Abstract

Zakat was a rather interesting discussion by economists in developing social islamic financial institutions. This is not a part of zakat's role in the past that really felt good in the era of Rasulullah, Khulafaur Rasyidin and up to Umar bin Abdul Aziz. That umar bin abdul aziz's era claimed to prosper the zakat factor was distributed to a maximum in his era. Therefore, Indonesia's important state as Muslim majority develop a professional zakat. This can start at any point, any region, including the campus code drovers. This work was done to facilitate the paperwork for baznas and laznas to endure. For example, with zakat (UPZ) collection unit under the institution, for example UPZ IAIN Madura, that maximum and optimally fundraising duty. This research used descriptive motode to explore and discover data as to how much UPZ lAIN Madura plays in helping the mustahik. The other role is to minimize the poverty of college students. The UPZ lAIN Madura has at least aided 35 other students of madura with the UPZ lAIN Madura scholarship program by offering educational help to the students who have been allegedly qualified to pass the malacca lAIN Madura selection.   Zakat merupakan pembahasan yang cukup menarik dibahas oleh para pemerhati ekonomi dalam mengembangkan lembaga keuangan Islam berbasis sosial. Hal ini tidak lepas dari peran zakat dalam sejarah di masa lalu yang sangat terasa perannya baik di era Rasulullah, khulafaur rasyidin dan sampai Umar bin Abdul Aziz. Negara yan dipimpin Umar bin Abdul Aziz diklaim makmur faktor zakat didistribusikan secara maksimal di era itu. Oleh karena itu, penting negara Indonesia ini sebagai muslim mayoritas mengembangkan zakat secara profesional. Hal ini bisa dimulai dari semua titik wilayah, termasuk lembaga penggerak zakat dalam naungan kampus. Perkara ini dilakukan dalam rangka mempermudah tugas yang ditanggung BAZNAS dan LAZNAS. Misalnya dengan adanya Unit Pengumpul Zakat (UPZ) yang berada dibawah naungan institusi, seperti UPZ IAIN Madura, sehingga tugas pengumpulan dana zakat berjalan secara maksimal dan optimal. Penelitian ini menggunakan metode kualitatif deskriptif untuk menggali dan menemukan data terkait seberapa besar peran UPZ IAIN Madura dalam membantu para mustahik. Peran lain adalah untuk meminimalisir angka kemiskinan mahasiswa yang masuk kategori miskin di kampus. UPZ IAIN Madura setidaknya telah membantu 35 mahasiswa IAIN Madura dengan program beasiswa UPZ IAIN Madura dengan memberikan bantuan biaya pendidikan kepada mahasiswa yang telah dinayatakan lolos seleksi beasiawa UPZ IAIN Madura.

Abstract

In recent decades, grant disputes have attracted considerable attention because the decisions often present debates and the decisions concluded need to reach decisions that are just and in accordance with applicable legal principles. This article will analyse Decision Number: 48/Pdt.Sus/2011 on grant cancellation. The method used in this research uses a normative juridical approach method by examining the results of the decision. This research aims to understand how Islamic law is applied in grant dispute cases, particularly in the context of grant cancellation between parents and their children. Through this case study, the legal bases used by the court were analysed, including the Compilation of Islamic Law (KHI) and the Compilation of Sharia Economic Law (KHES). This study found that the court's decision refers to Article 212 of the KHI and Article 712 of the KHES which stipulates that the grantor can withdraw the grant after the handover has been carried out on the condition that the recipient agrees to it, this provision does not apply to grants from parents to their children. Grants from parents to their children can be withdrawn as long as the child is still alive, according to article 714 paragraph (2) KHI.

Abstract

This study examines the phenomenon of Islamic legal pluralism in the system and practice of determining inheritance rights among the local Madurese Muslim community, by taking a case study in Rubaru District, Sumenep Regency. This study is a field study conducted based on qualitative research. After analyzing field data, this research found two important findings; First, the distribution of community inheritance in Banasare and Mandala villages is in accordance with KHI and Islamic law, because customary law was abolished after Islamization, thus affecting the community's hereditary beliefs and practices, as well as cooperation between Islamic culture and religion; Second, according to customary law the inheritance system among the local Muslim community in Rubaru District, Sumenep is as follows; a) Inherited to those who stay and not inherited to those who migrate as is the case in Basoka Village; b) Given entirely to men, because boys have a big responsibility in life and supporting their wives, as is the case in Karangnangka village; c) given entirely to women such as in Tambaksari village because the traditional inheritance of Rubaru District follows the individual inheritance system because when the property is distributed it can be divided among the heirs so that it is included in the parental kinship system in which descendants who come from the genealogy live parent. Studi ini mengkaji fenomena pluralisme hukum Islam dalam sistem dan praktik penetapan hak waris di kalangan masyarakat muslim lokal Madura, dengan mengambil studi kasus di Kecamatan Rubaru Kabupaten Sumenep. Kajian ini merupakan studi lapangan yang dilakukan berdasarkan jenis penelitian kualitatif. setelah melakukan analisa data lapangan, penelitian ini mendapati dua temuan penting; Pertama, pembagian waris masyarakat di desa Banasare dan Mandala sesuai dengan KHI dan hukum Islam, karena hukum adat dihapuskan setelah Islamisasi, sehingga mempengaruhi keimanan dan praktik turun-temurun masyarakat, serta kerja sama antara budaya Islam dan agama; Kedua, menurut hukum adat sistem pewarisan di kalangan Masyarakat Muslim lokal di Kecamatan Rubaru Sumenep adalah sebagai berikut; a) Diwariskan kepada yang menetap dan tidak diwariskan kepada yang merantau seperti yang berlaku di Desa Basoka; b) Diberikan sepenuhnya kepada laki-laki, karena anak laki-laki memiliki tanggung jawab yang besar dalam hidup dan menghidupi istri seperti yang terjadi di desa Karangnangka; c) diberikan seluruhnya kepada perempuan seperti di desa Tambaksari karena warisan adat Kecamatan Rubaru mengikuti sistem pewarisan perseorangan karena pada saat pembagian harta dapat dibagi-bagi di antara para ahli waris sehingga menjadi termasuk dalam sistem kekerabatan orang tua yang di dalamnya tinggal keturunan yang berasal dari silsilah orang tua. Abstract

The tompangan tradition in Sumenep, Madura, is a long-standing form of communal cooperation involving exchanging money and goods. However, on November 12, 2023, during a bahsul masā’il session, the Sumenep branch of Nahdlatul Ulama (PCNU), led by KH. Hafidzi Syarbini declared that the practice is “permissible but prohibited.” This ruling reflects growing public concerns over its negative effects, as tompangan has increasingly shifted from social solidarity toward profit-oriented practices that burden families economically. The study examined the transformation through the lens of maqāṣid al-syarī‘ah using Jasser Auda’s systemic approach. Employing a socio-legal, qualitative-exploratory method, data were collected through interviews and literature review. The findings reveal a shift in value from social to profit-driven orientations; many transactions have become individualistic, self-serving, and textually exclusive, neglecting broader ethical and social considerations. As the result, this shift fails to realize both the al-hadaf (immediate goals) and al-gayah (ultimate purposes) of Islamic law, diverging from Auda’s systemic interpretation of the maqāṣid. The study contributes by framing tompangan, not merely as a socio-cultural phenomenon but also as a legal-ethical case that illustrates the tension between ʿurf and the higher objectives of Islamic law. The findings enrich contemporary Islamic legal discourse by offering the systemic maqāṣid framework as a critical analytical tool for evaluating socio-religious practices.

Abstract

This study examines the philosophical dimensions in the development of Sharia economic law methodology by highlighting three main aspects: ontological, epistemological, and axiological. The purpose of this research is to formulate a methodological framework capable of integrating the normative Islamic sources based on divine revelation with scientific rationality and empirical perspectives within the discipline of economics. Methodologically, this normative-legal study employs a qualitative approach through a philosophical–integrative library research method. This approach involves a critical analysis of classical and contemporary literature on Islamic law, economic theory, and the philosophy of science, to formulate the relationship between spiritual and material realities, as well as between transcendental values and the empirical realities of the economy. Through this approach, the research is not only descriptive of the methodology of Sharia economic law but also constructive in formulating the direction for developing an adaptive Sharia economic law methodology in response to modern socio-economic dynamics. The findings show that, ontologically, Sharia economic law is rooted in the integration of spiritual and material realities; epistemologically, it combines revelation, rationality, and empirical understanding as the foundation of legal knowledge; and axiologically, it emphasizes justice, balance, and public benefit (maṣlaḥah) as its normative orientation. Thus, this study contributes to strengthening the philosophical foundation while providing a conceptual direction for the development of Sharia economic law methodology that is holistic, adaptive, and grounded in Islamic ethical values consistent with the maqāṣid al-sharī‘ah, ensuring its continued relevance to contemporary global economic challenges.

Abstract

The issue of brankrupt BMT is problematic since its settlement deals with a dilemma in which the goverment is irresponsive to that issues and the protection of customers’ fund is necessary. It is important to have a regulation of legal protection upon the brankrupt small and medium enterprises, such as BMT, dealing with a fact that many BMTs are brankrupt without having a substitutive funds. This article depicts a condition in which two BMTs in Yogyakarta, BMT Sabilul Muhtadin and BMT Al-Muthi’in, are assumed as having brankrupty, and the ways both of them made a legal protection to their customers and had some ways of settlements of their rights after that brankrupt situation. Keywords: Protection, Baitul Maal wat-Tamwil, Brankrupty
