Abstract

Studi ini mengkaji tentang tinjauan hukum islam terhadap aturan adat pernikahan di Desa Air Merah Kecamatan Malin Deman Kabupaten Mukomuko. Permasalahannya adalah pelaksanaan, sanksi, maksud dan tujuan serta bagaimana tinjauan hukum Islam terhadap aturan adat pernikahan di Desa Air Merah Kecamatan Malin Deman Kabupaten Mukomuko. Penelitian ini merupakan penelitian lapangan. Data yang diperoleh melalui wawancara semi terstruktur dan dokumentasi. Setelah data terkumpul diolah dengan cara kualitatif dan dianalisis dengan cara reduksi data, penyajian data dan simpulan. penelitian ini menemukan hasil pertama pelaksanaan aturan adat pernikahan ini yaitu batanyu (melamar), proses mamak rumah, proses kepala kaum, mufakat senek (kecil) dan mufakat gedang (besar), ndaon, makan gedang dan akad nikah, barak, mecak punjong dan asam basu. Kemudian sanksi adat bagi yang melangsungkan akad nikah di KUA yaitu bagi perempuan membayar denda uang ke adat sejumlah Rp. 900.000 dan bagi laki-laki harus nuhuk (mengikuti) kaum dengan membayar uang ke adat sejumlah Rp. 450.000. Kedua tujuan dan maksud adanya aturan adat pernikahan ini adalah 1) mengumumkan pernikahan dan menjaga nama baik kaum dan keluarga dari aib, 2) untuk melestarikan adat di Desa Air Merah, dan 3) memberikan efek jera bagi para pelaku yang melanggar dan tindakan preventif (pencegahan) bagi masyarakat lainnya. Ketiga tinjauan hukum Islam terhadap aturan adat pernikahan di Desa Air Merah Kecamatan Malin Deman Kabupaten Mukomuko dibagi menjadi dua bentuk yaitu 1) bagi masyarakat yang ekonominya mampu, maka aturan adat pernikahan tersebut boleh dijalankan 2) bagi masyarakat yang ekonominya tidak mampu, maka aturan adat pernikahan tersebut tidak boleh dijalankan.

Abstract

This study examines the Wakaf Behind Pawn Practice Reviewed From the Perspective of Sharia Economic Law ( Case Study at the Masjid Ma'mur Tiga Batur, Sungai Tarab District, Tanah Datar Regency). The problem is how wakaf practice is behind pawnbroking, what are the driving factors for wakaf practice behind pawnbroking and how sharia economic law views wakaf practice behind pawnbroking at the Ma'mur Tiga Batur Mosque, Sungai Tarab District, Tanah Datar Regency. This type of research is field research with qualitative descriptive methods with data collection techniques being interviews and documentation. The practice of waqf behind pawnbrokers that are carried out by pawnbrokers starts with the pawnbroker and the pawnbroker and then the pawnbroker manages, utilizes, and there are results. Factors driving the practice of wakaf behind pawnshops include the factors driving the worship and environmental factors of local parties or community leaders and scholars who explain pawnshops and waqf, thus making the wakif interested in. Wakaf is basically allowed from pawnshops, but it is not recommended because the source of the wakaf comes from everything that is not allowed, namely the use of pawnshops by pawnbrokers. Abstract

This research aimed at analyzing the effectiveness of the Bankziska program in empowering victims of loan sharks through the al-Qarḍ al-Ḥasan contract funded by zakat, administered by the Amil Zakat Infaq and Shadaqah of Muhammadiyah Institutions. Qualitative method was used in this research with a phenomenological approach using the activity data from the Amil Zakat Infaq and Shadaqah of Muhammadiyah Institutions in empowering loan shark victims through the Bankziska program. The data sources were obtained from managers, volunteers, and loan shark victims who were the partners of Bankziska. The research results showed that the reasons for the Amil Zakat Infaq and Shadaqah of Muhammadiyah Institutions to lend zakat funds were the references from fiqh and fatwa, training studies, organizational encouragement, academic input, and it is easy to implement. The implementation of the Bankziska program had detailed standard operating procedures, starting from the beneficiary categories, distribution, and payment processes, to mitigating the risk of default. The al-Qarḍ al-Ḥasan program of Bankziska had an impact on improving the quality of skills, mental, intellectual, technological, communication, and religious studies of managers and volunteers. The impact of the program for partners was the awareness to abandon usury, reduced debt both in nominal terms and the number of loan sharks and an increase in the ethos of economic independence. This research contributes to providing discourse and alternatives for other social and religious fund management institutions in using zakat funds productively for economic empowerment through the al-Qarḍ al-Ḥasan contract for victims of loan sharks who have difficulty accessing Sharia financial institutions to obtain business capital or financing services.

Abstract

The Qur'an's Surah an-Nisa verses 11, 12, and 176, along with the hadith of Prophet Muhammad, establish the inheritance system and the share of each heir in Islam. However, in practice, many people simply agree on a division of inheritance. The reconciliation in question is mentioned in item 183 of the Compilation of Islamic Law. Therefore, this essay addresses peace in inheritance distribution from the perspective of Maqasid Sharia and its application based on KHI. Descriptive qualitative content analysis is employed in this study. The Saussure model is mentioned as the data analysis method. The analysis of relevant research materials, classification of information, interpretation of data, and verification of findings are the steps involved in analyzing research data. A credibility test is used to authenticate the data, primarily by encouraging researchers to spend more time examining crucial details from the source materials. According to the study's findings, Maqasid Sharia's emphasis on preserving the well-being of heirs is closely related to harmony in inheritance distribution. 'Takharuj', or harmony in inheritance distribution, refers to heirs' willingness to waive their rights as stipulated in the will. This willingness may occur with predetermined compensation or without any compensation at all. When peace is achieved, it occurs once each heir is fully aware of their rights under the terms of the will

Abstract

Popular fiqh literature addresses practical aspects of life. A considerable portion of this literature portrays women within a conservative framework. This research aims to investigate the tendency of spousal relationships as depicted in those popular fiqh literature. Subsequent to cataloging, a random selection of literary samples underwent qualitative content analysis. The findings revealed that popular fiqh literature on the household, especially on marital relations, is dominated by gender biased discourse by placing women only in the domestic realm where their position is inferior. This dominance stems from the authors’ references projecting back to the provisions of classical fiqh, which are gender biased and lack authoritative interpretation of the texts. The presence of this literature is also due to the market demands of the publishing industry. Furthermore, societal understanding dominated by patriarchal ideology contributes significantly to the prevalence of gender-biased popular fiqh literature.[Abstrak: Literatur fiqh populer mengatasi aspek praktis kehidupan. Sebagian besar dari literatur ini menggambarkan perempuan dalam kerangka konservatif. Penelitian ini bertujuan untuk menyelidiki kecenderungan hubungan suami istri seperti yang digambarkan dalam literatur fiqh populer tersebut. Setelah proses katalogisasi, seleksi acak sampel-sampel dianalisis dengan pendekatan konten kualitatif. Hasil temuan menunjukkan bahwa literatur fiqh populer tentang rumah tangga, terutama dalam hubungan pernikahan, didominasi oleh wacana bias gender yang menempatkan perempuan hanya dalam ranah domestik di mana posisi mereka lebih rendah dibanding laki-laki. Dominasi ini berasal dari referensi penulis yang mencerminkan kembali ketentuan fiqh klasik, yang memiliki bias gender dan kurangnya interpretasi otoritatif dari teks-teks tersebut. Kehadiran literatur ini juga karena tuntutan pasar industri penerbitan. Selain itu, pemahaman masyarakat yang didominasi oleh ideologi patriarki turut berkontribusi secara signifikan pada prevalensi literatur fiqh populer yang bersifat bias gender.]

Abstract

This research examines forms of domestic violence and the considerations of judges at the Batusangkar Religious Court in deciding divorce cases and judges' considerations in divorce cases from the perspective of Law Number 23 of 2004 concerning the Elimination of Domestic Violence. The type of research used in writing this thesis is a qualitative approach. The results of the first research, forms of domestic violence in divorce cases. Second, the consideration of the judge at the Batusangkar Religious Court in deciding a divorce case, one party leaving the other party for 2 (two) consecutive years, a prison sentence of 5 (five) years, the husband violating the divorce agreement. The three judge's considerations regarding divorce cases are seen from the perspective of Law Number 23 of 2004.

Abstract

The main problems in this study are the background of the ban on matrimony and the public's views on the ban and the impact of a ban on marriage between the children of Nagari Singkarak and Nagari Saniangbaka in the Prespective of Islamic Law. The purpose of this research is to know and understand the background and public view of the Ban on Marriage and the Impact of a Ban on Matrimony between Nagari singkarak's children and the Prespektive of the Law of Islam. The type of research used is field research with the method used is a qualitative approach. The primary sources of data in this study are local scholars, perpetrators who violated the prohibition of marriage and who cancelled marriage, Niniak mamak party who violates the prohibited marriages, Civil Rights of Nagari (KAN), Wali Nagari Singkarak and Saniangbaka, Parents/Families who violate the forbidden marriage. The data collection technique used in this study is the interview. The data analysis technique in this research is the reduction of data, the display of data and conclusions or conclusions. This research found results that first, the background of the occurrence of the ban on marriage suspension between Nagari Singkarak and Nagari Saniangbaka's children because of the oath of the ancestors that they said they had a brotherly relationship because of an oath that was set so that they could not make marriage. In the case of a marriage ban, there are two reasons why people accept the rule of the ban because they believe in the absolute provisions of the ancestral oath that they are brothers and sisters so that marriage is not permitted. Some people do not accept this ban because it is contrary to Islamic law. Second, the effect of this ban is two, namely: a. the cancellation of marriage due to the ban on marriage. b. the existence of a series marriage carried out by the community because it did not get permission from the people, the elders and the government. Seeing from the perspective of Islamic law, this prohibition of marriage is more harmful than beneficial, so it can cause forbidden acts.

Abstract

Marriage is an act recommended by Allah and by the Prophet, this can be seen in the Al-Qur'an and the Hadith of the Prophet where the content is in the form of a recommendation to marry. In 2009, the MUI issued a ijtima' decision on early marriage. According to the MUI, early marriage is legal as long as the conditions and pillars of marriage have been fulfilled, but it is illegal if it causes harm. In terms of maṣlāḥah, early marriage is not against Islamic law, because marriage aims to create problems. However, the impacts arising from early marriage tend not to bring problems to the marriage partner. This is the focus of this research. The research question is what is the background to the emergence of the 2009 MUI Fatwa on the Law on Early Marriage, what is the intention of getting married at an early age unlawful if there is concern that harm will arise in the MUI fatwa. According to existing regulations, the age for student acceptance is for elementary school students in the age range of seven years to a maximum of 12 years and a minimum of six years on July 1 of the current year. Then junior high school students with a maximum age of 15 years and high school 21 years. This means that according to applicable regulations, high school students are allowed to marry because they are between 21 and 23 years old. An in-depth study is needed on this matter.
