Abstract

Metode penjualan barang dan produk jasa dengan sistem Multi Level Marketing telah dipraktikkan oleh masyarakat, namun belum dapat dipastikan kesesuaiannya dengan aturan fiqh muamalah. Oleh sebab itulah DSN MUI mengeluarkan fatwa NO: 75/DSN MUI/VII/2009 tentang panduan penjualan langsung berjenjang syariah termasuk MLM di dalamnya. Secara umum fatwa tersebut berisi larangan penipuan (gharar), perjudian, riba, dharar, dzulm, maksiat dan ketidakadilan dalam transaksi muamalah. Selain itu produk yang diperjualbelikan harus halal, dalam perekrutan anggota tidak ada unsur yang melanggar aturan Islam dan dalam pengupahan harus sesuai beban kerja serta tidak ada unsur money game di dalamnya. Fatwa DSN MUI ini memiliki peran penting dalam menjamin kenyamanan, keamanan dan kehalalan bertransaksi via MLM karena masyarakat akan merasakan kepastian hukum dan aman dari transaksi yang merugikan.

Abstract

Qardl hasan is the treasure given by the debt provider (muqridh) to the debt recipient (muqtaridh) then to be returned to them (muqridh) according to the amount received when he has been able to pay without obligation to pay interest or other benefits, because in qardl actually there is no clause with coercion where one side does not abuse the other. Muqtaridh is only burdened with paying off debts as big as the loan within a certain period. However, muqtaridh is recommended to return the better of debts to muqridh. Because the essence of qardl hasan is to reward Allah for Islamic interests, and of course the repayment is not same as the repayment made by humans. In this case of Islamic banking represented by Bank Muamalat Indonesia has completely arranged matters relating to qardl hasan which are generally in accordance with the rules in fiqh. If qardl hasan is implemented properly and those distributions of funds can reach all levels of middle to lower class in society, so it will be the solution for the economic progress in society.

Abstract

Polygamy has been a debate among some scholars of Islam about whether or not to allow it.After investigation, the actual points of that debate can be found in the practice of polygamy that happen in society. Gender activists who disagree and opposed poligamy actually oppose the practice of polygamy that opposes polygamy lies in the practice of polygamy that oppressdespoticalyto women.Hence the verse about the permissibility of polygamy should not be deprived to legalize the satisfication of the sexual libido of mens.Otherwise, thatverse should be placed in the study of sharia law that releases with no disregard the historical aspects of the practice of polygamy which is exemplified by the Prophet.With this perspective, the dimensions of morality in the verse of polygamy become the central point for consideration,because, the law without ethics is a wicked, and ethics without law is justutopia that far from harmonious and desirable social regulation building.Necessarily Muslims, who want to polygamy, not only follow the Sharia law but also followthe regulations of law that applied in Indonesia.

Abstract

Politics is a means to bring goodness and refuse damag but some unethical behavior of politicians who tend to justify any means of obtaining and sustaining power have shaped the bad stigma among society that politics is closely related to lies,tyranny and corruption. So as if there are a thick wall that became the separator between ethics and politics.Therefore, need to reaffirm the Islamic concept of political ethics of government and society in reviewing political ethics in this paper. The author did the study on the thought santri Ma`had Aly PP . Salafiyah Syafi`iyyah Sukorejo of Situbondo written in the book Fiqh Progressive. After the discussion was found that in the view of Santri Mahad Aly, a leader should always prioritize the importance of people, make a policy that leads to justice and benefit, did not anarchic to the people and must be mandate in maintaining people's trust and in using state facilities. While the people's political ethics must support and select leaders based on quality, capability, and justice, was not because of money. When leaders make mistakes so the people must submit a polite and constructive criticism.

Abstract

Syekh Muhammad Nawawi Banten is a figure of the Indonesian Ulama who has a major contribution in Islamic law and the formation of national character. His works cover various disciplines. Syekh Nawawi is one of the scholars who are able to combine science of jurisprudence and tasawwuf. In his Sufi fiqh thinking there are a number of moderation values that affect peace. This study uses literature and conceptual studies. The values of moderation in fiqh thinking include always trying to minimize differences of opinion, tolerant in the midst of differences of opinion madzhab, be careful (ihtiyath) in setting the law, and not fanatic madzhab. While among moderate thoughts in Sufism is the teaching about the combination of Shari'a, Tariqot and the nature, between tawakkal and endeavor in seeking income. The values of moderation in the thought of fiqh and tasawwuf Shaykh Nawawi Banten are very influential in shaping the nation's character and creating peace. This can be seen from the moderate thinking of his students who have extraordinary influence in Indonesia. The thought of fiqh and Sufism Shaykh Nawawi can foster tolerance, mutual respect amid differences, enthusiasm for work and discipline in all activities.

Abstract

Abstract This paper is intended to answer questions related to wasathiyah values, wasathiyah relations and peace, Islamic wasathiyah values ​​in Islamic boarding schools as a modality for pesantren in realizing world peace, and how to promote it as a solution for world peace. After conducting the analysis, it was concluded that moderation (wasathiyyah) is a characteristic of Islam which is a combination and unification of the concepts of ta'adul, tawazun and tawassuth in every pattern of thought, pattern of action, and behavior. At the practical level, the form of moderation in Islam can be classified into four areas of discussion, namely, moderate in matters of aqidah, moderate in matters of worship, moderate in matters of temperament and character, moderate in matters of the formation of the Shari'a. Promoting and campaigning for wasathiyah values ​​through pesantren education can prevent the emergence of radicalism in Indonesia and Muslim-majority countries in general. The promotion of wasathiyah Islam as strategic communication has an important role in maintaining Islamic education. Promoting wasathiyah in the context of Islamic boarding school education requires a balance between the process of delivering information and the process of self-transformation and the system. Knowledge sourced from the scientific tradition of Islamic boarding schools, when disseminated and interpreted in accordance with the wasathiyah concept, will eventually produce people who have strong faith, morality, moderation, and are able to understand and provide an understanding of Islam that is rahmatan lil `alamin.

Abstract

Diantara hikmah disyariatkannya pernikahan adalah untuk menentukan status keturunan. Menurut Islam anak yang lahir dengan jalan pernikahan yang sah memiliki status nasab yang jelas. Dalam tulisan ini penulis memaparkan tentang keberadaan habaib di Indonesia, kedudukan nasab dalam Islam, penentuan nasab pada zaman Nabi dan zaman modern serta pandangan orang arab terhadap nasab. Setelah melalui pembahasan didapartkan kesimpulan bahwa Bangsa Arab merupakan bangsa yang sangat memperhatikan dan menjaga nasab dan hubungan kekerabatan, karena mereka tidak lupa nenek moyang mereka. Sedangkan dalam hukum Islam, nasab mempunyai peran yang sangat penting. Dengan jelasnya status nasab seseorang, hukum-hukum yang berkait dengan hal ini juga akan jelas. Semisal tentang perkawinan, warisan dan hubungan mahram.

Abstract

Undang-Undang Republik Indonesia Nomor 1 tahun 1974 pada Pasal 2 menjelaskan bahwa sahnya pernikahan harus dilakukan sesuai keyakinan masing-masing dan tiap-tiap perkawinan harus dicatat sesuai peraturan pemerintah. Para Ulama menjelaskan bahwa kewajiban pencatatan pernikahan yang ditetapkan oleh pemerintah tidak bertentangan dengan syariat Islam karena sesuai dengan disyariatkannya pernikahan. Dengan pencatatan nikah, di samping akan terwujud ketertiban perkawinan masyarakat, juga bagi masing-masing laki-laki dan perempuan yang sudah terikat pernikahan memiliki bukti otentik sebagai pasangan suami isteri. Dengan demikian, pernikahannya memiliki kepastian hukum. Namun jika ada pernikahan yang tidak dicatatkan, maka secara agama tetap sah selama syarat dan rukunnya terpenuhi.

Abstract

Pernikahan sebuah kebutuhan manusia yang harus dipenuhi, karena hal itu merupakan kebutuhan biologis dan psikologis yang tidak bisa berasal dari kehidupan manusia. Pernikahan merupakan runtutan dari hasrat seksualitas yang dimiliki manusia. Namun, terlepas dari terlepasnya berbagai alasan tersebut, Islam mempertimbangkan adanya kecocokan dan kesesuaian antara kedua insan yang akan menjalani kehidupan keluarga. Dalam bahasa fiqhnya kecocokan itu disebut dengan kafaah. Karena alasan tidak kafaah banyak pasangan gagal mengarungi bahtera rumah tangga. Setiap orang yang mempunyai persepsi berbeda-beda tengan kriteria-kriteria yang ditetapkan kafaah. Maka penting untuk dipaparkan dalam artikel pandangan-pandangan ulama madzhab empat tentang standarisasi kafaah dan kedudukannya dalam pernikahan.

Abstract

Hingga saat ini masih ada kelompok yang terus berusaha memperjuangkan tegaknya khilâfah islâmiyyah di Indonesia. Mereka menyakini bahwa khilâfah adalah satu-satunya solusi seluruh problematika umat. Di lain pihak ada kelompok yang berpendapat bahwa saat ini khilafah sulit untuk diwujudkan karena setiap negara Islam yang ada di dunia ini memiliki sistem dan bentuk pemerintahan yang berbeda-beda. Menurut kelompok kedua ini negara hanyalah wasi>lah dan kemaslahatan umatlah yang menjadi tujuan utama. Ada tiga persoalan penting yang dibahas dalam artikel ini melalui pendekatan fiqh tata negara, pertama, realisasi pendirian negara Islam pada zaman modern ini. Kedua, prinsip-prinsip pemerintahan Islam perspektif Al-Qur`ân dan Hadith. Ketiga, terkait pendirian negara Islam apakah masuk ranah qat{`iyyah atau ijtihâdiyyah. Setelah melalui pembahasan diperoleh kesimpulan bahwa diantara prinsip-prinsip pemerintahan Islam adalah keadilan, persamaan, mushawarah, kebebasan dan pengawasan rakyat. Adapun pendirian negara Islam di Indonesia bahkan di dunia masih sulit terwujud karena setiap negara memiliki sistem dan bentuk pemerintahan yang berbeda-beda. Pendirian negara Islam masuk dalam ranah ijtihâdiyyah karena tidak ada aturan baku dalam Al-Qur`ân dan Hadith terkait bentuk dan sistem pemerintahan tertentu. Aturan yang ada berupa aturan universal yang muara akhirnya adalah keadilan dan kemaslahatan bagi rakyat.
