Abstract

This article describes about Domestic Violence: Perspectives of the Act. No. 23 of 2004 on Domestic Violence: An Effort In the Struggle for Human Rights "Human Rights". Womens issues that dimapankan for several generations until today is in line with the process of strengthening the traditional Islam (classical), which tend to be conservative and literal in understanding the religious messages and doctrines that exist, patiarkhi an established cultural constructs are universally and lasts for centuries, and the justification of authority backed by the state law. Therefore, this condition resulted in follow-up of violence by husbands against wives. Domestic violence (domestic violence) can be positioned as a result of which was born from a gender biased social system. All forms of violence, particularly Domestic Violence (Domestic Violence) is a violation of human rights (human rights), and the evil of human dignity and a form of discrimination that must be removed. Abstract

AbstractBackground This article departs from concern about the high violation of childrens rights in Indonesia, particularly children in conflict with the law (child in conflict with the law), either as witnesses, victims or perpetrators of crime. In this article, focusing on the study of the question of the juvenile criminal justice system, namely Law. No. 11 of 2012 on the Criminal Justice System Child (Law SPPA), which still left many problems so that justice and the rights of children difficult to materialize. However, it should be realized that the product legislation is the result of a political compromise so much criticism even guguatan shown in SPPA law shortly after enactment. Although, on the other hand the Act SPPA lot of progress compared to the previous juvenile justice law. Therefore, in this article that will be studied is what are the issues in the Act SPPA and how efforts to optimize the Act SPPA in justice and human rights protection for children in Indonesia against the law. Keywords: Criminal Justice System Child, Violation of Human Rights and Justice AbstrakLatar belakang artikel ini berangkat dari keprihatinan terhadap tingginya pelanggaran hak-hak anak di Indonesia, khususnya anak-anak yang berkonflik dengan hukum (child in conflict with the law), baik sebagai saksi, pelaku atau korban tindak pidana. Dalam artikel ini, fokus pada kajian terhadap persoalan mengenai sistem peradilan pidana anak, yakni UU. No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (UU SPPA),  yang masih menyisakan berbagai persoalan sehingga keadilan dan hak-hak anak sulit untuk terwujud. Namun harus disadari bahwa, produk undang-undang adalah hasil kompromi politik sehingga banyak kritik bahkan guguatan yang ditunjukkan pada UU SPPA tidak lama setelah diundangkan. Meskipun, disisi lain dalam UU SPPA banyak mengalami kemajuan jika dibandingkan dengan UU peradilan anak sebelumnya. Oleh karena itu, dalam artikel ini yang akan dikaji adalah apa sajakah persoalan-persoalan dalam UU SPPA dan bagaimana upaya optimalisasi UU SPPA dalam mewujudkan keadilan dan perlindungan HAM bagi anak di Indonesia yang berhadapan dengan hukum. Kata kunci : Sistem Peradilan Pidana Anak, Pelanggaran HAM dan Keadilan

Abstract

Protection of human rights (human rights) in the Constitution applies in Indonesia ever prove that one of the requirements for a state law is the guarantee  of human rights. Indonesia assertion of law set forth in the 1945 amendment of Article 1 paragraph (3) “State of Indonesia is the Rule of Law”. The form states have laws on the protection of human rights in implementation by the Constitutional Court (MK) in Decision No. 46/PUU-VIII/2010 on the Status of Child Marriages outside. Political decisions of law sought to protect the rights of the child, in addition to trying to dismantle the positivistic-legalistic law, which for year’s had been shackled for justice and human rights. However, in Indonesia the law of the Constitutional Court reap the political pros and cons. Therefore, it is necessary socialization broadly relevant decision of the Court, the Court of law that political action are on the correct constitution, embodying the rule of law and democratic ideals for the sake of our nationhood and nation’s dignity. Constitutional Court’s decision is a wise choice and a step forward in the field of law for the defense of children’s rights that have long shackled Article 43 of the Act. N0. 1 of 1974 on Marriage. To be effective this decision the government should immediately respond with a set of supporting regulations that can be implemented by the Ministry of Religious Affairs and Ministry of  Interior.

Abstract

The background of this paper departs from concern over the fragility of the value of Indonesia's sovereignty which has an impact on the violations of the rights of Indonesian citizens (human rights). Law No. 22 of 2001 on Oil and Gas (Oil and Gas Law) has undermined the sovereignty of the state and the nation's economic sovereignty. Oil and Gas Law poses systemic impact on people's lives and could harm the country's finances. This is because oil and gas law opened liberalization of oil and gas management which is highly dominated by foreign entity since oil and gas world in Indonesia is dominated by foreign companies up to 89 percent. Therefore, in an effort to restore the sovereignty of the Republic of Indonesia in the field of oil and gas, the Constitutional Court as a State institution has taken progressive step in its decision No. 36 / PUU-X / 2012 on the dissolution of BP Migas. The legal policy of the Court decision constitute a wise choice and is a progressive step in the field of law, especially the protection of human rights of the people of Indonesia.

Abstract

The Quran laid down a normative standard, that men and women should  be held in equal regards, also in matters spiritual. It strives for a meritocracy that the worship of God should be without a spiritual monopoly by one gender. Regrettably, this message becomes distorted through the imposition cultural and sociological aspects. Our patriarchal culture for example, takes the Quran and hadiths at face value, and refusing to realize its underlying message, creates misogynic rules and perspectives. A product thereof is a ban (or at least a strong discouragement) on women from going to the mosques to pray, resulting in a loss of religious rights and a limitation in the avenues of worship for women. Such inequality causes discomfort and loss of rights and dignity to women as human beings, and such inequality, being inherently detrimental towards justice and humanity must be put to an end.

Abstract

In the normative level, generally all agreed to place women are equal to men, that is the position as humans, as well as the servant of Allah. Women are recognized to have a number of rights and freedoms, including the right to engage in politics, especially in the organization of the Islamic society. To strengthen the protection of women's rights, the government of Indonesia to make a policy or legislation (political law), both to improve policies of national legislation and policies ratified international law. However, when the policy (political law) or a pattern of gender relations between men and women drawn into operational a practical level, it appears that a long debate and a serious problem occurs. The rights of women experiencing prolonged discrimination, discrimination and marginalization occurs at the level of political rights and policies in the organization of Islamic society. In Indonesia, the rights of women in Islamic society organization, still have enough depth concerns. The pro and contra related to gender equality in Indonesia, particularly in the field of Islamic society organizations would affect the wheels of government in Indonesia, particularly in relation to the State of trademark law is the protection and freedom of human rights. Therefore, policies need to be related to equality between men and women both fair and legal.

Abstract

Marketing strategy is the spearhead for a financial institution to introduce and market the advantages of its products. Marketing strategy can be done by using a marketing mix strategy which is a tool for marketers consisting of various elements of marketing programs such as product, price, place and promotion. In this study, the authors formulated the problem of how the marketing strategy for financing products at BMT Assyafi'iyah Berkah Nasional Pekalongan East Lampung branch and how the marketing strategy through SWOT analysis on mudharabah financing products at BMT Assyafi'iyah Berkah Nasional Pekalongan branch, East Lampung. To obtain the data in this study, the researchers used several research methods, namely this type of research using field research. The data source of this research uses primary, secondary and tertiary data sources. Meanwhile, the data collection method uses observation, interviews and documentation and uses the Snawoball sampling method and questionnaire. The result of this research is the marketing strategy applied to BMT Assyafi'iyah Pekalongan East Lampung Branch, namely using product marketing strategies, price, place, and promotion. The result of the SWOT analysis above shows that BMT Assyafi'iyah Pekalongan East Lampung Branch shows at the quadrant II level by means of a diversification strategy.

Abstract

The Urgency of Qur’anic Literary Zoology: A Case Study on the Art of the Zoomorphic Story of Al-Farasy in Surah Al-Qari'ahThe criminalization of animals can be manifested in concrete actions and disproportionate interpretation of religious texts. This paper aims to describe the urgency of a literary zoological perspective on animal studies in the Quran and provide examples of its application in analyzing one of the cases of animal criminalization al-Farasy in Surat Al-Qari'ah. The author uses qualitative research methods with descriptive-interpretive analysis. The author uses the theory of Tasybih and Roland Barthes’s Semiotics theory with a literary zoological approach. The results of this paper are: First, literary zoology is essential for animal research in the Quran for several reasons. They are  (1) animals in the Quran are included in the literary category, so that an important literary approach is presented to find the meaning behind the existential of animals in the Quran, (2) ) Literary zoology is interdisciplinary, multidisciplinary, and transdisciplinary. Based on these characteristics, the zoosembiology between literature and animals can be expressed comprehensively and holistically, (3) literary zoological opposes anthropocentric philosophy, which is alleged to have produced many actions that destroy nature. Nature conservation, especially related to the future of animals, needs to be encouraged in the current era. Second, the discrimination against al-Farasy by the ulama resulted in monodisciplinary studies. Al-Farsy as an example of humans when the Day of Judgment comes is not meant for taqbih halihi (humiliating the human condition when the Day of Judgment comes), but rather for bayanu halihi and taqriru halihi (reporting the situation)
