Abstract

This article attempts to answer why FPI's relationship with Dayah in Aceh is so close. This condition is seen in contrast to several other areas in Indonesia that are seen to experience frequent collisions. This article shows that the relations between FPI and Dayah groups in Aceh occurred for several reasons: first, the FPI organization in Aceh was led by Dayah people and used the Dayah santri network as a mass base. When FPI entered Aceh, the idea was rejected by some senior Acehnese scholars. After FPI succeeded in approaching young people from the Dayah circles, such as Muslem Attahiry, FPI's progress was seen to be very strong and succeeded in establishing its influence in some Dayah. Second, FPI in Aceh has the right space on the issue they are raising, namely Islamic Syari'at. Politicians who need an image of taking sides with shari'ah need to use FPI, either directly or indirectly. Third, the character of Acehnese people who are fanatical and like religious symbols so they don't care less about FPI's background. The people of Aceh will accept it as long as they (FPI) wrap their actions and agendas with narratives and religious symbols.

Abstract

Qanun Gampong Durian Kawan, South Aceh Regency Number: 05 of 2018 concerning Management and Utilization of Natural Resources (Forest and Water Maintenance Customs) is one of the reusam codification efforts which usually regulates people’s behavior regarding habits carried out by the community in an unwritten form. However, what should be suspected is whether the gampong qanun has gone through the applicable legislative process. The main problem in this study is how the process of forming the Qanun Gampong Durian Kawan is and how the suitability of the process of forming the Qanun is reviewed with the South Aceh Regent Regulation Number 77 of 2017. The methodology in this research uses a qualitative research type with a descriptive approach. The results show that the process of forming Qanun Gampong Durian Kawan, South Aceh Regency Number: 05 of 2018 concerning Management and Utilization of Natural Resources (Forest and Water Maintenance Customs) through 4 stages, namely first, pre-design phase by collecting community aspirations, second, design phase through deliberation with various levels of society, third, the stipulation phase, namely ratifying the qanun based on the results of deliberation decisions and fourth, the promulgation phase, namely signing by the keuchik. Judging by the guidelines for the formation of gampong legal products in South Aceh, in principle, they are appropriate because they use the principle of deliberation, but from a systematic and technical perspective there are still many that are not in accordance with South Aceh Regent Regulation Number 77 of 2017.

Abstract

Maraknya penolakan dari masyarakat terhadap pemberian dana pensiun bagi pejabat tinggi negara yang hanya menjabat selama 1 periode (5 Tahun) namun mendapatkan hak pensiun seumur hidup, hal ini tentu bertentangan dengan kondisi masyarakat indonesia saat ini. Sangatlah tidak etis memberikan hak kepada kelompok atau perorangan secara berlebihan, tanpa mempertimbangkan aspek keadilan, dan kemanfaatannya. Berdasarkan permasalahan tersebut, Penelitian ini bertujuan untuk mengetahui bagaimana penerapan pemberian dana pensiun bagi Pimpinan dan Anggota Lembaga Tinggi Negara di Indonesia, dan bagaimana tinjauan maqāsid syarīah terhadap pemberian dana pensiun bagi pimpinan dan Anggota Lembaga Tinggi Negara. Dalam penelitian ini penulis menggunakan metode Yuridis Normatif, dengan pendekatan Perundang-undangan, pendekatan konsep, dan pendekatan perbandingan. Penelitian ini menggunakan kajian pustaka (library research). Adapun hasil penelitian yang didapat adalah Besaran uang pensiun Pejabat Tinggi Negara didasarkan pada Surat Menteri Keuangan No S-520/MK.02/2016 dan Surat Edaran Setjen DPR RI No KU.00/9414/DPR RI/XII/2010. Besaran uang pensiun Pejabat Tinggi Negara yakni 60 persen dari gaji pokok setiap bulan. Adapun besaran uang pensiun menurut Surat Menteri Keuangan yaitu setiap mantan anggota MPR, dan DPR akan mendapat sebesar Rp 2.5 juta hingga Rp 3.02 juta per-bulannya setelah tidak menjabat. Selanjutnya hasil penelitian ini menunjukkan bahwa Pemberian dana pensiun bagi pejabat tinggi negara belum sesuai dengan konsep maqāṣid al-syarī’ah, karena pemberian dana pensiun tersebut lebih banyak mendatangkan mudaratnya, seperti bertambahnya beban APBN, pembengkakan utang negara, pemborosan dana, serta kesenjangan sosial.

Abstract

This research aims to elaborate on the standing of Islamic law regarding regional head post-filling and how this post-filling is designed to conform with the principle of Islamic law. This research employed mixed methods and statutory, conceptual, case, and normative-theological approaches. The research results reveal that Islam holds the principles that can be adopted into the constructions of the national law in the matter of regional head post-filling. In the time to come, this post-filling should conform to the principle of al muhafadhotu ala qodimis sholih wal akhdzu bil jadidil ashlah, in which this post-filling should refer to the applicable model coupled with the development of this model with an asymmetric post-filling system. With this approach, areas with direct regional head elections will face reduction. Consequently, the areas not eligible to establish direct elections should consider another election model.

Abstract

Historically, Indonesia's death penalty does not originate from religious doctrine but a series of democratization processes agreed upon in the legislation. Amidst these processes, two competing opinions respond to Indonesia's death penalty: the retentionist and the abolitionist. These different approaches to address the death penalty, whether imposed or abolished, result in competing perspectives and arguments in regulatory and practical issues both in the national and international arena. This study aimed to revisit the death penalty discourse in Indonesia that opposes the human approach by assuming that the death penalty violates human rights. The data were analyzed in three steps, among other things, unitization, comparison, and conclusion. This study showed that the death penalty remains relevant to Indonesia despite the long struggle of its rejection. It concluded that Indonesia's imposition of the death penalty is regarded as worth defending, with specific and selective applications. The specific application means that the death penalty is applicable for corruptors, drug dealers, terrorists, gross human rights violators, and premeditated murders. Selective application means that a convict sentenced to death must be proven in court with a level of accuracy considered and accepted in law. Abstract

This research examines the neglect of the principle of transparency in Qur'an literacy tests for legislative candidates in Aceh, which has hindered voters from making informed decisions. It explores two key questions: What forms does the neglect of transparency take in the Qur'an literacy test for legislative candidates in Aceh? And what are the causes and impacts of this neglect? The findings reveal that the neglect of transparency occurs in two primary forms: first, the establishment of subjective score standards, and second, the refusal of the Independent Electoral Commission (KIP) Aceh to publicly announce the test results. This issue arises from the absence of regulatory mechanisms that would require KIP Aceh to disclose the test outcomes and from the closed process by which the score standards are determined in collaboration with the Qur'an Reading Test Team. The impact of this neglect is the limited public access to vital information needed to elect legislators with religious competence, a quality of significant importance in Aceh, where religious knowledge plays a key role in qualifying individuals for public office.

Abstract

ABSTRACTThis study aims to examine the presence of the UUPA Guard Team which is generally intended to ensure that the articles in the UUPA run properly. This research uses a type of normative legal research, which is carried out by examining library materials that are focused on examining the application of the rules or norms in the UUPA. Data collection techniques were carried out through library research by reading previous studies and readings related to the development of Aceh's special autonomy, followed by observation, in-depth interviews with key informants and several informants who are closely related to this study. The results showed that the formation of the UUPA Guard Team was important because the work apparatus of the Aceh Government and the DPRA did not specifically have the competence and ability to understand the regulations in the UUPA. The formation of the UUPA Guard Team by both the Aceh Government and the DPRA was due to the demands of the article in the UUPA that every change to the UUPA must go through consultation and consideration of the DPRA and the Governor of Aceh, so that the UUPA Guard Team is expected to provide input to the two institutions when there is an attempt to change the provisions. in the UUPA. The presence of the UUPA Guard Team for the specificity of Aceh did not have a direct impact. This is due to the nature of the Guard Team being only limited to the Aceh government support team which was formed temporarily to provide input on the enactment of the UUPA so far. ABSTRAKPenelitian ini bertujuan menelaah kehadiran Tim Pengawal UUPA yang secara umum ditujukan untuk memastikan agar pasal-pasal dalam UUPA berjalan sebagaiamana mestinya. Penelitian menggunakan jenis penelitian hukum normatif, yang dilakukan dengan meneliti bahan-bahan pustaka yang difokuskan untuk mengkaji penerapan kaidah atau norma-norma dalam UUPA. Teknik pengumpulan data dilakukan melalui library research dengan membaca studi sebelumnya dan bacaan-bacaan yang berkaitan dengan perkembangan otonomi khusus Aceh, dilanjutkan dengan observasi, indepth interview dengan key-informan dan beberapa informan yang berhubungan erat dengan studi ini. Hasil penelitian menunjukkan bahwa pembentukan Tim Pengawal UUPA penting dilakukan disebabkan perangkat kerja Pemerintah Aceh dan DPRA yang ada tidak secara khusus memiliki kompetensi dan kemampuan memahami aturan dalam UUPA. Pembentukan Tim Pengawal UUPA baik oleh Pemerintah Aceh dan DPRA dikarenakan tuntutan pasal dalam UUPA bahwa setiap terdapat perubahan terhadap UUPA maka harus melalui konsultasi dan pertimbangan DPRA dan Gubernur Aceh, sehingga Tim Pengawal UUPA diharapkan dapat memberikan masukan terhadap kedua lembaga tersebut tatkala ada upaya untuk mengubah ketentuan dalam UUPA. Kehadiran Tim Pengawal UUPA terhadap kekhususan Aceh tidaklah berdampak secara langsung. Hal ini dikarenakan sifat Tim Pengawal hanya sebatas tim pembantu pemerintahan Aceh yang dibentuk secara temporer untuk memberi masukan terhadap keberlakuan UUPA selama ini.

Abstract

This study examines the phenomenon of electoral authoritarianism in Indonesia through the lens of the 2024 presidential election victory of the Prabowo-Gibran ticket. Using a descriptive qualitative method, this research analyzes data from mass media and NGO reports to uncover how state power was strategically deployed to benefit one candidate. The findings reveal three core manifestations of electoral authoritarianism: (1) presidential intervention through policies, statements, and political actions in favor of Prabowo-Gibran; (2) active involvement of government officials—including ministers and regional leaders—in campaign activities; and (3) repression of opposition candidates via administrative obstructions and permit cancellations. These practices, although formally legal, violate democratic ethics and principles of electoral fairness, illustrating how legal frameworks were manipulated to maintain regime power while maintaining a façade of democratic legitimacy. The study concludes that Indonesia is experiencing democratic backsliding, marked by executive aggrandizement and strategic manipulation of elections—hallmarks of competitive authoritarian regimes that undermine the democratic process while preserving its superficial mechanisms.

Abstract

The rejection of Rohingya refugees in Aceh at the end of 2023 led to various negative narratives that shaped an unfavorable image of this group in the eyes of the local community. This research argues that such rejection occurred because of the portrayal of Rohingya Refugees as a threat to society. There are two questions addressed: (1) how did social media contribute to the construction of an imaginary enemy against Rohingya refugees in Aceh?; and (2) what factors drove the shift in the attitude of the Acehnese people from solidarity to rejection? This research is conducted descriptively from various sources of literature, social media content, and news in the mass media. It also borrows the netnography method developed by Kozinets to examine the culture and communities that emerge in computer-mediated communication (social media). The findings reveal that rejection of Rohingya refugees occurs in three forms: negative sentiment expressed on social media platforms, media reports of criminal acts committed by refugees, and the perception that the Rohingya refugees were morally problematic. This phenomenon is underpinned by the ineffectiveness of state mechanisms to protect the socio-economic interests of local residents and the absence of a clear national government policy on Rohingya refugees. Consequently, rejection of refugees has led to dehumanization and created an imaginary enemy for local residents to justify their rejection of refugees. Refugees are no longer perceived as human beings, but rather as threats, burdens, or even as savages who lack of human values. Applying the concept of imaginary enemy, this study shows that the community actions justified through the perception of refugees as an exaggerated threat which gradually escalated into fear.
