Abstract

BKM (Badan Keswadayaan Masyarakat) merupakan hibah dari pemerintah dalam program Kotaku (Kota tanpa Kumuh) pada tahun 2014, namun pergantian birokrasi membuat keberlanjutan BKM menjadi tidak jelas. Di Kecamatan Pecangaan hanya 2 BKM yang aktif sementara 12 lainnya non aktif. Kegiatan pengabdian ini bertujuan untuk memberikan pendampingan kepada pengurus BKM di Kecamatan Pecangaan dan menganalisis SWOT BKM Kecamatan Pecangaan. Dari hasil analisis SWOT diperoleh bahwa BKM berada di kuadran III yang mengindikasikan bahwa BKM memiliki peluang tumbuh namun tidak dapat dimaksimalkan karena kelemahan internal yang dimiliki, sehingga diperlukan strategi untuk mengatasi kelemahan tersebut. Beberapa langkah yang dapat ditempuh diantaranya: (1) mengalokasikan laba untuk memberikan bagi hasil kepada para pengurus dengan jumlah yang sesuai; (2) menjalin kerjasama dengan berbagai stakeholder; (3) memperkuat modal sosial yang dimiliki pengurus dan anggota; (4) memanfaatkan bantuan LBH untuk memberikan somasi pada anggota dengan kredit macet.

Abstract

UPK-BKM di wilayah kecamatan Pecangaan mengalami permasalahan Non-Performing Loan (NPL) yang sangat tinggi. Hal tersebut disebabkan karena permasalahan (1) Penyaluran pinjaman dilakukan secara peer-to-peer lending oleh ketua koordinator dengan ketua Kelompok Swadaya Mandiri (KSM) sehingga tidak transparan (2) Penanganan pinjaman dilakukan sentralistik tanpa melibatkan peran masing-masing pengurus (3) Lemahnya sistem kolektibilitas kredit. (4) Tidak mempunyai tata kelola risiko yang baik. Metode pelaksanaan pengabdian dilaksanakan dengan Inhouse Training, pendampingan pembuatan Standar Operation and Procedure (SOP) dan Risk Mapping untuk merubah pola kerja perguliran dana yang terkonstruk sejak lama dengan pola perguliran dana yang baru dengan transparansi melalui center-meeting pada saat pencairan dana serta memasukan unsur Mubadalah atau saling melengkapi atau menggantikan antara suami atau istri ataupun penjamin pada penyaluranya atau penerimaan dana. Kegiatan pendampingan lapangan penanganan perguliran dana yang terlanjur macet (NPL existing) melalui pola rescheduling, reconditioning, restructuring, refinancing. Kegiatan tersebut dilaksanakan selama delapan bulan dengan hasil berupa penambahan perguliran macet baru sebesar 0%. UPK-BKM in the Pecangaan sub-district area is encounter tremendous non-performing Non-Performing Loan (NPL) volumes. This is due to problems (1) Loan distribution is carried out peer-to-peer lending by the head of the coordinator with the head of the Independent Self-Help Group (KSM) that is making lending distribution not transparent (2) Loan handling is carried out centrally without involving the role of each administrator (3) Weak credit collectibility system. (4) Needing good Risk Management. The method of implementing the service is carried out with In-house Training, assistance in creating Standard Operations and Procedures (SOP), and Risk Mapping to change the workflow of fund lending which has been constructed for a long time with a new fund lending flow with transparency through center-meeting at the time of disbursement of funds and including elements of Mubadala is it complement or replace each other between husband or wife or guarantor in the distribution or receipt of funds. Field assistance activities for handling the circulation of funds that are already stuck (existing NPL) through rescheduling, reconditioning, restructuring, and refinancing models. This activity was carried out for eight months with results in the form of an increase in new Non-Performing Financing (NPL) weighted 0%.

Abstract

Oyster mushrooms (Pleurotus Ostreatus) are increasingly in demand in Indonesia due to their ease of cultivation and economic benefits. Oyster mushroom cultivation, which can be carried out throughout the year, does not require large areas of land, and utilizes easily obtained raw materials, provides advantages in the context of urban and rural agriculture and environmental sustainability. However, entrepreneurs in Srikandang Village, Jepara Regency, face challenges in conventional marketing and unattractive packaging design. This research used a qualitative case study approach to identify and develop digital marketing strategies and packaging design improvements. Results show that innovations in packaging design and logo, as well as the implementation of digital marketing strategies through social media, can improve product competitiveness and expand market reach. The implementation increased sales by 20 per cent in three months and improved the digital skills of the entrepreneurs. The programme also brought about positive social and cultural changes, with local communities appreciating digital marketing and packaging design more. The long-term impact is expected to improve the economic and social welfare of the people of Srikandang Village by strengthening the position of oyster mushroom products in the national market.

Abstract

These articles explore various aspects of Islamic marriage law, particularly in relation to the marriage contract and its impact on modern life. The studies cited include comparative analysis of marriage contracts in Islamic law, the application of prenuptial agreements, challenges of Islamic family law in the modern era, and the role of marriage contracts in preventing conflict and building harmony in the household. These studies show that marriage contracts can be an important tool in protecting the rights of married couples and maintaining household stability, although challenges remain in adapting to social and cultural changes. In addition, the studies also examine how premarital education can increase legal awareness among the community, as well as the influence of communication on household harmony through marriage contracts. In a broader context, these studies also discuss the evolution of Islamic family law in various Muslim countries, showing the dynamics between religious law and secular law. These studies make an important contribution to the understanding of the role of law in shaping and maintaining family structures in contemporary Islamic societies. Artikel-artikel ini mengeksplorasi berbagai aspek hukum pernikahan Islam, khususnya terkait dengan perjanjian perkawinan dan pengaruhnya dalam kehidupan modern. Penelitian-penelitian yang dikutip mencakup analisis perbandingan kontrak pernikahan dalam hukum Islam, penerapan perjanjian pranikah, tantangan hukum keluarga Islam di era modern, serta peran perjanjian perkawinan dalam mencegah konflik dan membangun keharmonisan dalam rumah tangga. Berbagai studi ini menunjukkan bahwa perjanjian perkawinan dapat menjadi alat penting dalam melindungi hak-hak pasangan suami-istri serta menjaga stabilitas rumah tangga, meskipun tantangan tetap ada dalam penyesuaian dengan perubahan sosial dan budaya. Selain itu, penelitian juga mengkaji bagaimana pendidikan pranikah dapat meningkatkan kesadaran hukum di kalangan masyarakat, serta pengaruh komunikasi terhadap keharmonisan rumah tangga melalui perjanjian perkawinan. Dalam konteks yang lebih luas, studi ini juga membahas evolusi hukum keluarga Islam di berbagai negara Muslim, menunjukkan dinamika antara hukum agama dan hukum sekuler. Kajian ini memberikan kontribusi penting terhadap pemahaman tentang peran hukum dalam membentuk dan memelihara struktur keluarga di masyarakat Islam kontemporer.

Abstract

This article discusses the optimization of Posyandu Remaja which is a Jepara Regency Regional Government program. This research aims to analyze the role of Posyandu Remaja in improving adolescent life skills and its potential in delaying child marriage using Giddens' structuration theory approach. This research uses qualitative methods with a sociological approach, located in several villages in Jepara Regency. Data was obtained through interviews, observation and documentation. The research results show that optimizing the role of Posyandu Remaja  can be achieved through increasing socialization, innovative activities, and delivering more relevant material. By actively involving teenagers in activities, this program can be more effective in supporting youth empowerment and delaying marriage until a more mature age.

Abstract

       Hadhanah merupakan salah satu hak bagi seorang anak. Hadhanah merupakan kekuasaan hak asuh kepada diri anak meskipun kedua orang tuanya bercerai. Dalam aturan Undang-undang dan hukum islam terdapat beberapa hal yang menyatakan tentang hadhanah yang salah satunya dalam Kompilasi Hukum Islam atau di singkat KHI. Dalam pasal 105 KHI menyatakan bahwa apabila anak belum mumayyiz atau sebelum usia 12 tahun maka yang berhak mengasuh adalah ibu. Peraturan ini juga di jadikan patokan para hakim dalam memutuskan persoalan hadhanah. Namun terdapat perbedaan dengan Hukum Islam. Hal ini yang akan di kaji oleh peneliti adalah terkait batas usia hak asuh anak pasca perceraian. Dengan menggunakan metode pendekatan yuridis normatif dan bersifar analisis deskriptif yang akan menelaah lebih lanjut KHI pasal 105. Hasil penelitian menyatakan bahwa usia 12 tahun merupakan usia yang ideal bagi anak untuk memilih yang baik dan buruk terhadap dirinya. Karena anak akandi suruh memilih siapa yang lebih berhak mengasuh kedepannya.   Selain itu juga para hakim melakukan pertimbangan mana yang lebih baik bagi kepentingan anak. Seperti pendidikan moral, kasih sayang serta lingkuagan yang positif.

Abstract

Marriage in Islam is a sacred bond recognized by law and religion, but many marriages are not officially recorded, necessitating marriage validation (isbat nikah) for legal recognition. This study aims to identify the challenges in implementing isbat nikah and the mechanisms for resolving them at the Jepara Regency Religious Court, as well as to analyze the applied Islamic law and positive law approaches. Using a descriptive-analytical qualitative approach, data were collected through in-depth interviews with judges, clerks, and petitioners, non-participatory observation of court proceedings, and document analysis of 15 isbat nikah case files from 2022–2023. Data analysis followed the Miles and Huberman interactive model, involving data reduction, presentation, and conclusion drawing with verification through triangulation. The findings reveal key issues, including low legal literacy among the public, particularly regarding witness and document requirements, and limited access to legal services and e-Court technology, with isbat nikah requests being reactive for administrative purposes. The Jepara Religious Court addresses these issues through educational approaches, tolerance for incomplete evidence, and collaboration with village governments, guided by Law No. 1 of 1974 (amended by Law No. 16 of 2019) and the Compilation of Islamic Law. The discussion highlights that this approach reflects the principle of maslahah, but challenges in legal literacy and technology access require cross-institutional collaborative strategies to enhance the effectiveness of isbat nikah and public legal awareness

Abstract

This study examines the differences in the determination of the timing of ṭalāq between the Compilation of Islamic Law (KHI)—as a codified representation of Islamic law in Indonesia and the views of classical scholars, particularly those of the Shafi’i school. The focus of the study lies in how each legal system defines the moment when ṭalāq is considered valid and legally effective, as well as its legal implications on the rights of husbands and wives and the integrity of the family institution. This research adopts a juridical-normative approach and applies a descriptive-analytical method, drawing from literature reviews of classical fiqh texts, statutory regulations, and relevant scholarly journals. The findings indicate that, according to the Shafi’i school, ṭalāq is considered to take effect immediately upon the husband’s pronouncement of a valid ṭalāq, whether expressed explicitly (ṣarīḥ), which requires no accompanying intention, or implicitly (kināyah), which must be accompanied by intent. In this context, the legal effect of ṭalāq does not depend on court proceedings or administrative registration; rather, it hinges on the husband’s verbal expression and intention as the substantive conditions for validity. Conversely, under the KHI, ṭalāq is only deemed valid if it is formally declared by the husband before a panel of judges during a Religious Court session. Any ṭalāq pronounced outside this official mechanism, such as privately or informally, has no legal standing, even if stated verbally by the husband. This divergence reflects a shift in legal paradigms: from a substantive-textual approach in classical jurisprudence to a formal-procedural approach in contemporary, institutionalized Islamic law. The KHI emphasizes women’s protection and legal certainty within the household, while the Shafi’i school focuses more on the authority of the husband and the spiritual-legal meaning of ṭalāq. Therefore, this study highlights the importance of harmonizing classical fiqh values with the demands of modern legal frameworks, ensuring that Islamic law remains contextual, just, and responsive to the evolving dynamics of contemporary society.

Abstract

This study explores the concept of Hifz an-Nafs (protection of life) in Islamic law and its relevance to the legal protection of children who are victims of sexual violence in Indonesia. Utilizing a qualitative-descriptive approach, the research compares Islamic legal norms with national legal frameworks, especially Law No. 35 of 2014 on Child Protection and Law No. 12 of 2022 on Sexual Violence Crimes. The findings indicate that although Hifz an-Nafs offers a holistic and moral-spiritual foundation for protecting the dignity and safety of children, its application in practice remains largely symbolic. In contrast, the implementation of national law, while structurally adequate, still suffers from exclusivity and access inequality. The study also identifies how social and ideological boundaries—such as religious conservatism, family honor, and community stigma—hinder victims’ access to justice and reinforce protection for perpetrators. These boundaries contribute to the fragmentation of communal protection mechanisms, weakening both legal enforcement and moral solidarity. This research emphasizes the need for an integrative model that combines Islamic ethical principles with the inclusiveness of modern legal systems to achieve effective and compassionate protection for children.

Abstract

Despite the enactment of legal restrictions on early marriage, the issue persists, particularly in rural areas of Central Java, where rates have increased. This study's main problem is the significant knowledge gap regarding how formal age-restriction policies are mediated and often undermined by deeply ingrained social and cultural norms at the community level. While previous studies have provided a broad overview of the impacts, they often lack a nuanced, micro-level understanding of the complex tensions between policy intentions and local realities. This research, therefore, provides a focused, qualitative analysis of the socio-economic dynamics of early marriage in a specific case study of rural Jepara, Indonesia. The study’s primary objectives were to analyze the social and economic impacts of the policy, identify community-level challenges, and offer actionable recommendations. A qualitative case study design involved in-depth interviews with 30 purposively selected informants, including adolescents, parents, community leaders, and government officials. The data, collected through interviews and observations, were analyzed using thematic analysis. The findings reveal a compelling tension between the policy's aims and strong traditional norms, such as the stigma of delaying marriage. While the policy has positively influenced families to prioritize education and long-term economic welfare, social pressure has significantly hampered its effectiveness. This study's unique contribution lies in its in-depth exploration of this tension, providing a grounded basis for future policy and community interventions. The conclusion clarifies how these findings address the research objectives and offers concrete recommendations for a more holistic approach that combines legal measures with targeted, community-based support and dialogue.
