Abstract

Disharmony among religious communities in the era of globalization has become a focal point for religious observers, as it often gives rise to complex issues in Europe, North America, and other parts of the world. This article will explore the importance of Islamic studies in understanding the complexity of relationships between Islam and other cultures and religions. It will utilize Richard C. Martin's multidisciplinary approach to Islamic studies. The research method employed is qualitative-normative, focusing on literature review and the concepts of cross-cultural dialogue and inclusivity within the context of global religious diversity. The findings of the research indicate that Martin's approach, which advocates for inclusivity and cross-cultural dialogue, is the best way to promote a deeper understanding of religions and to reduce global conflicts. Understanding the historical approach, phenomenological approach, theological approach, comparative religions approach, and structuralist approach is one of Martin's methods to achieve an inclusive interpretation of religions broadly, especially Islam. Such an understanding can lead to better global peace and cooperation. Martin's ideas offer profound insights into how Islamic studies can play a crucial role in building harmony among religious communities, particularly as a means of resolving conflicts through comparative methods. His approach underscores the need for a comprehensive understanding of the historical, social, and cultural contexts of religions to foster mutual respect and cooperation in a multicultural world. Keywords: Resolution, Conflict, Islamic Studies, Harmonization   Disharmoni antar umat beragama di era globalisasi menjadi sorotan para pemerhati agama karena sering kali melahirkan persoalan kompleks seperti di Eropa, Amerika Utara maupun di belahan dunia lainnya. Artikel ini akan mengulas pentingnya studi keislaman (islamic studies) dalam memahami kompleksitas hubungan antara Islam dengan budaya dan agama lain. Artikel ini akan menggunakan pemikiran Richard C. Martin sebagai pendekatan multidisipliner dalam Islamic studies. Metode penelitian yang digunakan adalah metode kualitatif-normatif dengan mengkaji literatur Pustaka (liberary research) dan konsep dialog lintas budaya dan inklusivitas dalam konteks keberagaman religius global. Temuan dari penelitian ini menunjukkan bahwa pendekatan Martin, yang menganjurkan inklusivitas dan dialog lintas budaya, adalah cara terbaik untuk mempromosikan pemahaman yang lebih dalam tentang agama-agama dan mengurangi konflik global. Memahami pendekatan historis, pendekatan fenomenologis, pendekatan teologis, pendekatan perbandingan agama, dan pendekatan strukturalis adalah salah satu metode Martin untuk mencapai interpretasi inklusif terhadap agama-agama secara luas, khususnya Islam. Pemahaman seperti ini dapat membawa kepada perdamaian dan kerja sama global yang lebih baik. Gagasan Martin menawarkan wawasan yang mendalam tentang bagaimana studi Islam dapat memainkan peran penting dalam membangun keharmonisan di antara umat beragama, terutama sebagai sarana untuk menyelesaikan konflik melalui metode komparatif. Pendekatannya menggarisbawahi perlunya pemahaman yang komprehensif mengenai konteks sejarah, sosial, dan budaya agama-agama untuk menumbuhkan rasa saling menghormati dan kerja sama dalam dunia yang Multi-kultural. Abstract

Penelitian ini mengeksplorasi gagasan William A. Graham dan Earle H. Waugh dalam menganalisis teks suci al-Qur'an dan kenabian. William A. Graham menekankan peran al-Qur'an sebagai teks keagamaan yang otoritatif, terutama yang disampaikan secara lisan, dan pengaruhnya terhadap sastra dan percakapan sehari-hari. Di sisi lain, Waugh berfokus pada Nabi Muhammad sebagai figur paradigmatik dan pembawa wahyu. Metode yang digunakan adalah penelitian kepustakaan, yang menggabungkan penelitian dari buku, jurnal, dan referensi digital lainnya. Temuan dari penelitian ini mengungkapkanbahwa al-Qur'an dan kenabian adalah dua konsep yang saling bergantung, dengan signifikansi al-Qur'an yang berasal dari transmisi lisan dan sifatnya yang otoritatif dan Nabi Muhammad dipandang sebagai sosok yang membawa al-Qur'an. Wawasan ini memiliki implikasi praktis untuk memahami al-Qur'an dan kenabian dalam studi agama, dengan menyoroti nilai mempertimbangkan teks dan asal-usul kenabian. William dan Earle menggunakan pendekatan historis sebagai alat analisis untuk menyelesaikan konflik dan menghindari masalah politik dan agama yang kompleks. William dan Earle juga menganggap bahwa Muhammad adalah sosok paradigmatik dan pembawa wahyu yang ekspresif secara teologis.

Abstract

The tradition of tompangan, which was originally a form of social solidarity between residents, has shifted into an informal debt system, with returns exceeding the initial amount given, thus causing injustice and economic inequality. This study discusses the critique of contemporary economic justice and the relevance of Sharia Economic Law to the shift in the tradition of Topangan in Madura. This study uses a qualitative approach with data obtained through interviews and observations. The results of the study indicate that social change and modernization have shifted the traditional value of tompangan, which was originally a grant, into a qardh (debt) contract that tends to be capitalistic. Based on the perspective of Sharia economic law, returns that exceed the amount of the loan can be categorized as usury which is prohibited in Islamic law. This study also found that the community still considers this practice socially legitimate despite the uncertainty and injustice in the return of tompangan goods. Therefore, combining insights from the tompangan tradition with contemporary economic justice theory can open up new perspectives for economic policies that are fairer and more responsive to the needs of local communities and in line with the principles of Sharia economic law.

Abstract

Until now, the religious views of the Indonesian Government, known as official Islam, tend to be masculine and patriarchal in determining laws. The masculinity of official Islam can easily be found in some regulations in Indonesia. The establishment of the Indonesian Congress of Women Islamic Scholars (Kongres Ulama Perempuan Indonesia, KUPI) has introduced a new perspective on gender amid the dominance of official Islamic masculinity. This article focuses on the role and position of KUPI amid the dominance of official Islamic masculinity in Indonesia. Through content analysis and Charles Peirce's theory of knowledge construction, the author found that KUPI has successfully become a center for reproducing female authority in Islamic law. This is achieved by reinterpreting several government rules and policies that tend to be masculine and disadvantageous to women. The success of KUPI as a center for the reproduction of the authority of women Islamic scholars plays a role in revising official Islam. KUPI accomplishes this by offering a new paradigm that embodies the values of justice and gender equality.  Abstrak: Pandangan-pandangan keagamaan Pemerintah Indonesia yang dikenal dengan istilah official Islam selama ini masih cenderung maskulin dan patriarki dalam menetapkan hukum. Maskulinitas official Islam dapat dengan mudah ditemukan dalam sebagian aturan di Indonesia. Penyelenggaraan Kongres Ulama Perempuan Indonesia (KUPI)  memunculkan perspektif baru terkait gender di tengah dominannya maskulinitas Official Islam tersebut. Artikel ini menganalis peran dan posisi KUPI di tengah dominannya maskulinitas Official Islam di Indonesia. Melalui pendekatan content analysis dan teori konstruksi pengetahuan Charles Peirce, penulis berargumen bahwa KUPI telah berhasil menjadi pusat reproduksi otoritas ulama perempuan di Indonesia. Hal ini dicapai dengan melakukan penafsiran ulang terhadap beberapa aturan dan kebijakan pemerintah yang cenderung maskulin dan merugikan perempuan. Keberhasilan KUPI menjadi pusat reproduksi otoritas ulama perempuan ini berperan dalam merevisi Official Islam tersebut. Hal ini dilakukan oleh KUPI dengan menawarkan paradigma baru yang lebih mengandung nilai-nilai keadilan dan keseteraan gender.

Abstract

Samman ritual dance in Sumenep, Madura, is a cultural heritage reflecting the harmonious integration of spirituality and social life in Sufistic Islam. As an artistic expression rich in symbolism, this dance serves as a medium of worship to God and as a tool of social glue within the local community. This research explores two main dimensions of Samman dance: spiritual value and social value. Spiritual value is seen in the harmony of movement, music, and singing, which creates a contemplative space and strengthens the human relationship with the Creator. Meanwhile, social value is manifested through collective participation, solidarity between individuals, and respect for local traditions that enhance the cultural identity of the Madurese community. However, the challenges of modernization, such as the commodification of culture in tourism, can potentially reduce the sacred meaning of this dance. Through descriptive-empirical and qualitative approaches, this study analyses the function of ritual as a dynamic spiritual and social medium. The study concludes that Samman Dance preservation efforts require a holistic strategy involving local communities, the government, and the younger generation to balance traditional preservation and modern innovation. With this approach, Samman Dance can continue to thrive as a symbol of cultural and spiritual wealth that is relevant in the contemporary era.

Abstract

Bali faces challenges in implementing halal product assurance because the majority of its population is non-Muslim, and there is an increasing demand for halal tourism. This study aims to analyze the dynamics of halal food development in Bali in the context of religion, regulation, and local culture. The method is a socio-legal approach with interview techniques, observation, and legal document analysis. The findings show that the interaction between religious norms, state policies, and local culture affects the availability of halal food. The novelty of this study lies in the contextual approach to halal governance in non-Muslim majority areas. Recommendations include increasing halal literacy, supporting MSMEs, and strengthening locally-based halal supply chains.

Abstract

Studi ini fokus membahas dinamika pluralisme hukum Islam dari masa ke masa, mulai dari zaman rasulullah, masa sahabat, hingga di masa kontemporer. Secara umum, pembahasan artikel ini bertujuan menjawab tiga rmusan masalah, apa yang disebut dengan pluralisme hukum? Bagaimana realitas pluralisme hukum Islam yang ada pada masa rasulullah? Bagaimana Pluralisme hukum yang ada masa sahabat hingga masa saat ini? Berdasarkan metodologinya, penelitian ini dilakukan dengan menggunakan jenis penelitian deskriptif kualitatif. adapun jenis dan sumber datanya, penelitian ini menggunakan data primer dan data sekunder. Setelah melakukan analisa berdasarkan teori pluralisme hukum, penelitian ini mendapati beberapa temuan, pertama, pluralisme hukum Islam adalah segala perangkat peraturan atau norma yang secara normatif mengikat kehidupan manusia yang dikukuhkan berdasarkan nilai-nilai Islam, dapat juga berbentuk adat atau kebiasaan namun memiliki relevansi dengan nilai-nilai islam. kedua, pada masa rasulullah. Pluralisme hukum Islam di masa Rasulullah SAW tidak terlalu berkembang seperti yang ada pada masa-masa selanjutnya, seperti era tabi’in, tabi’it -tabi’in, dst. Sumber hukum Islam saat itu bersandar secara langsung pada Al-Quran dan as-Sunnah, jika ada persoalan masyarakat segera dilaporkan kepada Rasulullah. Sedangkan di Era sahabat, terjadilah ekspansi wilayah Islam yang membawa masuknya masyarakat non-Muslim ke dalam kekuasaan Islam. Hal ini memicu perlunya pengaturan hukum untuk mengakomodasi keberagaman yang ada. Pluralisme hukum Islam pada masa Tabi'in dianggap sebagai tahap awal perkembangan hukum Islam, sehingga menjadikan wajah hukum Islam menjadi beragam atau plural seperti sekarang.

Abstract

The compliance of Islamic Financial Institutions (LKS) with Islamic economic regulations is crucial for maintaining the stability and competitiveness of Indonesia's Islamic finance industry. Key regulations—such as Law No. 21 of 2008, OJK regulations, and DSN‑MUI fatwas—are designed to ensure that LKS operations adhere to Sharia principles. However, the implementation of these regulations faces several challenges, including regulatory harmonization, infrastructure readiness, and low levels of public Islamic financial literacy. This study employs a descriptive qualitative approach by analyzing the regulations and their implementation through legal document reviews, regulatory reports, and academic research. The findings indicate that the effectiveness of LKS compliance depends heavily on the role of the Sharia Supervisory Board (DPS), which often encounters issues of independence and competence. Furthermore, both employees' and customers' understanding of Islamic finance emerges as a key factor influencing regulatory adherence. Based on these results, this study recommends enhanced synergy among regulators, the industry, and the public to strengthen Sharia governance, boost DPS competence, and improve Islamic financial literacy. Such efforts are necessary to optimize regulatory compliance and enable the sustainable development of the Islamic finance industry.

Abstract

The duties and functions of BAZNAS are regulated in RI Law Number 23 of 2011 concerning the management of zakat, namely planning, implementing, and controlling the collection of zakat in terms of distributing zakat and utilizing zakat including reporting and being accountable for the movement of zakat. To optimize the duties and functions of BAZNAS nationally, the Government issued a Decree of the Director General of Islamic Community Guidance No DJ. II / 568 / the Year 2004. Based on this decision, Baznas was born and formed for Pamekasan, Bangkalan, Sampang, and Sumenep Regencies on Madura Island. The strategy for procuring HR in the context of revitalizing Regency BAZNAS in Madura based on e-commerce/ digitization of zakat online is carried out following existing regulations, namely BAZNAS Regulation Number 1 of 2019 concerning procedures for appointing and dismissing Provincial BAZNAS and Regency/City BAZNAS leaders and circular letter from the Head of BAZNAS No. 3 of 2018 concerning the dissemination of the decision of the Chairman of BAZNAS number 24 of 2018 concerning guidelines for the management of amil zakat at Provincial BAZNAS and Regency/City BAZNAS. This strategy is not yet fully accommodating to online digitization-based services. The promotion strategy for revitalizing the Regency BAZNAS in Madura based on e-commerce/ online zakat digitalization is carried out directly and indirectly. In online digitization, promotions are carried out by uploading advertisements inviting people to make donations of zakat, infaq, and sadaqah at BAZNAS Regency in Madura through their website and Facebook. The potential application of e-commerce/ digitization of zakat online in the context of revitalizing BAZNAS districts in Madura is not yet representative in serving the collection of zakat, infaq, and sadaqah funds through digitalization online. Empowerment of the Community's economy through online digitization at the Regency BAZNAS in Madura has not yet been carried out because the digital application owned by BAZNAS Regency in Madura is not representative. After all, it is still done directly/manually.

Abstract

This study investigates the academic challenge of reconciling economic development with ecological sustainability in the context of coastal reclamation in Tapakerbau, Sumenep, Indonesia—a process that has generated social conflict, environmental degradation, and distributive injustice. Utilizing the maqāṣid framework, the research employs a qualitative socio-legal methodology, incorporating in-depth interviews, field observations, and analysis of legal documents alongside a review of literature on Islamic environmental jurisprudence (fiqh al-bī'ah). The findings reveal that, despite the brief duration of the reclamation project, it resulted in initial ecological damage, restricted fishermen’s access to coastal resources, and reinforced the dominance of local political and economic elites. This study emphasizes the significance of environmental preservation (ḥifẓ al-bī'ah) as a fundamental objective within the framework of maqāṣid discourse, particularly in the context of contemporary ecological challenges. It highlights the imperative for coastal development models that are inclusive, participatory, and ecologically equitable. Practically, the Tapakerbau case provides a crucial lesson for environmental conservation in Indonesia, emphasizing the importance of addressing sustainable development and environmental justice issues.
