Abstract

Indonesia, Indonesia is a nation of law that uses a rule of law country (rechtstaat) concept. The concept of rule of law Indonesia set forth in its Constitution, the 1945 Constitution, Article 1 paragraph (3). There is an important element of democracy stated on the Constitution, namely the protection of human rights, that every citizen has the right to enjoy it. One of the rights protected in the Constitution is right to access a good and healthy living environment. For this, the environment needs to be preserved and function through administrative law enforcement. The study uses normative juridical approach with descriptive-analytics, which describes the norms and associated with theories, and opinions of legal experts. The development of a democratic nations of law can be seen from the aspect of law enforcement in particular with environmental administration. In Indonesia, it can be reviewed through the theory of organic states and the theory of pluralist states. Based on the theory of an organic state and looking at the aspects of environmental administration law enforcement in Indonesia, the state has regulated the enforcement of environmental administrative sanctions whereby the state can regulate every activity and/or business in the environmental issues. Therefore, the pluralist state theory recognized a variety of diverse interests  in society that the state has accommodated all citizens rights to a good and healthy environment through pro-environment government policies.

Abstract

Negara hukum di Indonesia sering disebut dengan rechtstaats atau the rule of law. Indonesia dalah ngara hukum dicantumkan dalam Pasal 1 ayat (3) UUD 1945. Bahwa elemen dari demokrasi adalah adanya kebebasan HAM, bahwa setiap warga negara menikmati hak-hak dasar, dalam demokrasi setiap warga masyarakat dapat menikmati hak-hak dasarnya secara bebas. Perkembangan negara hukum demokrasi ditinjau dari aspek penegakan hukum administrasi lingkungan hidup di indonesi adalah dapat ditinjau melalui Teori negara organis dan Teori negara pluralis. Berdasarkan teori negara organis jika melihat dari aspek penegakan hukum administrasi lingkungan hidup di Indonesia negara telah mengatur mengenai penegakan sanksi administrasi lingkungan hidup dimana agar negara dapat mengatur mengenai setiap kegiatan dan/atau usaha dibidang lingkungan hidup. Dilihat dari teori negara pluralis Ditinjau dari teori negara pluralalis ini negara mengakomodasi berbagai kepentingan yang majemuk dalam masyarakat. Bahwa negara telah mengakomodir seluruh hak setiap warga negara atas lingkungan hidup yang baik dan sehat melalui kebijakan-kebijakan pemerintah yang pro lingkungan.

Abstract

Di Laut Natuna Utara, Zona Ekonomi Eksklusif (ZEE) Indonesia tumpang tindih dengan klaim ZEE Indonesia-Vietnam. Fenomena ini berpotensi menimbulkan kerusakan ekosistem laut dan sumber daya ikan di wilayah tersebut serta lingkungan hidup karena tidak terkendalinya kapal gelap yang masuk ke ZEE Indonesia, sehingga juga berpeluang menimbulkan konflik penangkapan ikan illegal yang tidak dilaporkan. Oleh karena itu, fenomena ini memerlukan langkah-langkah pembuatan batasan yang komprehensif dan berbasis prinsip sebagaimana diatur dalam UNCLOS. Tujuan dari penelitian ini adalah untuk menyelidiki penangkapan ikan ilegal di ZEE antara Indonesia dan Vietnam. Hasilnya menunjukkan 155 kapal ikan Vietnam (KIA) dengan bendera Vietnam memasuki zona tumpang tindih klaim Indonesia-VIEZ pada tahun 2023 S.D. Indonesia. Situasi ini tidak hanya mengancam kelestarian sumber daya kelautan Indonesia, namun juga menimbulkan risiko terhadap keamanan maritim dan aktivitas perekonomian lainnya di kawasan.

Abstract

This research explores strategic legal pathways for addressing the unresolved maritime boundary delimitation in East Segment II of the Singapore Strait, a maritime area jointly bordered by Indonesia, Singapore, and Malaysia. The lack of formal delimitation in this segment has resulted in a jurisdictional vacuum, often referred to as a legal grey zone, which has significant implications for state sovereignty, international legal compliance, and regional maritime security. Through a qualitative legal analysis grounded in empirical research methods, this study investigates the intricate legal issues surrounding the Trijunction Point—a critical zone of overlapping claims. As a potential solution, the study supports the application of the Three-Stage Approach, comprising the construction of a provisional equidistance line, adjustment based on relevant geographic and legal considerations, and the application of a disproportionality test. Widely employed in international maritime adjudication, this method is recommended as a viable and equitable framework to facilitate legal certainty, foster regional cooperation, and uphold the rights and obligations of the littoral states involved.

Abstract

The community service program entitled "Distribution of Life Jackets and Marine Safety Education for Students Using Small Boats in Numbing Village" is based on the high risks faced by students in coastal villages who use small boats as their daily means of transportation. Numbing Village, as a coastal area, has limited access to land transportation, so many students rely on small boats to go to school. However, a lack of understanding about marine safety and a lack of safety equipment, such as life jackets, increases the risk of fatal accidents at sea, especially in bad weather conditions. The main aim of this program is to improve student safety by distributing life jackets and providing marine safety education. The distribution of life jackets is expected to reduce the risk of accidents caused by drowning, while marine safety education aims to increase students' awareness and skills in maintaining personal safety while on board. Apart from that, this program also aims to build awareness of the importance of marine safety from an early age. This program involves collaboration with local schools in Numbing Village, the village government, and the local maritime community. With support from various parties, the program can run more effectively in students' daily activities. This activity is carried out through two main steps. First, the distribution of life jackets to students which has a direct impact on their physical protection when they use ships. Second, organizing marine safety education which includes explaining how to use life jackets, steps to deal with emergency situations at sea, and awareness of weather and water conditions. It is hoped that this program can be implemented in other coastal areas in Indonesia to build a better maritime safety culture.

Abstract

Existing global agreements related to forest governance indicate that the current approach centered on promoting synergy among various instruments is insufficient to address the persistent regulatory gaps. One of the most pressing issues is the recurring transboundary air pollution caused by forest fires in Indonesia, which significantly affects neighboring countries. Indonesia’s tropical rainforests, often dubbed the lungs of the world, contribute to approximately 40% of the earth’s oxygen supply, underscoring their global environmental importance. Despite the existence of numerous international treaties that partially regulate forest-related activities, there remains no single, comprehensive international legal instrument that fully integrates all three pillars of sustainable development environmental, social, and economic in the context of forest ecosystems. This study employs a doctrinal legal research method using statutory, conceptual, and case study approaches. It concludes that the fragmented and sectoral nature of existing agreements hinders the achievement of sustainable forest management. Accordingly, this article advocates for a paradigm shift by expanding the scope and mandates of existing frameworks such as the Convention on Biological Diversity (CBD) and the World Trade Organization (WTO) to explicitly include sustainable forest governance. Furthermore, the article emphasizes the importance of cooperative mechanisms in addressing transboundary hazardous air pollution and proposes the establishment of a single, unified international convention on forests. Such a convention would provide a holistic and legally binding framework to strengthen forest protection, promote sustainable use, and enhance international collaboration.

Abstract

Indonesia's recently enacted Measured Fishing (PIT) policy represents an important development in national fisheries governance, transitioning from administrative licensing toward catch limit based management. This article evaluates the policy's compliance with international obligations established under UNCLOS 1982 and UNFSA 1995, using normative legal analysis. The research confirms that Measured Fishing implements the allowable catch concept and incorporates science-based management through quota systems calculated from fish stock assessments. Nevertheless, critical gaps remain. Government Regulation No. 11 of 2023 does not explicitly adopt the precautionary approach required by UNFSA, particularly regarding the management of scientific uncertainty and the establishment of precautionary reference points. The regulation assumes data availability but lacks guidance for situations involving insufficient or unreliable information. To achieve full international compliance, this article recommends: (1) explicitly integrating the precautionary principle into national fisheries legislation; (2) establishing target and limit reference points as specified in UNFSA Annex II; (3) strengthening scientific stock assessment mechanisms; and (4) enhancing vessel monitoring and enforcement systems. By implementing these recommendations, Indonesia can transform Measured Fishing into a comprehensive precautionary fisheries management regime that ensures both legal compliance and ecological sustainability.

Abstract

The community service program conducted in Mapur Village, Bintan Pesisir District, Bintan Regency, represents a concrete effort to address various strategic challenges faced by local communities in optimizing their regional potential. This program was implemented through a series of systematic stages involving active participation from both the community and local stakeholders. The main objective of this activity was to map and develop the potentials of Mapur Village through a participatory approach that positions the community as the primary agents of development. The methods employed included field observation, Focus Group Discussions (FGD), pre-tests, and post-tests to assess the community’s level of understanding regarding their local potentials. The pre-test results indicated that only about 5% of the population were aware of existing potentials beyond the fisheries and tourism sectors. The study further identified several other promising potentials, such as local culinary industries, handicrafts and the creative economy, youth involvement, and the contribution of migrant villagers, all of which play strategic roles in driving economic and social development. Therefore, community-based potential mapping serves as an essential foundation for realizing an independent, competitive, and sustainable rural development model in coastal areas.

Abstract

Halal tourism is growing rapidly worldwide as Muslim travelers increasingly demand services aligned with Sharia principles. The Riau Islands, particularly Penyengat Island with its rich Islamic cultural and historical heritage, hold strategic potential to be developed as a leading halal tourism destination. This study evaluates its readiness using the ACES (Access, Communication, Environment, Services) framework with a descriptive mixed-method approach involving observation, questionnaires, interviews, and documentation. Findings show Penyengat Island achieved a score of 69, categorized as Ready. Accessibility and environmental aspects are strong, but communication remains weak, particularly in halal certification transparency, multilingual information, and digital promotion. Pareto analysis identifies communication and halal food access as priority improvements, while fishbone analysis highlights regulatory complexity, low digital literacy and language skills, limited halal technology, and insufficient community support as key challenges. Based on these findings, development strategies should focus on enhancing communication, simplifying regulations, improving human resources, and adopting digital technology to strengthen the sustainable competitiveness of halal tourism on Penyengat Island.
