Abstract

Border area management entails navigating geographical complexity and socio-cultural diversity, necessitating a comprehensive approach that integrates security and welfare. This article highlights a paradigm shift from traditional to economic security, recognizing economic dependence as a potential national vulnerability. Despite challenges like geographic remoteness and economic inequality, border regions are vital for economic growth. Using a conceptual approach, the article emphasizes the need to balance security and welfare through cross-border trade development and community empowerment. While Law Number 43 of 2008 aims to manage borders, unclear authority and regulatory overlap hinder effectiveness, compounded by military-focused defense strategies, limited budgets, and inadequate infrastructure. To address these issues, enhancing international cooperation, clarifying authority, and empowering communities through local wisdom are essential. Such empowerment is expected to bolster self-esteem, reduce economic dependency, and strengthen economic security, emphasizing the importance of balancing protection with economic development. Strategies like expanding trade zones and enhancing social capital, alongside infrastructure development and improved social services, are crucial for ensuring access and fostering the welfare of border communities.

Abstract

The United Nations Commission on International Trade Law (UNCITRAL) Working Group III (WG III) has been meeting intensively to formulate comprehensive reforms to Investor-State Dispute Settlement (ISDS) based on emerging criticisms. In July 2017, UNCITRAL established Working Group III with a mandate to identify and evaluate ISDS-related concerns, consider the need or desirability of reforms, and develop relevant solutions. Some of the issues that have been identified in relation to the current ISDS mechanism include lack of consistency and predictability of arbitral awards by ISDS forums, lack of independence and impartiality of arbitrators, cost and duration of proceedings, and third-party financing. The WG III forum has formulated several options to address these issues: 1) establishment of a court mechanism, 2) appointment of arbitrators and adjudicators, 3) parties' involvement and control, 4) dispute prevention and mitigation: strengthening dispute prevention and mitigation mechanisms, 5) cost management and third-party financing transparency: efforts to manage costs and related procedures, as well as transparency in third-party financing. The findings indicate that Indonesia actively participates in WG III by advocating for balanced reforms that safeguard state sovereignty and public interest while addressing investor rights. Key recommendations include enhancing transparency and leveraging regional alliances to strengthen Indonesia’s position in international investment frameworks.

Abstract

Human trafficking for online scams has emerged as a growing transnational crime, particularly in Southeast Asia. This study examines the role of ASEAN in combating this evolving form of human trafficking, highlighting its legal framework, challenges, and regional cooperation efforts. ASEAN has established multiple agreements, including the ASEAN Convention Against Trafficking in Persons (ACTIP) and the ASEAN Leaders' Declaration on Combating Trafficking in Persons Caused by the Abuse of Technology, to address the issue. However, the implementation of these agreements remains inconsistent due to the region’s adherence to the “ASEAN Way” principle, which prioritizes non-interference and consensus-based decision-making. This research employs a socio-legal approach, analyzing ASEAN’s institutional response and the legal framework supporting anti-trafficking measures. Findings indicate that while ASEAN has made significant strides in formalizing commitments, enforcement gaps persist. Human traffickers exploit weak border controls, technological advancements, and corruption to sustain their operations. Additionally, the rise of cyber fraud linked to trafficking in persons has intensified the urgency for coordinated regional action. The study underscores the need for ASEAN member states to adopt stronger enforcement mechanisms, improve victim protection, and enhance cross-border cooperation. Strengthening ASEAN’s role in combating human trafficking for online scams is crucial not only for upholding human rights but also for maintaining regional security and economic stability. The findings contribute to the discourse on transnational crime and the effectiveness of regional governance in addressing emerging criminal threats.

Abstract

Data pribadi menjadi hak privasi seseorang yang wajib dilindungi dari berbagai aspek kehidupan. Konsep perlindungan data mengisyaratkan bahwa individu memiliki hak untuk menentukan apakah mereka akan membagi atau bertukar data pribadi mereka atau tidak. Hakikat pemenuhan dan perlindungan hak asasi manusia ialah menjaga eksistensi martabat manusia melalui keseimbangan, termasuk keseimbangan antara kepentingan individu dan kepentingan umum. UU Perlindungan Data Pribadi merupakan upaya negara untuk memenuhi hak privasi warganya. Desa Mekarsari Kabupaten Kubu Raya, sebagai Desa Konstitusi, menjadi tempat implementasi sosialisasi peningkatan pemahaman perlindungan data pribadi sebagai bagian dari HAM yang dijamin dan diatur oleh Kontitusi (UUD 1945). Metode kegiatan yang akan dipergunakan dalam kegiatan ini adalah penyampaian materi sosialisasi serta dialog interaktif dalam bentuk penyuluhan hukum.Berdasarkan hasil evaluasi yang dilakukan, kegiatan sosialisasi tentang perlindungan data pribadi sebagai bagian dari HAM yang khususnya di Desa Mekarsari, Kabupaten Kubu Raya, yang telah diakui sebagai Desa Konstitusi telah berhasil meningkatkan pemahaman masyarakat mengenai pentingnya perlindungan data pribadi sebagai bagian dari HAM.

Abstract

Kenakalan remaja di Pontianak, yang mencakup pelanggaran aturan sekolah, kejahatan, penyalahgunaan narkoba, dan pergaulan bebas, mencerminkan fenomena sosial dan psikologis kompleks. Penyebabnya meliputi faktor internal seperti perubahan emosional dan sosial, serta faktor eksternal seperti pengaruh lingkungan dan tekanan teman sebaya. Pontianak, dengan ketimpangan sosial dan ekonomi, turut memengaruhi perilaku remaja. Penelitian menunjukkan pentingnya pemahaman psikologis dan sosial dalam mengatasi masalah ini. Pengabdian Kepada Masyarakat (PKM) di SMA 3 Pontianak bertujuan meningkatkan kesadaran tentang kenakalan remaja melalui pendekatan holistik, melibatkan siswa, guru, dan masyarakat. Kegiatan ini mencakup penyuluhan, workshop, dan peningkatan koordinasi antar stakeholder untuk menciptakan lingkungan sekolah yang aman dan mendukung perkembangan positif. Evaluasi dilakukan melalui wawancara dan antusiasme peserta, dengan harapan program ini dapat memberikan dampak jangka panjang dalam mencegah perilaku negatif dan meningkatkan kualitas pendidikan di Pontianak.

Abstract

Documents-Only Arbitration (DOA) is a type of arbitration that is carried out entirely by written documents-only. DOA is beneficial when the burden and substance of the dispute are relatively simple and when there are obstacles to conduct a face-to-face proceeding (instance in the Covid-19 Pandemic or limitation of cost). This study examined the DOA trial method and how it is based on Law No. 30 Year1999 concerning Arbitration and Alternative Dispute Resolution as the lex arbitri in Indonesia. Regulations, Rules, and Procedures from arbitration institutions, both national and international are also studied to better understand the problem. This study aimed to explain the legality of arbitration based on Documents-Only Arbitration in Indonesia. This study concluded that the conduct of DOA is very possible to be implemented in Indonesia and does not conflict with Law No. 30 Year 1999 concerning Arbitration and Alternative Dispute Resolution (Arbitration Law).

Abstract

Investment Court System (ICS) proposed by the European Union (EU) has been ratified through Bilateral Investment Treaty (BIT) between the EU and several partner countries such as Canada, Vietnam and Singapore. A study is needed to get an idea on the ICS mechanism. This is a normative research. The result shows that although there is a mechanism that is not in accordance with the concept of arbitration, the ICS decision is enforced as an arbitration award and is subject to the 1958 New York Convention. Indonesia as one of the countries currently still negotiating with the EU in the formation of an FTA is also still reviewing the adoption of ICS into the text agreement. In addition, although the background and objectives of the ICS are positive, there are still some points of weakness in the provisions of the ICS that will result in obstacles in their implementation which can be seen from the legal, political and technical side.

Abstract

The Indonesian Government is currently in the process of developing several new ports in its territory as a means of supporting infrastructure development and maritime connectivity. One of them is the Development of the Kijing Terminal Port in the Province of West Kalimantan. It is important to study international and national legal regulations related to ports and how they affect the development of Tanjungpura Port, Kijing Terminal, which will be directed to become one of the international hub ports in Indonesia. The research methodology employed in this study is normative, with in-concreto legal study approach. It is found that, the consequence of the status of the "international hub" is that it is necessary to ensure that the best international port management and regulatory systems can be implemented at Tanjungpura Port, Kijing Terminal. The development plan for the Kijing Terminal Area to support increased regional competitiveness includes the construction of a Bauxite Smelter, the construction of the Kijing Industrial area, the construction of the Kijing Special Economic Zone (SEZ), the construction of a nuclear power plant to meet community and industry needs, the construction of the Pontianak - Sei Pinyuh, Sei Toll Road route Pinyuh – Mempawah, Mempawah – Kijing, Kijing – Singkawang, the construction of the Trans Kalbar Railway Road to increase ease of access and the establishment of the PT EUP refinery in Kijing. Several inputs that need to be considered so that Tanjungpura Port Governance can be carried out efficiently include repositioning the Government's role in the management and development of the Port with a focus on supporting market mechanisms and fair competition. In addition, related parties need to stipulate a Minister of Transportation Regulation on Ship Security Management and Port Facilities to provide a reference regarding the implementation of the ISPS Code or International Provisions for Ship Security and Port Facilities.
