Abstract

This article aims to find the relationship between the authority of the results of the Supreme Audit Agency's examination of the types of audits. Audits with a Specific Purpose are carried out as a follow-up to financial audits and audits because it is suspected that there is a criminal element in financial actions or the performance of agencies that have been examined, prosecuted and decided which have permanent legal force ( inkracht van gewijds) while the Convicted fled the country. The problem is how the duties and authorities of the State Audit Board are related to the Extradition Treaty of the Republic of Indonesia with the State of Singapore and what is the effectiveness of the Extradition Agreement of the Republic of Indonesia with the State of Singapore. The type of research used is qualitative with the type of normative research. Legal materials are analyzed qualitatively by explaining theories, logical principles to obtain scientific results that are descriptive. The results show that the Extradition Treaty of the Republic of Indonesia and the State of Singapore was signed by the Extradition Treaty of Indonesia and Singapore, aiming to prevent and eradicate transnational criminal acts, such as corruption. by the requesting State for prosecution or trial or execution of sentences for extraditable offenses

Abstract

This article aims to find the truth of the law epistemologically, Epistomology has an exploration in the scope of how knowledge can basically be obtained and tested for truth, if it is specified in the realm of legal epistemology, the study is in an effort to listen to how legal knowledge can be obtained and how level of truth so that it can be a determinant of legal methodology. The meaning of truth according to the Big Indonesian Dictionary is the real situation. Truth is "absolutely true", even though it is actually a reconstructive truth. Legal truth is coherent truth, The Accordance Theory of Truth. This theory explains that a truth or a condition is true if there is a match between the intended meaning of a statement or opinion with the object intended or intended by the statement or opinion. Truth in the Law of Evidence In each definition of the law of evidence there are six things that will be discussed further regarding the parameters of the law of proof, each of which is bewijstheorie, bewijsmiddelen, bewijsvoering, bewijslast, bewijskracht, and minimum bewijs. The type of research used in this research is qualitative, normative juridical research type. Legal materials are analyzed qualitatively by explaining theories, logical principles to obtain scientific results that are descriptive. The epistemology of legal science can be accommodated into a single unit in a meeting point of legal truth. The concept of convergence of legal epistemology seeks to open and dilute the pattern of relationships that are independent and mutually dominate legal truth, with this concept legal truth does not come from one legal thought alone, but can be extracted from all legal epistemologies in Indonesia, so that with this concept the truth the resulting law is more complete and comprehensive. The truth of the law, using pragmatic theory, the truth of the law is related to the usefulness of the law. The pragmatic truth perspective is not oriented to a process or a legal event but the result of the legal process or event. Something is said to be true if it has benefits for human life. What is felt useful is the real law.

Abstract

This article aims to find a fair view of workers/labourers regarding the value of severance pay when workers are affected by Termination of Employment (PHK) which has been regulated in Law Number 1 of 2020 concerning Job Creation in conjunction with Government Regulation Number 35 of 2021. Linked to Court Decisions Serang District Number 3/Pdt.Sus-PHI/2018/PN.Srg and the Decision of the Industrial Relations Court at the Serang District Court Number 111/Pdt.Sus-PHI/2021/PN.Srg. The purpose of this study is how to regulate laid-off workers/labourers in terms of providing severance pay, service pay and compensation in Law Number 11 of 2020 concerning Job Creation which has been regulated in Law Number 1 of 2020 concerning Job Creation. Government Regulation Number 35 of 2021. Relates to the Serang District Court Decision Number 3/Pdt.Sus-PHI/2018/PN.Srg and the Industrial Relations Court Decision at the Serang District Court Number 111/Pdt.Sus-PHI/2021/PN.Srg realize the principle of justice to Workers/Labourers. The research method used is empirical normative juridical with primary and secondary data. Research results Efforts to realize the principle of justice regarding the provision of severance pay, service pay and compensation in Law Number 11 of 2020 concerning Job Creation is to revise Article 156 paragraph (1) and paragraph (4) of Law Number 11 Year 2020 regarding Job Creation in conjunction with Government Regulation Number 35 of 2021 Work Agreements for Specific Time, Outsourcing, Working Time and Rest Time, and Termination of Employment. by involving the participation of Trade Unions and employers.

Abstract

Pertumbuhan ekonomi digital di Indonesia telah mengalami eskalasi eksponensial yang menghadirkan paradoks kompleks antara inovasi teknologi dan kebutuhan akan kepastian hukum. Penelitian ini bertujuan untuk melakukan analisis yuridis komprehensif mengenai peran strategis pemerintah dalam mengatur lanskap bisnis digital serta mengevaluasi efektivitas regulasi saat ini dalam menciptakan ekosistem perdagangan elektronik yang adil, transparan, dan aman. Metode penelitian yang digunakan adalah hukum normatif dengan pendekatan perundang-undangan dan konseptual melalui analisis bahan hukum primer seperti Undang-Undang Informasi dan Transaksi Elektronik dan sumber akademik sekunder. Hasil penelitian menunjukkan adanya pergeseran fundamental dalam posisi pemerintah, bertransformasi dari sekadar fasilitator pasif menjadi regulator proaktif yang ketat melalui implementasi UU No. 11 Tahun 2008 (UU ITE) dan Peraturan Pemerintah No. 71 Tahun 2019. Rekonstruksi regulasi ini dirancang untuk memberikan landasan hukum yang kokoh bagi transaksi digital dan menegakkan kedaulatan digital nasional terhadap dominasi teknologi global. Namun, penelitian ini mengidentifikasi tantangan struktural yang signifikan, terutama terkait kerentanan Usaha Mikro, Kecil, dan Menengah (UMKM) lokal terhadap strategi predatory pricing yang dilakukan oleh platform digital global. Selain itu, kurangnya sinkronisasi antara berbagai regulasi sektoral seringkali menghasilkan ketidakpastian hukum yang dapat menghambat pertumbuhan ekonomi yang berkelanjutan. Penelitian ini juga menyoroti bahwa efektivitas regulasi tersebut sangat bergantung pada independensi kelembagaan dan pengembangan infrastruktur digital mandiri untuk mengurangi ketergantungan pada entitas asing. Kesimpulannya, meskipun kerangka hukum yang ada telah memberikan fondasi, diperlukan rekonstruksi hukum yang lebih progresif dan terintegrasi untuk mengharmonisasikan kebijakan sektoral. Pendekatan ini sangat krusial untuk melindungi kedaulatan ekonomi digital nasional dan memastikan bahwa transformasi digital memberikan manfaat bagi seluruh lapisan masyarakat Indonesia.
