Abstract

Pertumbuhan lembaga keuangan Islam mengalami peningkatan dalam beberapa tahun terakhir. Selain kehadiran perbankan Islam atau syariah yang memeroleh respons sangat baik dari masyarakat, asuransi syariah juga mendapat sambutan yang hangat. Sebagaimana dalam lembaga keuangan umumnya, dalam perjalanannya terkadang terjadi permasalahan atau sengketa antara institusi dan masyarakat. Artikel ini membahas tentang penyelesaian sengketa ekonomi syariah yang terdapat di dua lembaga keuangan syariah di Kota Jambi, yaitu Bank Syariah Mandiri (BSM) Cabang Jambi dan Asuransi Takaful Cabang Jambi.

Abstract

Economic crisis which knock over world in this time, is factor from mistake of itself human being, running economic system capitalist, this system only giving wide of opportunity to big investors, whereas small investors will be pulled over. Differ the things of with economic system of Islam applying the infinite system, justice, prohibition order obligation and lap pay forreligious obligatory (zakat). This matter make economic growth and growth of Islam go forward by significant. Therefore need the existence of Islam economic principle implementation in national economic system. One of the way of by applying sharing holder system (profit-sharing).

Abstract

This study seeks to understand the pragmatism of the development of sharia economic law, and its implications for Islamic financial products in Indonesia. The data comes from the results of interviews and focus group discussions with key informants from academics, practitioners, authorities, and the public. This research finds that pragmatism in the development of Islamic economic law is an approach that still dominates the DSN-MUI fatwas. The pragmatism style used is complex-eclectic pragmatism which is represented through makhārij al-fiqhiyyah, which is to choose a mild opinion by sticking to the strongest method or also called "taysīr al-manhajī". The use of this method is intended to ensure that the fatwa is truly able to answer the needs of the business world, as well as being in line with sharia principles. DSN-MUI also does not use maslahah as a legal consideration in a free or liberal way. Rather, it returns maslahah in consideration of the method, so that it is permissible to use the bay’ al-'inān contract only in a forced state (ḍarurah).

Abstract

This study aimed to determine women's position in the division of inheritance in the Jambi Malay community. This study uses the social legal research method to understand legal phenomena from the social and cultural context in which the law exists. The primary data for this study came from in-depth interviews with religious and traditional leaders, while the secondary data was obtained from relevant literature. The data is then analyzed by editing, organizing, and grouping the research results. The study results indicate legal dualism in inheritance distribution in the Jambi Malay community, namely Islamic and customary law. However, customary law dominates compared to Islamic law. In practice, the flexibility of women's inheritance distribution in the Jambi Malay community aims to find out about the negotiations of the Jambi Malay community in dealing with the equalization of men and women in the distribution of inheritance. Equality is permitted in Islam because, in practice, there must be agreement and approval from each heir

Abstract

The attempt to equate freedom of speech with other rights, such as freedom of expression or opinion, is misguided because these rights have distinct realms concerning their promotion and resolution of legal violations. In practice, this misconception persists in Indonesia, where there is no specific law dedicated to regulating freedom of speech. Therefore, this study explored the factors that lead to legal vacuum for freedom of speech and provided solutions to overcome this vacuum. This study also assessed the various legal frameworks and practices concerning the promotion of freedom of speech in Indonesia after the 1998 Reform Era using a normative juridical approach. The result showed that legal vacuum in promoting the right to freedom of speech attributed to the conflicting priorities of human rights and the ambiguity surrounding the understanding of freedom of expression. It is important to synchronize laws and regulations regarding the rights belonging to freedom of expression and strengthen the associated regulation that specifically contain definitions, limitations, and ways of resolving violations of the law. This process provided a detailed legal direction or umbrella for efforts to promote freedom of speech.

Abstract

Khul' or divorce requested by a wife is one of the causes marital termination. According to Imam Syafi'i, khul' is a divorce (talak) with an  'iddah of three menstruat cycles. In contrast, for Imam Hanbali, khul' is fasakh in which its 'iddah is one menstrual cycle and its legality does not require a judge's decision. This difference has dissimilar legal implications when it is applied in Indonesia. Therefore, this article aims to seek the both relevancies in the context of Indonesian law, especially under the Compilation of Islamic Law and the nature of the religious practice of Indonesian Muslims. After examining the relevant literature sources, this article shows that, both Imam Syafi'i and Imam Hanbali agree that khul' is like a buy-sell contract, and hence a judge's decision is not required. However these both agremeents are not relevance under the Compilation of Islamic Laws, but the Imam Hanbali's fiqh in which khul' as fasakh would be difficult to seek its relevance. Thus, the fiqh of Imam Syafi'i is more appropriate, since beside it is used as a basis for the Compilation of Islamic Laws the majority of Indonesian Muslims embrace the Syafi’i mazhab. [Khulʻ atau tebus talak merupakan salah satu penyebab putusnya perkawinan. Menurut Imam Syafi’i, khulʻ adalah talak dengan ʻiddah tiga kali haid. Sebaliknya, menurut Imam Hanbali, kedudukan khulʻ adalah fasakh dengan ʻiddah satu kali haid serta ketetapannya tidak memerlukan keputusan hakim. Perbedaan ini memiliki implikasi hukum yang berbeda-beda jika diterapkan di Indonesia. Karena itu, tulisan ini mencoba mencari relevansi keduanya dalam konteks hukum di Indonesia khususnya di bawah Kompilasi Hukum Islam dan watak pengamalan beragama umat Islam Indonesia. Setelah menelaah sumber-sumber pustaka yang relevan, tulisan ini menunjukkan bahwa, baik Imam Syafiʻi maupun Imam Hanbali bersepakat bahwa khulʻ layaknya seperti (akad) jual beli sehingga tidak membutuhkan hakim di pengadilan. Walaupun kedua kesepakatan ini tidak relevan ditinjau dari sisi kompilasi hukum Islam, fiqih Imam Hanbali yang menyatakan khulʻ sebagai fasakh sulit untuk menemukan keselarasannya. Karena itu, pendapat Imam Syafi’i lebih tepat, selain ia dijadikan sebagai dasar penyusunan Kompilasi Hukum Islam, juga karena umat Islam Indonesia mayoritas bermazhab Syafiʻi.]

Abstract

This article explores how the Suku Anak Dalam (SAD) community resists the application of Islamic law in family matters, specifically in the determination of dower (mahr), the management of joint property, and the distribution of inheritance. While most SAD members have formally converted to Islam, their legal practices remain rooted in a matrilineal customary system passed down through generations. Challenging prevailing scholarly emphasis on integrative frameworks between Islamic law and local custom, this study demonstrates that, in the SAD context, resistance emerges when elements of Islamic jurisprudence (fiqh) clash with the community’s socio-cultural structure and shared values. Using a socio-legal approach and qualitative methods, the research draws on in-depth interviews with seven key informants, including a religious leader, the tumenggung (tribal chief), customary elder, community facilitator, subdistrict head, and SAD community members. The findings reveal a persistent orientation toward collective female authority: mahr is determined by the bride’s maternal kin group; joint property, upon divorce, is granted entirely to the wife; and inheritance follows a strictly matrilineal line. Rather than rejecting Islamic law on theological grounds, this resistance reflects a form of public reasoning grounded in ancestral consensus. The study highlights the importance of interpreting Islamic law through contextual, dialogical, and adaptive lenses—particularly within societies shaped by legal pluralism. [Artikel ini mengkaji bentuk-bentuk resistensi yang muncul dalam komunitas Suku Anak Dalam (SAD) terhadap penerapan hukum Islam dalam ranah hukum keluarga, khususnya terkait penetapan mahar, pengelolaan harta bersama, dan pembagian warisan. Meski secara formal mayoritas anggota komunitas SAD telah memeluk Islam, praktik hukum yang dijalankan tetap berpijak pada sistem hukum adat matrilineal yang diwariskan lintas generasi. Berbeda dari kecenderungan literatur sebelumnya yang menekankan model integratif antara syariah dan adat, studi ini justru menunjukkan bahwa dalam konteks SAD, resistensi muncul ketika ketentuan-ketentuan fikih dianggap tidak sejalan dengan struktur sosial dan nilai-nilai kolektif komunitas. Dengan pendekatan sosio-legal dan metode kualitatif, penelitian ini mengumpulkan data melalui wawancara mendalam dengan tujuh informan kunci: tokoh agama, tumenggung (kepala suku), pemimpin adat, pendamping komunitas, pejabat lokal, dan anggota komunitas SAD. Temuan utama memperlihatkan bahwa praktik hukum keluarga di komunitas ini lebih menekankan otoritas kolektif perempuan, tercermin dari penentuan mahar oleh keluarga pihak ibu, pengalihan penuh harta bersama kepada istri setelah perceraian, serta sistem pewarisan yang mengikuti garis keturunan perempuan. Artikel ini berargumen bahwa resistensi tersebut bukan merupakan penolakan teologis terhadap hukum Islam, melainkan lahir dari penalaran publik yang bertumpu pada konsensus adat. Temuan ini menegaskan pentingnya pendekatan hukum Islam yang lebih kontekstual, dialogis, dan responsif terhadap pluralitas hukum dalam masyarakat adat.]

Abstract

Lower-to-middle-class communities in Indonesia continue to exhibit resistance to religious moderation, frequently perceiving it as a foreign concept influenced by Western ideologies. This misconception persists even though religious moderation is deeply rooted in Islamic tradition and represents neither a new religion nor a secular invention. Such resistance often manifests through overt, semi-covert, and covert strategies, reflecting varying levels of opposition ranging from open rejection to more subtle forms of disengagement. This study employed a qualitative approach, drawing on data from online media platforms to analyze patterns of resistance and their underlying causes. The findings revealed that resistance was frequently driven by misinformation, distrust of government-led initiatives, and a limited understanding of the historical and theological foundations of religious moderation. These attitudes fostered intolerance and social fragmentation, posing a serious threat to national resilience, democratic values, and social harmony. Furthermore, the study emphasized that addressing resistance required not only educational interventions but also inclusive policymaking that bridged the gap between state narratives and grassroots religious experiences. The research offers crucial insights for policymakers and educators in developing culturally sensitive and community-based strategies to promote religious moderation and counteract the growing tide of intolerance in diverse socio-religious contexts across Indonesia.

Abstract

This research is motivated by the unrealized specific road for transporting coal mining products in Jambi Province which has been delayed for 9 years. This study uses a qualitative research approach. The data sources used in the study were selected by purposive sampling method. The results showed that the construction of a specific road for coal transportation in Jambi Province had not yet had an impact on people's lives. These impacts are economic, social and road safety impacts. The unrealized policy is caused by several factors including the budget, political pressure, the complexity of licensing, and the dynamics of land acquisition.

Abstract

Abstrak Artikel ini menunjukkan bahwa teks suci agama banyak ditemui penjelasan tentang persamaan posisi dan hak  baik untuk laki-laki dan  perempuan. Namun, fakta dilapangan tidak sesuai dengan prinsip keadilan, kesetaraan, dan persamaan dimata hukum sebagai akibat dari penafsiran yang bias. Artikel  ini merespons kekosongan dalam literatur sebelumnya yang terkesan adanya pembodohan terhadap perempuan baik dalam ranah privat maupun publik, dan bertujuan menghapus kekeliruan dalam memahami teks-teks suci dengan upaya pembacaan ulang teks agama. Artikel ini menggunakan teori dekonstruksi Jacques Derrida dalam membaca ulang teks. Penulis ingin menunjukkan bahwa menggunakan dekonstuksi Derrida mampu mempengaruhi gaya berpikir seseorang ketika memahami suatu makna dalam menemukan konteks tetapi tidak berakhir dan terus berkelanjutan. Kemudian, dekonstruksi teks tersebut dapat menenetapankan hukum dari pendapat fuqaha yang memenuhi kebutuhan dan dinamika masyarakat. Perlu membangun pemahaman di masyarakat dengan ajaran fiqh dalam teks yang harus ditafsirkan dengan realitas sosial (fiqh al waqi’). Pemahaman fiqh ini mengejawantahkanbudaya di masyarakat dan menghilangkan kesan bahwa fiqh lebih cenderung lahir dari relasi kuasa patriarki. Kata Kunci: Dekonstruksi, Fikih Gender, Posisi dan Hak-hak Perempuan, Teks-teks Keagamaan [This article provides many explanations about the equal positions and rights of men and women. However, in fact, this reality is not alway based on the principles of justice and equality in the eyes of the law as a result of biased interpretation.  This study responds to a Lacuna in the previous literature that tends to emphasize the seeming dumbing down of women in both the private and public spheres. This article aims to erase the misunderstanding of sacred texts, by attempting to re-read religious texts. This article  uses Jacques Derrida's deconstruction theory in re-reading the text. The author wants to show that using Derrida's deconstruction is able to influence one's thinking style when understanding a meaning in finding a context but not ending and continuing. Then, the deconstruction of the text can establish the law of the fuqaha opinion that meets the needs and dynamics of society. It is necessary to build  understanding in society with the teachings of fiqh in the text that must be interpreted with social reality (fiqh al-waqi'). This understanding of fiqh embodies the culture in society and eliminates the impression that fiqh is more likely to be born from patriarchal power relations.
