Abstract

This article explores the crisis narrative surrounding the erosion of democracy in Indonesia, with a particular emphasis on political and ethical responsibilities. It examines the prevailing consensus on the consequences, factors, and conceptualization of democracy, especially concerning political trust and ethical governance. The discussion underscores how democracy evolves by deconstructing and reshaping societal structures, drawing on Kantian philosophy and the core pillars of democratic society. The paper highlights the inherent flaws in democratic principles, demonstrating how these imperfections permit varying degrees of freedom within societal practices. It advocates for the value of cultivating a culture of open, public discourse aboutcollective societal objectives. However, it also points out that the actual practice of lawmaking, implementation, and enforcement often deviates from its doctrinal ideals, particularly when the law’s purported impartiality contrasts with its impact on marginalized communities. These inconsistencies are examined as outcomes of the exercise of political power, illustrating that the law is shaped by political morality and legitimacy rather than being wholly independent. Furthermore, the article delves into the decline of democracy by engaging in dialogue about the process of its deterioration, rather than simply questioning the reasons behind it. This study also explores democracy and philosophy both in theory and practice, framing law as a reflective inquiry into the democratic process. Ultimately, it advocates for the political concepts of democracy to be subjected to scientific analysis and validation.

Abstract

This study explores the moral ontology of law within the framework of Legal Realism, contextualizing law as both a social institution and an institution of justice. Drawing on Joseph Raz's perspectives on practical reason, normativity, and the foundations of norms, the analysis examines how law, as a practical guide, inherently carries moral dimensions in regulating social interactions and pursuing justice. Legal Realism frames law as a dynamic product of human interaction within a social context, while Raz's philosophical insights illuminate the interplay between practical reasoning, normativity, and legal structures. By focusing on the moral underpinnings of legal norms, this paper seeks to address how law as an institution can uphold social legitimacy while meeting the demands of justice. The analysis offers a conceptual framework to understand the role of moral ontology in modern legal systems, particularly in navigating legal pluralism and societal complexity.

Abstract

The purpose of writing this article is to describe the basic concept of liquid democracy and analyze the principles of liquid democracy in digital society based on Jurgen Habermas’ discourse ethics. This study uses a historical-factual method based on the view that humans are historical creatures that develop in thought and experience. Liquid democracy is a system that allows each individual to convey aspirations directly or delegate aspirations to others who are more expert in the decision-making process. The application of liquid democracy in digital society is based on the principles of Jurgen Habermas’ discourse ethics which are divided into two types, namely universal and discourse principles. Universal principles relate to the interests and needs of each individual in the decision-making process. Discourse principles relate to procedures in the decision-making process based on certain norms.

Abstract

In modern states, law is often reduced to merely a tool of power. Many contemporary practices treat law as nothing more than a procedural requirement, disregarding its substantive values and the social conditions of society. This article discusses the validity of law within a political community from Habermas's perspective. According to him, the law must be discursive and stem from rational subjects capable of effective communication. The fundamental questions addressed are: how can law ideally be derived from norms within a political society? And how can law subsequently foster a democratic society? This article employs historical-factual methods, with primary sources drawn from the works of Jí¼rgen Habermas. Habermas used discourse ethics and the theory of communicative action. Data collection is conducted through textual analysis. The article concludes that the validity of law must originate from discursive norms present in society, even though there may be tensions between theory and practice in society.

Abstract

Calligraphy as motifs on sarongs in the santri environment is a challenge because batik motifs with calligraphy are prone to resemble writing that has a sacred meaning and makes the user feel sorry when wearing it. The purpose of this study is to analyze the creative response of contemporary batik artist, Abyan Farazdaq, in creating the motif “calligrafitty”, which is a combination of calligraphy and graffity aesthetics on sarong which is a product of santri culture. The research uses a qualitative approach on Abyan Farazdaq’s batik artwork by collecting data through observation, interviews and visual documentation of artworks. This research show that the artist created a calligraphy pattern, so that the motif cannot be read literally in order to maintain the cultural ethics of sarong users. As a result, the calligraphy motif becomes a form of visual adaptation that maintains the identity of the students and enriches the expression of contemporary batik art.

Abstract

This article examines the intrinsic relationship between law and values through the lens of legal epistemology, focusing on Joseph Raz’s legal philosophy. It investigates how judicial interpretation, shaped by epistemological foundations, influences legal reasoning and outcomes. Central to the discussion are normative challenges in adjudication such as ambiguity, uncertainty, and moral conflict. It also discusses how Raz’s thought of legal authority and the chain of validity among norms provide a framework for evaluating the legitimacy and justification of legal decisions. Raz argues that legal authority must offer independently justified reasons for action, reinforcing the law’s role in maintaining social order. The article further examines how legal structures shape and sustain societal values, positioning legal epistemology not only as a tool for understanding the basis of authority but also as a normative foundation for aligning legal principles with societal values. In conclusion, the research affirms that a robust epistemological approach to law, as proposed by Raz, is crucial for ensuring legitimacy and fairness in legal systems, making legal epistemology indispensable in affirming the normative force of law in contemporary society.

Abstract

Javanese aesthetics embody the concept of beauty as experienced through rasa, a sensibility that integrates physical perception, spiritual intuition, and cultural meaning. Rooted in Javanese philosophical and mystical traditions, rasa serves as the essential criterion in defining aesthetic value. This study explores the manifestation of Javanese aesthetics in the craft of keris hilts made from Tayuman wood (Bauhinia purpurea), believed to possess spiritual potency (tuah). Beyond its fine texture, rich brown hue, and workable density, Tayuman wood is valued for its mystical energy. The unyeng-unyeng motif that concentric grain patterns formed by dormant branch knots is considered the visual and spiritual core of its aesthetic appeal. Using a qualitative research method with a Javanese aesthetic construction approach, this study applies hermeneutic interpretation and symbolic analysis to reveal the multilayered meanings embedded in the artifact. The analysis identifies both exoteric (technical and visual) and esoteric (spiritual and metaphysical) dimensions that converge harmoniously in the crafting process. The Tayuman wood keris hilt thus emerges not merely as an object of visual beauty, but as a symbolic expression of Javanese cultural identity, linking humans, nature, and the spiritual realm through the unity of art, belief, and tradition.
