Abstract

Kedudukan Kejaksaan dalam sistem ketatanegaraan tergolong ambivalen karena berada pada dua sisi cabang kekuasaan yang seharusnya terpisah, yaitu pertama cabang kekuasaan eksekutif terkait struktur dan alur komando yang berujung pada Presiden sebagai Kepala Pemerintahan, dan kedua cabang kekuasaan yudikatif dalam konteks tugas penuntutan dalam sistem peradilan pidana. Perihal independensi akan menjadi isu sentral dalam pemosisian Kejaksaan dalam penugasannya, dimana secara struktural Jaksa Agung berujung kepada Presiden dengan hak prerogatifnya, namun secara fungsi dituntut untuk mandiri dan independen dari tekanan politik apapun. Penelitian ini adalah penelitian normatif dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan perbandingan. “Putusan Mahkamah Konstitusi RI Nomor 6/PUU-XXII/2024” telah membuat konsep baru tentang independensi Kejaksaan dalam sistem ketatanegaraan Indonesia. Tujuan dari penelitian ini adalah untuk mencari dan menemukan konsep kelembagaan terbaik bagi “Kejaksaan Republik Indonesia” dalam menjalankan fungsi dan tugas yudikatif dan eksekutif sekaligus secara seimbang dan transparan. Diharapkan konsep kelembagaan tersebut dapat memaksimalkan peran Kejaksaan dalam penegakan hukum serta memberikan positioning lembaga Kejaksaan didalam sistem peradilan pidana di Indonesia. “Putusan Mahkamah Konstitusi RI Nomor 6/PUU-XXII/2024” telah memberikan tafsir konstitusional yang berbeda dan dapat berakibat pada aspek kelembagaan Kejaksaan sehingga dapat berpengaruh terhadap mekanisme penegakan hukum di Indonesia. Penelitian ini akan memberikan rekomendasi terbaik bagi konsep dan visi Kejaksaan ke depan.

Abstract

This research was conducted to find out how mining management policies are reviewed based on Law Number 3 of 2020 concerning mineral and coal mining. In this research, the method used is normative juridical which focuses on the application of rules or norms in positive law to raise, discuss and explain the legal issues raised. Mining is some or all stages of activities in the context of research, management and exploitation of minerals or coal which includes general investigations, exploration, feasibility studies, construction, mining, processing and refining, transportation and sales, as well as post-mining activities. Mining is an activity carried out either simply (manually) or mechanically which includes preparation for scattering, loading and transporting excavated materials. Excavated goods contained in the Indonesian mining jurisdiction are national wealth which is a gift from God in the form of natural deposits.

Abstract

This research is motivated by environmental problems caused by campaign props (APK) waste that is not properly managed after election campaigns end. Current regulations focus only on the installation and removal of APK but do not comprehensively address waste management. The purpose of this study is to analyze how APK waste management policies can align with environmental sustainability principles, as well as how election organizers and Bawaslu can support more environmentally friendly campaigns. This study uses normative legal research methods with statutory and conceptual approaches. The findings indicate that stricter and more synchronized policies are needed between election regulations and environmental regulations, including the application of reduce, reuse, recycle (3R) principles, the use of environmentally friendly campaign materials, as well as education and sanctions for election participants. The implications of this study are expected to encourage improvements in regulation and collaboration between institutions so that election campaigns not only uphold democratic principles but also support environmental sustainability.

Abstract

Otoritas Jasa Keuangan (OJK) satu-satunya lembaga yang dapat melakukan pungutan terhadap kegiatan di sektor jasa keuangan dan pungutan tersebut bersifat wajib. Dalam UU P2SK mengatur ketentuan terkait dengan pengelolaan pungutan yang dilakukan oleh OJK. Pasal 37 ayat (3) UU P2SK mengatur bahwa pungutan dan penerimaan lainnya dikelola sesuai dengan ketentuan peraturan perundang-undangan di bidang keuangan negara dengan ketentuan hasil pungutan dapat digunakan sebagaian atau seluruhnya secara langsung oleh OJK untuk memenuhi kebutuhan pendanaan kegiatan. Sedangkan Pasal 23A UUD NRI Thn 1945 yang menyatakan bahwa “Pajak dan pungutan lain yang bersifat memaksa untuk keperluan negara diatur dengan undang-undang”. Jenis penelitian adalah penelitian normatif, dengan pendekatan conseptual approach dan statute approach. Teori hukum positivisme yang diusung oleh Hans Kelsen tentang stufenbau theory memotret fenomena hierarki dan norma hukum yang lebih rendah bergantung kepada norma hukum yang lebih tinggi.

Abstract

Garbage is the residue of human business or activities in solid form, either in the form of organic or inorganic substances that are biodegradable or non-biodegradable and are considered no longer useful so that they are disposed of into the environment. The phenomenon of the distribution of waste in Indonesia is currently rampant, due to the lack of public awareness to dispose of waste in the places provided. This causes the amount of waste to increase every year. In addition, the distribution of waste is caused by the absence of legal firmness regarding waste policies, the lack of waste management efforts, uneven means of transporting waste, the inadequate Final Disposal Site (TPA) system and the lack of public awareness in reducing the volume of waste. The waste management is regulated in Article 19 of Law Number 18 of 2008 concerning Waste Management which is carried out by handling and reducing waste. In addition, there is also a principle to regulate the increasingly rampant distribution of waste, namely the principle of good environmental governance. This principle in a regional regulation will produce a permanent legal force that is coercive. It is intended to preserve the environment through environmentally sound waste management.

Abstract

The position of the Attorney General's Office in the constitutional system is ambivalent because it is located on two sides of the branches of power that should be separate, namely the first branch of executive power related to the structure and flow of command that leads to the President as Head of Government, and the second branch of judicial power in the context of prosecution duties in the criminal justice system. The issue of independence will be a central issue in the positioning of the Attorney General's Office in its assignment, where structurally the Attorney General leads to the President with his prerogatives, but functionally is required to be independent and independent of any political pressure. This research is a normative research with a statutory approach, conceptual approach and comparative approach. The decision of the Indonesian Constitutional Court Number 6/PUU-XII/2024 has created a new concept of the independence of the Prosecutor's Office in the Indonesian constitutional system. The purpose of this research is to seek and find the best institutional concept for the Prosecutor's Office of the Republic of Indonesia in carrying out judicial and executive functions and duties at the same time in a balanced and transparent manner. It is expected that the institutional concept can maximize the role of the AGO in law enforcement and provide positioning of the AGO institution in the criminal justice system in Indonesia. The decision of the Constitutional Court of the Republic of Indonesia Number 6/PUU-XII/2024 has provided different constitutional interpretations and can have an impact on the institutional aspects of the Prosecutor's Office so that it can affect the law enforcement mechanism in Indonesia. This research will provide the best recommendations for the concept and vision of the Prosecutor's Office in the future.

Abstract

The utilisation of digital technology in tourism promotion plays a vital role in increasing competitiveness and visibility in the tourism industry. Sidomulyo Tourism Village, located in Jember Regency, faces challenges in promoting its tourism potential due to limited use of digital media. This community service programme provides an innovative solution through training on the introduction and development of Virtual Reality (VR) Tour technology as an interactive promotional tool. The activities include workshops, hands-on practice in creating VR Tour content, and continuous technical mentoring conducted by a team of experts. The training aims to enhance participants’ knowledge and skills in using digital media, especially in producing immersive virtual experiences that can attract visitors. The results show that participants’ understanding of VR technology has significantly improved, and they are capable of producing simple VR Tour prototypes independently. In addition, this programme encourages collaboration between village tourism managers, the local community, and IT practitioners to develop sustainable digital-based promotional content. The implementation of the VR Tour is expected to increase tourist visits, strengthen the digital branding of Sidomulyo Tourism Village, and serve as a model for other tourism villages in Jember Regency.

Abstract

Kegiatan Pengabdian Kepada Masyarakat (PKM) ini bertujuan untuk menguatkan eksistensi Badan Usaha Milik Desa (Bumdes), Desa Wisata Sidomulyo, Kecamatan Silo, Kabupaten Jember. Potensi Bumdes Desa Sidomulyo sebagai badan usaha milik masyarakat desa harus dapat dioptimalkan melalui bidang usaha yang berbasis potensi masyarakat. Sebagai organisasi bisnis, Bumdes harus memiliki visi, misi, disain struktur organisasi yang sesuai, dan program kerja yang tersusun dengan baik agar tujuan mensejahterakan warga desa dapat tercapai. Metode pelaksanaan PKM ini adalah pelatihan / bimbingan teknis yang dilaksanakan dengan melibatkan beberapa elemen terkait, meliputi aparat desa, pengurus Bumdes, Pokdarwis. Kegiatan bertujuan untuk meningkatkan pengetahuan dan kapasitas sumber daya manusia pengelola Bumdes terkait kemampuan penyusunan, visi, misi redesain struktur organisasi dan program kerja sehingga dapat mendukung kegiatan Bumdes yang efektif.

Abstract

Despite national efforts to reduce stunting, Kaliwates District in Jember Regency presents a unique paradox where high stunting prevalence persists amidst adequate urban infrastructure. This study aims to analyze the implementation effectiveness of Article 3 Letter C of Jember Regent Regulation Number 29 of 2024, specifically regarding integrated interventions for pregnant women, and to identify the determinative factors behind its execution. Employing a juridical empirical method with a socio-legal approach, this research utilizes primary data obtained through in-depth interviews with pregnant women, health officials, and local government agencies, complemented by observations and legal documentation analysis. The findings reveal that the regulatory mandate for integrated services remains largely unfulfilled due to significant bureaucratic fragmentation and sectoral ego between agencies. A critical discovery is the phenomenon of administrative stunting, where rigid requirements for residency documents exclude vulnerable populations from accessing state sponsored nutrition programs. Furthermore, the implementation faces cultural resistance from elite urban communities who reject health interventions, viewing them as irrelevant to their social status. Consequently, the regulation has not been effective, creating a distinct gap between the written law and its practical application. The study concludes that structural rigidity and lack of officer legitimacy hinder the protection of constitutional health rights. These findings imply an urgent need for bureaucratic reform towards more adaptive governance, requiring policymakers to establish discretionary mechanisms that bypass administrative hurdles to ensure stunting eradication efforts are inclusive for all social strata.
