Abstract

Hukum secara kompre­hen­sif sebagai suatu sistem yang terintegrasi menjadi sangat penting untuk dilakukan. Strategi pembangunan hukum ataupun pembangunan nasional untuk mewujudkan gagasan Negara Hukum (Rechtsstaat atau The Rule of Law) juga tidak boleh terjebak hanya berorientasi membuat hukum saja, ataupun hanya dengan melihat salah satu elemen atau aspek saja dari keseluruhan sistem hukum. konsepsi Negara Hukum Indonesia yang diamanatkan dalam UUD 1945, terutama sekarang telah ditegaskan dalam rumusan ketentuan Pasal 1 ayat (3) UUD 1945. Semua lembaga atau institusi hukum yang ada hen­daklah dilihat sebagai bagian dari keseluruhan sistem hukum yang perlu dikembangkan dalam kerangka Negara Hukum itu, bangsa Indonesia perlu menyusun suatu blue-print, suatu desain makro tentang Negara Hukum dan Sistem Hukum Indonesia yang hendak kita bangun dan tegakkan di masa depan.

Abstract

This paper discusses mediation and hakam (peacemaker) in procedural law the Religious Courts. This article uses the legal approach and it is analyzed by qualitative descriptive method. The results showed that mediation is a step that is carried out through the Islamic Court judges mediators to facilitate dialogue, assist the parties to clarify the needs and desires of justice seekers, set up guide, assist the parties in rectifying differences of views and work towards an acceptable the parties in the settlement binding.

Abstract

The policy of sanctioning laws and regulations for violations of marriage registration provides space for discourse in both a philosophical and practical context. The understanding of marriages that are not recorded encompasses violations in juridical terminology, as the content of sanctions can have actual implications for the emergence of problematic law enforcement in the field of marriage. This research was conducted to analyze and find out what the juridical implications are for the sanction policies contained in various legal regulations related to violations of marriage registration. The literature study method is the method used in this research, by collecting data through a review of various kinds of legal rules. This study uses a statutory regulation approach in examining regulations related to legal issues regarding sanctions for violations of marriage registration. Several policies that contain sanctions for violations of the legal registration of marriages are considered inappropriate because they cannot be met on a fundamental basis. There is a bias in the authority of law enforcement in the object of this violation of marriage registration. Legal ambiguity can arise in the process of sentencing if it is associated with the content of sanctions that have a tendency not to be in the realm of private law.

Abstract

Breastfeeding is a bonding of a mother to her baby which is natural to meet the basic needs of the baby so that it can grow and develop physically and psychologically properly. Islamic teachings explicitly regulate this in the Qur'an and Hadith, which aim to make the basic life processes of a child follow Islamic law. This study aims to analyze breastfeeding (ar-radha'ah) problems, especially regarding breastfeeding of non-biological children which creates intimacy between mother and child, and contemporary problems related to breastfeeding through the verses of law in the Qur'an based on the opinion of scholars, especially commentators. The research in this paper uses qualitative methods with data collection techniques based on literature study by reading several references such as the Qur'an, hadith, books, and articles, and analyzing the opinions of commentators. The results of this study state that breastfeeding is recommended for mothers to their biological children, but breastfeeding is carried out by mothers to non-biological children, so this breastfeeding has legal implications, namely the prohibition of marriage. Breastfeeding creates friendship between mothers who donate breast milk and babies who are breastfed either through direct suction (tsadyu) or not, even if it's only one suck or by way of fair (sau'ut) which lasts for two years because this will form bones and grow flesh in the growth of the baby so that it will make marriage illegal. In ar-radha'ah include recommendations for breastfeeding, the father's obligation to provide support during breastfeeding, the permissibility of breastfeeding children other than the biological mother, and the nature of breastfeeding.
