Abstract

Korupsi sebagai metode perang proksi adalah upaya mempengaruhi kebijakan dalam negeri melalui pendekatan secara legal atau ilegal kepada badan hukum atau perorangan yang memegang otoritas publik atau terkait dengan kepentingan publik. Kepolisian (Polri) sebagai salah satu instansi yang berwenang melakukan pemberantasan korupsi dituntut untuk mengoptimalkan pemberantasan korupsi di Indonesia melalui fungsinya di bidang pencegahan dan penindakan atau penegakan hukum. Sehingga perlu suatu reformulasi dalam pemberantasan korupsi di Indonesia, khususnya dalam perspektif Kepolisian menghadapi korupsi sebagai ancaman perang proksi. Urgensi dari tulisan ini adalah untuk memberikan masukan tentang perlunya reformulasi pemberantasan korupsi di Indonesia khususnya yang dilaksanakan oleh Polri melalui fungsinya di bidang pencegahan dan penindakan atau penegakan hukum melalui penguatan organisasi Lembaga Anti Korupsi Polri dalam sebuah struktur yang tersentralisasi. Metode penelitian yang digunakan dalam penulisan ini adalah yuridis normatif, dengan spesifikasi penelitian adalah deskriptif analitis serta dengan menggunakan teknik pengumpulan data melalui penelitian kepustakaan berupa penelaahan bahan kepustakaan dalam bentuk dokumen maupun peraturan perundang – undangan yang berlaku.Dari pembahasan yang dilakukan dapat ditarik kesimpulan tentang perlunya reformulasi pemberantasan korupsi dalam menghadapi ancaman perang proksi di Indonesia melalui penyempurnaan desain struktur organisasi anti korupsi Polri dalam suatu regulasi internal (Peraturan Polri) dan harus ditegakkan secara konsisten.

Abstract

Environment dispute settlement carried out by general and administrative court, depends on the object of disputes. Government has to based on principle of good environmental governance when issue the permit and policies. The issues are the urgency to build environmental court and implementation of principle of good environmental governance. Method use is juridical normative, primary data used are regulations, secondary data are expert opinions, articles. Data analysis qualitatively and describe in descriptive analysis. Environmental court will be under Administrative Court as special court, which comprises of private, penal and administrative chamber. Implementation of principle of good environmental governance through issue permit, policies and supported by strengthen law enforcement. Regulations as based of law to build environmental court has to be synchronized with relevant regulations in order to enforce the environmental law enforcement and gives environmental justice. Novelty in this research is build environmental court to strengthen environmental law enforcement.

Abstract

Law enforcement is one of the many facets of society that have seen substantial changes as a result of the quick growth of digital technology, especially artificial intelligence (AI). The purpose of this study is to assess how electronic evidence is used in Indonesia's criminal justice system, pinpoint the difficulties encountered, and offer suggestions for enhancing the efficiency and equity of electronic evidence in the age of artificial intelligence. In line with the technological elements included in digital and criminal investigation research methodologies, this qualitative study aids in the creation of a theoretical framework for the use of electronic evidence in the setting of artificial intelligence. The results show that Indonesian law is now able to meet the needs of the digital age with its adaptation to technological advancements. Finding material truth in court proceedings is made possible by electronic evidence, which is legally acknowledged as a legitimate tool in criminal justice. To successfully address these issues and optimize the use of AI in the legal system, it is imperative to develop a strong ethical framework, improve law enforcement capacities, and update rules on a regular basis.

Abstract

Parents as the first guardian of the child make their role irreplaceable for children. The negligence of parents in interpreting their role as caretakers of children can have an impact on children's development. True children do not have the ability to plan a crime. ABH is more accurately seen as a victim. This study reveals the responsibility of parents to child offenders of criminal offenses in Indonesian law today and its reforms in the future. This study uses a qualitative approach and normative juridical research methods. Code No. 11 of 2012 concerning the Juvenile Criminal Justice System implies the use of Restorative Justice in every settlement of juvenile crime. There is no formal legality of parents' responsibility for criminal acts committed by children, however, the Law on the Criminal Justice System for Children only regulates the responsibility of parents in the form of compensation in terms of diversion. The principle of Vicarious Liability can be applied to child crimes in the future. The principle of Vicarious Liability can be clearly stated in the regulations relating to juvenile punishment. The principle of vicarious liability can be applied to parents for criminal acts committed by children in the context of the transfer of criminal acts, based on legal objectives, namely justice, certainty and legal usefulness in the application of criminal law in Indonesia.

Abstract

The criminal justice system of children is very important in the effort to settle cases. Children are gifts of God that are entrusted to be cared for, guarded, and guided for a good future. In article 1 number 1 of Law no. 11 of 2012 states that what is meant by the juvenile justice system is the whole process of resolving cases of children dealing with the law from the investigation stage to the guidance stage after undergoing the crime. The aims of the study were to find out and analyze the juvenile justice system (SPPA) in conflict with the law and to examine the implementation of legal protection against children in conflict with the law based on Law Number 11 of 2012. The research method used to see the arrangement of this arrangement is juridical-normative legal research, this research is research that is attempted with the system reviewing applicable laws and regulations or applied to a particular legal case and concept. The method of collecting legal material with the document method is to collect library research contained in secondary legal materials, then analyzed deductively. The results of this study are to look at the process of the juvenile justice system based on subsystems, components, the process of achieving justice for restorative justice and the process of implementing child protection based on the applicable laws and regulations.

Abstract

This research is motivated by the urgency to critically evaluate the reintroduction of offenses against the President's dignity in Article 218 of Law Number 1 of 2023 (the New Indonesian Criminal Code). While intended to protect state symbols, this regulation controversially mirrors colonial-era laws and fails to fully accommodate the democratic and socio-cultural values of modern Indonesian society. Unlike previous studies that predominantly focus on the normative bounds of free speech, this study offers a novel approach by utilizing the Critical Theory paradigm to deconstruct the power dynamics, colonial legacy, and discriminatory nature embedded within the law. Employing a normative legal research method with statutory and conceptual approaches, this study reveals that Article 218 paragraph (1) remains obscure and discriminatory, failing to reflect the "virtual reality" of Indonesia's living norms. The findings emphasize that legal products must not be treated as immune dogmas; rather, they require continuous critical evaluation to prevent the infringement of human rights. Ultimately, the study advocates for a progressive regulatory reconstruction that truly aligns with moral integrity, human rights, and democratic justice in Indonesia.

Abstract

The criminal justice system is not solely oriented towards punishment, but also towards restitution, accountability of perpetrators, and restoration of social relations. In the Indonesian context, restorative justice (RJ) is relevant because it aligns with the values ​​of Pancasila, particularly just and civilized humanity, deliberation, and social justice. However, the implementation of RJ has not been fully optimal due to fragmented regulations, differences in standards between institutions, limited facilitators, and the risk of unequal protection for victims. This study aims to analyze RJ as a manifestation of Pancasila Justice and formulate a strategy for its integration into the Indonesian criminal justice system. The method used is normative legal research with a statutory and case approach. The results show that RJ has a sociological basis in local wisdom and customary law, as well as an increasingly strong juridical basis, particularly through Law Number 20 of 2025 concerning the Criminal Procedure Code and Law Number 1 of 2023 concerning the Criminal Code. However, this normative strengthening has not been fully followed by systematic integration in practice. The main contribution of this article lies in the Pancasila-based RJ integration model at the normative, institutional, and legal culture levels as a direction for criminal law reform that is more recovery-oriented.
