Abstract

Pengelolaan sumber daya alam (SDA) yang berkelanjutan merupakan tantangan krusial dalam menjaga hak atas lingkungan hidup yang sehat. Namun, integrasi hak tersebut ke dalam kebijakan publik masih menghadapi kendala signifikan, terutama dari sisi implementasi hukum administrasi negara. Penelitian ini menggunakan metode yuridis normatif dengan analisis dokumen hukum, kebijakan publik, serta literatur terkait untuk memahami pengaturan dan pelaksanaan hukum dalam pengelolaan SDA. Hasil kajian menunjukkan bahwa meskipun kerangka hukum sudah ada, terdapat berbagai masalah seperti tumpang tindih regulasi, lemahnya koordinasi antar lembaga pemerintah, dan minimnya partisipasi masyarakat dalam proses kebijakan. Diperlukan penguatan mekanisme hukum administrasi negara yang mampu menjamin transparansi, akuntabilitas, dan perlindungan hak atas lingkungan hidup sehat dalam kebijakan publik. Penelitian ini menyimpulkan bahwa reformasi hukum administrasi negara menjadi kunci utama untuk mewujudkan pengelolaan SDA yang adil, berkelanjutan, dan menghormati hak asasi manusia.

Abstract

Waqf land holds a strategic position in Islamic law and social development, functioning not only as a religious asset but also as a productive resource that may be sustainably utilized for education, healthcare, and public welfare. In Aceh Province, the potential of waqf land is substantial; however, legal certainty through registration and certification remains incomplete. This study aims to analyze institutional collaboration patterns in waqf land registration in Aceh and to assess their effectiveness through the perspective of collaborative governance. The research employs normative legal research using statutory and conceptual approaches. Data were collected through library research and document analysis of legislation, institutional reports, and official waqf-related records in Aceh. The findings indicate that a collaborative framework has been established through the synergy among the Regional Office of the Ministry of Religious Affairs of Aceh, the National Land Agency, the Aceh High Prosecutor’s Office, and the Regional Leadership Coordination Forum, supported by cooperation agreements and inter-agency coordination mechanisms. This collaboration has contributed to accelerating waqf land certification, yet its implementation remains suboptimal. Major challenges include the absence of integrated inter-agency data systems, limited administrative capacity of nazhir, insufficient supporting documentation, and the lack of shared understanding at the local level. This study concludes that the collaboration pattern in waqf land registration in Aceh remains in the developing stage.

Abstract

The transformation of the Negara Hukum into a welfare state positions social assistance policies as a strategic instrument for fulfilling citizens’ rights. However, in practice, the implementation of social assistance in Indonesia faces significant challenges, including mistargeting, weak accountability, and regulatory disharmony. This study aims to analyze the conformity of social assistance policies with the principles of the rule of law and to reconstruct an ideal policy model. The research employs a normative juridical approach through the analysis of legal frameworks, particularly the Undang-Undang Dasar 1945, as well as relevant legal doctrines and literature. The findings indicate that although social assistance policies possess strong constitutional legitimacy, their implementation reveals a gap between normative expectations and practical realities. Therefore, policy reconstruction is required through a rights-based approach, integrated data system reform, regulatory harmonization, and strengthened multi-level oversight. In conclusion, social assistance must be treated as a constitutional right managed with transparency and accountability. This study recommends strengthening regulatory frameworks, digitalizing data systems, and enhancing public participation as strategic measures for policy improvement.
