Court guidelines and involved public interests in the electricity sector. This study has both theoretical and practical significance, as it clarifies the legal standing of oral agreements in civil evidentiary law and provides guidance for judges and litigants in assessing evidence in debt-related disputes. Nevertheless, the study recommends that agreements be documented in written form to ensure legal certainty and facilitate proof in judicial proceedings. Keywords: oral agreement; evidence; debt; breach of contract

Abstract

The increasingly rampant narcotics crimes in Indonesia pose a serious threat to public order and security. This study aims to analyze and compare the evidence of actus reus and mens rea in cases of attempted intermediary transactions of Class I narcotics based on Decision Number 572/Pid.Sus/2014/PN.Jkt.Utr and Decision Number 163/Pid.Sus/2015/PN.Mam. By using normative juridical research methods through case, comparative, statutory, and conceptual approaches, this study found fundamental differences in the judge's approach. In Decision 572/Pid.Sus/2014/PN.Jkt.Utr, the judge placed more emphasis on non-juridical considerations such as the social conditions and background of the defendant which resulted in an acquittal, even though when viewed from the elements of the attempt in Article 53 Paragraph (1) it had been fulfilled. In contrast, in Decision Number 163/Pid.Sus/2015/PN.Mam, the judge prioritized legal considerations based on evidence, while still considering the principle of the child's best interests, thus imposing a correctional measure. This research emphasizes the need for consistent standards of consideration to maintain legal certainty.Keywords: Comparison; Evidence; Drug Intermediary Trial

Abstract

Perkembangan teknologi kecerdasan buatan (Artificial Intelligence/AI) telah melahirkan inovasi baru dalam bentuk deepfake, yaitu teknologi manipulasi wajah yang mampu menciptakan konten visual palsu secara meyakinkan. Salah satu penyalahgunaan teknologi ini adalah dalam pembuatan dan penyebaran konten pornografi, yang dapat merusak reputasi, privasi, serta martabat korban, meskipun mereka tidak pernah benar-benar terlibat dalam pembuatan konten tersebut. Studi ini berfokus pada pengkajian bentuk pemidanaan yang dapat dikenakan terhadap individu yang menyebarluaskan konten pornografi yang dihasilkan melalui teknologi deepfake, dalam kerangka hukum pidana nasional, khususnya merujuk pada ketentuan yang diatur dalam UU No. 44/2008 tentang Pornografi. Penelitian dilaksanakan dengan menggunakan pendekatan yuridis normatif, melalui telaah terhadap peraturan perundang-undangan serta kajian literatur yangs sesuai. Temuan dari penelitian ini memperlihatkan bahwa meskipun hingga seakrang ini belum didapati ketentuan hukum yang eksplisit mengatur tentang penggunaan teknologi deepfake, namun pengenaan sanksi pidana terhadap perbuatan tersebut masih dimungkinkan melalui konstruksi norma yang telah ada. pelaku dapat dikenakan sanksi berdasarkan UU Pornografi, UU ITE, serta UU PDP. Namun, masih terdapat tantangan dalam aspek pembuktian dan pelacakan digital, yang menuntut reformasi hukum dan peningkatan kapasitas penegak hukum. Oleh karena itu, pengaturan yang lebih spesifik mengenai deepfake perlu segera dihadirkan dalam sistem hukum nasional Indonesia.

Abstract

The problem in this research is the act of default carried out by the auction winner. Article 1 paragraph 29 of Minister of Finance Regulation Number 213/PMK.06/2020 concerning Auction Implementation Instructions explains that buyers are required to pay for the auction object won in the auction no later than 5 (five) working days after the auction. The aim of this research is to understand the problems that occur in the implementation of voluntary non-execution auctions at the Office of the Notary/PPAT/Class II Auction Officer Dr. HR. Ibnu Arly, S.H., M.Kn and IBID Surabaya auction center. As well as to understand the legal protection for auction organizers against auction winners who default. The type of research is juridical-empirical with descriptive qualitative research characteristics. Using a conceptual approach, statutory approach and case approach. Legal materials come from primary legal materials, secondary legal materials and non-legal materials. Procedures for collecting legal materials include observation, interviews and literature study. The research results found that there are two legal protections for auction organizers against defaults committed by auction winners, namely preventive and repressive. As a preventive measure, hold an open house and sellers are required to submit a Land Registration Certificate (SKTP). For repayment, the security deposit belonging to the auction participant who defaults will not be returned and will not be allowed to participate in the auction again for 6 (six) months.   Keywords: Legal Protection, Default, Auction.
