Abstract

This article explores religious moderation as a form of Islamic legal politics in Indonesia from both philosophical and juridical perspectives. Using a qualitative normative approach, the study analyzes how the concept of maqāṣid al-syarī‘ah (the higher objectives of Islamic law) and siyāsah syar‘iyyah (Islamic public policy) are reflected in the government’s policy on religious moderation initiated by the Ministry of Religious Affairs since 2019. The research argues that religious moderation represents not only a sociocultural strategy but also a legal-political manifestation of Islamic values aimed at ensuring justice, balance, and public welfare within Indonesia’s pluralistic society. Through an interpretative analysis of relevant literature, laws, and state policies, this study finds that the principle of moderation aligns harmoniously with the Pancasila-based constitutional framework and strengthens the position of Islamic law as an ethical foundation for national legal development. In conclusion, religious moderation serves as an adaptive expression of maqāṣid al-syarī‘ah in Indonesia’s democratic context, promoting peaceful coexistence, legal pluralism, and the realization of collective welfare (maslahah ‘ammah) as envisioned in Islamic jurisprudence.

Abstract

This study aims to determine public perceptions of uninhabitable housing in Panton Reu District, West Aceh Regency. The research problem is: "What is the public perception of uninhabitable housing in Panton Reu District, West Aceh Regency?" This qualitative study, conducted by the sub-district, considers the equal status of those with decent housing and those with uninhabitable housing. Data collection was conducted through interviews and observations of eight households with uninhabitable housing. Descriptive qualitative data analysis revealed that the Panton Reu community has both positive and negative perceptions. Positive perceptions include considering the economic situation of residents of uninhabitable housing as a fate that must be accepted and appreciated due to their income. Another positive perception is the hope that residents of uninhabitable housing can build better housing with government and non-government assistance. Negative perceptions, on the other hand, focus more on social treatment, which devalues residents of uninhabitable housing, thus alienating them from their social environment. Interviews with eight households revealed that not only the physical aspects of housing were impacted, but also residents' self-confidence and social participation in community activities. Some residents of RTLH (household housing) tend to limit their social interactions due to discomfort with their living conditions. On the other hand, some members of the community show concern through moral support and encouragement for RTLH residents to receive assistance with home repairs.

Abstract

This research aims to examine in depth how the application of Qanun Jinayat in Aceh affects the dynamics of social order in the community. With a qualitative approach based on case studies, this study explores the perceptions of various community groups including religious leaders, law enforcement officials, and vulnerable groups to understand the effectiveness, challenges, and social impacts of the implementation of sharia-based law. Data was collected through in-depth interviews, field observations, and focus group discussions in four strategic areas of Aceh, and then analyzed thematically with the help of ATLAS.ti software. The results of the study show that although the jinayat law contributes to a reduction in moral offenses such as gambling and alcohol consumption, its implementation is not uniform and still faces various obstacles, both technical, social, and legal. Concerns about discriminatory treatment of women and minority groups are also a major concern. Therefore, it is recommended that there be harmonization between qanun and national law and the strengthening of protection for vulnerable groups, so that the application of this law can take place fairly and inclusive in order to maintain social stability in Aceh.
