Abstract

Productive waqf is a very strategic economic instrument to realize welfare. However, this potential has not been maximally utilized because waqf organizers have difficulties in finding funds to increase investment in waqf assets. On the other hand, the Hajj Financial Management Agency (BPKH) is given the mandate to manage hundreds of trillions of Hajj funds. Law No. 34 of 2014 regulates the financial management of Hajj based on sharia principles that aim to increase the welfare of the people. The Waqf Law also mandates the management of waqf assets to improve public welfare. So that, it is the right thing to do cooperation between BPKH and waqf organizer (nazhir). In this study, the approach method used is a juridical-normative method to study the management of Hajj funds with productive waqf in terms of law and concept. Therefore, the purposes of this research are to review the laws and schemes in the collaboration. The research concludes: first, the synergy between Hajj funds and productive waqf can be done legally and second, the method that can be used by BPKH in placing Hajj funds with productive waqf schemes is profit sharing collaboration contract (Mudharabah) or Sukuk waqf.

Abstract

This research is a juridical and empirical study about the implementation of Regional Sukuk (Islamic bonds) in Indonesia.  Sukuk constitute the Islamic bonds that are issued as proof of ownership of assets or infrastructure projects both in rupiah and foreign currency based on sharia principles. sukuk represents one of the strategic sources of state infrastructure financing in addition to state bonds (SUN). The impact of the strengthening of regional autonomy in Indonesia has triggered regional demands that sukuk not only be issued by central government authorities but also by provincial governments. Regulatory, the implementation of regional sukuk has not been supported by the legal basis of the law governing the mechanism and regulation of regional Sukuk. However, as a form of commitment to regional autonomy and equitable development, the Government through the Financial Services Authority (OJK) has established a Regulation on the Issuance of Regional Sukuk in 2017. This study discusses the regulatory aspects of regional sukuk, sharia principle in the operation sukuk, mechanism for issuing sukuk regions, the stakeholders, and the benefits of implementing regional sukuk. The Regional Sukuk Law regulation represents highly necessitate by the regional governments anda communities. Regional Sukuk can encourage the growth of sharia industries in the region, encourage clean infrastructure project governance based on sharia, alternative investment in local communities, and can increase the local revenue capacity.

Abstract

Bapak dan Ibu dapat melakukan kesepakatan perdamaian mengenai kewajiban untuk membiayai dan memelihara anak dikarenakan perkawinan telah berakhir karena perceraian. Kesepakatan perdamaian yang dibuat oleh para pihak dihadapan notaris merupakan salah satu perjanjian yang diharapkan mampu melahirkan kepastian hukum dan menjadi dasar pertimbangan hakim dalam menjatuhkan putusan. Oleh karena itu perlu untuk meneliti dan menganalisis kekuatan pembuktian surat kesepakatan perdamaian serta kedudukan hukum di Pengadilan. Bentuk penelitian yang digunakan yuridis normatif yaitu penelitian yang secara khusus meneliti hukum dan mengadakan sistematisasi terhadap bahan-bahan hukum tertulis pada data sekunder untuk menjawab permasalahan. Hasil analisis adalah surat kesepakatan perdamaian yang legalisasi oleh notaris, mempuyai kepastian tanggal dan tanda tangan para pihak dan isi akta tersebut dan surat kesepakatan perdamaian batal demi hukum karena tidak sesuai dengan syarat-syarat sah perjanjian

The birth of Islamic financial service technology innovation (Shari'ah Fintech) has provided a lot of convenience. In practice, the community can carry out the financing collaboration process without having to meet face-to-face. However, behind all these conveniences, it is not widely known to what extent this sharia fintech application service is in accordance with the provisions of the DSN MUI Fatwa No. 117/DSN-MUI/II/2018 and also Islamic law, or is not in accordance with the legal provisions stipulated apply. This study aims to analyze the provisions of the MUI DSN Fatwa and Islamic Law on the fintech application services of PT. Ammana Fintek Syari'ah. The research method used in this study is normative juridical using a qualitative descriptive approach, namely research that aims to analyze the provisions of the Fatwa of DSN MUI and Islamic Law in theory and practice in the field. Based on the results of the study, it was found that the fintech services at PT. Ammana Fintek Syari'ah as a whole has conformity, as stated in the DSN-MUI Fatwa No. 117/DSNMUI/II/2018, including for points of general provisions, legal provisions, legal subjects, provisions related to general service guidelines and provisions related to mechanisms. contract. Meanwhile, according to Islamic law, the presence of fintech services at PT. Ammana Fintech Syari'ah has provided benefits for many people. There are two things from the five points of maqashid sharia that are maintained by the existence of PT. Ammana Fintech Syari'ah, namely, hifz al-mal (protection of property), and hifz al-nafs (protection of the soul).

Abstract

Problem mendasar berkaitan dengan wakaf di Indonesia salah satunya adalah aset wakaf yang tidak produktif dan nazhir yang tidak profesional. Dalam hal ini seharusnya nazhir mampu mengelola wakaf dengan baik seperti tugas dan wewenang nazhir yang sudah disebutkan dalam undang-undang No. 41 Tahun 2004. Didalam undang-undang juga disebutkan seharusnya nazhir mendapatkan pendampingan atau bimbingan dari BWI yang sudah menjadi tugas BWI dalam aturan Undang-undang tentang wakaf. Maka, seharusnya jika BWI sudah menjalankan tugas dalam membina nazhir secara profesional akan terbentuk nazhir yang bagus, dan profesional sehingga dapat mengelola wakaf dengan baik. Penelitian ini membahas dua hal yaitu: pertama, bagaimana peranan Badan Wakaf Indonesia dalam membina nazhir profeaionalitas? kedua, mengapa masih banyak wakaf di Indonesia yang nazhirnya belum dapat mengelola wakaf dengan baik dan professional sebagaimana aturan yang dijelaskan dalam UU No. 41 Tahun 2004 tentang peranan Badan Wakaf Indonesia? Adapun metodologi penelitian yang digunakan penulis adalah penelitian hukum yuridis. Sumber data yang digunakan adalah data primer dan data sekunder. Analisis data yang digunakan adalah penelitian kualitatif.

Abstract

The synergy between Sharīʿah fintech regulation and halal tourism must be grounded in the objectives of Islamic law (maqāṣid al-sharīʿah), which prohibit usury (ribā), uncertainty (gharār), and gambling (maysir), to foster a fair, transparent, and sustainable economic ecosystem that empowers local communities. In practice, however, this synergy faces several challenges, including regulatory oversight gaps, superficial Sharīʿah compliance, cross-sectoral regulatory fragmentation, low levels of Sharīʿah financial literacy, and limited digital infrastructure. In Indonesia, Sharīʿah fintech is regulated by POJK No. 77/2016 on technology-based lending services, DSN-MUI Fatwa No. 117/2018 on Sharīʿah-compliant fintech operations, and PBI No. 19/2017 concerning fintech implementation and financial system stability. Halal tourism, meanwhile, is governed by Law No. 33/2014 on Halal Product Assurance, which mandates halal certification for goods and services, including tourism-related activities. This normative legal research employs legislative, conceptual, and analytical approaches, drawing on primary and secondary legal materials obtained through literature review and document analysis. The findings indicate that regulatory integration between Sharīʿah fintech and halal tourism is essential for promoting sustainable and inclusive economic growth. Such synergy enhances transparency, accountability, and trust, while enabling halal tourism operators to access ethical financing through instruments such as muḍārabah and mushārakah. Ultimately, this collaboration strengthens Indonesia’s national halal ecosystem, supports SMEs, enhances economic development, and increases global competitiveness in halal market.
