Abstract

Trafficking in persons through the non-procedural recruitment of migrant workers is still a problem because it involves unauthorized parties and increases the risk of exploitation. This study aims to examine the prevention of human trafficking in the context of accepting illegal migrant workers in Cirebon Regency. The research used a normative juridical method with a legislative approach. Techniques for collecting legal materials through literature studies, as well as observations at the Cirebon Regency Manpower Office. Law Number 21 of 2007 is the legal basis for the eradication of human trafficking, while Law Number 18 of 2017 regulates the protection and placement of Indonesian Migrant Workers. The results of the study show that Cirebon Regency does not have special regulations regarding the prevention and handling of the recruitment and departure of prospective migrant workers by brokers or individuals. Therefore, local governments need to establish special regulations, strengthen supervision, and increase public understanding so that prospective migrant workers use official channels. This step is necessary to prevent illegal trafficking from the early stages and reduce the possibility of exploitation of migrant workers working abroad.

Abstract

In e-commerce, customer reviews play an important role in influencing the decisions made by customers. Before making a purchase, many people read positive customer reviews because they can offer useful information to potential buyers and increase their overall level of trust in the product. Positive customer reviews also help a store look more credible However, what happens to business actors is not as expected, so consumers act in bad faith by making bad judgments in marketplace product reviews. The purpose of this study is to analyze the good faith of business actors and how it impacts the law established by the Consumer Protection Law. This study uses a normative legal research study whose findings show that consumers are not liable for criticism that harms business entities, in accordance with the Consumer Protection Law (UUPK). In particular, Article 5a requires consumers to pay special attention to product descriptions listed in stores.

Abstract

The rapid expansion of digital financial transactions has significantly increased the prevalence of online investment fraud, including fraudulent online arisan schemes that exploit public trust through promises of unrealistic returns. Despite the enactment of Indonesia's new Criminal Code, challenges remain regarding the legal interpretation and judicial application of fraud provisions in technology-based financial crimes. This study aims to analyze the modus operandi of online arisan investment fraud, evaluate the effectiveness of positive criminal law in protecting victims, and examine the legal reasoning employed by judges in Decision Number 47/Pid.B/2025/PN.Cbn. This research employed a qualitative normative juridical approach using a case study design. Primary legal materials consisted of court decisions, the Indonesian Criminal Code, Law Number 1 of 2023 concerning the Criminal Code, and relevant statutory regulations, while secondary materials included scholarly journals, legal doctrines, books, and official publications. Data were collected through document analysis and literature review, and analyzed using statutory, case, and conceptual approaches supported by qualitative thematic analysis. The findings demonstrate that the defendant intentionally employed deception, false promises, and misleading investment offers to unlawfully obtain financial gain from multiple victims. The court concluded that all legal elements of fraud under Article 378 of the Criminal Code had been satisfied, resulting in a conviction supported by comprehensive judicial reasoning grounded in the principles of legal certainty, justice, and evidentiary standards. The study concludes that judicial reasoning plays a crucial role in ensuring effective law enforcement against online investment fraud, while reinforcing legal certainty and strengthening victim protection within Indonesia's evolving digital legal environment.

Abstract

Indonesia possesses considerable potential for salt production, particularly in Cirebon Regency, West Java, given its extensive maritime territory. However, challenges such as low productivity, poor quality, and limited access to technology and capital impede the development of the local salt industry. The preponderance of salt farmers' reliance on conventional methodologies engenders an incongruity between domestic market demand and production capacity. The present study undertakes a rigorous examination of the extant regulations pertaining to salt policies and their impact on farmers' welfare in Waruduwur Village, Mundu Sub-district. The present study employs a qualitative case study approach to investigate the role of government policies in overcoming capital and technological barriers, including the application of geomembrane technology. It is hypothesized that the findings will provide recommendations for balancing effective regulation and farmer protection. The implementation of these recommendations is expected to improve farmers' welfare, reduce import dependency, and enhance the competitiveness of local salt in the national market.
