Abstract

Tulisan ini menegaskan keadilan dan kesetaraan dalam perspektif Al-Qur’an dan Hadis. Islam sebagai agama yang menjunjung tinggi nilai keadilan dan persamaan mengandung prinsip-prinsip kesetaraan. Laki-laki dan Perempuan sama-sama sebagai hamba, khalifah di bumi, dan menerima perjanjian primordial. Adam dan Hawa sama-sama aktif dalam drama kosmis. Laki-laki dan perempuan berpotensi untuk meraih prestasi optimal. Implementasi kesetaraan gender perspektif al-Qur’an melahirkan adanya transformasi hukum Islam yang bertalian dengan isu kesetaraan. Relasi di bidang profesi, seperti adanya hakim perempuan serta memicu lahirnya produk hukum yang berpespektif kesetaraan dan keadilan gender.  -------------------------In this paper, the writer emphasises justice and equality in the perspective of the Quran and the Hadith. Islam as a religion holds the values of justice and equality contains the principles of equality. Both men and women are equally as worshippers of Allah; men and women alike as the leaders on this earth; they alike receive primordial covenant. It is believed that Adam and Eve were both active in the cosmic drama, men and women have the potential to achieve optimal performance. The implementation of the gender equality based on the perspective of the Quran in Islamic law leads to the transformation of Islamic law relating to the issues of the relation of equality between men and women. It is also within professional fields such as the female judge whose produce the legal products based on gender equality .

Abstract

One of the problems that arise after death is regarding the distribution of property to whom and how much share will be obtained, this has been regulated in Islamic inheritance law, but an issue that until now is often debated and prone to conflict in the family is the inheritance rights of women who in the Islamic inheritance system are different from men so that there is a stigma that Islamic inheritance law tends to be discriminatory and gender biased, This is due to the assumption that the inheritance system in Islam is something patent and cannot be changed, whereas the formulation of inheritance in the books of fiqh is the interpretation of scholars in the social setting where the ulama live, therefore it is necessary to reinterpret the inheritance system for women because the law is actually a social response that will continue to interact with the social construction of community life.
