Abstract

Basically, the Aceh Special Autonomy Fund policy is to provide wider authority for local governments and the people of Aceh to regulate and take care of themselves within the framework of the Republic of Indonesia. This broader authority also includes the authority to regulate the use of natural resources in the Aceh Province area, as much as possible for the prosperity of the Acehnese people, empowering their economic, social, and cultural potential, including providing a significant role for the indigenous people of Aceh to be involved in the process of formulating regional policies, determining development strategies while still respecting the equality and diversity of people's lives in the Province Aceh. Therefore, the author reviews the relationship between central and regional authorities in the Republic of Indonesia with the regions, especially Aceh in the Special Autonomy Law with qualitative methods and through understanding the concept of decentralization. The results clearly show that, however, the implementation of the Special Autonomy Fund in Aceh is different from what is described in autonomy as stated in the law. In fact, in the field, so far, the central government's assistance, coaching and supervision have not been seen.

Abstract

Human rights law encourages the implementation of state obligations by enacting policies that remove accessibility barriers for persons with disabilities, including a guaranteed access to information. Unfortunately, attention and efforts to facilitate the accessibility of people with deaf disabilities are insufficient, especially regarding religious information. The West Java Islamic Da’wah Center (Pusat Dakwah Islam/Pusdai), as one of the social service units within the local government, barely has a systematic policy basis to facilitate access to religious information, particularly for the “Friday Sermon” for persons with Hard of Hearing (HOH). This article identifies that human rights law can be the underlying basis for the fulfilment of visual communication for persons with HOH. This article discusses a visual design construction that may facilitate communication barriers for deaf-disabled persons in accessing religious information in Pusdai. By employing a socio-legal approach, including visual communication design lens, this study finds a gap in the visual information availability and facility for people with HOH. This study contends that visualization, in the form of moving and static signs, is necessary to facilitate the convenience of persons with HOH and it is seen as an effort to realize inclusive religious services. Such a measure needs to be incorporated into the National Action Plan on Human Rights (RANHAM) in West Java Province.

Abstract

West Java Province affects a Tourism Provincial Regional Regulation (Perda) of 2008.  Recently, the respected Perda remains down to date both in the regulatory reasoning and normative structure. Such a lacuna is due to the issuance of Tourism Law No. 10 of 2009, in which expression the philosophical base acknowledges tourism activities as a part of human rights. This is coupled with various renewals of the National Action Plan for Human Rights (RANHAM), Indonesia's commitment to the Sustainable Development Goals, and the New Urban Agenda 2016. All of those sharpen efforts to localize human rights through various sectors of development and community services. This study aims to identify the frameworks for the renewal of the respected Perda. Through the study of legal materials, documents, secondary data in, namely, “Neraca Satelit Pariwisata Jawa Barat 2019-2020”, this paper emphasizes the juridical, philosophical, and sociological reasonings on the need for the renewal of the Perda. These perspectives lead to the highlight of vulnerable groups as part of the inclusion of fulfilling socio-economic rights. Not only being the centre of attention for economic and cultural activities, but it is also time for a human rights perspective to be inseparable from the tourism sector. Provinsi Jawa Barat (Jabar) telah memberlakukan Peraturan Daerah (Perda) yang mengatur kepariwisataan sejak tahun 2008. Dengan berbagai perkembangan, Perda tersebut nampaknya menyisakan kesenjangan baik dari landasan-landasan pengaturannya maupun sistematisasi penormaan. Kesenjangan tersebut terjadi sejak keluarnya Undang-Undang Nomor 10 Tahun 2009 tentang Kepariwisataan yang di antara politik hukumnya sekaligus sebagai landasan filosofis adalah menempatkan wisata sebagai bagian dari hak asasi manusia. Hal itu ditambah dengan berbagai pembaharuan Rencana Aksi Nasional Hak Asasi Manusia (RANHAM), komitmen Indonesia sebagai salah satu negara yang turut menargetkan Agenda 2030 Tujuan Pembangunan Berkelanjutan, disertai dengan Agenda Baru Perkotaan yang dideklarasikan tahun 2016. Kesemuanya menajamkan upaya melokalkan HAM melalui berbagai sektor pembangunan dan pelayanan masyarakat. Dalam kajian ini hendak diidentifikasi bagaimana  pokok-pokok kerangka pemikiran dapat ditawarkan untuk pembaruan Perda Jabar yang dapat direkomendasikan. Melalui studi bahan-bahan hukum dan berbagai dokumen, termasuk data sekunder berupa Neraca Satelit Pariwisata Jabar Barat 2019-2020, tulisan ini menggarisbawahi landasan-landasan yuridis, fislosofis, dan sosiologis sebagai alasan kebutuhan pembaharuan Perda tersebut. Kesemua persepektif tersebut mengarah pada perhatian terhadap titik berat kelompok rentan sebagai bagian dari inklusifitas pemenuhan hak-hak ekonomi, sosial, dan budaya. Tidak hanya menjadi pusat perhatian kegiatan ekonomi dan kebudayaan, sudah saatnya perspektif HAM tidak terpisahkan dari sektor wisata.

Abstract

This research is a literature study that analyzes the construction of regional autonomy perspectives in the appointment of Acting Regional Heads from the active Indonesian National Army (TNI) based on various academic studies. with various studies among academics. The appointment of acting regional heads from the military raises fundamental questions regarding its consistency with the principles of regional autonomy, merit systems, and local democracy. The main focus of this research is to examine: This research is a literature study that analyzes the construction of regional autonomy perspectives in the appointment of Acting Regional Heads from the active Indonesian National Army (TNI) based on various academic studies. with various studies among academics. The appointment of acting regional heads from the military raises fundamental questions regarding its consistency with the principles of regional autonomy, merit systems, and local democracy. The main focus of this research is to examine: First, How is the construction of regional autonomy perspectives in various studies regarding the appointment of Acting Regional Heads from active TNI elements before the enactment of Permendagri No.4 of 2023? Second, What is the regulatory basis that can be corrected for the appointment of Acting Regional Heads from active TNI elements in the perspective of regional autonomy?. This research uses normative juridical methods and uses secondary data from library materials. The approaches used in this research are legislative approach and conceptual approach. This research concludes: First, the dominance of the perspective stating that the practice of appointing Acting Regional Heads from among the active TNI tends to conflict with local democracy. Second, a more assertive regulatory reformulation is needed in limiting the appointment of Acting Regional Heads from the active TNI and strengthening mechanisms of transparency, accountability, and DPRD participation in the selection process.

Abstract

Artikel ini mengajukan pola fast-track legislation dalam pembentukan Peraturan Daerah tentang Pembubaran Bank berbentuk BUMD yang dalam tahap likuidasi oleh LPS. Persoalan yang dikaji dalam artikel ini adalah karena adanya prinsip otonomi daerah bagi Pemerintah Daerah dalam pelayanan publik berupa pembentukan dan pembubaran bank BUMD pada satu sisi, namun pada sisi lain LPS yang berwenang melakukan likuidasi tidak dapat menunggu lama proses pembentukan Perda secara reguler karena dapat menggangu prinsip prediktabilitas dan kepastian hukum penyelesaian likuidasi bank. Artikel ini beragumen bahwa pola fast-track legislation dapat menjadi jalan tengah dua rezim hukum yang berbeda yakni hukum perbankan bagi LPS dan rezim hukum pemerintahan daerah bagi pemerintah daerah itu sendiri. Pola fast-track legislation itekankan pada perencanaan kumulatif terbuka, tidak perlunya Naskah Akademik, penyederhanaan dan percepatan waktu pembahasan maupun penetapan, pengesahan dan pengundangan.

Abstract

The urbanisation of the contemporary world reveals urban challenges, for example, inequalities in spatial distribution, and Indonesia is no exception. One of the challenges is the insufficient opportunity for participation in planning decision-making. Country leaders worldwide agree to address their urban challenges by applying the New Urban Agenda (NUA) to accelerate Goal 11 of the 2030 Agenda for Sustainable Development (SDGs). This article aims to emphasize the extent of public participation in the NUA to enrich the relevant legal improvements and promote prospective enhancements to regulate public participation in planning decision-making as a right to participate in public life. A legal doctrine design, a library-based approach, and the NUA standard are applied to examine the existing laws resting on urban planning, local government, and human rights law regimes. Accordingly, the public participation setting in planning decision-making requires the NUA standard to include the key features of “equal treatment”, “design and implementation”, “evaluation”, and “effective remedies”. The study suggests that the legal compatibility in Indonesia is insufficient to accommodate those NUA standards. Therefore, it contributes to developing legal compatibility in Indonesia, which should foster citizens’ enjoyment of public participation in spatial planning decision-making towards the actualization of the NUA.

Abstract

This research aims to analyze the influence of the phrase 'Online' on the fulfillment of Public Participation in Law Formation through the DPR's legislative information system. This research uses a normative legal research approach which includes legislative, conceptual and historical approaches. Method: The data collection approach in this research is library research. The data obtained is then processed through three stages, namely data reduction, data presentation, and drawing conclusions. Results: Research findings show that the term 'online' in article 96 of Law Number 13 of 2022 requires the DPR to be able to assist in implementing community involvement, one of which is through sileg. Apart from that, based on the provisions of Secretary General Number 13 of 2020 and the parliamentary website guidelines that have been prepared by the IPU, improvements and developments need to be made in the implementation of Sileg. Novelty: The novelty of this research comes from the research object, namely the formation of laws through the DPR Legislative Information System in the context of the influence of the phrase 'Online' on the fulfillment of community participation. Conclusion: Adequate information in Sileg at all stages of law formation can facilitate and encourage public participation in providing input on each bill that is being discussed and/or will be discussed in the DPR. The ideal implementation of sileg is as an online medium for people to carry out more meaningful community activities.
