Abstract

Yayasan memerlukan akta autentik dalam berbagai keperluan, salah satunya ialah untuk memberhentikan pengurus yayasan. Pemberhentian pengurus dilakukan dengan didahului rapat pembina, yang hasil keputusan rapatnya dibuatkan akta autentik oleh notaris. Akta ini yang kemudian digunakan untuk memberhentikan pengurus yayasan. Pemberhentian tersebut menimbulkan sengketa antara pembina dan pengurus yayasan, dan melibatkan notaris sebagai turut tergugat dalam perkara peradilan. Permasalahan yang diangkat dalam penulisan ini ialah mengenai keabsahan pemberhentian pengurus Yayasan SHT dan kedudukan Notaris sebagai turut tergugat. Untuk menjawab permasalahan tersebut, digunakan tipe penelitian yuridis normatif dengan metode penelitian deskriptif analisis yakni penelitian yang menggambarkan dan menjelaskan permasalahan berdasarkan putusan pengadilan. Data yang digunakan merupakan data sekunder yang diperoleh dari studi kepustakaan dengan bahan hukum primer yaitu peraturan hukum, dibantu bahan hukum sekunder. Hasil analisis disimpulkan bahwa pemberhentian pengurus yayasan harus mengikuti ketentuan yang diatur dalam Undang-Undang Yayasan maupun anggaran dasar yayasan, yang seluruhnya telah dipatuhi dalam proses pemberhentian pengurus Yayasan SHT. Kedudukan Notaris selaku turut tergugat merupakan bagian dari tanggung jawab notaris, karena terdapat pihak lain yang tidak puas dengan akta yang dibuatnya. Kewajiban notaris ialah untuk menjamin kebenaran formil dari akta tersebut, namun permasalahan hukum antara penghadap dengan pihak ketiga bukan merupakan tanggung jawab notaris. Sedangkan sebagai pihak turut tergugat, Notaris hanya dapat menerima dan mematuhi hasil putusan pengadilan yang mengikat tergugat. Sebaiknya seorang notaris menerima pendampingan dalam perkara sebagai turut tergugat, agar dapat menjelaskan batasan tanggung jawab profesi, dan tidak serta merta dituntut untuk bertanggung jawab diluar kewenangannya. Abstract

In essence, the scope of the task of carrying out the position of a Notary is to make evidence as desired by the parties who appear to carry out a certain legal action. The case raised in this study originated from a lease agreement made before a Notary. Based on the applicable laws and regulations, the Notary is obliged to read the Deed in front of an audience in the presence of at least 2 witnesses, or 4 witnesses specifically for the making of a private will, and signed at the same time by the appearer, witness, and the Notary. However, the Notary in this case included the name of a witness in the relevant Lease Deed, even though the witness was actually not present on the day of making, reading, and signing of the deed by the parties. Therefore, one of the parties in the Lease Deed filed a lawsuit against the Notary because he felt aggrieved by the possibility that the Lease Deed would lose its proving power as an Authentic Deed because it did not meet the requirements as regulated in the laws and regulations. The main issue raised in this study is the responsibility of the Notary in including the name of the Instrumental Witness who was not present at the signing of the Authentic Deed and its implementation in the decision of the Rantau Prapat District Court Decision Number 26/Pdt.G/2020/PN RAP. This research is normative judicial research. The type of data used is secondary data obtained through literature study. To further elaborate the main issue, it is further described in the introduction, a discussion of the Instrumental Witness and the responsibilities of the Notary in relation to the inclusion of the name of the Instrumental Witness who was not present at the signing of the Authentic Deed, and closing.

Abstract

One of the powers of a Notary is to be able to make a will as mandated in the UUJN, including making a will before witnesses as regulated in Article 939 paragraph (4) of the Civil Code and making a will without witnesses as regulated in Article 939 paragraph (2) of the Civil Code. A Notary in carrying out a legal action must always act carefully so that the Notary before making a deed must examine all relevant facts in his consideration based on the applicable laws and regulations. The making of a will by a Notary must pay attention to all the provisions regulated or determined in the provisions of the legislation governing the implementation of a will. So that in the future nothing happens that can harm the parties which can then also harm the Notary who made the will. This study focuses on discussing legal protection for will recipients against notaries who do not report a will. This study uses a normative juridical method with a statutory approach and an analytical approach. Legal protection for the beneficiary against a Notary who does not report the list of deeds, namely preventive legal protection and repressive legal protection. If in the making of the will, the requirements and elements have been determined as stipulated in the Civil Code and the Law on Notary Positions, then legal protection for the beneficiary will still exist and reporting is an administrative requirement that must be met.

Abstract

The granting of Building Use Rights (hereinafter referred to as HGB) cannot be given to limited partnerships. This is because the Limited Partnership is a business entity, while what can be granted HGB is a legal entity. HGB is the right to construct or own a building on land that is not one's own for a limited period of time. In Indonesia, this HGB is regulated in the Basic Agrarian Law (hereinafter referred to as UUPA) and those who can own this HGB are Indonesian Citizens (WNI) and legal entities established and domiciled in Indonesia as described in Article 36 paragraph (1 ) UUPA. In practice, there is a policy that allows these Limited Partnerships to own HGB as contained in Circular Letter Number 2/SE-HT.02.01/VI/2019 issued by the Minister of Agrarian Affairs and Spatial Planning regarding the Granting of HGB to Limited Partnerships. This Circular Letter aims to increase investment and encourage economic growth in all regions of Indonesia by granting HGB to Limited Partnerships. This research focuses on discussing the suitability and legal consequences of granting HGB to limited partnerships based on Circular Letter Number 2/SE-HT.02.01/VI/2019. This study uses a normative juridical method with a statutory approach and an analytical approach. This research will explain the granting of HGB based on the UUPA and government regulations, the status of limited partnerships in Indonesia, and the legal consequences of enforcing Circular Letter Number 2/SE-HT.02.01/VI/2019 on obtaining HGB for limited partnerships.

Abstract

This study aims to analyze the effectiveness of these regulations in terms of sanctioning workers in the work environment. The method used in this study is a literature study, in which data are obtained from literature and documents related to the topic under study. Data analysis was carried out using a qualitative approach, namely by analyzing the content of literature and documents related to government regulations and company regulations related to the provision of sanctions letters to workers. The results showed that government regulations and company regulations have an important role in determining the provision of sanctions letters to workers. However, the effectiveness of these regulations in sanctioning workers still needs to be improved. Some factors that affect the effectiveness of these regulations include workers' awareness of the rules, clarity of regulations, and supervision carried out by the company. This study recommends the need for efforts to improve the effectiveness of government regulations and company regulations related to providing sanctions letters to workers, such as increasing workers' awareness of the rules, clarifying regulations, and increasing supervision by companies. Thus, it is expected to create a better working environment and minimize the occurrence of violations of rules in the workplace.

Abstract

This research uses normative juridical research methods which are used to analyze the effectiveness of Law of the Republic of Indonesia Number 2 of 2014 concerning the Position of Notary Public, Law Number 40 of 2004 concerning the National Social Security System and Law Number 24 of 2011 concerning the Social Security Organizing Body for Notary Workers play a crucial role in aiding Notary performance in serving deed making services, such as assisting in preparing for making, registering, and validating private letters and deeds and serving as a witness at the inauguration of a deed (Instrumentair Witness). Workers are a crucial component of a Notary's duties and responsibilities, as they hold a strategic position in the process of creating a document; without workers, the Notary's design cannot be carried out as intended. Therefore, the existence of Notary employees must be taken into account so that they can carry out the Notary's instructions effectively.

Abstract

In every company, always strives to create a cooperative and comfortable work environment for every employee. However, it is not uncommon for disputes or conflicts to occur in a company due to differences of opinion or matters that are not in accordance with the regulations in force in Indonesia. When a dispute occurs, sometimes employees need representatives to convey their aspirations or act on behalf of employees. With the existence of a workers' union in a company, it is intended for all aspirations will be better conveyed and create a harmonious relationship between the Company and employees. Many companies currently have labor unions to improve the welfare of workers, including when there is a dispute over work relations whether it ends in termination of employment or not. By using normative research techniques, this paper is intended to discuss the role of trade unions, especially those that have an impact on termination of employment.

Abstract

Manpower laws and regulations regarding the granting of sanctions letters to workers at PT. X that violates the provisions in the company regulations and/or employment agreement has not been fully implemented. Given the violation committed by the company by providing sanctions letters in the form of warning letters that are not consecutive to workers. Using non-doctrinal or empirical research methods, the main data sources used are secondary data supported by primary data from interviews with several informants and primary legal materials consisting of laws and regulations (Law No. 13 of 2003 concerning Manpower, Perpu No. 2 of 2022 concerning Job Creation, and PP No. 35 of 2021 concerning PKWT, Outsourcing, Rest Time, and Working Time, and Layoffs). This type of research is doctrinal or juridical normative. The nature of this research is qualitative research. So this paper will analyze how effective PP No. 35 of 2021 and Company Regulations are on granting sanctions letters to workers at PT. X and the factors that play a role in the effectiveness of the rule.

Abstract

Dalam pelaksanaan perlindungan bagi para tenaga kerja yang berupa Jaminan Sosial Ketenagakerjaan masih banyak para pekerja yang belum terlindungi, Sehingga sangat rawan terjadinya risiko kecelakaan kerja ataupun kematian yang nantinya merugikan pekerja dan ahli waris. Dalam Undang Undang Ketenagakerjaan dan juga Perlindungan Jaminan Sosial sudah dijelaskan bahwa perlindungan bagi para tenaga kerja wajib dimiliki oleh setiap pekerja baik sektor formal maupun informal, terlebih Untuk melindungi hak tersebut, pemerintah memberikan jaminan sosial berupa Jaminan Kecelakaan Kerja (JKK) bagi pekerja yang mengalami penyakit akibat kerja dan kecelakaan kerja. Kecelakaan kerja dapat menimbulkan dampak yang serius seperti cacat atau berpotensi cacat yang tentunya mempengaruhi kemampuan bekerja. Return to Work merupakan perluasan manfaat pada jaminan kecelakaan kerja, yaitu berupa pendampingan kepada peserta yang mengalami kecelakaan kerja yang menimbulkan cacat atau berpotensi cacat, mulai dari terjadinya musibah kecelakaan sampai dengan dapat kembali bekerja. Tujuan program ini adalah untuk memastikan pekerja yang mengalami kecelakaan kerja dapat mendapatkan pelatihan dan kembali bekerja tanpa takut menghadapi risiko pemutusan hubungan kerja karena kecacatan yang dialaminya.

Abstract

ABSTRAKKesehatan dan Keselamatan Kerja diperlukan seiring dengan perkembangan industri yang membawa serta penggunanan berbagai alat, mesin, instalasi dan bahan-bahan berbahaya maupun beracun. Penggunaan alat dan bahan yang awalnya bertujuan untuk memudahkan pekerja/buruh dalam melakukan pekerjaannya kerap justru menimbulkan peningkatan resiko kerja dalam proses penggunaan/pengerjaannya.  Oleh karena itu perlindungan tenaga kerja bagi pekerja sangatlah penting. Secara garis besar adanya perlindungan tenaga kerja merupakan prinsip dalam pengaturan maupun pelaksanaan kesehatan dan keselamatan kerja. Salah satu prinsip dalam pengaturan maupun pelaksanaan kesehatan dan keselamatan kerja yaitu tanggung jawab pengusaha dan pinsip campur tangan pemerintah/intervensi pemerintah. Tujuan dalam penelitian ini adalah untuk mengetahui peran pemerintah dalam melakukan pengawasan terhadap pengusaha/perusahaan dalam menerapkan sistem menejemen keselamatan kerja dilingkungan tempat kerja dan bagaimana akibat hukum bagi pengusaha yang melanggar peraturan perundang-undangan terkait keselamatan kerja bagi pekerja di tempat kerja. Penelitian ini dilakukan menggunakan jenis penelitian yuridis normatif yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan-bahan kepustakan atau data sekunder belaka. Adapun pendeketan masalah yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan (statue approach) dan pendekatan kasus (case approach). Kata Kunci : Peran Pemerintah, Keselamatan Kerja, Pengawasan, Perlindungan, Tempat Kerja ABSTRAKOccupational Health and Safety is needed in line with the development of the industry that brings with it the use of various tools, machinery, installations and hazardous and toxic materials.The use of tools and materials that originally aimed to facilitate workers in doing their work often actually causes an increase in the risk of work in the process of use / workmanship. Therefore, labor protection for workers is very important.Broadly speaking, the existence of labor protection is a principle in the regulation and implementation of occupational health and safety. One of the principles in the regulation and implementation of occupational health and safety is the responsibility of employers and the principle of government interference / government intervention. The purpose of this study is to find out the role of the government in supervising employers / companies in implementing a system of managing work safety in the workplace environment and how the legal consequences for employers who violate laws and regulations related to occupational safety for workers in the workplace.This research is carried out using a type of normative juridical research, which is legal research conducted by examining library materials or mere secondary data.The short-term problems used in this study are the legislative approach (statue approach) and the case approach (case approach). Keywords: Role of Government, Safety, Supervision, Protection, Workplace
